Abstract

Abstract

This research aims to analyze the role of Sharia-based Fintech Peer to Peer (P2P) Lending in promoting economic justice in Indonesia. Using a normative juridical method and Amartya Sen’s theory of economic justice as a theoretical framework, the study explores literature, legal regulations, and current fintech practices. The findings show that while Sharia P2P Lending holds strong potential to expand financial access and empower MSMEs, significant challenges remain regarding sharia compliance, consumer protection, and regulatory clarity. The integration of Amartya Sen’s capability approach with Islamic economic principles highlights the importance of equitable access to finance in realizing just and inclusive economic development. The research emphasizes the need for comprehensive regulation, public financial literacy, and technological innovation aligned with Islamic legal values. It concludes that Sharia P2P Lending can become a strategic instrument to strengthen welfare and reduce inequality, provided it adheres to fair, transparent, and sharia-compliant financial practices.

Abstract

This study aims to analyze the practice of agricultural land management cooperation known as mappatesang in Pa’rasangan Beru Village, Takalar Regency, and to examine its conformity with the principles of fiqh mu‘amalah. The mappatesang practice is a form of cooperation between landowners and cultivators that has been carried out for generations based on local customary traditions. However, in its implementation, several issues are still found, such as unclear contracts, profit-sharing systems, and the rights and obligations of the parties, which have the potential to create injustice and conflict. This research employs a qualitative method with an empirical juridical approach. Data were collected through observation, interviews, and documentation involving landowners, cultivators, and village government officials. The data were analyzed descriptively to describe the actual practice of mappatesang in the community and to compare it with the provisions of the mukhabarah contract in fiqh mu‘amalah, including its pillars, conditions, and the principle of justice in profit-sharing. The results of the study indicate that the mappatesang cooperation practice in Pa’rasangan Beru Village is essentially similar to the mukhabarah contract; however, it has not fully complied with the principles of fiqh mu‘amalah. Several aspects, such as contract clarity, profit-sharing arrangements, and written agreements, still need improvement to prevent losses to either party. Therefore, efforts are needed to socialize and educate the community regarding mukhabarah contracts in accordance with Islamic law while preserving local wisdom, so that a fair, lawful, and sustainable cooperation can be achieved.

Abstract

This study aims to analyze how the community of Benteng Malewang Village utilizes pawnshop services to gain access to financial services and their impact on community welfare. The research focuses on the use of gold pawn services as an alternative financing instrument, both to meet consumptive needs and as productive business capital. The research method employed is a descriptive qualitative approach, with data collection techniques including interviews, observation, and documentation. The informants in this study consist of customers and employees of Islamic Pawnshops (Pegadaian Syariah) who are directly involved in gold pawn practices. The results of the study indicate that the community of Benteng Malewang Village utilizes pawnshop services as an easily accessible means of obtaining financial access, particularly for lower- and middle-income groups, due to simple requirements, fast disbursement processes, and the use of gold as collateral, which is commonly owned by the community. Gold pawning is not only used to meet urgent needs but is also utilized productively as business capital. Furthermore, the impact of gold pawning on the welfare of the Benteng Malewang Village community in Bulukumba Regency includes increased income and improved household welfare. In addition, gold pawning functions as a financial safety mechanism in coping with emergency situations. Nevertheless, the study also identifies challenges in the implementation of gold pawn services, particularly delays in repayment or redemption, which are generally caused by economic and social factors such as declining income and competing household priorities. Overall, gold pawn services at Sharia Pawnshops play a significant role in enhancing financial inclusion and supporting community economic resilience through fair and transparent Sharia principles
