Abstract

Indonesia is developing a Special Economic Zone (SEZ) in the tourism sector with Singhasari being the only SEZ that emphasizes cultural and historical heritage tourism. However, until the end of November 2022, Singhasari SEZ has not demonstrated significant success. This article explores the reason behind the Singhasari SEZ’s relative lack of success compared to other SEZs, based on the results of research conducted in November 2022. It examines the institutional governance of the Singhasari SEZ since its inception and analyzes the obstacles encountered, utilizing the theory of the three main pillars of SEZ success. The research employed a qualitative approach utilizing a case study method. Data collection was conducted through observation, interviews, and literature study. The findings reveal that the Singhasari SEZ is managed according to existing regulations with Intelegensia Grahatama, Ltd. as a Development and Management Business Entity of the Singhasari SEZ. A significant obstacle identified from a strategic perspective was the initial decision to focus on a historic location for tourism, a choice that lost its relevance during the COVID-19 pandemic. However, the efforts to transition the Singhasari SEZ’s focus from tourism to digital education demonstrate its strategic dynamism. In terms of strategic implementation, the Singhasari SEZ requires assistance from the Central Government regarding infrastructure development to achieve its objectives. The theoretical implication of this research is that it adds community actors to SEZ institutions. The allocation of special funds for infrastructure development in each approved SEZ as well as the increase of involvement of private and community actors in various SEZ activities are the policy implications of this research.

Abstract

This article discusses the harmonization of law in facing the future challenges of notaries in Indonesia in the Cyber Notary era. With the development of technology, traditional notary practices have undergone a significant transformation towards digitalization, creating a need to review the existing legal framework. This article focuses on two main problem formulations. First, the analysis of the suitability of laws and regulations with the needs of Cyber Notary practices in Indonesia. This evaluation includes whether existing regulations, such as the Notary Law, the Regulation of the Minister of Law and Human Rights, and the Law on Information and Electronic Transactions are sufficient to support electronic notaries and how legal harmonization can improve the certainty and effectiveness of notary services. Second, the interpretation and adaptation of existing legal principles to address legal and ethical challenges in the Cyber Notary era. This article examines aspects of document validity, personal data protection, and notary responsibilities in the context of digitalization. The main objective is to identify emerging legal challenges and provide recommendations for legal harmonization that can ensure integrity and trust in the notary profession in the digital era.

Abstract

The transfer of land and/or building rights through a sale and purchase agreement, as stipulated in the Circular Letter of the Supreme Court Number 4 of 2016, is valid without necessitating a deed of sale and purchase, in accordance with Article 1338 of the Civil Code, while the deed constitutes an authentic deed per Article 1868 of the Civil Code. Nonetheless, it does not ensure that the conveyance of land rights to another individual may be substantiated unless the transfer is executed in accordance with Article 1459 of the Civil Code; a PPJB prior to an AJB is permissible provided that the required requirements in the regulation are satisfied. The legal protection acquired by the parties in the transfer of land and/or building rights through PPJB is preventive in nature. This is achieved by including specific clauses in the PPJB that ensure legal protection for the parties involved, thereby facilitating realization and safeguarding their interests. Repressive legal protection for the parties can be addressed by alternatives to judicial and court institutions

Abstract

Perceraian merupakan pilihan terakhir untuk menentukan jalannya rumah tangga setiap pasangan. Dampak dari perceraian tidak selama membawa dampak negatif, tergantung dari alasan bercerai pada pasangan. Terutama dampak tersebut dapat menimbulkan anak menjadi terluka secara psikologis. Lalu timbul masalah mengenai hak asuh anak, dari hak asuh anak itulah sering terjadi perbeutan anak sehingga mengambil paksa anak di bawah kekuasaan orang tua yang tidak mendapatkan hak asuh. Tujuan penelitian ini adalah mengkaji bagaimana perlindungan hukum bagi anak yang diambil secara paksa oleh orang tua yang tidak mendapatkan hak asuh anak. Untuk menemukan jawaban atas permasalahan dalam penelitian ini, peneliti menggunakan teori-teori hukum tertentu yang digunakan sebagai landasan untuk menganalisanya. Teori tersebut meliputi ; Teori Perlindungan Hukum dan Teori Keadilan. Metode pendekatan yang digunakan ialah bersifat yuridis normatif. Penelitian ini menggunakan 2 macam pendekatan yakni Pendekatan Perundang-undangan (Statute Approach ) dan Pendekatan Konseptual (Conceptual Approach). Hak asuh anak diatur dalam Pasal 105 Kompilasi Hukum Islam yang menyatakan bahwa anak di bawah umur 12 tahun diasuh oleh ibunya, sedangkan anak di atas umur 12 tahun berhak memilih pemegang hak asuhnya di antara ayah atau ibunya. Biaya pemeliharaan ditanggung oleh ayahnya. Jika ayah tidak dapat memenuhi kewajiban tersebut, maka ibu dapat ikut andil dalam biaya tanggungan anaknya. Orang tua yang tidak mendapatkan hak asuh masih berhak bertemu dengan anaknya, namun tidak bisa membawanya tanpa ijin orang tua yang mendapatkan hak asuh anak walau hanya untuk sekedar pergi untuk mengunjungi suatu tempat. Mengenai bisa atau tidak membawa anak tanpa izin dari pemegang kuasa anak, terdapat ketentuan dalam Pasal 330 Kitab Undang-Undang Pidana (KUHP).

Abstract

Notaris mempunyai peranan yang sangat penting dalam dunia perbankan, terutama hal yang berkaitan dengan pemberian kredit. Pemberian kredit yang disalurkan oleh perbankan mempunyai berbagai macam jenis. Yakni kredit konsumtif dan Produktif. Kredit konsumtif merupakan jenis kredit yang diperuntukkan bagi masyarakat yang tujuan nya adalah bersifat konsumtif seperti, Kredit Pemilikan Rumah (KPR), Kredit Multi Guna, Kredit Renovasi Rumah. Sedangkan, kredit produktif adalah jenis kredit yang ditujukan kepada masyarakat luas untuk digunakan sebagai menambah modal usaha, memperkuat pondasi jenis usaha atau menambah jenis usaha yang sedang dijalankan. Dari dua hal tersebut twntu mempunyai fungsi dan tujuan yang berbeda beda. Akan tetapi apapun jenis kredit yang disalurkan, perbankan membutuhkan peran seorang Notaris dalam menjalankan bisnis nya. Notaris mempuyai tertori untuk membuat suatu akta perjanjian kredit sepanjang pihak kreditur dalam hal ini perbankan meminta kepada notaris untuk membuat akta perjanjian kredit secara notariil. Selain itu, dalam hal contoh  perjanjian kredit pemilikan rumah yang memiliki agunan berupa  sertifikat tanah, disinilah peran dan tugas notarisuntuk membuat perjanjian assesoir dimana perjanjian tersebut harus dibuat dengan akta otentik. Peran notaris dalam perjanjian kredit ini juga sangat penting karena notaris dapat dinyatakan sebagai pihak yang dapat menjamin kepastian hukum bagi para pihak dimana akta tersebut memiliki kekuatan eksekutorial apabila ada pihak yang melakukan cidera janji.

Abstract

In the Indonesian legal system, cession is a transfer of rights to receivables or obligations made by a creditor to another party without the consent of the debtor. In practice, cession often involves collateral objects in the form of Mortgage Rights, such as Right to Cultivate Certificates (HGB). However, legal issues arise when the collateral object, namely HGB, has expired. In this case, the recipient of the cession needs to understand the legal consequences that arise in connection with the cession deed involving HGB whose validity period has expired. The purpose of this study is to analyze and explain the legal consequences for the recipient of the cession against the cession deed that includes collateral objects in the form of HGB whose validity period has expired. This study uses a normative legal research method. The results of the study on the legal consequences for the recipient of the cession against the cession deed with the collateral object of the building use rights certificate whose term has expired is that the deed is still considered valid and the new creditor still obtains the right to collect it, but the building use rights cannot be used as collateral by the new creditor and the collateral object cannot be registered with the land office because the term of the building use rights has expired and the legal efforts that can be taken by the recipient of the cession against the cession deed with the collateral object of the Right to Cultivate Certificate Mortgage whose term has expired are to negotiate with the old creditor regarding the cession deed by requesting accountability from the old creditor to renew or extend the term of the building use rights whose term has expired.

Abstract

This research investigates the phenomenon of political participation among the tribal community of the Baduy Tribe within the context of general elections (Pemilu) in Lebak Regency, Banten, Indonesia. An in-depth understanding of the political dynamics of the Baduy Tribe is urgently needed to ensure their democratic rights and promote greater involvement in the national political process. This study identifies structural and cultural barriers hindering Baduy's political engagement and proposes practical strategies to overcome these obstacles. The findings are expected to provide valuable insights for policymakers and stakeholders in efforts to strengthen the political representation of the Baduy Tribe. This research employs an empirical approach combining legal and political analysis. Data collection techniques involve in-depth interviews with members of the Baduy tribal community and traditional leaders (pu’un), participatory observation, and analysis of policy-related documents and regulations. The research findings indicate that dynamics between traditional customs, local economy, and national politics influence the political participation of the Baduy community. Despite their high commitment to the democratic process, they face constraints such as administrative requirements and incongruence between customary and formal rules. In conclusion, recognizing their local identity, protecting political rights, and meeting the needs of public services are the primary focus of enhancing inclusive political participation for the Baduy community.

Abstract

Abstract: In this case, the social function of the notary is very important to provide authentic deeds for the community. A person in a respectable position who is able to carry out the requirements of an authentic deed is needed by the community, which guarantees legal certainty and builds trust in the production of written evidence. In addition to being responsible for themselves, this individual is also responsible for society. A notary must be moral in order to be able to carry out his responsibilities, investigating and reporting transactions made by service users to PPATK, the authorized organization. Notaries are not harmed by their role as Whistleblowers in Government Regulation Number 43 of 2015 in accordance with the mandate of Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering Crimes. Regulation Number 9 of 2017 concerning the Application of the Principle of Recognizing Notary Service Users in order to help eradicate money laundering crimes.

Abstract

Pergantian Antar Waktu (PAW) anggota DPR merupakan mekanisme konstitusional untuk menggantikan anggota legislatif yang berhenti sebelum masa jabatannya berakhir, dengan calon dari Daftar Calon Tetap (DCT) dari partai politik dan daerah pemilihan yang sama. Namun, dalam praktiknya, PAW kerap disalahgunakan sebagai instrumen politik untuk menyingkirkan anggota dewan yang dianggap tidak sejalan dengan kepentingan partai pengusung. Kondisi ini menciptakan ketergantungan posisi anggota legislatif terhadap kehendak partai, sehingga mengancam independensi dan integritas wakil rakyat. Bahkan, tidak jarang muncul indikasi penyalahgunaan kewenangan internal partai yang mengarah pada praktik jual beli jabatan. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan mengandalkan data primer dan sekunder dari literatur hukum yang relevan. Penanganan sengketa PAW dapat dilakukan melalui dua jalur peradilan, yaitu Pengadilan Tata Usaha Negara (PTUN) apabila menyangkut keputusan administratif, dan Pengadilan Umum jika menyangkut aspek perdata atau pidana. Temuan ini menunjukkan pentingnya penguatan regulasi dan pengawasan terhadap proses PAW agar tetap berada dalam koridor hukum yang adil dan tidak diselewengkan untuk kepentingan politik praktis

Abstract

Surat ijo awalnya hanya dibangun untuk karyawan pemerintah kota surabaya saja. Karena lahan-lahan surat ijo banyaknya dari tanah peninggalan pada masa penjajahan hindia belanda. Kepemilikan yang tidak jelas disuatu tanah yang terindikasi surat ijo maka akan diambil oleh pemerintah kota surabaya. Pemerintah kota surabaya melalu dinas pertanahan akan menyatakan bahwa tanah itu sebagai tanah hpl (hak pengelolaan lahan). Tanah maupun lahan yang berstatus hpl membuat ini sangat unik untuk dibahas, karena di dalam undang-undang pokok agraria (uupa) tidak mengenal tanah yang berstatus hpl maupun sertifikat ijo. Undang-undang pokok agraria (uupa) hanya mengenal adanya surat hak milik, hak guna bangunan, hak guna usaha. Disini akan lebih dibahas dari kacamata tata usaha negara, dan menjawab mengapa surat ijo hanya ada di kota surabaya saja.
