Abstract

Seiring dengan berjalannya waktu kajian Islam semakin meningkat. Islam tidak lagi hanya menyentuh persoalan tekstual dan doktrinal, tetapi telah menjadi fenomena yang kompleks. Islam bukan sekedaf way of life Islam telah melebur sebagai sistem budaya menuju peradaban. Mengkaji dan mendekati tidak lagi hanya dari satu aspek saja, oleh karena itu diperlukan metode historis dalam mengkaji pendekatan yang berhubungan dengan masa lampau. Sejarah bahkan menjadi salah satu objek yang sangat penting dalam melakukan kajian dalam agama Islam.

Abstract

The housing complex around the campus is a laboratory for lecturers and students as the most effective embodiment of the tri dharma of higher education. This tri dharma is based on campus programs called environmental development, where the campus feels responsible for students living in villages around the campus. One pattern of bringing the campus world closer to the community is how to empower human resources around the campus. This article aims to describe the role of the State Islamic Religious College in empowering the Kampoeng Amanah Social Institution (Amanah Learning Center), a village whose mission is to make the village an English-language village. Research and service methods are carried out in a participatory manner, namely through social analysis of community potential and assisting them in realizing a language village pilot based on Islamic values. The assistance stages are through entrance, Diagnosis, Action Planning, Intervention, Evaluation and Reflection. The results of this research and service have brought about the reorganization of ALeC management based on a map of the human resource potential of Kampoeng Amanah who has a background in education, economics and religion. This assistance has also resulted in a sustainable ALeC program design and the implementation of these programs for ALeC's survival in creating a language village based on Islamic values.The housing complex around the campus is a laboratory for lecturers and students as the most effective embodiment of the tri dharma of higher education. Abstract

Divorce mediation carried out outside the court (community) and within court, institutions has yet to be effective even though the government has issued a Supreme Court Regulation regarding mediation in court. The achievement of mediation success, which is still below 5%, has encouraged the Supreme Court to add an article on good faith (article 7, Supreme Court Regulation No. 1 of 2016) as a principle of mediation and the threat of sanctions for parties who do not have good faith. This study aims to reveal how the good faith clause is implemented in resolving divorce conflicts through mediation and sanctions for parties who do not act in good faith at the Pekalongan Religious Court. The data mining method was carried out through interviews with mediators, mediator judges at the Pekalongan Religious Court area, parties to the conflict, and experts in the field of mediation. Data mining was carried out through observational and documentation of domestic conflict studies. The collected data was analyzed through descriptive analysis. This paper concludes that (1) the principles of mediation have not been fully carried out in good faith in resolving divorce conflicts through mediation outside the court, so mediation fails and results in the neglect of protracted conflict issues, (2) mediation in the majority of courts lack of success due to internal and external factors, and (3) the mediator or mediator judge experiences difficulties in implementing sanctions against parties who do not have good intentions in resolving family conflicts. This research recommends that outsied of the court mediation be carried out by professional mediators who support the success of the mediation process in the justice system.

Abstract

Jika sebelumnya aktivitas di dunia virtual merupakan salinan dari apa yang terjadi di dunia nyata, barangkali sekarang ceritanya berbeda. Di ruang keberagamaan misalnya, orang bisa menemukan dengan mudah beberapa ritual luring yang murni lahir sebagai anak dari negosiasi antara dunia maya dan nyata. Ngaji Ihya’ Virtal (NIV) dan Kopdar Ngaji Ihya’ (KNI) boleh kiranya disebut sebagai bentuk nyata dari pola barusan. Artikel ini tertarik untuk melihat lebih jauh proses pergeseran yang pecah dalam tubuh NIV hingga membuahkan KNI, kekhususan masing-masing dari mereka, dan apa saja yang memungkinkan perubahan di atas hadir di Indoensia. NIV untuk kali pertama muncul sebagai kajian rutin yang dipelopori Ulil Abshar Abdalla melalui akun Facebooknya. Karena dirasa laku dan bahkan mendapatkan banyak apresiasi, beberapa bulan selepasnya, Abdalla memutuskan untuk membentangkan sayap NIV menjadi KNI. Di level NIV, seseorang hanya bisa melihat Abdalla duduk bersila di suatu ruang dengan meja di depannya berlatar televisi sembari menjelaskan kitab Ihya’. Adapun di Kopdar ia akan menemukan nuansa yang sama sekali berbeda, baik dengan bentuk daringnya atau pun model kajian Ihya’ di pesantren, seperti soal hidangan, keakraban sampai konten ngaji. Darinya, saya merasa penting untuk menginvestigasi bagaimana pergeseran tersebut bisa muncul dan pada titik apa keduanya saling bernegosiasi dalam membentuk suatu praktik keberagamaan baru di dunia Islam, terlebih Pesantren—sebagai ibu kandung dari ngaji Ihya’. Walhasil, artikel berpendapat bahwa kemunculan itu berkelindan dengan beragamnya fitur yang dimiliki Facebook, ketokohan Abdalla, dan kecenderungan generasi Muslim baru melek teknologi yang secara tanpa sadar menuntut adanya negosiasi di muka.

Abstract

This study examines the dialectical relationship between the normativity of revelation and social reality in the Islamic legal thought of Munawir Sjadzali. Islamic law is not merely a normative-legal system derived textually from the Qur’an and Sunnah, but also an ethical framework that must be continuously interpreted in response to changing social conditions. Using a qualitative library research approach, this study critically analyzes Munawir Sjadzali’s major works to explore his epistemological framework, methodology of contextual ijtihad, and his contribution to the reactualization of Islamic law in modern Indonesia. The findings demonstrate that Munawir Sjadzali conceptualizes revelation as a source of moral objectives rather than rigid legal formulations, while social reality functions as the arena for the actualization of these objectives. His approach challenges legalistic and textualist paradigms that tend to absolutize historical formulations of fiqh without considering socio-historical transformations. Through his reinterpretation of issues such as Islamic inheritance law and banking interest, Munawir articulates a model of substantive justice grounded in maqāṣid al-sharī‘ah. However, this study also reveals critical tensions within his approach, particularly regarding methodological boundaries that prevent excessive relativism in legal interpretation. Overall, Munawir Sjadzali’s thought represents a significant intellectual contribution to the development of Islamic law as a dynamic, contextual, and justice-oriented system, offering a viable framework for reconciling divine normativity with the complexities of contemporary social life.
