Abstract

Proyek penelitian ini berfokus pada implementasi pengadilan elektronik dan proses litigasi dalam pengadilan negeri dan pengadilan agama di Daerah Istimewa Yogyakarta. Pendekatan penelitian yang digunakan mengintegrasikan metodologi penelitian hukum normatif dan empiris. Temuan penelitian menunjukkan bahwa implementasi sistem e-court dan e-litigation efektif. Namun, penting untuk memperkuat akuntabilitas dan transparansi dalam sistem e-court dan e-litigation untuk membangun sistem peradilan elektronik yang independen dan tidak memihak. Hal ini dapat dicapai dengan meningkatkan beberapa aspek utama, seperti jaminan kualitas peradilan elektronik, independensi dan ketidakberpihakan hakim dalam kerangka elektronik, pelaksanaan sistem panitera berbasis elektronik, perekaman sidang secara elektronik, memastikan keamanan data, dan menyediakan akses tanpa batas dalam hal ruang dan waktu.

Abstract

This paper discusses about licensing the establishment of houses of worship. In practice, the licensing arrangements for worship in both countries have significant differences. Indonesia has a bureaucratic approach that is formal, administrative, and social and community-based. Indonesia specifically regulates the requirements for the establishment of houses of worship in PBM 9 & 8/2006. Administrative, technical, and special requirements are required to obtain licenses. However, PBM 9&8/2006 has a loophole for the rejection of houses of worship, thus potentially inhibiting freedom of worship. On the other hand, Germany takes an ecological, spatial, and architectural approach to licensing houses of worship. Germany adheres to BauGB as a regulation related to building construction by paying attention to FNP and B-Plan as guidelines. This normative juridical research uses comparative, conceptual, and statutory approaches. The main finding of this research is that the two countries have different approaches in considering permits for the establishment of houses of worship. It is found that the difference between the two lies in the aspects of regulation, characteristics, and the approach to resolving disputes over the establishment of houses of worship.

Abstract

Introduction: In the agenda of the supremacy of law in Indonesia, one of the tangible manifestations carried out is the establishment of the Constitutional Court in 2003. One of the powers of the Constitutional Court is judicial review which has a major role and influence in upholding human rights. The Purposes of the Research: The purpose of this study is to analyze especially from the philosophical perspective of the role of the Constitutional Court in upholding certainty regarding gender equality in Indonesia. The main research authority is judicial review.The Methods of the Research: The research method used in this study is a normative research method with a legal and philosophical approach. The method and approach will be used in examining the role of the Constitutional Court in upholding certainty regarding gender equality in Indonesia.Results of the Research: A series of Constitutional Court decisions, including Number 22-24/PUU-VI/2008, demonstrates Indonesia's commitment to gender equality. These rulings changed election systems, ensuring equal opportunities for all candidates. The Court nullified affirmative action provisions in Law No. 10 of 2008, shifting from a 30% female representation goal. Decision Number 20/PUU-XI/2013 strengthened gender equality in politics, while Decision Number 82/PUU-XII/2014 supported women's electability in leadership roles. Decision Number 22/PUU-XV/2017 addressed gender-based discrimination in the Marriage Law. These decisions show the Constitutional Court's role in promoting gender equality, yet ongoing efforts are needed for further progress.

Abstract

Penelitian ini tentang pengenyampingan keadilan substantif dalam penerapan ambang batas sengketa hasil pilkada di Mahkamah Konstitusi, yang dilatarbelakangi oleh persoalan penerapan ambang batas sebagai syarat formil permohonan penyelesaian sengketa hasil pilkada. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif/ doktrinal dengan pendekatan perundang-undangan (statute approach), pendekatan analitis (analytical approach), pendekatan kasus (case approach). Teknik pengumpulan data dilakukan dengan cara penelitian kepustakaan (library research) dan analisis data menggunakan deskriptif kualitatif.Hasil penelitian membuktikan bahwa penerapan ambang batas permohonan sengketa hasil (0,5-2%) pada pilkada tahun 2015, 2017, dan 2018 yang seluruhnya diterapkan dengan kaku dengan mengutamakan Pasal 158 Undang-undang Pilkada yang berkepastian hukum. Penerapan ini telah menciderai ketentuan Pasal 24 ayat (1), Pasal 18 ayat (4), dan Pasal 28D ayat (1) Undang-undang Dasar 1945 yang menegaskan peradilan MK tidaklah sekedar menerapkan kepastian hukum (undang-undang pilkada), peradilan MK sesungguhnya adalah menerapkan konstitusi, bukan undang-undang. Artinya jika ada undang-undang melanggar/ menghalangi ketentuan ruh peradilan konstitusi, maka harus dibatalkan/ dikesampingkan dalam penerapannya (kasuistis). Marwah peradilan konstitusi harus ditegakkan dengan mengutamakan keadilan substantif agar mampu membuktikan penerapan nilai-nilai demokrasi yang jujur dan adil, sekaligus membuktikan tidak adanya pelanggaran yang terstruktur, sistematis, dan masif.

Abstract

The Constitutional Court often uses a positive legal approach, and some of the decisions it produces do not contain substantive justice. In its development, the Constitutional Court began to face a new paradigm as an institution for interpreting the constitution and began to use a progressive legal approach. This study aims to examine the application of a positivist legal approach and the urgency of using the progressive legal approach in the law review process. This research is normative legal research. Based on the results of this research, the Indonesian legal system is designed to accommodate human interests and needs through progressive legislation. The Constitutional Court, through a progressive legal approach, can issue decisions that fulfill substantive justice. This research is used in several cases, such as the heart article decision, ultra petite, and open legal policy. It can be concluded that through a progressive legal approach, it is a challenge for judges to guard the constitution through judicial review and an opportunity to prove that the Constitutional Court is an institution that prioritizes the constitutional rights of the people. In addition, the Constitutional Court can restore its spirit as the guardian of the constitution and democracy.

Abstract

The research focuses on evaluating and strengthening the electronic justice system in Indonesia, with a particular emphasis on its accountability and transparency. It is motivated by the numerous challenges in the electronic justice system implementation related to regulations, human resources, case management, and other potential emerging problems. This research employed normative and empirical legal methods. The research results reveal that electronic justice systems may be classified within the appropriate category. The most important thing is to strengthen the accountability and transparency in it towards an independence and impartiality of the electronic judiciary system through strengthening the quality assurance of the electronic judiciary system, electronic administration of the judiciary system by a clerk court based on an electronic trial recording (e-records), data security guarantees in e-court and e-litigation processes, and unlimited access assurance to space and time.

Abstract

This community service program focuses on increasing the understanding of integrity and election law for young election activists in Yogyakarta. The partners in this service are Rumah Muda Integritas and the Voter Education Network for the People in the Special Region of Yogyakarta. Its background needs to be improved in understanding community partners regarding elections with integrity and enforcement of election law. The service method is carried out through deliberation, planning, realization, and maintenance. The service results showed increased participants' understanding of the implementation of the integrity principle in the 2024 National Election, law election, law enforcement of election, types of electoral offenses, the state institutions that have jurisdiction over dispute resolution, and dispute resolution mechanisms for administrative, ethical, and criminal offenses. Hence, the participants have a solid commitment to oversee the 2024 elections that are democratic, honest, fair, and have integrity.

Abstract

Tujuan program pengembangan desa mitra: (1) memetakkan potensi wisata yang dimiliki DesaWisata Songgo Langit; (2) Memetakan strategi yang dilakukan untuk mewujudkan Desa Wisataberbasis alam, budaya dan pertanian; (3) Melakukan implementasi pengembangan desa wisata.Tujuan ini dilatarbelakangi adanya persoalan yang muncul dalam pengelolaan desa wisata adalahlemahnya pengembangan destinasi yang berkelanjutan, (struktur dan sumber daya manusia) yangkurang memiliki pemahaman yang baik dalam manajemen tata kelola desa wisata, manajemen dankomunikasi pemasaran yang tidak terencana dengan baik dan bersifat konvensional. Metodepelaksanaan dalam program pemberdayaan (partisipasi aktif) ini adalah metode survei danwawancara, pelatihan, pendampingan, focus group discussion, studi banding ke desa wisatapercontohan nasional.Hasil pemberdayaan masyarakat dalam pengembangan Jelajah Sawah Pertanian Bowongan(Jspb) Desa Wisata Songgo Langit, Mangunan, yaitu munculnya: pemetaan potensi-potensi unggulan,berupa: (1) Jelajah Wisata Persawahan Bowongan Songgo Langit, disertai wisata alam watu pipisan,wisata alam watu pipisan memiliki destinasi yang menarik, berupa watu pipisan dan gunung trasi; (2)Sanggar Ngesti Budoyo Songgo Langit yang didalamnya terdapat Kesenian Wayang Wong, Rasulan,Wiwitan, Sholawat Maulid Nabi, dan lainnya; (3) Wisata edukasi (pendidikan) berupa edukasipertanian tradisional, edukasi wayang wong, termasuk didalamnya outbound untuk mengenalkan alamkepada para wisatawan.Strategi pengembangan dengan: (1) Gotong Royong dan Musyawarah Pembangunan DesaWisata, (2) Pelatihan, meliputi: Pelatihan Pengelolaan Desa Wisata, Pengelolaan Desa Wisata yangBerkelanjutan, Komunikasi Pariwisata (model komunikasi pariwisata, komunikasi Pemasaran DesaWisata, Branding Desa Wisata, Pelatihan Pengelolaan Website dan Media Sosial untuk mendukungPromosi Desa Wisata), Pengelolaan Keuangan Desa Wisata dan Badan Usaha Milik Desa Wisata, danPelatihan Wayang Wong. Selain itu dilakukan FGD Pengembangan Desa Wisata untuk menemukansolusi terhadap persoalan-persoalan berkaitan dengan pengembangan desa wisata, baik manajemenpengelola, persoalan regulasi, sumber daya manusia, dan keuangan. Strategi lainnya adalah Studibanding dilakukan untuk memahami pengalaman terbaik (best practice) manajemen pengelolaan DesaWisata yang memiliki potensi dan keunggulan yang sama dengan Desa Wisata Songgo Langit. Studibanding dilakukan di Desa Wisata Nglanggeran dan Desa Wisata Sri Gethuk, Gunungkidul. Selainitu, untuk memperkuat potensi dibuatlan profil potensi desa wisata dan website desa wisata denganalam www.persawahanbowongan.com.

Abstract

This research is based on the weaknesses of constitutional review design in Indonesian and how the best design in Germany. This normative legal research is analysed using legislation and comparative approaches. The results showed that the German and the Indonesian Constitutional Courts had the same design and practice of constitutional review. The German Constitutional Court has complete authority, namely the abstract judicial review, concrete judicial review, and constitutional complaints. While the Indonesian Constitutional Court is only given the abstract judicial review and does not have a concrete judicial review and constitutional complaint authority, in practice, some applications are characterized by both. The design of abstract judicial review between the German and Indonesian Constitutional Courts has the same object of disputes but differences in the party applying. The object of the dispute on the concrete judicial review at the German Constitutional Court is the implementation of laws relating to court cases. The objects of petitions for constitutional complaints are judicial decisions, laws, and others.

Abstract

This article examines the determining factors inducing the decreasing votes of two renowned political parties in Indonesia: The Democrat Party (PD) and the People Conscience Party (Hanura). As the ruling party in the 2009 election, the PD’s votes declined dramatically in the two following elections. Meanwhile, Hanura failed to exceed the parliamentary threshold in 2019. Methodologically, it is qualitative research by utilizing a comparative case approach. To gather data, this study employed in-depth interviews and documentary analysis and strengthened by NVivo 12plus platform by using Crosstab Query and Wordcloud Analysis to visualize data. By applying the party change indicators developed by Harmel and Janda, the findings revealed that leadership change was the most influential factor toward the poor performance of both parties in the electoral competition. Such leadership change caused a detrimental conflict and changed a dominant faction inside the party. More specifically, the corruption case behaved by the PD’s politicians aggravated the party charm, and the parliamentary threshold was a supporting aspect of the thrown out of Hanura from the parliament.
