Abstract

Under Indonesia’s Anti-Corruption Law, asset confiscation is treated as a civil and in personam matter, further impeded by parliamentary opposition to the Asset Forfeiture Bill. This article examines deficiencies in Indonesia’s asset recovery framework through a comparative legal analysis with Islamic jurisprudence. Employing a critical–comparative approach, the study conducts a normative analysis of Law No. 20 of 2001 on Corruption Eradication, Law No. 8 of 2010 on Money Laundering, the Draft Asset Forfeiture Bill, and Law No. 1 of 2023 (the new Criminal Code), alongside Islamic legal sources. Anchored in the Islamic principle of radd al-maẓālim (the restitution of unjustly acquired wealth), the findings reveal that corruption encompasses both criminal and civil aspects. The study contends that the adoption of a non-conviction-based forfeiture mechanism—underpinned by a calibrated reverse burden of proof and robust judicial safeguards—could substantially improve Indonesia’s capacity for asset recovery. In practical terms, this research highlights the imperative of enacting comprehensive asset confiscation legislation as a fundamental component of Indonesia’s anti-corruption reforms.

Abstract

Sektor pertanian merupakan pondasi dalam menjaga ketahanan pangan dan Pembangunan ekonomi di Indonesia. Maka untuk menjaga ketahanan pangan dengan upaya meningkatkan produktivitas pertanian berkelanjutan. Pupuk merupakan komponen penting dalam upaya peningkatan produktivitas pertanian. Peredaran pupuk tidak terdaftar di masyarakat sangat berdampak terhadap penurunan produktifitas pertanian. Sehingga dari sudut pandang hukum, pemalsuan atau pengoplosan pupuk merupakan tindak pidana yang sangat merugikan masyarakat dan negara serta menimbulkan dampak negatif kerusakan lahan pertanian. Kasus pupuk tidak terdaftar terjadi di beberapa wilayah di Jawa Tengah. Penegakan hukum peredaran pupuk tidak terdaftar berdasarkan Pasal 73 dan Pasal 122 Undang-Undang Nomor 22 Tahun 2019 tentang Sistem Budi Daya Pertanian Berkelanjutan. Ketentuan Undang-Undang tersebut juga mengamanatkan kewenangan Penyidik Pegawai Negeri Sipil (PPNS) untuk membantu penyidik Polri sehingga upaya penegakan hukum tindak pidana peredaran pupuk tidak terdaftar berjalan efektif. Penelitian ini bertujuan untuk mengetahui efektivitas penegakan hukum tindak pidana peredaran pupuk tidak terdaftar di wilayah hukum Polda Jawa Tengah. Penelitian ini menggunakan metode pendekatan yuridis empiris dengan analisis kualitatif. Diperoleh hasil penelitian bahwa: pertama, efektivitas penegakan hukum tindak pidana peredaran pupuk tidak terdaftar di wilayah hukum Polda Jawa Tengah belum efektif, karena masih adanya korban, belum adanya Penyidik Pegawai Negeri Sipil (PPNS) di wilayah Jawa Tengah atau SDM khusus, belum memiliki sarana prasana lengkap untuk pengujian sampel pupuk di wilayah Jawa Tengah, belum adanya sarana prasarana IT, dan belum efektifnya pengawasan pupuk Komisi Pengawasan Pupuk dan Pestisida (KP3) Kabupaten/Kota di Provinsi Jawa Tengah. Kedua, kendala dalam Penegakan Hukum Tindak Pidana Peredaran Pupuk Tidak Terdaftar di Wilayah Hukum Polda Jawa Tengah dapat dilihat dari faktor struktur hukum (legal structure) yakni belum adanya PPNS di Kabupaten/Kota, dan kultur hukum (legal culture) yakni masih rendahnya kesadaran hukum masyarakat sehingga mudah menjadi korban peredaran pupuk tidak terdaftar di wilayah Polda Jawa Tengah.

Abstract

Hal ini penting untuk memahami bahwa notaris memiliki peran yang krusial dalam sistem hukum pidana. Mereka bertanggung jawab dalam membuat dan memvalidasi dokumen-dokumen hukum yang terkait dengan transaksi pidana, seperti akta perjanjian atau akta jual beli. Namun, dalam menjalankan tugasnya, notaris juga bisa terlibat dalam kasus-kasus pidana. Misalnya, jika notaris terlibat dalam pemalsuan dokumen atau pelanggaran hukum lainnya yang terkait dengan jabatannya. Dalam situasi seperti itu, notaris bisa menjadi tersangka dalam kasus pidana. Tujuan penelitian ini untuk mengetahui pemeriksaan terhadap Notaris yang diduga melakukan tindak pidana dalam tahap penyidikan sesuai dengan UUJN dan Ketentuan yang mengatur perlindungan hukum Notaris yang diduga melakukan tindak pidana yang sekarang berlaku, sudah cukup mengatur tentang perlindungan hukum Notaris. Jenis penelitian ini menggunakan jenis penelitian dengan metode pendekatan yuridis sosiologis (socio-legal approach). Proses pemeriksaan terhadap Notaris yang diduga melakukan tindak pidana dalam tahap penyidikan belum sesuai dengan Undang-Undang Jabatan Notaris, karena dalam proses pemeriksaan maupun pemanggilan Notaris tidak terdapat persetujuan dari Majelis Kehormatan Notaris sesuai dengan Pasal 66 ayat (1) Undang-Undang Jabatan Notaris. Ketentuan yang mengatur perlindungan hukum bagi Notaris yang diduga melakukan tindak pidana selama ini masih dirasa kurang, karena dalam penerapannya belum terdapat harmonisasi antara peraturan satu dengan peraturan lainnya, terlebih dalam perlindungan hukum bagi Notaris yang diduga melakukan tindak pidana belum diatur secara rigid oleh peraturan perundang-undangan.

Abstract

Violence in the investigation of the suspects are still frequently performed by the investigator. This study aimed to explore the roots of violence committed by the investigator, the legal basis of the work of investigators and legal protections for suspects, and the use of a scientific investigation in the investigation. This research is a qualitative approach is normative and legal study of the law in action, is a social science that studies non-doctrinal and empirical. The results show several things. First, the investigation of violent behavior against the suspect can be found from the history of the police force who works relating to the police. Second, the investigator and the suspect had an investigation on the basis of legitimacy of national legislation and international. Third, does the rule breaking is possible in the investigation to face the deadlock in the investigation due to the behavior of suspects who do not want to give his testimony by using hypnotic techniques. Abstract

Penerapan asas dominus litis merupakan hal baru di Indonesia. Hal tersebut dikarenakan penarikan tuntutan oleh Jaksa Penuntut Umum tersebut tidak diatur dalam peraturan di Indonesia. Penelitian ini membahas mengenai dasar penarikan surat tuntutan oleh Jaksa Penuntut Umum dalam kasus tindak pidana kekerasan dalam rumah tangga yang dilakukan oleh Valencya dan penerapan asas dominus litis dalam penarikan surat tuntutan oleh Jaksa Penuntut Umum dalam kasus Tindak Pidana Kekerasan dalam Rumah Tangga yang dilakukan oleh Valencya. Penelitian ini menggunakan metode pendekatan yuridis normatif dan pendekatan kasus (case approach), spesifikasi penelitian preskriptif analisis. Sumber data yang digunakan data primer dan data sekunder, data yang terkumpul disajikan dengan uraian yang sistematis dengan metode analisis kualitatif. Hasil penelitian menunjukkan bahwa peraturan perundangan di Indonesia mengenai penarikan surat tuntutan tidak diatur dalam peraturan perundang-undangan. Namun hal tersebut dapat dilakukan oleh Jaksa Agung selaku Penuntut Umum tertinggi yang mengendalikan perkara penuntutan di Indonesia. Jaksa Agung memiliki dasar hukum yaitu Pasal 35 huruf c Undang-Undang Nomor 11 Tahun 2021 Tentang Kejaksaan Republik Indonesia untuk menerapkan asas oportunitas dalam suatu perkara serta penerapan hukum progresif.

Abstract

Handling Civil-Military Jurisdiction Cases (In Indonesian, it is called Perkara Koneksitas) is the resolution of participation offenses (deelneming) carried out jointly by those who are subject to the general court judiciary and the military justice judiciary. The handling of these cases is carried out by two judicial subsystems, namely general justice and military justice, which jointly resolve connection cases. However, the current law does not clearly regulate the handling of Civil-Military Jurisdiction Cases, so law enforcement officials deviate from the provisions for handling. This article examines the Responsive law enforcement in handling civil-military jurisdiction cases with the conclusion that handling Civil-Military Jurisdiction Cases is part of general justice and military justice. Since there are two courts competent to enforce the law in the handling of such cases, under the provisions of Articles 89 to 94 of the Code of Criminal Procedure, the handling of such cases is carried out jointly by the subsystem in general justice and the subsystem in military justice. Investigations by the Police, Prosecutors and Military Poms/Oditors, Prosecution by Prosecutors and Oditurs, Trial by Judges from the General Court and Military Justice in a balanced manner. Because the two courts have very different case handling cultures, and until now there are no clear rules governing the technique of handling cases in connection, where there are two procedural laws that apply.

Abstract

 ABSTRACTCorruption in Indonesia is an extraordinary crime with systemic impacts on governance and public welfare. This normative legal study analyzes the differences in focus and legislative frameworks of anti-corruption policy across the administrations of Presidents Joko Widodo and Prabowo Subianto. Under President Joko Widodo, anti-corruption efforts faced significant setbacks. The 2019 revision of Law No. 19 on the KPK was widely criticized for weakening the institution's independence. Further legislation, including the Omnibus Law on Job Creation and the 2023 Criminal Code (KUHP), introduced new corruption risks and created legal disharmony. These developments contributed to a decline in Indonesia's Corruption Perceptions Index (CPI), marking the Jokowi era with institutional weakening and controversial reforms. In contrast, the Prabowo Subianto administration presents an evolving orientation. Early policy narratives prioritize asset recovery through restorative justice and strengthening the roles of the Attorney General’s Office and the Police. However, concrete legislative reforms remain limited. While this approach suggests a potential for stronger deterrence, it also raises concerns that political compromise could lead to implicit decriminalization. Overall, Indonesia’s anti-corruption legal politics reflect a complex dynamic shaped by fluctuating political will and competing interests. The Jokowi era was defined by institutional erosion, while the Prabowo era confronts the dilemma of balancing asset recovery, institutional strengthening, and political stability. The study concludes that the effectiveness of future anti-corruption efforts will depend on consistent political will to establish strong, transparent, and public-oriented regulations.Keyword: Corruption, Legal Politics, Criminalization and Decriminalization, Corruption Eradication Commission (KPK), Anti-Corruption LegislationABSTRAKKorupsi di Indonesia digolongkan sebagai kejahatan luar biasa yang berdampak sistemik pada tata kelola pemerintahan dan kesejahteraan publik. Studi hukum normatif ini menganalisis perbedaan fokus dan kerangka legislatif antikorupsi antara masa pemerintahan Presiden Joko Widodo dan Presiden Prabowo Subianto. Di bawah Joko Widodo, upaya antikorupsi mengalami pelemahan signifikan. Revisi UU KPK No. 19 Tahun 2019 dikritik karena melemahkan independensi institusi. Selain itu, legislasi seperti Omnibus Law Cipta Kerja dan KUHP 2023 dianggap menciptakan risiko korupsi baru dan ketidakharmonisan hukum. Perkembangan ini berkontribusi pada penurunan Indeks Persepsi Korupsi (CPI) Indonesia. Era Jokowi ditandai oleh pelemahan institusional dan reformasi yang kontroversial. Sebaliknya, administrasi Prabowo Subianto menampilkan orientasi yang berbeda. Narasi kebijakan awal menitikberatkan pada pemulihan aset melalui keadilan restoratif serta penguatan Kejaksaan Agung dan Kepolisian. Meskipun reformasi legislatif konkret masih terbatas, pendekatan ini menyiratkan potensi deterensi yang lebih kuat. Namun, hal ini juga menimbulkan kekhawatiran bahwa kompromi politik dapat mengarah pada dekriminalisasi implisit. Secara keseluruhan, politik hukum antikorupsi Indonesia mencerminkan dinamika yang kompleks, dibentuk oleh kemauan politik yang tidak stabil. Era Jokowi diwarnai erosi institusional, sementara era Prabowo menghadapi dilema untuk menyeimbangkan pemulihan aset, penguatan kelembagaan, dan stabilitas politik. Efektivitas upaya antikorupsi di masa depan sangat bergantung pada konsistensi kemauan politik untuk menciptakan regulasi yang kuat, transparan, dan berorientasi publik.Kata Kunci: Korupsi, Politik Hukum, Kriminalisasi dan Dekriminalisasi, Komisi Pemberantasan Korupsi (KPK), Legislasi Antikorupsi.

Abstract

The surge in online scam-based human trafficking cases in Cambodia affecting hundreds of Indonesian citizens calls for more efficient cross-border legal action. The urgency of this paper lies in analyzing the obstacles to coordination among prosecutors, such as differences in legal systems, complex bureaucracy, and limited access in foreign jurisdictions. Using a normative method with a case approach, this article evaluates the role of prosecutors in the Mutual Legal Assistance (MLA) mechanism to facilitate the repatriation and restitution of victims. The results show that the Attorney General's Office Bill strengthens the function of dominus litis and the executive authority of prosecutors in asset tracing and confiscation for victim compensation. In conclusion, strengthening the role of prosecutors as the central authority in MLA, supported by proactive legal diplomacy and digital technology, is crucial to overcoming structural barriers in Cambodia. Abstract

This article examines the important of applying restorative justice principles in Indonesia’s juvenile justice system. The principle of child protection emphasises processes that are free from violence on safeguarding children’s rights, welfare, development, and overall well-being, including cases involving children in criminal acts. However, the current implementations of diversion and restorative justice often remains limited in its ability to address the underlying systemic and structural issues that lead to juvenile delinquency. These limitations underscore the need for a shift toward transformative justice, which seeks not merely to resolve individual conflicts, but also to confront and remedy their underlying causes. In this context, this article adopts a conceptual approach grounded in doctrinal legal research. The analysis employs systematic and teleological of interpretation to examine the legal norms within the juvenile justice framework. This research uses a normative juridical research design, with data collected through a literature review and analysed qualitatively. The findings of the study show that transformative justice in handling children’s cases in Indonesia calls for legal reform through the expansion of the restorative justice approach under the SPPA Law. Transformative justice offers an alternative framework that move beyond a narrow focus on legal sanctions by also considering the child’s personal circumstances, including social background and family conditions. As such, this concept supports a more holistic approach to child development and provides a more comprehensive framework for handling cases involving children.
