Abstract

Covid-19 pandemic situation has had a major impact on the sustainability of the community's businesses, thus hampering them in fulfilling their responsibilities in paying their debt obligations. Actio Pauliana as an instrument in the bankruptcy law on the one hand protects the interests of creditors, but on the other hand it is necessary to pay attention to the legal protection of buyers with good intentions. This research was conducted to examine: (1) Legal protection for creditors due to:  transfer of the object of bankruptcy; and (2) the legal consequences of canceling the sale and purchase of objects bankruptcy and its protection against buyers in good faith. The approach method used is through a normative juridical approach, descriptive analysis research specifications, which are supported by types and sources of data derived from secondary data, especially primary legal materials, secondary legal materials, and tertiary legal materials, then qualitative data analysis is carried out. The results of the study: (1) the Bankruptcy Act and the provisions of the Civil Code as general provisions provide protection to creditors due to the transfer of the object of bankruptcy through the instrument Actio Pauliana to cancel the debtor's actions are detrimental to the creditor; and (2) Good faith buyers get protection to get his right to get a guarantee of the safe and secure goods he bought, and failure to fulfill it gives the buyer the right to claim compensation. Abstract

The regulation regarding production sharing agreements in Indonesia has been regulated based on Law Number 2 of 1960 concerning Revenue Sharing Agreements, the profit sharing agreements that occurred in the Nagrak Village Area, Cianjur District, Cianjur Regency, the arrangement still uses the arrangement of profit sharing agreements according to local customary law. The role of the Village Head in this case is very necessary so that there is no dispute between the two parties in the implementation of the agricultural land production sharing agreement. As for the identification of the problem in this research, namely, whether the production sharing system for agricultural land in Nagrak Village, Cianjur District, Cianjur Regency has complied with the provisions of Law Number 2 of 1960 concerning Production Sharing Agreements? in Nagrak Village, Cianjur District, Cianjur Regency?, and what steps did the Head of Nagrak Village, Cianjur District, Cianjur Regency take in resolving the obstacles faced by farmers and cultivators in the agreement for agricultural land yields?. This research uses a normative juridical approach, which examines juridical data on the application of agricultural land production sharing agreement regulations. It is concluded that the regulation regarding production sharing agreements for agricultural land in Indonesia is still using Law Number 2 of 1960 concerning Production Sharing Agreements. The form of the agreement is made in writing before the Village Head and ratified by the Camat, but in practice Law Number 2 of 1960 concerning Profit Sharing Agreements is still not effective this is due to the ignorance of the local community with the existence of Law Number 2 of 1960 concerning Agreements Profit sharing.Keywords: Profit Sharing Agreement, Role of Village Head, Agricultural Land.

Abstract

By the increasing of the population and the economic structural development, the need of land for non-agricultural activities are likely to rise. This phenomenon leads a conversion of agricultural land, especially the unavoidable paddy. The causative factors of agricultural land conversion are: (1) Population; (2) The need of non-agricultural soil; (3) Economy; (4) Socio-cultural; (5) Autonomous Region; and (6) Lack of regulation. The Impacts of this conversion not only threatening food security but also interfering the stability of the economy, social, political, and development of the general population. There are three ways in controlling the use of land, they are: (1) Regulation; (2) Acquisition and management, those are perfecting the system and rules of land selling and the perfection of land tenure patterns (Land Tenure system) in supporting efforts towards maintaining agricultural land; and (3) Incentive and charges.Keywords: Agricultural land conversion, Food Security, Land Tenure System

Abstract

Sustainability of national development is the increase in the life of the community effort that is supported through the granting of credit facilities or loans, as the provision of money or bills that can be equated with that loan agreement borrow the returns are made on a period of time to come. In order to provide protection and reassurance against creditors in obtaining her credit refund, the Government ratified the Act No. 42 Year 1999 About the Fiduciary Guarantee gives the right to the lender through fiduciary certificates as material warranties that are submitted on the basis of trust, where the owner can still use his guarantee for economic activities. The ease, often abused the debtor not good intentioned one through the securing of objects belonging to third parties fiduciary are against the law to the detriment of creditors because it resulted in no fiduciary guarantee legitimately so the lender no longer has the right to obtain payment preferent precedence if the debtor tort in fulfilling the obligation payment of his credit. In addition, the owners of goods that harms his ownership was made the object of a fiduciary guarantee. Legal protection for owners of goods due to the securing of objects that are against the law of fiduciary relationships can do the prosecution indemnity as well as requesting removal of the disturbances a pleasure over the right material.Keywords: Fiduciary Certificates, Credit, Against The Law, Torts.

Abstract

Pada tanggal 21 November 2022, Kabupaten Cianjur, Provinsi Jawa Barat, Indonesia, diguncang gempa bumi berkekuatan 5,6 Mw (Lima Koma Enam Magnitudo). Permasalahan mengenai penanggulangan bencana sering terjadi, pemerintah terus berupaya untuk melakukan penataan dan penertiban dengan mengeluarkan berbagai kebijakan, termasuk masalah relokasi masyarakat pemilik hak atas tanah. Tujuan dari penelitian ini adalah untuk menganalisis kepastian hukum hak milik masyarakat atas tanah yang ditinggalkan akibat bencana gempa bumi dan hak atas tanah yang direlokasi di Kabupaten Cianjur. Metode penelitian ini menggunakan metode pendekatan yuridis normatif didukung yuridis sosiologis untuk akurasi serta validitas data, dengan spesifikasi penelitian deskriptif analisis, jenis dan sumber data menggunakan data primer dan data sekunder, serta analisis data dilakukan secara kualitatif. Kepastian hukum hak milik masyarakat atas tanah yang ditinggalkan akibat bencana gempa bumi dan hak atas tanah yang direlokasi di Kabupaten Cianjur. Tanah yang berada di Zona Merah tetap menjadi hak milik masyarakat juga sertifikatnya, namun tanah tersebut tidak dapat digunakan sebagaimana mestinya. Sedangkan, tanah di lokasi relokasi akan menjadi hak milik masyarakat setelah 10 (Sepuluh) tahun, sehingga belum ada sertifikat kepemilikan saat ini. Setelah masa tersebut berakhir, kepemilikan tanah tersebut akan disahkan dengan Sertifikat Hak Milik.

Abstract

Tax is a source of state revenue that plays a major role in financing all state expenditures, including financing national development. The absence of counter-performance that the taxpayer can directly accept is one of the causes of tax crimes committed by corporations through transfer pricing practices, which are difficult to hold accountable, so it is necessary to optimize the application of the principle of Beneficial ownership (BO). The aim of this research is to examine the factors that cause transfer pricing as a form of corporate crime, the application of Beneficial ownership principles in the field of taxation, and the obstacles encountered in implementing Beneficial ownership in the field of taxation along with the solutions. The method is a normative juridical approach, descriptive-analytical research specifications, data types, and sources are derived from secondary data through the support of primary legal materials, secondary legal materials, and tertiary legal materials, and data analysis is carried out qualitatively. The results of the study explain that transfer pricing is a corporate crime that is supported by the use of earnings management, the use of opportunities for special relationships, the support of political connections, and thin capitalization. The application of the principle of Beneficial ownership in the field of taxation means that owners are entitled to enjoy income in the form of dividends, interest and/or royalties, which both individual and corporate taxpayers receive. The obstacles faced in implementing BO in the field of taxation are the weak update of information on Beneficial owners and their changes and partial and sectoral regulations. Abstrak Pajak merupakan salah satu sumber pendapatan negara yang berperan besar dalam membiayai semua pengeluaran negara termasuk membiayai pembangunan nasional. Tidak adanya kontra prestasi yang langsung dapat diterima wajib pajak menjadi salah satu penyebab terjadinya kejahatan di bidang perpajakan yang dilakukan korporasi melalui praktik transfer pricing, yang sulit untuk dimintai pertanggungjawabannya sehingga perlu dioptimalkan penerapan prinsip Beneficial ownership (BO). Tujuan penelitian untuk mengkaji faktor-faktor penyebab terjadinya transfer pricing sebagai bentuk kejahatan korporasi, penerapan prinsip Beneficial ownership di bidang perpajakan dan kendala yang dihadapi dalam menerapkan Beneficial ownership di bidang perpajakan disertai solusinya. Metode pendekatan yuridis normatif, spesifikasi penelitian deskriptif analisis, jenis dan sumber data berasal dari data sekunder melalui dukungan bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, dan analisis data dilakukan secara kualitatif. Hasil penelitian menjelaskan bahwa transfer pricing merupakan kejahatan korporasi yang didukung pemanfaatan manajemen laba, pemanfaatan peluang hubungan istimewa, dukungan political connection dan thin capitalization. Penerapan prinsip Beneficial ownership di bidang perpajakan merupakan pemilik yang berhak menikmati penghasilan berupa deviden,bunga dan atau royalti, yang diterima baik wajib pajak perorangan maupun wajib pajak badan. Kendala-kendala yang dihadapi dalam menerapkan (BO) di bidang perpajakan yaitu lemahnya update informasi Beneficial owner maupun perubahannya, serta regulasi yang bersifat parsial dan bersifat sektoral. Abstract

AbstrakPenggunaan media elektronik memunculkan tindak kejahatan baru yang disebut carding, yang merupakan jenis kejahatan siber dengan sifat transnasional (melintasi negara). Hal ini menuntut perlunya penegakan hukum, terutama melalui konsep tort. Penelitian ini menggunakan pendekatan yuridis normatif dengan spesifikasi deskriptif analitis. Data yang digunakan berasal dari sumber sekunder, termasuk bahan hukum primer, sekunder, dan tersier, yang kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa carding adalah kejahatan yang memanfaatkan internet untuk memperoleh nomor kartu kredit konsumen secara ilegal, dengan kegiatan yang melintasi batas negara. Dalam konteks ini, tort sesuai dengan Pasal 1365 KUH Perdata dapat digunakan sebagai alat penegakan hukum atas kerugian yang timbul akibat carding, karena memenuhi unsur-unsur perdata, melibatkan unsur asing, dan beroperasi di beberapa sistem hukum negara. Salah satu tantangan utama dalam menanggulangi carding sebagai kejahatan siber internasional adalah masalah yurisdiksi, yaitu kewenangan suatu negara dalam menangani peristiwa hukum yang melibatkan pihak-pihak atau kejadian yang melintas batas-batas wilayah negara tersebut). AbstractThe use of electronic media has given rise to a new type of crime called carding, which is a type of cybercrime with a transnational nature. (melintasi negara). This demands the necessity of law enforcement, especially through the concept of tort in International Civil Law. This research uses a normative juridical approach with a descriptive-analytical specification. The data used comes from secondary sources, including primary, secondary, and tertiary legal materials, which are then analyzed qualitatively. Research results show that carding is a crime that exploits the internet to illegally obtain consumers' credit card numbers, with activities crossing national borders. In this context, tort in accordance with Article 1365 of the Civil Code can be used as a legal enforcement tool for losses arising from carding, because it meets the elements of civil law, involves foreign elements, and operates in several legal systems of the country. One of the main challenges in combating carding as an international cybercrime is the issue of jurisdiction, which refers to a country's authority to handle legal events involving parties or incidents that cross the borders of that country.

Abstract

Cash Waqf in Islamic Banks for economic equality has become an essential topic in the legal framework regulated by Law Number 4 Year 2023 concerning the Development and Strengthening of the Financial Sector and Islamic Economic Law. Cash waqf in Islamic Banks provides a legal basis for raising funds needed to support economic equality, which aims for sustainable economic development. The purpose of this study is to explain Cash Waqf in Islamic Banks for economic equality, first, according to Law Number 4 Year 2023 concerning the Development and Strengthening of the Financial Sector and, second, according to Islamic Economic Law. The research method used normative juridical with a statute and conceptual approach, while the research specifications used descriptive analytical. The results of the study indicated that Law Number 4 Year 2023 provides a legal framework to support cash waqf in Islamic Banks by providing opportunities for them to become waqf nazirs. Then, this will support national economic equality in accordance with the objectives of waqf according to Islamic economic law. However, harmonization of regulations related to banks as cash waqf nazirs is needed.

Abstract

This research analyses the application of the concept of zaakwarneming in the medical world, specifically related to medical actions taken by doctors without the consent of patients or their families in emergency conditions. In Indonesian civil law, zaakwarneming allows a person to take care of the interests of others without power of attorney with the aim of protecting their interests. In the medical context, the application of this concept can justify the doctor's actions in situations where consent cannot be obtained in a timely manner. However, this action still poses legal and ethical dilemmas, especially in relation to the patient's right to autonomy as well as the doctor's professional responsibility. This research uses a mixed method, namely a quantitative approach through a community survey and a qualitative approach through a literature study. The survey results show that most people understand the importance of informed consent, but there are differences of opinion on whether doctors can act without consent in an emergency. Most respondents also support transparency and better communication between doctors and patients to avoid legal disputes. Legally, unauthorised medical action can have consequences in civil, criminal and administrative aspects. Therefore, clearer regulations are needed regarding the limits and responsibilities of doctors in the application of zaakwarneming. A more detailed Standard Operating Procedure (SOP) and public education on patient rights in medical services are expected to reduce the potential for legal disputes and increase legal certainty for medical personnel.

Abstract

Sexual violence and bullying in schools are serious and complex issues that negatively affect students’ psychological, social, and academic well-being. A learning environment that should serve as a safe and nurturing space can become harmful if these issues are not addressed appropriately. This community service program, conducted at SMA 1 Pasundan Cianjur, aims to introduce and integrate local Sundanese wisdom values such as silih asih (mutual affection), silih asah (mutual learning), and silih asuh (mutual care) as a cultural approach to preventing sexual violence and bullying in schools. The activities were carried out through seminars and interactive discussions involving students, teachers, and school staff. Data were collected through direct observation and feedback from seminar participants. The results indicate that the majority of students are aware of bullying practices in their school environment, and some reported having experienced or felt concerned about potential incidents of sexual violence or bullying. This program successfully raised awareness of the importance of cultural values as a foundation for character education and child protection within the educational setting. Moving forward, the integration of local wisdom is expected to become part of a sustainable preventive strategy to create a safe, inclusive, and culturally rooted school environment.
