Abstract

Micro, Small, and Medium Enterprises (MSMEs) have a strategic position as a form of business activities capable of expanding job opportunities, providing broad economic services, playing a role in the process of equitability and increasing community income, encouraging economic growth, and contributing to the realization of national stability. Despite having shown its role in the regional economy, MSMEs in Badung Regency still face various obstacles and challenges, both internal and external, which lead to a weak competitive edge compared to other business players. This research aims to analyze the problems faced by MSMEs and formulate efforts for empowerment and development of MSMEs in Badung Regency. The research results indicate that empowerment efforts to address the problems of MSMEs in Badung Regency include education and training for human resources related to access to financing, product development, and strengthening marketing networks. Development efforts for MSMEs are directed at micro enterprises with the aim of increasing their scale to small enterprises by increasing the percentage of entrepreneurs in Badung Regency.

Abstract

Development in the economic field is the main driver of development, micro-enterprises play an important role in development and economic growth, this happens not only in developing countries but also in developed countries. The formulation of the problem in this study is: 1. How is the implementation of credit restructuring for MSME debtors at Bank BRI Gianyar Unit Office?, 2. What are the legal consequences for MSME debtors if the restructuring efforts are not successful? The research method used is a type of normative legal research. The most important part of developing micro-enterprises is business loans obtained from credit obtained from a bank. In an agreement, the debtor sometimes defaults. The problem in this study is the occurrence of default on credit agreements. Default or non-fulfillment of the agreement can occur either intentionally or unintentionally. Parties who commit defaults can occur because they are indeed unable to fulfill these achievements or are also forced to carry out these achievements.

Abstract

This research examines the factors contributing to the ongoing trade of imported used clothing at Tabanan Regency’s Frog Market and evaluates the enforcement of Minister of Trade Regulation Number 40 of 2022, which prohibits the import and sale of such items. Imported used clothing poses a threat to local MSMEs and is flagged as a potential health risk due to its contact with human skin. However, the Frog Market, established in the early 2000s, remains a bustling hub for secondhand clothing, fueled by consumer demand for affordable, quality apparel. The study employs an empirical legal research method, incorporating socio-legal and legislative approaches through field observations and interviews. Findings reveal that economic necessity, unique fashion appeal, and environmental considerations drive consumers to purchase used clothing. Additionally, sellers leverage flexible, informal sales channels, including online groups, to sustain their businesses. Despite awareness of the legal restrictions, the economic reliance on thrifting poses challenges for regulation enforcement. The study concludes that for regulatory effectiveness, enhanced public awareness, law enforcement engagement, and consideration of local socio-economic realities are essential. These findings provide insights for policymakers aiming to balance legal mandates with the socio-economic impact on communities reliant on this trade.

Abstract

A nominee agreement is an agreement that has not been specifically regulated in the Civil Code, but grows and develops in the community. The agreement is included in a special agreement or often called an innominate agreement. Based on this background, this research was conducted with the aim of describing the arrangement of nominee agreements as a form of land ownership by citizens in Bali and the responsibilities of notaries in drafting agreement deeds for land tenure by foreign nationals in Bali. The research method used was normative legal research. Based on the results, it was revealed that there was no specific regulation regarding the nominee agreement which was regulated in the Civil Code. As long as the parties are able to carry out the agreement properly in accordance with the provisions of the law regarding the validity of the agreement and regarding land ownership rights that have been regulated in the Civil Code and the Basic Agrarian Law, the agreement is valid before the law. Furthermore, the responsibilities and duties of a notary have been regulated in the Law on Notary Position. the ownership of land by a foreigner based on a nominee agreement is an act that is prohibited or against the law. The violation of the articles referred to in Article 84 of the Notary Position Law is a guarantee of the formal requirements for making an authentic deed. The government must supervise this anonymous agreement because this agreement is legal smuggling.

Abstract

The formation of investment activities in a country varies greatly according to the open nature of the country and its people. Therefore, cooperation is created and established between the two parties is because of the desire to seek profit so that a group of people together create a company, either with parties from one country or across countries. This is what forms a joint venture agreement. Based on this background, this research was conducted with the aim of describing how the procedure for making a joint venture agreement in the hotel business and what the legal consequences are for the default of the joint venture agreement in the hotel business. This research was conducted using a normative legal research method. The results of this study indicated that the procedure for making a joint venture agreement in a hotel business must be in the form of a limited liability company and must have conditions in providing a hotel company and are required to apply for a principle license and a permanent business license subject to the investor coordinating body to submit reports on the investor's activities. In addition, the legal consequence of the joint venture agreement default in the hospitality business is that those who violate the agreement, the parties related to the agreement, will be subject to statutory sanctions related to the rules of the joint venture agreement as well as the regulations that they have agreed upon together.

Abstract

Selebgrams are celebrities who exist on lnstagram social media accounts and become public figures on lnstagram social media. The viral figure of celebrities on Instagram is used as an opportunity for business people to endorse/promote cosmetic products through Celegram's Instagram account. However, these activities have a negative impact, namely, the products being promoted are illegal goods that do not have permission from the relevant institutions and this can cause harm to consumers. In terms of writing this research the writer discusses two legal issues, namely the legal arrangement for celebrities who endorse/promote cosmetic medicinal products and legal sanctions against celebrities who endorse/promote illegal goods in cosmetic medicinal products. This research aims to determine the regulations and legal sanctions against celebrities who promote illegal cosmetic medicinal products. This research uses the type of normative legal research, Law No. 8 of 1999, Law No. 19 of 2016, and the Civil Code as a legal basis to determine legal arrangements and legal sanctions against celebrities who endorse/promote illegal goods. The problem approach used is the approach by analyzing legislation related to the problem. The results of this study indicate that the imposition of legal sanctions on celebrities is different from business actors who are producers of these products.

Abstract

The spread and growth of the Corona Virus in Indonesia directly and indirectly affect the performance and the capacity of micro, small, as well as medium business debtors. Therefore, it may undermine bank performance and financial system stability, thereby affecting economic growth. Based on these considerations, the Financial Services Authority (Otoritas Jasa Keuangan) issued the Financial Services Authority regulation number 11 /POJK/03/2020 which regard National Economic Stimulus as a Countercyclical Policy for the impact of Corona Virus Disease 2019. The purpose of this research is to find out how the Financial Services Authority's policies are in dealing with bad credit due to Covid-19. The research method that carried out in this scientific paper is the empirical method, namely legal research based on actual conditions in the field. The results of this research are the things that have not been regulated in the credit agreement can be changed and or added by using an additional agreement or addendum. In the Financial Services Authority Implementation Regulation No. l l/POJK.03/2020, the Financial Services Authority requires every bank to formulate guidelines to designate debtor's affectively the spread of Coronavirus Disease 2019. Each bank will have different policies for handling the credit of its debtor's.

Abstract

In this era, the growth of the goods and services industry has had a positive impact. One of the positive impacts is providing sufficient quantity and higher quality demand, as well as there are a lot of alternative choices for consumers to meet their needs. On the other hand, there are also negative impacts, namely the use of technology and the impact of business behavior due to increased competition which has an impact on the consumer community. This study aims to determine whether business actors are responsible for consumer losses related to goods that are not produced in accordance with the label, and to find out what legal sanctions have been imposed on business actors for violations due to inappropriate labels and manufactured goods. This type of research is normative legal research. The results show that the responsibility of commercial actors is related to the mismatch between the label and the goods produced, namely compensation for damage, pollution, and consumption of goods or services. Then, legal sanctions can be imposed for violations of business actors, including imprisonment for a maximum of 5 (five) years or a maximum fine of Rp. 2 billion. Thus, it can be concluded that business actors can be held accountable for the incompatibility of labels with goods that have been produced, and if the violation is too detrimental to consumers, they can be prosecuted in accordance with applicable laws and regulations.

Abstract

The development of computer, telecommunication and information technology has proceeded in such a way that is now has a very big difference from 10 years ago. Trade and industrial business have given rise to new transaction models due to advantages of technological advances. In today's digital age computers, telecommunications, and information are developing very rapidly, making the use of this technology encouraging proof of screenshots to be one of the evidence used in court. This study aims to determine the legal regulation of printed evidence (screenshots) in civil court proceedings, and to determine the strength of the printed evidence (screenshots) in proving civil cases. The research method used is normative legal research with a statutory approach related to this research. The results show that the legal regulation of screenshot evidence can be seen in Law No. 19 of 2016 and Article 1866 of the Criminal Code which is usually used in civil case trials. Then, the strength of the screenshot evidence has the power of proof that is binding for the judge and the parties concerned. So, it can be concluded that screenshot evidence can be used in civil case cross-examination because it is in the same position as other evidence and can be used legally, and this screenshot evidence is binding both for judges and for other parties who wish to use it.

Abstract

Nowadayas, the increasing of economic growth requires individuals to try to make ends meet. The employment relationship between the business owner and his workers is regulated in a work agreement. In the current covid-19 pandemic, many companies are implementing part-time work to reduce company operating costs. This research examines two main problems, namely the regulation of health and safety laws for certain time workers, and legal protection of social security for certain time workers. Normative legal research is used in this research by examining problems based on the applicable legal basis in the form of statutory regulations and supported by theories from experts. The results showed that the legal basis regarding health and safety for part-time workers is regulated in Article 99 paragraph (1) of Law no. 23 of 2003 concerning Employment which regulates that every worker and his family has the right to obtain employment social security. Then, employment social security is regulated in Law no. 40 of 2004 concerning the National Social Security System (SJSN) and Law no. 24 of 2011 concerning BPJS. The implementation of social security is based on simultaneous efforts that are family and mutual in nature according to the mandate of the Pancasila and the 1945 Constitution of the Republic of Indonesia. Based on the research results, it can be concluded that in this case part-time workers do not really understand the protection of their rights as workers within a certain period of time. For this reason, this regulation on the protection of workers should be further disseminated to workers and business actors so that workers can obtain their rights in accordance with applicable regulations.
