Abstract

Regulation is a set of rules formed to regulate the order of social life. Regulations also regulate various lines of life including religion. Religion is defined as man's belief in the existence of God including the ordinances of worship. Freedom of religion also needs to be applied in universities as evidence of Freedom of Religion and Belief. This study aims to find out how the regulation of religious freedom in Higher Education (Semarang State University Campus Study) from the point of view of Freedom Of religion And Belief. This study used normative juridical methods. In this study, it can be concluded that the procurement of houses of worship in universities is still very rare. This is because there are no regulations or policies that regulate this matter. However, there are also several universities that already have multi-religious houses of worship, one of which is Semarang State University. The construction of the house of worship aims to strengthen religious moderation through tolerance.

Abstract

Abstract. The legal maxim al-umūru bimā maqāṣidihā (“acts are judged by their intents”) is a foundational principle with a broad scope that encompasses all human behavior, both speech and action. It affirms that every deed is evaluated in light of the purpose or intention behind it. In criminal law, mens rea refers to the mental state or intent of an offender at the time a criminal act is committed and constitutes a crucial element in determining criminal liability. This study aims to build a conceptual understanding of the relationship between intention and criminal fault while highlighting the relevance of Islamic ethical values to the formulation of principles of criminal responsibility within Indonesia’s legal system. The findings are organized systematically to provide both theoretical and practical contributions to the development of criminal law scholarship grounded in moral values and the principle of substantive justice. Employing a library-research method, the study reviews relevant literature and references to analyze the concept of intention as the basis for criminal responsibility from the perspectives of Islamic law and positive criminal law. The study concludes that the correlation between intention in Islamic law and the doctrine of criminal responsibility is not merely conceptual, but also normative and philosophical in nature. Kaidah Al-Umûru Bimâqâshidihâ merupakan salah satu kaidah pokok yang memiliki cakupan makna yang sangat luas. Kaidah ini mencakup seluruh perilaku manusia, baik dalam bentuk ucapan maupun tindakan. Prinsip ini menegaskan bahwa setiap perbuatan dinilai berdasarkan tujuan atau niat yang melatarbelakanginya. Selanjutnya, dalam hukum pidana, mens rea merupakan unsur yang mengacu pada keadaan mental atau niat pelaku ketika melakukan suatu tindak pidana dan menjadi salah satu elemen penting dalam menentukan pertanggungjawaban pidana seseorang. Penelitian ini bertujuan untuk membangun pemahaman konseptual mengenai keterkaitan antara niat dan kesalahan pidana, serta menegaskan relevansi nilai-nilai etika dalam hukum Islam terhadap pembentukan asas pertanggungjawaban pidana dalam sistem hukum Indonesia. Temuan yang dihasilkan disusun secara terstruktur guna memberikan sumbangan teoritis dan praktis bagi pengembangan studi hukum pidana yang berlandaskan pada nilai moral dan prinsip keadilan substantif. Penelitian ini menggunakan metode penelitian kepustakaan dengan cara menelaah berbagai literatur dan sumber referensi yang relevan guna menganalisis konsep niat sebagai landasan pertanggungjawaban pidana dalam perspektif hukum Islam dan hukum pidana positif. Hasil dari penelitian ini adalah ditemukan bahwa korelasi antara niat dalam hukum Islam dan asas pertanggungjawaban pidana bukan hanya bersifat konseptual, tetapi juga normatif dan filosofis. Abstract

Bribery of prosecutors is a form of professional misconduct and corruption that threatens the integrity of law enforcement in Indonesia. This study discusses the factors that cause bribery in the legal profession and strategies to prevent it. It uses a normative legal research method through a literature review of existing literature, regulations, and previous research results. The results of the study show that the factors causing bribery can originate from internal individual aspects, family pressure, education, low compensation, weak laws, and lack of supervision. According to GONE Theory, bribery behavior is influenced by greed, opportunity, need, and low risk of disclosure. Prevention strategies include preventive, detective, and repressive approaches, accompanied by strengthening morality, transparency, strict law enforcement, optimization of supervisory institutions, and the application of ethical values. The implications of this study emphasize the need for institutional reform and moral integrity to realize clean, objective, and fair law enforcement. Penyuapan terhadap jaksa merupakan salah satu bentuk tindakan pelanggaran etika profesi dan tindak korupsi yang mengancam integritas penegak hukum di Indonesia. Penelitian ini membahas faktor-faktor yang menyebabkan praktik suap dalam profesi jaksa serta upaya strategi pencegahannya. Menggunakan metode penelitian hukum normatif melalui studi kepustakaan terhadap literatur, regulasi, dan hasil penelitian terdahulu. Hasil kajian menunjukkan bahwa faktor penyebab penyuapan dapat bersumber dari aspek internal individu, tekanan keluarga, pendidikan, kompensasi yang rendah, lemahnya hukum, serta kurangnya pengawasan. Melalui Teori GONE, perilaku suap dipengaruhi oleh keserakahan, kesempatan, kebutuhan, dan rendahnya risiko pengungkapan. Strategi pencegahan mencakup pendekatan preventif, detektif, dan represif, disertai penguatan moralitas, transparansi, penegakan hukum yang tegas, optimalisasi lembaga pengawas, serta penerapan nilai-nilai etika. Implikasi penelitian ini menegaskan perlunya reformasi kelembagaan dan integritas moral untuk mewujudkan penegakan hukum yang bersih, objektif, dan berkeadilan.

Abstract

The development of Islamic economics in Indonesia has shown significant growth, in line with the increasing demand for a financial system based on sharia principles. However, this growth has also led to more complex disputes among business actors and Islamic financial institutions. In this context, the application of fiqhiyyah principles (legal maxims) plays a crucial role as a normative and methodological foundation in resolving Islamic economic disputes. This article aims to analyze how fiqhiyyah principles are applied in dispute resolution practices within both religious courts and alternative institutions such as sharia arbitration. The research employs a normative juridical method with conceptual and statutory approaches, supported by a review of relevant decisions from religious courts. The findings indicate that the application of fiqhiyyah principles—such as al-yaqīn lā yazūlu bi al-syak (certainty is not removed by doubt), al-‘ādah muhakkamah (custom is an authoritative source of law), and al-masyaqqah tajlib al-taysīr (hardship brings about ease)—serves as a key judicial consideration in realizing substantive justice aligned with maqāṣid al-syarī‘ah (the objectives of Islamic law). Therefore, the implementation of fiqhiyyah principles not only strengthens the legitimacy of Islamic law within the national legal system but also becomes an essential instrument for achieving equitable, beneficial, and socially just resolutions in Islamic economic disputes.

Abstract

Poverty, which arises as a result of unequal development, has become a serious issue for many communities. Economic hardship often compels individuals to justify any means necessary to achieve their goals, even at the cost of violating moral values. This condition not only triggers criminal behavior but also contributes to the decline of morality, as people may neglect social and religious norms in order to survive. As a multidimensional problem, poverty generates various social issues. Under economic pressure, individuals working as laborers, small traders, or low-income employees are sometimes driven to deviant acts such as theft, robbery, or even prostitution. Such circumstances also influence the practice of religious duties, as some people tend to neglect religious and moral obligations in order to fulfill their basic needs. This study aims to examine the relationship between fasting as a religious obligation and the sense of compulsion brought about by economic difficulties. Miles & Huberman identify the main causes of poverty as low levels of education, weak work ethic, and limited employment opportunities. Consequently, religious practices such as prayer, fasting, and other Islamic activities are often performed inconsistently. From the perspective of Islamic law, this phenomenon reflects a shift in intention: acts of worship that should be based on sincerity may instead be carried out under compulsion due to economic pressure. Thus, poverty fosters survival strategies that weaken the quality of religious observance and create a dilemma between genuine devotion and compulsion in performing fasting

Abstract

The legal profession plays a vital role in the judicial system to ensure the principle of equality before the law as well as fair and accountable legal proceedings. In accordance with Law No. 18 of 2003 on Advocates, an advocate is an autonomous, independent, and accountable legal professional who is granted immunity as stipulated in Articles 14, 15, and 16, which provide protection from civil and criminal claims when acting in good faith while performing their duties. However, in practice, the scope of this immunity often leads to differing interpretations, particularly regarding the parameters of “good faith” and the scope of “professional duties,” which can result in the criminalization of lawyers. This is evident in the case of Hendra Sianipar, where a lawyer’s actions in exercising legal authority were instead subject to criminal prosecution. This study aims to examine the limits of attorney immunity and explore the potential for criminalization of this profession using a normative legal approach combined with a legal utility analysis. The findings of this study indicate that attorney immunity is not absolute but is limited by good faith, compliance with the law, and professional ethics, thus requiring clearer and more balanced clarification of these limits.

Abstract

This study aims to analyze the abuse of authority by notaries in the making of authentic deeds, focusing on the forms of misconduct, legal loopholes, and weaknesses in the supervisory system. The research employs a qualitative method with a normative juridical approach through library research, examining laws and regulations, legal doctrines, scholarly literature, and relevant cases related to notarial practice. The findings reveal that abuse of authority occurs due to both negligence and intentional actions. Common forms of misconduct include the failure to verify the authenticity and completeness of supporting documents, the preparation of deeds outside the notary’s authorized jurisdiction, the delegation of notarial duties to unauthorized parties, and the existence of conflicts of interest that compromise impartiality. In addition, legal loopholes arise from ambiguous regulatory provisions, inconsistencies in legal interpretation, and the rapid development of digital technology, particularly electronic transactions and online services, which have not yet been comprehensively regulated. The study also finds that the existing supervisory system remains weak, reactive, and often ineffective in preventing violations before they occur. Therefore, the abuse of notarial authority should be viewed as a systemic issue requiring comprehensive reforms in legal regulations, supervisory mechanisms, professional ethics enforcement, and notarial education to ensure legal certainty, accountability, and the preservation of public trust in the notarial profession.
