Abstract

This research discusses the meaning and legal consequences of an illegitimate child whom his biological father recognizes with a letter of decision from the District Court but who receives an inheritance share that he should not receive following vide. 285 of the Civil Code written in the Inheritance deed and the Deed of Division and Separation of Inheritance Assets made by a Notary. The heirs only consist of 2 (two) people, namely the husband and an illegitimate child. There is no marriage agreement between husband and wife and a will. The research method used is normative juridical, using primary legal materials in the form of statutory regulations, including the Civil Code, Marriage Law No. 1 of 1974, KHI, and Customary Law. Secondary legal material was obtained from several articles that had been written by previous researchers with other problems related to illegitimate children. The results obtained are that the illegitimate child only gets ΒΌ share of all the assets left behind by his biological mother. The remainder is controlled by the stepfather or second husband of the illegitimate child's biological mother, who should have received 1/3 of the share if he were a legitimate child or included in the group. Abstract

Determination Project National Strategic Area in the Pantai Indah Kapuk-2 (PIK-2) area, Tangerang Regency, has caused polemic Because suspicion spatial planning violations and lack of analysis impact environment as well as social for public around. Research This aim analyze policy determination of PIK-2 as Project National Strategic and enforcement justice in implementation regulations the method law normative used with reviewing secondary data in the form of regulation legislation and documents related. Findings main show that determination of PIK-2 not in accordance with Constitution Number 26 of 2007 concerning Spatial Planning and Banten Regional Regulation Number 1 of 2023. Regulatory process done without notice spatial planning regulations and impacts environment in a way comprehensive and minimal involvement community. Impact identified concrete covering damage environment coast and loss access public to land productive. Research propose giving sanctions in the form of enforcement law strict to the issuing official regulations No in accordance rules to avoid violations in the future. The implication is that enforcement more laws strong and evaluation repeat PIK-2 Project National Strategic policy is important done with involving community and stakeholders interests so that development walk sustainable, fair, and maintain sustainability environment as well as social.

Abstract

The implementation of agricultural reform comprises the enactment of access and asset reform. In order to ensure compliance with the aforementioned instructions, the Indonesian government issued Presidential Regulation Number 86 of 2018, which stipulates the commencement of agricultural reform as a means to support asset and access reform. The primary goal of access arrangements is to enhance access to finance and various forms of support to enhance welfare outcomes through land utilization. This particular methodology is frequently denoted as community empowerment. The normative juridical research technique, commonly known as library law research, perceives law as a normative system that possesses autonomy, independence, and distinctiveness from society. The methodology necessitates the utilization of a conceptual framework that incorporates a social tenure domain model and a legal perspective. The research findings indicate that the central concept of agrarian reform for justice entails implementing a comprehensive land administration system encompassing diverse land claims and rights through the utilization of the Social Tenure Domain Model (STDM) approach. The concept of the social method pertains to a theoretical framework that centers on the impact of social influences on human behavior. The notion of the STDM explores the interconnection between individuals and land.

Abstract

The complexities of land concerns are a real issue that has yet to be handled. The fact that the amount of land available is fixed, while the desire for physical development grows in tandem with population growth, results in social conflicts that cannot be avoided. The battle of interest between the government, which requires land to build various infrastructures, and the people who wish to keep their rights to the property they own is one of the reasons for social conflict. As a result, it is required to reform land laws that direct the mechanism of integrated state land asset management that can simultaneously accommodate the needs of the government and the rights of community holders of land rights to achieve social justice for all Indonesians. Using the land bank concept as a way of integrated state land asset management may solve the development land dilemma. This study employs a normative legal approach and a descriptive qualitative analysis. In this study, it was revealed that the government's strategy on land purchase through the Land Acquisition Law could have been more effective in resolving land issues; hence, one land component was incorporated through the Job Creation Law via the Land Bank

Abstract

The cosmetics and personal care industry has emerged as one of the most prominent and fastest-growing markets, especially among millennials worldwide. The halal cosmetics industry is also important to today's young generation. They and social media technology have become an important part of consumer research. This study explores the factors determining the millennial generation's choice of halal cosmetics. This study used the exploratory factor analysis (EFA) method with 202 millennial respondents from Indonesia and Malaysia. The Kaiser-Meyer-Olkin (KMO) test result is 0.723%, indicating a middling sampling. The Bartlett test result shows a value of 1848,828 with a significance level of 0.0000 < 0.05, indicating a correlation between the variables. There are no statements with a score of less than 0.5 after the communalities checking. As a result, every statement can be used more thoroughly in this research. Based on the results, six main factors can increase the millennial generation's interest in making choices about halal cosmetics: social media campaign, influencer trustworthiness, halal awareness, brand curiosity in social media, cosmetics advertisement language, and brand trust and product quality.

Abstract

This study discusses how the implementation of the inheritance rights of children born outside of marriage according to Islamic law in the application of the inheritance law system in Indonesia. In Islamic law, children born from a legitimate relationship have clear rights to their parents' inheritance. However, for children born outside of marriage, the situation becomes more complex. In many communities, social stigma and negative views of children born outside of marriage often affect their acceptance of inheritance rights. This can lead to injustice and discrimination, where these children do not get the rights they should receive according to Islamic law. The research method with a qualitative research type, this study uses library research, namely research that focuses and limits its activities to libraries to obtain data without conducting research in the field. Data collection techniques by conducting review studies of books, literature, notes, and reports that are related to the problem to be solved. Data sources in this study were obtained by tracing literature and laws and regulations, books, the Qur'an, and hadiths related to the research. Data collection techniques are carried out using documentary techniques. Documentary comes from the word document which means written object. In using the documentary method, the author collects written data such as books, scientific journals and so on. The results and discussion that in Islamic law, illegitimate children have limited inheritance rights, namely only the right to inherit from the mother and her family, without inheritance rights from the father. This is based on the view that illegitimate children do not have a legal bond with their father, but it is important to align the principles of Islamic law and positive law in regulating the inheritance rights of illegitimate children in order to realize justice and legal certainty for all parties. This harmonization effort will not only protect illegitimate children, but also strengthen the national inheritance law system as a whole
