Abstract

This research focuses on the Proportionality test model of Competing Rights in practice in civil law countries (Germany and South Korea) and the Common Law System (United States and Canada). The research method used is a normative legal research method with statutory, comparative, and case approaches. The results show that the proportionality test is the "ultimate rule of law," a fundamental benchmark in judicial review, and has become a global constitutionalism recognised and applied internationally. Its application is structured and systematic with four test stages, such as German, Canadian, and South Korean models. Meanwhile, it is unstructured in the United States, and there is only one analytical tool (balancing test). In the case of decision, the four stages are only sometimes applied, but according to the needs of the analysis. If, at the third stage (necessity/minimal impairment), it is found that the object being tested is contrary to the Constitution, then the argumentation focuses on that analysis of it. The fourth stage is used if the case is more complicated and requires analysing the balance of norms and legal values. Meanwhile, in the Indonesian Constitutional Court practice, there is a proportional analysis, but it is partial, unstructured, and unsystematic. Therefore, in the future, it is essential to develop an Indonesian model of the principle of proportionality under the values of Pancasila and the 1945 Constitution.

Abstract

Community service program focused on developing competitive and cultured leading of tourism village. The partner of this service is "Tapak Tilas Sultan Agung" tourism village, one of the leading tourism products is Watu Goyang. This service was carried out with active participation through training, assistance, and development facilitation. Some of the programs that have carried out are: (1) strengthening human resources by organizing of tourism village, training includes: financial coaching, marketing training, innovation tourism product, package marketing training, marketing communication, and digital marketing training; (2) Outbound tourism, this development have carried out by providing training of trainers, and packaging outbound in watu goyang; (3) Packaging tourism products by applying the concept of "living in" in a tourist village, (4) Facilitating the development of watu goyang, carried out with various things: provider of superior tourist product information boards and information on watu goyang tourism map; (5) making the watu goyang tourism map; (6) changes in the new brand of watu goyang "watu goyang: wisata negeri khayangan" and carried out various promotions through websites, social media, and others.

Abstract

Tujuan program ini adalah menjadikan rumah budaya Ki Marto Pawiro sebagai model rumah budaya masyarakat sebagai destinasi wisata budaya baru yang memiliki ciri keunikan/ kekhasan serta aktivitas budaya masyarakat. Program pemberdayaan ini dilakukan dengan pendekatan community development (rembug, realisasi dan rawat), bentuk kegiatan dengan workshop/ diskusi rutin dan fasilitasi pengembangan.  Program pengembangan yang dilakukan adalah melakukan diskusi mendalam dengan masyarakat mengenai potensi pengembangan rumah budaya, melestarikan peralatan budaya (gamelan, keris pusaka, seperangkat wayang kulit, gamelan, dan lainnya), perumusan tata kelola (desain rumah budaya). Program juga mencakup pengembangan seni dan budaya, berupa: edukasi seni dan budaya, serta pertunjukan tari nitik siti arum. Inovasi lainnya adalah pengembangan pemaketan wisata budaya dengan mengeintegraskan homestay (live in package) dan paket niti laku sejarah Sultan Agung di Mangunan.

Abstract

Abstrak: Program pengabdian ini memfokuskan pada penguatan kemampuan advokasi bagi kader Muhammadiyah dalam mendorong kebijakan publik yang berkeadilan. Urgensi penguatan ini dilatarbelakangi banyaknya kebijakan publik di daerah yang menyimpang dari peraturan perundang-undangan. Tujuannya untuk memperkuat kemampuan kader dalam melakukan advokasi kebijakan publik, selain itu mempertegas komitmen dan sinergitas kader dalam mendorong kebijakan publik yang berpihak terhadap umat dan bangsa. Metode pengabdian dilakukan dengan musyawarah, realisasi program, dan evaluasi dengan mitra pengabdian Lembaga Hikmah dan Kebijakan Publik Pimpinan Pusat Muhammadiyah. Pelaksanaan dengan menggunakan metode workshop dengan jumlah peserta yang hadir sebanyak 42 kader pada pimpinan wilayah dan daerah Muhammadiyah se-Provinsi Daerah Istimewa Yogyakarta. Metode evaluasi hasil dengan meminta tanggapan dan penilaian perwakilan peserta dari 7 utusan lembaga, hasil nilai rata-rata adalah 83, 57% dengan kriteria bahwa workshop advokasi kebijakan publik berdampak pada peningkatan nalar kritis kader terhadap persoalan politik kebangsaan. Selain itu, program tersebut sudah sesuai dengan persoalan dan isu-isu strategis bidang advokasi kebijakan publik di daerah.Abstract: This community service programme aims to strengthen the advocacy skills of Muhammadiyah cadres to promote equitable public policies. This is motivated by the large number of public policies in the region that deviate from the law. The programme aims to enhance the ability of cadres to advocate for public policies and reinforce their commitment to promoting policies that benefit the people and the nation. The community service method involved deliberation, programme implementation and evaluation in collaboration with the community service partner, the Department of Politics and Public Policy of Muhammadiyah. A workshop method was used for the implementation, with 42 cadres from the regional and district leaderships of Muhammadiyah in the Special Region of Yogyakarta Province in attendance. The results were evaluated by requesting feedback and assessments from seven institutional delegates, who were participants. The average score was 83.57%, indicating that the public policy advocacy workshop had impacted cadres' critical thinking on national political issues. Additionally, the programme addressed the strategic issues and problems in the field of public policy advocacy in the region.
