Abstract

Abstract .The process of splitzing land ownership certificates is regulated in the Regulation of the Head of the National Land Agency of the Republic of Indonesia Number 1 of 2010 concerning Service Standards and Land Regulations. In practice, the application process for splitzing the certificate of ownership of individual land more than 5 (five) fields in Babakancaringin Cianjur Village is accepted by the Cianjur Regency Land Office. This research aims to find out the process of splitzing the certificate of ownership of individual land more than 5 (five) fields in Babakancaringin Cianjur Village is in accordance with the applicable provisions and to find out the legal protection for land buyers against the split certificate of ownership of individual land more than 5 (five) fields in Babakancaringin Cianjur Village in the realization of legal certainty. The research method used in this research is the normative juridical approach method. Research specification is descriptive analytical. The research stage was carried out by conducting library research and interviews as supporting material for secondary data and data analysis was carried out using qualitative juridical methods. The results of this study found that the process of splitzing the Certificate of Ownership on individual land in Babakancaringin Cianjur Village is not in accordance with the applicable provisions, which are contained in the Regulation of the Minister of Agrarian Affairs / Head of BPN of the Republic of Indonesia Number 1 of 2010 concerning Service Standards and Land Regulations in Appendix II concerning the Split / Separation of Individual Land Fields and Legal Entities. In addition, Legal Protection for land buyers in Babakancaringin Cianjur Village is the provision of Land Ownership Certificates in the realization of legal certainty. ABSTRAK. Proses pemecahan Sertifikat Hak Milik atas tanah diatur dalam Peraturan Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 1 Tahun 2010 tentang Standar Pelayanan dan Pengaturan Pertanahan. Dalam praktik proses permohonan pemecahan Sertifikat Hak Milik atas tanah perorangan lebih dari 5 (lima) bidang di Desa Babakancaringin Cianjur diterima oleh Kantor Pertanahan Kabupaten Cianjur. Penelitian ini bertujuan untuk mengetahui proses pemecahan Sertifikat Hak Milik atas tanah perorangan lebih dari 5 (lima) bidang di Desa Babakancaringin Cianjur sudah sesuai dengan ketentuan yang berlaku dan untuk mengetahui perlindungan hukum bagi pembeli tanah terhadap pemecahan sertifikat Hak Milik atas tanah perorangan lebih dari 5 (lima) bidang di Desa Babakancaringin Cianjur dalam terwujudnya kepastian hukum. Metode penelitian yang digunakan metode yuridis normatif. Spesifikasi Penelitian yang digunakan deskriptif analitis. Tahap penelitian dilakukan dengan melakukan penelitian kepustakaan dan wawancara, analisis data menggunakan metode yuridis kualitatif. Hasil dari penelitian bahwa Proses pemecahan Sertifikat Hak Milik atas tanah perorangan di Desa Babakancaringin Cianjur tidak sesuai ketentuan yang berlaku, yang terdapat dalam Peraturan Menteri Agraria/Kepala BPN Republik Indonesia Nomor 1 Tahun 2010 tentang Standar Pelayanan dan Pengaturan Pertanahan Lampiran II tentang Pemecahan/Pemisahan Bidang Tanah Perorangan dan Badan Hukum. Selain itu, Perlindungan Hukum bagi pembeli tanah di Desa Babakancaringin Cianjur adalah pemberian Sertifikat Hak Milik atas tanah dalam terwujudnya kepastian hukum.

Abstract

Pengadaan tanah merupakan proyek kepentingan umum melibatkan upaya memperoleh tanah diatur dalam Undang-Undang Nomor 2 Tahun 2012 tentang pengadaan tanah bagi pembangunan untuk kepentingan umum dan Peraturan Pemerintah Nomor 19 Tahun 2021 tentang penyelenggaraan pengadaan tanah bagi pembangunan untuk kepentingan umum. Dengan memberikan kompensasi kepada pemilik yang melepaskan tanah, bangunan, tanaman, dan aset terkait. Seringkali, proses ini menimbulkan konflik di masyarakat khususnya berkaitan dengan ganti rugi. Penelitian ini bertujuan untuk memahami pengadaan tanah pembangunan Tol Cisumdawu Kabupaten Sumedang sudah sesuai dengan ketentuan yang berlaku, dan kepastian hukum ganti rugi bagi masyarakat yang terdampak pengadaan tanah pembangunan Tol Cisumdawu Kabupaten Sumedang. Metode penelitian yang digunakan dalam penelitian ini adalah metode pendekatan yuridis normatif. Spesifikasi Penelitian adalah deskriptif analitis. Tahap penelitian dilakukan dengan melakukan penelitian kepustakaan dan wawancara sebagai bahan pendukung data sekunder dan Analisis data dilakukan menggunakan metode yuridis kualitatif. Hasil penelitian menunjukan bahwa skripsi ini untuk menjawab permasalahan tidak sesuai dengan ketentuan yang berlaku yang terdapat dalam Undang-Undang Nomor 2 Tahun 2012 tentang pengadaan tanah dan Peraturan Pemerintah Nomor 19 Tahun 2021 tentang penyelenggaraan pengadaan tanah bagi pembangunan untuk kepentingan umum. ABSTRACT. Land acquisition is a public interest project that involves efforts to acquire land by providing peace to owners who release land, buildings, plants and related assets. Often, this process creates conflict in society, especially regarding compensation.Therefore, this research aims to obtain land for the construction of the Cisumdawu Toll Road, Sumedang Regency in accordance with applicable regulations, and ensure legal compensation for communities affected by the land procurement for the construction of the Cisumdawu Toll Road, Sumedang Regency. The research methodology uses a normative juridical approach, qualitative research type, descriptive analysis research specifications, data collection methods and techniques in the form of library research to collect secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials, as well as qualitative analysis methods using interpretation. grammatically with a statutory regulatory approach. The research results show that this thesis is to answer the problem so that it does not continue to become a mistake over and over again, so it is important to understand the format, basis and procedures for determining compensation in the context of land acquisition for the public interest.

Abstract

Abstract. Legal protection for home consumers must be proven with a certificate of land ownership or building rights as regulated in Law Number 5 of 1960, which has been updated by Government Regulation Number 18 of 2021. In practice, there is a sale and purchase of the Bandung City View 2 housing estate. After losing the dispute as per the Bandung Administrative Court decision. The purpose of this research is to determine the legal protection for consumers and the judge's considerations in deciding the case after the developer's defeat in Administrative Court Decision Number 3/G/2021/PTUN.Bandung. The research method used in this study is a normative juridical approach, with a specific descriptive-analytic analysis. The data analysis is normative qualitative.The conclusion of the research is that legal protection for consumers of the Bandung City View 2 housing estate who do not have a certificate of land ownership or building rights, which has been revoked by the Bandung State Administrative Court, is lacking. In this case, referring to Law Number 1 of 2011, Article 42, the judge did not pay clear attention to the law regulating land registration, and therefore the consumer is entitled to compensation as regulated in Law Number 8 of 1999, Article 7, which regulates the obligations of business actors. Abstrak. Pelindungan hukum bagi konsumen yang memiliki rumah harus membuktikan dengan sertifikat hak milik atas tanah atau hak guna bangunan sebagaimana yang diatur di dalam uu nomor 5 tahun 1960 yang telah di perbaharui dengan pp np 18 tahun 2021 .dalam praktik terjadinya jual beli perumahan bandung city view 2 . setelah kalah sengketa sebagaimana putusan pengadilan tata usaha bandung. Adapun tujuan dari penelitian ini untuk mengetahui perlindungan hukum bangi konsumen dan pertimbangan hakim dalam memutus perkara pasca kekalahan developer dalam Putusan PTUN Nomor 3/G/2021/PTUN.Bandung.Metode penelitian yang digunakan dalam penelitian ini pendekatannya adalah yuridis normatif, spesifikasi analisaisnya deskriptif analitis Analisa datanya normatif kualitatif .Simpulan dari penelitian bahwa perlindungan hukum bagi konsumen perumahan bandung city view 2 tidak memiliki sertifikat hak milik atas tanah atau hak guna bangunan yang dicabut oleh pengadilan tata usaha negara kota bandung dalam hal ini tinjau uu no 1 no 2011 pasal 42 pengadilah tidak memperhatikan dengan jelas uu yang mengatur tentang pendaftaran tanah serta dengan hal ini konsumen berhak memperoleh ganti rugi sebagaimana uu no 8 tahun 1999 pasal 7 mengatur kewajiabn pelaku usaha.

Abstract

The cosmetics and personal care industry has emerged as one of the most prominent and fastest-growing markets, especially among millennials worldwide. The halal cosmetics industry is also important to today's young generation. They and social media technology have become an important part of consumer research. This study explores the factors determining the millennial generation's choice of halal cosmetics. This study used the exploratory factor analysis (EFA) method with 202 millennial respondents from Indonesia and Malaysia. The Kaiser-Meyer-Olkin (KMO) test result is 0.723%, indicating a middling sampling. The Bartlett test result shows a value of 1848,828 with a significance level of 0.0000 < 0.05, indicating a correlation between the variables. There are no statements with a score of less than 0.5 after the communalities checking. As a result, every statement can be used more thoroughly in this research. Based on the results, six main factors can increase the millennial generation's interest in making choices about halal cosmetics: social media campaign, influencer trustworthiness, halal awareness, brand curiosity in social media, cosmetics advertisement language, and brand trust and product quality.

Abstract

The binding of credit collateral with mortgage rights can be bound by several creditors with more than one mortgage. If the debtor is in default, only the creditor holding the first rank of mortgage rights can submit the auction, as stated in Law Number 4 of 1996 concerning Mortgage Rights. At the time of the debtor's default, the binding of the first-ranked mortgage has been released by the creditor of the first mortgage holder, the second mortgage holder applies for a mortgage auction and is rejected based on the law. The purpose of this research is to find regulations that provide justice to creditors of second lien holders. Implementation based on the principle of justice to the position of the creditor of the second lien holder in the application for submission of the auction. The research method used in this research uses a normative juridical approach, descriptive analysis and prescriptive analysis specifications with secondary and primary data types, data collection through interviews and qualitative juridical analysis methods, comparative heurmeneutic data that interpret and understand the intent of the regulatory text. The results of this study, as well as updates to previous research, the application of the Mortgage Rights regulation has not been based on the principle of justice, based on the value of justice, it should be that if the debtor is in default, the holder of the mortgage right has the right to sell the object of the mortgage right on its own power through a public auction with the first mortgage right holder having the first right to take repayment of its debt from the proceeds of the sale.

Abstract

This study discusses how the implementation of the inheritance rights of children born outside of marriage according to Islamic law in the application of the inheritance law system in Indonesia. In Islamic law, children born from a legitimate relationship have clear rights to their parents' inheritance. However, for children born outside of marriage, the situation becomes more complex. In many communities, social stigma and negative views of children born outside of marriage often affect their acceptance of inheritance rights. This can lead to injustice and discrimination, where these children do not get the rights they should receive according to Islamic law. The research method with a qualitative research type, this study uses library research, namely research that focuses and limits its activities to libraries to obtain data without conducting research in the field. Data collection techniques by conducting review studies of books, literature, notes, and reports that are related to the problem to be solved. Data sources in this study were obtained by tracing literature and laws and regulations, books, the Qur'an, and hadiths related to the research. Data collection techniques are carried out using documentary techniques. Documentary comes from the word document which means written object. In using the documentary method, the author collects written data such as books, scientific journals and so on. The results and discussion that in Islamic law, illegitimate children have limited inheritance rights, namely only the right to inherit from the mother and her family, without inheritance rights from the father. This is based on the view that illegitimate children do not have a legal bond with their father, but it is important to align the principles of Islamic law and positive law in regulating the inheritance rights of illegitimate children in order to realize justice and legal certainty for all parties. This harmonization effort will not only protect illegitimate children, but also strengthen the national inheritance law system as a whole

Abstract

Land registration is carried out to regulate the legal relationship between the landowner and the land itself. Land registration has the aim of creating legal certainty. Landowners do land registration has a strong evidentiary tool that is in the form of a certificate of land rights. The intention of proving a strong land certificate is that the land certificate can still be cancelled, with the possibility of land certificates being cancelled; then, the cancellation harms the holder of land rights. In addition, people who have controlled the land for more than 20 years must be evicted due to losing the lawsuit for ownership rights. Hence, people who have utilized and maintained the land get losses because they cannot control the land anymore. The research method used is normative juridical with a statutory and conceptual approach. The result of this research is the Concept of Protection of Certificate Holders of land rights in realizing legal certainty is done by applying the Social Tenure Domain Model, acquisitive perjuring someone to get land with acquisitive verjaring for 20 years of controlling the land in good faith, rechtverwerking due to 20 years of not using and utilizing the land will be deprived of land rights. So, a person who has obtained a certificate of land rights is protected because the state guarantees it.

Abstract

Abstract. This study analyses the role of the Financial Services Authority (OJK) in the health supervision of Bank Muamalat during 2013-2023 and evaluates the implementation of the regulations applied. OJK functions as an independent institution that maintains the stability of the national financial system, especially in the supervision of Indonesia's first Islamic bank, Bank Muamalat. The health of Bank Muamalat is an important indicator to assess the effectiveness of OJK supervision, especially amid economic challenges and the impact of the COVID-19 pandemic.The method used is normative juridical with a descriptive-analytical approach, as well as qualitative data analysis. Primary data includes Bank Muamalat's annual report, OJK regulations, and Islamic banking legal literature. The results showed that OJK plays a strategic role through risk-based supervision and regulations such as POJK Number 10/SEOJK.03/2014, which provides a comprehensive assessment framework.During the period, Bank Muamalat experienced fluctuations in the Risk Profile aspect, with the Non-Performing Financing (NPF) ratio decreasing significantly to 2.70% in 2023. Corporate governance showed improvement, although profitability still needs to be improved. In conclusion, OJK regulations contribute to the stability of Bank Muamalat, but there is still room for improvement in operational efficiency. Abstrak. Penelitian ini menganalisis peran Otoritas Jasa Keuangan (OJK) dalam pengawasan kesehatan Bank Muamalat selama 2013-2023 dan mengevaluasi implementasi regulasi yang diterapkan. OJK berfungsi sebagai lembaga independen yang menjaga stabilitas sistem keuangan nasional, terutama dalam pengawasan bank syariah pertama di Indonesia, Bank Muamalat. Kesehatan Bank Muamalat menjadi indikator penting untuk menilai efektivitas pengawasan OJK, terutama di tengah tantangan ekonomi dan dampak pandemi COVID-19. Metode yang digunakan adalah yuridis normatif dengan pendekatan deskriptif-analitis, serta analisis data kualitatif. Data primer meliputi laporan tahunan Bank Muamalat, peraturan OJK, dan literatur hukum perbankan syariah. Hasil penelitian menunjukkan OJK berperan strategis melalui pengawasan berbasis risiko dan regulasi seperti POJK Nomor 10/SEOJK.03/2014, yang memberikan kerangka penilaian komprehensif. Selama periode tersebut, Bank Muamalat mengalami fluktuasi dalam aspek Risk Profile, dengan rasio Non-Performing Financing (NPF) menurun signifikan hingga 2,70% pada 2023. Tata kelola perusahaan menunjukkan perbaikan, meskipun profitabilitas masih perlu ditingkatkan. Kesimpulannya, regulasi OJK berkontribusi pada stabilitas Bank Muamalat, namun masih ada ruang untuk perbaikan dalam efisiensi operasional. .

Abstract

This research examines the role, function, and duties of the Dewan Kehormatan Pusat (DKP) in enforcing notary ethics and imposing sanctions on violators. Notaries, as public officials, are responsible for creating authentic legal documents, which requires adherence to a strict code of ethics to maintain their professionalism and public trust. The study uses a juridical-normative approach to analyze the processes DKP follows in investigating ethical violations, from the initial report to the final decision, and the types of sanctions it imposes, ranging from warnings to the revocation of notary membership. Findings highlight the critical role DKP plays in safeguarding the integrity of the notary profession, ensuring accountability, and promoting continuous professional development through education and guidance. The research concludes by recommending improvements in DKP's operational procedures, reporting systems, and collaboration with other legal bodies to further enhance its effectiveness.
