Abstract

Background: Child labor in Indonesia remains a complex social issue, especially within Micro, Small, and Medium Enterprises (MSMEs), where informal employment often overlooks children’s rights. Specific Background: Many hawker children in Sidoarjo Regency work without contracts, fair wages, or safety standards, violating labor law provisions. Knowledge Gap: Previous studies have discussed child labor broadly but have not specifically examined the enforcement of hawker children’s rights within MSME contexts through a legal lens. Aim: This study aims to analyze the legal protection and enforcement of hawker children’s rights under Indonesian labor law. Results: Findings show that child workers in MSMEs experience excessive working hours, sub-minimum wages, and lack of contracts or occupational safety measures, primarily due to low legal awareness among MSME owners and weak supervision. Novelty: The study uses a conceptual and statutory approach by linking MSME regulations with labor law principles. Implications: The research suggests the need for inclusive labor policies, consistent law enforcement, legal education for entrepreneurs, and empowerment programs ensuring children’s rights to education and welfare. Abstract

Objective: This research investigates Supreme Court rulings in Indonesia concerning online loans from 2020 to 2024. Method: The analysis employs empirical methods with a legal research approach, integrating primary data from Supreme Court decisions and secondary data from legal regulations and journal literature. Results: Studied cases encompass civil and criminal classifications, emphasizing disputes in divorce cases and violations of information technology laws. Bibliometric analysis results highlight the complexity of addressing online loan cases in Indonesia within the contexts of justice, and law enforcement. Novelty: This research provides a comprehensive review of Supreme Court rulings on online loans in Indonesia over a recent five-year period, combining civil and criminal perspectives and employing bibliometric analysis to reveal the challenges in legal enforcement and justice.

Abstract

Penelitian ini dilakukan untuk menganalisa pelaksanaan tahapan verlijden pada Jabatan Notaris di Indonesia setelah adanya perubahan terhadap Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris. Metode yang digunakan adalah metode yuridis sosiologis (socio legal research) ditunjang data primer berupa dokumen dan wawancara dengan Majelis Pengawas Daerah Sidoarjo dan pejabat notaris di lingkungan Kabupaten Sidoarjo. Pada penelitian ini di temukan bahwa terdapat Notaris yang mlewatkan tahap-tahap verlijden, dan tidak memahami proses pembuatan aktanotaris secara lengkap dan komprehensif.

Abstract

Objective: This study aims to analyze the role of Indonesian positive law in regulating the sale of premium accounts through third parties and to assess the extent of consumer legal protection in such digital transactions. Method: The research adopts a normative juridical approach with a statutory and conceptual framework, supported by literature analysis and examination of relevant laws and regulations concerning e-commerce and consumer rights. Results: The findings reveal that current Indonesian legal provisions inadequately address the legality and consumer protection aspects of third-party premium account sales, creating a regulatory gap in the digital marketplace. The analysis indicates the need for clearer legal definitions, stronger enforcement mechanisms, and updated consumer protection frameworks to mitigate potential fraud and misuse. Novelty: This study contributes to the growing discourse on digital commerce law by highlighting the emerging legal implications of intangible digital goods transactions and proposing a structured legal perspective to enhance consumer protection in Indonesia’s rapidly evolving e-commerce environment.

Abstract

Indonesia has extensive and strategic forest areas, but managing them remains challenging, mainly due to limited community knowledge of forestry laws. This community service program was conducted in Girisekar Village, Gunungkidul, to improve legal and ecological awareness through legal counseling focused on village and community forest management. The approach used was legal counseling with a juridical-empirical method, involving 25 participants from diverse social backgrounds. The pre-test results showed that most participants were unfamiliar with the latest forestry regulations, the status of customary forests, or the requirement to register community forests. However, they had a basic understanding of technical management through social forestry groups. After the counseling session, the post-test indicated a significant increase in knowledge about community forest management (from 50% to 73%) and the rights and obligations of managers (from 35% to 80%). While understanding of statutory regulations remained unchanged, the activity successfully facilitated important dialogue between the community and resource persons and also strengthened ecological awareness. This activity significantly advances legal development by promoting practical understanding and community involvement in sustainable forest governance. The recommendation is to maintain ongoing, structured legal counseling programs and to enhance village institutions so they can efficiently manage, store, and market forest products. Therefore, legal counseling is not just a temporary activity but a strategic tool for fostering an adaptive, just, and community-focused legal culture.

Abstract

The growth of information technology-based lending services or peer-to-peer (P2P) lending in Indonesia has provided a financing alternative for the public while simultaneously offering investors opportunities to deploy their capital. Although P2P lending offers various advantages, investors remain exposed to significant risks, particularly the possibility of financial losses arising from unsuccessful financing activities or unlawful conduct committed by platform operators or other related parties. The implementation of P2P lending creates a legal relationship involving three main parties, namely the platform operator, the borrower, and the investor. Each party is bound by rights and obligations derived from applicable laws as well as contractual agreements entered into by the parties. Based on these circumstances, this research focuses on examining the civil liability of directors of P2P lending platform companies when unlawful acts result in financial losses for investors. The study also explores the legal relationships formed among the parties participating in P2P lending transactions and analyzes the legal grounds on which directors may be held civilly responsible for investor losses. This research adopts a normative legal research method using a statutory approach. The analysis is based primarily on the Civil Code, Law Number 40 of 2007 on Limited Liability Companies, and Financial Services Authority Regulation (POJK) Number 10/POJK.05/2022 concerning Information Technology-Based Funding Services. Secondary legal materials consist of scientific articles obtained through a Google Scholar search using the keywords "Digital Startups in the Event of Unlawful Acts." The results of this study indicate that there are three legal relationships in P2P lending that place providers in a strategic position to manage risk. Organizers and directors can be held civilly liable if negligence is proven to meet the requirements of Article 1365 of the Civil Code. To improve investor protection, this study recommends strengthening the accountability and governance of organizers.

Abstract

This study analyzes legal certainty regarding the application of the Business Judgement Rule principle and examines compliance with corporate law principles related to GCG in the actions taken by the Board of Directors of PT ASDP Indonesia Ferry when conducting a business cooperation and acquisition of PT Jembatan Nusantara. The method used in this study is normative legal research that refers to legal literature research by examining the law in various situations, including norms, rules, principles, doctrines, theories, and other literature. The results of the analysis show that the Board of Directors of PT ASDP has carried out its fiduciary duty properly in managing the company in relation to the Business Cooperation (KSU) and acquisition of PT Jembatan Nusantara, as evidenced by its prudence, good faith, and responsibility, as well as its compliance with the articles of association as stipulated in the Limited Liability Company Law. The Board of Directors of PT ASDP deserves legal protection under the Business Judgement Rule principle and cannot be held personally liable for corporate actions taken in the course of managing the company. With the fulfillment of the five principles of Good Corporate Governance, the actions of the Board of Directors of PT ASDP Indonesia Ferry (Persero) cannot be classified as actions that deviate from good corporate governance or as abuse of authority. On the contrary, the actions of the Board of Directors constitute the exercise of professional, rational, and responsible management functions, even though they involve business risks.

Abstract

Invoice financing is gaining popularity as an alternative option for micro, small, and medium enterprises (MSMEs) experiencing difficulties accessing loans from conventional banks. This method allows businesses to obtain funds by using invoices or accounts receivable as collateral before their maturity. However, the use of invoices as a financing tool raises legal challenges, particularly regarding their validity as collateral and legal protection for creditors from the risk of default by debtors. This study aims to analyze the forms of legal protection for creditors in the context of invoice financing in Indonesia and evaluate the legal status of invoices from the perspective of the Civil Code, particularly through the cession mechanism stipulated in Article 613 of the Civil Code. The method used in this study is a normative legal method with a legislative and conceptual approach. The research findings indicate that the cession mechanism can provide legal protection by further strengthening the creditor's position as the holder of the right to collect. However, existing legal protection is still inadequate due to the lack of comprehensive specific regulations regarding invoice-based financing. Therefore, strengthening the legal framework is essential to ensure certainty and security in invoice-based financing transactions.

Abstract

General Background Digital marketing has encouraged businesses to utilize endorsement strategies as a promotional tool through social media, creating a legal relationship between businesses and influencers governed by contracts. Specific Background This study evaluates the role of endorsement agreements as a legal tool to support marketing strategy at PT Aliyan Jaya Perkasa within the perfume trading sector. Knowledge Gap Previous research primarily emphasized legal validity, good faith principles, and the binding force of contracts without explicitly assessing how endorsement agreements function as legal tools in marketing strategies or their operational impact on corporate marketing performance. Aims This study aims to evaluate the effectiveness of endorsement agreements as a legal tool to support corporate marketing strategy while protecting companies. Results The findings indicate that endorsement agreements provide legal security for companies, encourage influencer compliance with contractual terms, and help increase perfume product marketing. Novelty This work combines contract law perspectives with digital marketing performance evaluations to demonstrate how structured agreements manage commercial cooperation and dispute resolutions. Implications These findings establish that structured endorsement agreements serve dual functions as effective marketing tools and legal mechanisms for protecting corporate interests and managing compliance. Highlights: Endorsement contracts provide legal security for companies and encourage influencer compliance with established promotional terms. Structured agreements support product marketing expansion while establishing accountability and protecting corporate brand images. Graduated dispute resolution mechanisms, ranging from deliberation to contractual sanctions, successfully address promotional discrepancies and violations.
