Abstract

Kegiatan pengabdian masyarakat yang dilakukan oleh Tim Dosen Fakultas Hukum Universitas Ichsan Gorontalo bertujuan untuk meningkatkan pengetahuan dan pemahaman siswa tentang pentingnya pencegahan perkawinan di bawah umur. Melalui kegiatan ini, siswa dapat memahami peran masyarakat dan pemerintah dalam mencegah dan melindungi hak anak dari perkawinan di bawah umur. Dengan demikian, kegiatan pengabdian masyarakat ini dapat memiliki dampak positif dalam meningkatkan kesadaran dan pengetahuan masyarakat tentang pentingnya pencegahan perkawinan di bawah umur. Pemilihan metode penyuluhan hukum dipandang relevan karena mampu menjangkau langsung peserta didik dengan pendekatan interaktif, diskusi kelompok, serta studi kasus yang berkaitan dengan praktik perkawinan anak di masyarakat. Metode ini juga dilengkapi dengan penyampaian materi berbasis regulasi yang berlaku, seperti Undang-Undang Perkawinan dan Undang-Undang Perlindungan Anak, sehingga siswa tidak hanya memahami teori tetapi juga aspek normatifnya. Hasil kegiatan menunjukkan bahwa siswa lebih memahami dampak negatif perkawinan anak, baik dari sisi normatif, pendidikan, kesehatan, maupun sosial. Selain itu, mereka juga menyadari pentingnya peran keluarga, sekolah, dan aparat pemerintah dalam mencegah terjadinya praktik tersebut. Kesadaran ini diharapkan dapat menjadi bekal bagi siswa untuk turut berperan aktif dalam menyuarakan pencegahan perkawinan di bawah umur di lingkungan mereka.

Abstract

General Elections (Pemilu) are the main pillar in a democratic system, where voter participation is an important indicator of the legitimacy and success of the election. North Bolaang Mongondow Regency as one of the regions in North Sulawesi Province has its own social and geographical characteristics that influence the dynamics of voter participation. This study aims to analyze the level of community participation in the 2024 Election and identify factors that encourage and inhibit such participation. The research method used is a qualitative descriptive approach with data collection techniques through observation, interviews, and documentation studies. The results of the study show that voter participation in this area has increased compared to the previous Election, although there are still challenges such as low political literacy, limited information distribution, and the strong influence of local figures. These findings provide an important overview for election organizers and policy makers to design more effective participatory strategies in the future.

Abstract

Kualitas pelayanan publik Polri dipengaruhi oleh penilaian masyarakat. Baik buruknya penilaian masyarakat dipengaruhi oleh tinggi rendahnya kesenjangan antara harapan masyarakat dengan kenyataan pelayanan yang diterimanya. Adapun penilaian masyarakat terhadap kinerja Polri dipengaruhi oleh tingkat kepercayaan masyarakat terhadap anggota Polri itu sendiri. Tujuan penulisan ini adalah untuk mengetahui perspektif masyarakat terhadap perilaku oknum Polisi mempengaruhi kualitas pelayanan publik di Wilayah Kepolisian Daerah Gorontalo. Metodologi yang digunakan adalah pendekatan kualitatif dengan metode deskriptif analitis. Sumber data berupa data primer dan data sekunder, yang diperoleh melalui wawancara, penyebaran kuesioner dan studi dokumentasi. Hasil penelitian menunjukkan bahwa perilaku oknum Polisi yang melakukan tindak pidana akan berpengaruh pada kualitas pelayanan publik. Berhasil tidaknya pelayanan publik sangat ditentukan oleh perilaku aparat yang merupakan salah satu indikator layanan publik. Sedangkan pandangan masyarakat terhadap kualitas pelayanan publik menunjukkan hasil yang baik, namun harus dipertahankan dan ditingkatkan agar menjadi lebih baik, dengan memperhatikan responsivitas, kesopanan, akses, komunikasi, dan atribut pendukung layanan. Selain itu, pentingnya mendorong lahirnya sebuah kebijakan atau instrumen hukum tentang aplikasi berbasis teknologi yang mudah diakses, cepat, terjangkau dan terukur, agar masyarakat lebih mudah mengetahui perkembangan laporan pengaduan, serta strategi dalam menciptakan pelayanan publik yang inklusi dan berbasis HAM. Abstract

This study aims to analyze the legal aspects of the transfer of regional property in order to support good governance in South Bolaang Mongondow Regency. The transfer of regional property is a form of regional asset management that must be carried out transparently, accountably, and in accordance with applicable laws and regulations. The research method used is a normative juridical approach with a case study in South Bolaang Mongondow Regency. The results of the study show that the transfer of regional property still faces various legal obstacles, including the lack of understanding of regional officials on the transfer procedure, as well as the lack of supervision and transparency in its implementation. This has an impact on the low effectiveness of good governance. Therefore, it is necessary to increase the capacity of human resources, improve technical regulations, and strengthen the supervisory mechanism to ensure that the transfer of regional property runs according to the principles of good governance. This research provides strategic recommendations to encourage the creation of cleaner, transparent, and accountable governance in South Bolaang Mongondow Regency.

Abstract

Domestic violence (KDRT) is a human rights violation that has a serious impact on victims, especially women and children. Although it has been regulated in Law Number 23 of 2004 concerning the Elimination of Domestic Violence, the implementation of law enforcement in various regions still faces various challenges. This study aims to analyze the form of law enforcement for domestic violence cases in the jurisdiction of the Gorontalo Police, as well as identify the inhibiting and supporting factors in the law enforcement process. The research method used is empirical juridical, with a qualitative approach involving interviews with law enforcement officials, victims, and accompanying institutions. The results of the study show that although the Gorontalo Police have tried to handle domestic violence cases seriously, there are still obstacles such as lack of reports from victims, patriarchal culture, limited resources, and lack of public understanding of victims' rights. This study recommends increasing the capacity of law enforcement officials, cross-sectoral cooperation, and legal education to the public to realize more effective protection for victims of domestic violence.

Abstract

This study employs a Research and Development methodology, guided by the ADDIE framework, to design a sustainable restorative digital rehabilitation model for children in conflict with the law. It responds to critical systemic deficiencies observed in juvenile justice, including fragmented service delivery, non standardized intervention protocols, and persistently high recidivism rates. Data were synthesized from structured literature reviews, field observations at LPKA Class II Gorontalo, expert consultations, and controlled pilot trials. The principal outputs comprise a detailed process architecture, operational workflow maps, and a modular integrated application. This digital platform consolidates standardized assessment, intervention tracking, behavioural monitoring, and post-release reintegration support. Validation analyses indicate that the proposed model adheres to normative child justice standards and demonstrates technical feasibility for scalable implementation. The framework enhances intervention precision, improves the measurement of behavioural transformation, and strengthens readiness for community reintegration. Consequently, this research contributes a hybrid socio-legal and digital framework designed to increase systemic reliability and standardisation in juvenile rehabilitation. The model presents a scalable solution with potential global relevance for reducing recidivism among young offenders.

Abstract

Inclusive education constitutes a fundamental human right, yet children with disabilities in Gorontalo City face persistent barriers in accessing it. This study analyzes the legal framework governing inclusive education rights and evaluates the implementation of adaptive, technology-supported inclusive policies. Employing a socio-legal approach with a descriptive–analytical design, the research integrates normative analysis of legal instruments with empirical data from focus group discussions, interviews, and document review. Findings reveal that Regional Regulation No. 3 of 2023 has not been effectively operationalized, with implementation hindered by systemic factors (insufficient qualified teachers, non-adaptive curricula, inadequate accessible infrastructure), socio-cultural factors (stigma and bullying), and digital factors (limited device access and low digital literacy). The results highlight a substantial gap between normative guarantees and practical implementation. The study underscores the need for operational regulations, enhanced teacher capacity, accessible digital learning facilities, and multi-stakeholder collaboration to achieve an equitable and inclusive educational ecosystem.

Abstract

Independent candidacy in local head elections constitutes an important instrument for expanding political participation at the local level; however, in practice, it frequently gives rise to administrative disputes that directly affect the fulfillment of citizens’ political rights. This study aims to analyze the resolution of disputes involving independent candidates in the 2024 Regional Head Election (Pilkada) of Boalemo Regency and to assess the role of the Election Supervisory Body (Bawaslu) in realizing electoral justice. The research employs a normative juridical method, using statutory, conceptual, and case study approaches focused on two independent candidacy disputes handled by the Boalemo Regency Bawaslu. The findings indicate that the disputes were primarily triggered by inconsistencies between support data recorded in the digital nomination system (SILON) and physical supporting documents, as well as procedural limitations in the verification process. Bawaslu functioned not merely as an enforcer of legal certainty but also as a corrective institution that safeguards political rights through adjudicative decisions and deliberative (musyawarah) mechanisms. The dispute resolution practices reflect a balanced application of procedural and substantive justice. This study concludes that strengthening institutional capacity, integrating electoral information systems, and optimizing non-litigation dispute resolution mechanisms are essential prerequisites for achieving electoral justice and enhancing the quality of local democracy.

Abstract

Mining activities in Pohuwato Regency generate economic benefits while simultaneously giving rise to legal issues, particularly concerning land acquisition carried out through tali asih mechanisms. This practice often places local mining communities in a legally vulnerable position due to unequal power relations with mining companies and the absence of clear legal regulation. This study aims to analyze the legal standing of local mining communities in land acquisition practices conducted through tali asih mechanisms and to formulate forms of civil law protection that are fair, proportional, and grounded in social justice. This research employs a normative–empirical legal method with statutory, conceptual, and sociological approaches. Data were obtained through library research on legal regulations and doctrines, as well as empirical data collected through interviews and field observations. The findings indicate that tali asih practices have not fully complied with the principles of freedom of contract, good faith, and equality of the parties, resulting in the protection of the civil rights of local mining communities being largely formal rather than substantive. Furthermore, normative gaps and the weak role of the state in providing preventive protection exacerbate the legal vulnerability of affected communities. This study concludes that strengthening regulatory frameworks and adopting a legal protection approach oriented toward social justice are necessary to ensure that mining-related land acquisition not only provides legal certainty but also guarantees the protection of rights and the sustainability of the livelihoods of local mining communities.

Abstract

The development of consumer financing agreements secured by fiduciary guarantees in Indonesia has long relied on the principle of pacta sunt servanda as the primary legal foundation for contractual enforcement. Traditionally, this principle was applied in a rigid and formalistic manner, allowing creditors to unilaterally determine default and execute fiduciary collateral based solely on contractual provisions and fiduciary certificates. Such practices often resulted in an imbalance of legal positions between creditors and debtors, particularly due to the dominance of standard-form contracts. The Constitutional Court Decision Number 18/PUU-XVII/2019 marked a significant shift by asserting that default cannot be determined unilaterally and that fiduciary execution without debtor consent or judicial determination violates constitutional protections. This research aims to analyze the application of the pacta sunt servanda principle in consumer financing agreements before and after the Constitutional Court decision and to reconstruct the principle in order to achieve a fair, balanced, and constitutionally compliant model of fiduciary execution. Employing a normative juridical method, this study examines statutory regulations, legal doctrines, and relevant court decisions to identify changes in legal interpretation and enforcement practices. The findings indicate that the Constitutional Court decision has transformed pacta sunt servanda from an absolute principle into a conditional one that must be integrated with principles of justice, proportionality, good faith, and constitutional rights protection. The study concludes that the reconstruction of pacta sunt servanda is essential to harmonize contractual certainty with substantive justice, ensuring that fiduciary execution mechanisms in Indonesia respect both private autonomy and constitutional guarantees.
