Abstract

The purpose of this research is to study and analyze The Traditional Rights of the Ma’anyan Dayak Indigenous Society in Awang Sub Regency East Barito Regency which has not yet acquired recognition and protection and Analyzing The Legal Recognition and Protection of the Ma’anyan Dayak Indigenous Law Society when there is an event of legal actions occurs. This Research is Empirical Research which obtained through legal identification (Oral) in form of habits that are still valid in the Ma’ayan Dayak Indigenous Society unit in Awang Sub Regency East Barito Regency which is then analyzed using an objective and relevant theory about The Traditional Rights Indigenous Law Society, therefore accurate results can be discovered about types of rights analyze The Traditional Rights of the Ma’anyan Dayak Indigenous Society in Awang Sub Regency East Barito Regency which must be given recognition and protection. This Research concludes that The Traditional Rights of the Ma’anyan Dayak Indigenous Society in Awang Sub Regency have not been protected since the regional government of east barito regency until now has not implemented and follow up The Minister of Affairs Regulation Number 52 of 2014 and from the Decree the Governor of Central Kalimantan Number 188.44/360/2020 about establishment the Central Kalimantan Province. Legally, there has been legal recognition of the indigenous law society and traditional rights attached to The Traditional Rights of the Ma’anyan Dayak Indigenous Society in Awang Sub Regency, which is Article 18 B paragraph (1) of the 1945 Constitution, however, there has not been further regulated in form of legislation and the desired legal recognition is not just de jure, limited to limited verbal legal recognition which coming first from the indigenous society itself and the surrounding society, but demand on embodiment in the true sense. Therefore when there is an event of legal actions occurring over The Traditional Rights of the Ma’anyan Dayak Indigenous Society prefers to resolve legal actions outside the court with their mechanism to resolve legal actions that occur in their territory according to the customary law through deliberation and consensus. Therefore, the Regional Government of East Barito Regency is expected to form a regional regulation as legal protection for protecting the rights of indigenous society in the various development process, the rights of indigenous society are not ignored.

Abstract

Penetapan Undang-Undang No. 33 Tahun 2014 tentang Jaminan Produk Halal bertujuan untuk menciptakan keamanan bagi masyarakat Indonesia, terutama komunitas agama Muslim, terkait jaminan kehalalan untuk makanan dan minuman yang mereka konsumsi. Namun, kenyataannya masih ada pelaku UMKM makanan dan minuman yang belum memenuhi kewajiban tersebut. Rumusan masalah yang penulis angkat adalah: Bagaimana pelaksanaan kewajiban sertifikasi halal pada usaha UMKM makanan dan minuman di kota Palangka Raya? Bagaimana mekanisme jaminan produk halal pada makanan dan minuman berdasarkan Undang-Undang No.33 Tahun 2014 tentang jaminan produk halal?Jenis metode penelitian yang digunakan adalah penelitian Yuridis Empiris yang merupakan penelitian hukum berdasarkan fakta di lapangan yang diperoleh melalui wawancara atau tanya jawab dari beberapa narasumber di lokasi penelitian sebagai bahan untuk menjawab masalah hukum yang terjadi.Berdasarkan hasil penelitian yang dilakukan oleh penulis, pelaksanaan Undang-Undang No. 33 Tahun 2014 tentang Jaminan Produk Halal terhadap kewajiban sertifikasi halal UMKM makanan dan minuman di kota Palangka Raya telah dilaksanakan meskipun masih belum efektif karena masih ada pelaku UMKM Makanan dan Minuman yang belum memiliki sertifikat halal serta mekanisme jaminan produk halal berdasarkan Undang-Undang No.33 Tahun 2014 tentang jaminan produk halal melalui beberapa tahapan termasuk pengajuan permohonan hingga penerbitan sertifikat halalnya oleh Penyelenggara Jaminan Produk Halal (BPJPH).

Abstract

Coal mining in Barito Timur Regency, Central Kalimantan, significantly contributes to the economy but also negatively impacts the environment. Mining activities have caused water pollution, landscape changes, land degradation, and disruptions to the surrounding communities. This study aims to analyze the accountability of coal mining companies for environmental damage based on criminal, civil, and administrative law aspects. The research employs a qualitative approach with a descriptive case study method. The findings indicate that regulations concerning corporate accountability are outlined in various legal frameworks, such as Law Number 32 of 2009 on Environmental Protection and Management and Law Number 3 of 2020 on Mineral and Coal Mining. Criminal liability allows companies and their management to be prosecuted for violations. Meanwhile, civil liability requires companies to compensate for damages and restore affected environments, while administrative liability includes sanctions such as warnings, fines, and business license revocations. Despite the existing regulations, law enforcement implementation remains weak due to insufficient supervision and corporate non-compliance. Therefore, enhanced government oversight and active community participation are necessary to ensure adherence to environmental regulations. With appropriate measures, a balance between resource exploitation and environmental preservation can be achieved, ensuring ecosystem sustainability and community well-being.

Abstract

General Elections (Pemilu) are a means of implementing the sovereignty of the people as stipulated in the 1945 Constitution of the Republic of Indonesia, which is carried out directly, publicly, freely, confidentially, honestly, and fairly. One of the main challenges in organizing elections is maintaining the neutrality of the State Civil Apparatus (ASN), which is legally prohibited from engaging in practical politics. The neutrality of ASN is a serious concern because their non-neutrality can affect the integrity of the election process and reduce public confidence in the results obtained. In the context of the 2024 Election, the role of the General Election Supervisory Agency (Bawaslu) of Palangka Raya City is very important in ensuring the neutrality of ASN. This study aims to analyze the role of the Election Supervisory Agency (Bawaslu) of Palangka Raya City in maintaining ASN neutrality during the 2024 Election and to examine the supervision strategy implemented to handle violations of ASN neutrality. Through systematic monitoring, strict law enforcement, and socialization of the importance of ASN neutrality, it is hoped that Bawaslu can ensure the holding of fair and democratic elections.

Abstract

Study This aim For knowing description protection consumer to breach of contract committed by online drivers against misuse of personal data with method analyze protection consumer in practice in fact as well as responsibility answer perpetrator to consumers who feel dissatisfied​ safety , discomfort , and loss for consumers . The research techniques used is method juridical normative with approach legislation and conceptual . Research results show that mismatch driver identity is form default Because performance No implemented in accordance with agreement electronics . As a result law from default the violate right consumer on security , comfort and certainty law as arranged in Constitution Protection Consumers , so that open room accountability for drivers.

Abstract

Sexual violence against persons with mental disorders (ODGJ) raises serious legal issues related to the fulfillment of victims' rights and access to justice, particularly due to the victims’ limited capacity to provide testimony and defend themselves in criminal proceedings. This study aims to analyze the forms of legal protection and the effectiveness of regulatory implementation in handling ODGJ as victims of sexual violence in Palangka Raya City. This research employs an empirical legal research method through field data collection and analysis of relevant legal frameworks. The findings indicate that although Law No. 12 of 2022 concerning Sexual Violence Crimes and Law No. 17 of 2023 concerning Health provide a normative basis for victim protection, their implementation remains limited in practice. In Palangka Raya, several specific obstacles were identified, including the absence of specialized psychological assessment mechanisms to support victim testimony, limited availability of mental health experts during the investigation process, and the lack of standardized procedures for adapting examination techniques to victims with mental disabilities. In addition, the absence of integrated service facilities and limited training for law enforcement officers regarding disability-sensitive approaches further complicate the handling of such cases. This study emphasizes that legal protection for ODGJ victims of sexual violence requires a more comprehensive approach through capacity building for law enforcement officials, adaptive evidentiary mechanisms, and stronger institutional coordination to ensure the effective fulfillment of victims’ rights.
