Abstract

The practice of supernatural rituals in Indonesia continues despite advancements in science and technology, with various cases of fraud and abuse harming society, such as the cases involving shamans in Sukabumi and Yono. To address this issue, the government has regulated it under Article 252 of the 2023 Criminal Code (KUHP), which will take effect in 2026, aiming to curb harmful practices and prevent vigilante actions, although challenges in proving such offenses remain a major obstacle. This study employs a normative juridical approach, utilizing legal analysis and literature review methods related to evidentiary law in criminal offenses. Additionally, it examines the legal framework surrounding supernatural practices as a criminal act and how evidence is established under Article 252 of Law Number 1 of 2023 concerning the Criminal Code. The findings reveal that shamanic offenses were previously regulated under Articles 545 to 547 of the existing Criminal Code, but these provisions have been found inadequate in addressing harmful supernatural practices and fail to provide a deterrent effect due to lenient penalties.

Abstract

This study examines Ibn Taymiyyah’s perspective on waqf development and its application in university development in Indonesia. Using a descriptive qualitative method and content analysis approach, this research analyzes classical Islamic legal thought, contemporary waqf practices, and the implementation of waqf-based funding in several Indonesian Islamic universities. The findings show that Ibn Taymiyyah viewed waqf as a flexible and productive instrument aimed at maximizing public benefit (maṣlaḥah). He permitted the exchange, sale, or redevelopment of unproductive waqf assets when such actions generated greater social and educational benefits. This principle is highly relevant to the contemporary context of higher education financing in Indonesia, where universities increasingly require sustainable and independent funding sources. The study identifies four major forms of waqf development based on Ibn Taymiyyah’s thought: utilization of waqf proceeds, istibdal of unproductive assets, investment flexibility, and land financing. Several Indonesian universities have implemented these principles through productive waqf management, infrastructure development, scholarship programs, and educational investment schemes. This study argues that waqf can function not only as a religious instrument but also as a sustainable financial model for strengthening higher education development in Indonesia.

Abstract

In Indonesia, the death penalty remains in effect, preceded by the implementation of a ten-year suspension (moratorium), as stipulated in Article 100 of the newly enacted Criminal Code (KUHP). This moratorium serves as an opportunity for the convicted individual to demonstrate rehabilitation before the sentence is carried out. Therefore, this study aims to examine the legal norms governing the death penalty moratorium and to analyze the human rights perspectives regarding the moratorium. This research employs a normative juridical method, utilizing data collection through literature study and qualitative analysis methods. The findings indicate that the legal norms concerning the death penalty moratorium, as outlined in Article 100 of Law Number 1 of 2023, establish a waiting period for execution, during which the behavior of the convicted individual is assessed. If the individual exhibits good conduct during this period, the death sentence may be commuted. Meanwhile, the death penalty moratorium aligns with the human rights concept, as the right to life is a non-derogable right. The 2007 UN Resolution on the moratorium was supported by a majority of countries, in accordance with Article 3 of the Universal Declaration of Human Rights (UDHR) and Article 6 of the International Covenant on Civil and Political Rights (ICCPR), while also considering the local wisdom of each nation. However, under Islamic law, qishas (retributive justice) must still be applied to resolve grievances between the perpetrator and the victim or their family, thereby preventing the recurrence of similar crimes.

Abstract

Peningkatan umur harapan hidup menyebabkan jumlah lansia di Desa Slahung terus bertambah, disertai meningkatnya kasus penyakit tidak menular seperti hipertensi, diabetes, dan gangguan sendi. Namun, keterbatasan fasilitas kesehatan dan kurangnya pengetahuan masyarakat menyebabkan pemeriksaan medis rutin masih jarang dilakukan. Kegiatan pengabdian masyarakat ini bertujuan meningkatkan kesadaran dan pencegahan penyakit melalui pemeriksaan kesehatan dan edukasi bagi lansia. Kegiatan dilaksanakan melalui kolaborasi antara UNIDA Gontor, RS Yasfin, dan Pemerintah Desa Slahung. Kegiatan ini juga melibatkan mitra dari Desa Slahung, Ponorogo, dengan jumlah peserta sebanyak 90 orang. Pemeriksaan meliputi pengukuran tekanan darah, gula darah, dan indeks massa tubuh, disertai edukasi langsung oleh tenaga medis. Hasil kegiatan menunjukkan meningkatnya pemahaman lansia tentang pentingnya pola hidup sehat dan pemeriksaan berkala, serta mendorong partisipasi aktif masyarakat dalam menjaga kesehatan diri.

Abstract

Interfaith marriage involving Muslims remains a contentious issue in contemporary Islamic family law, particularly where classical jurisprudence intersects with state authority. This article examines the interpretation, codification, and regulation of classical Islamic doctrines within the legal frameworks of Indonesia, Malaysia, and Brunei Darussalam. Utilizing a comparative legal approach, the study analyzes statutory regulations, judicial precedents, and administrative policies concerning marriage with Ahl al-Kitāb. The findings reveal that, while all three nations draw on the Shāfiʿī school, their regulatory outcomes diverge due to variations in institutional design and the state's role in mediating Islamic law. Indonesia exhibits a dynamic model of legal pluralism, where administrative and judicial interpretations have historically created limited spaces for interfaith registration despite normative restrictions. Malaysia maintains a structured dual legal system characterized by jurisdictional separation and mandatory conversion requirements. Brunei Darussalam employs a highly centralized model of Islamic legal authority, resulting in an absolute prohibition without alternative recognition mechanisms. Ultimately, this study demonstrates that interfaith marriage regulation is shaped by the institutional transformation of Fiqh into enforceable state law, contributing to broader debates on legal pluralism and the "mujtahid state".
