Abstract

The principle of ultimum remedium suggests that criminal sanctions should be used as a last resort when other legal avenues have been exhausted. The principle is not explicitly stated in the Indonesian Criminal Procedure Law and is often considered a mere slogan in practice.  Recently, there has been a growing trend of resolving minor criminal cases outside the formal judicial process. Instead of imposing criminal penalties, conciliation or restorative justice methods are being used. In this context, restorative justice involves reaching an agreement that resolves conflict between the offender and victim. Although not specifically regulated by the Criminal Procedure Law, there has been a shift in how criminal law enforcement views minor cases, allowing for reconciliation or peace agreements. The introduction of restorative justice mechanisms by law enforcement agencies has made the practice of reconciliation more flexible, moving away from its initially punitive nature. Additionally, including peace within restorative justice indirectly strengthens the ultimum remedium principle, ensuring that criminal sanctions are truly used as a last resort in certain minor cases.DOI: https://doi.org/10.22304/pjih.v10n3.a1

Abstract

Memperoleh pendampingan hukum merupakan salah satu hak yang dimiliki oleh seorang terdakwa ketika menjalani proses peradilan. Pemberian bantuan hukum kepada terdakwa selama masa pandemi Covid-19 sedikit banyak mengalami kendala. Beralihnya mekanisme pendampingan hukum selama masa Pandemi Covid-19 yang dahulu dilaksanakan tatap muka secara langsung menjadi daring menggunakan perantara alat elektronik dianggap memicu munculnya hambatan dan kendala bagi Posbakum untuk melakukan pendampingan hukum secara optimal kepada terdakwa. Berdasarkan hal tersebut, Penelitian ini dilakukan untuk mencari tahu sejauh mana peran Posbakum sebagai penyedia layanan hukum cuma-cuma di pengadilan dan efektivitas pelaksanaan pemberian bantuan hukum yang dilakukan oleh Posbakum kepada terdakwa selama masa Pandemi Covid-19. Penelitian dilakukan menggunakan metode yuridis empiris, sehingga permasalahan tidak hanya dilihat secara normatif, tetapi juga melihat bagaimana kenyataan yang terjadi di lapangan secara langsung. Data lapangan didapatkan melalui hasil observasi dan wawancara dengan beberapa narasumber yang memiliki keterlibatan dengan proses pemberian bantuan hukum. Hasil penelitian menunjukkan bahwa pelaksanaan pemberian bantuan hukum yang dilakukan oleh Posbakum Pengadilan Cibinong selama masa Pandemi Covid-19 belum sepenuhnya efektif karena dalam pelaksanaannya masih menemukan kendala-kendala yang menjadikan pendampingan hukum tidak dapat diberikan secara optimal, sebagai akibat dari keterbatasan interaksi dan komunikasi antara penasihat hukum dengan terdakwa dan ketiadaan sarana atau prasarana yang kurang mumpuni.

Abstract

Many victims of child sexual violence suffer from trauma, shame, and a lack of support from their surroundings, making them reluctant to continue their education. Therefore, legal protection for child victims of sexual violence based on the Law on the Crime of Sexual Violence identifies efforts to reduce its impact, particularly on the sustainability of children's education.  Children should receive more and the best attention as per the principle of the best interests of the child.  Using a normative legal approach, this paper examines how Indonesian laws pertaining to sexual assault have evolved and how they connect to societal symptoms.  Child protection measures that are implemented according to the best interests of the child concept encompass social, psychological, and physical protection measures.  Legal, psychological, and social help for victims are provided by organizations including the Ministry of Women's Empowerment and Child Protection, KPAI, UPTD PPA, LPSK, Polri, P2TP2A, and NGOs.  Establishing a comprehensive and long-lasting protection system requires cooperation amongst institutions.  In order to better assist and handle child victims in accordance with their rights and integrate central and regional institutions, it is hoped that this journal will offer strategic contributions. One such contribution is to expedite the establishment of UPTD PPA in each region. Additionally, law enforcement officers, including prosecutors, should immediately utilize Law No. 12 of 2022 concerning Criminal Acts of Sexual Violence, as the TPKS Law regulates prevention, handling, recovery, and law enforcement, which prioritizes victim protection, particularly for victims of child sexual violence.

Abstract

Sexual violence crimes not only affect adults as victims but also targetand impact children. Concern over the high number of sexual crimes experienced by children should not solely focus on punishing the perpetrators but also on fulfilling the rights of child victims of criminal acts. One way to restore the condition of child victims of sexual violence is through restitution. In cases of sexual crimes against children, the Public Prosecutor (JPU) plays a central role in ensuring the fulfillment of the victim's right to restitution. The central role of the Public Prosecutor in providing restitution is stated in Government Regulation No. 43 of 2017. This study aims to examine the urgency of the Public Prosecutor's role in fulfilling restitution rights and to identify the challenges and efforts in the process of fulfilling these rights for child victims. This research uses a normative juridical approach. The findings indicate that filing for restitution for child victims of sexual violence crimes is crucial and should be included in the Public Prosecutor's indictment as a form of legal protection for the child victims. However, the implementation of restitution requests in the indictment still faces obstacles, both from within the prosecutor's office and from external institutions.

Abstract

The agrarian reform in Indonesia has not been effectively implemented, leading to significant challenges, particularly regarding the unresolved status of Right to Use Enterprises (HGU) held by plantation entrepreneurs. As a result, many plantation lands remain abandoned, which farming communities—lacking formal land ownership—subsequently cultivate. The government views this activity as unauthorized land occupation, commonly referred to as reclamation. Conflicts over plantation land arise from differing perspectives: while farming communities seek justice, the government perceives plantation land as state property that necessitates state control and management. This issue is further complicated by plantation entrepreneurs who believe they retain valid HGU rights. To address this multifaceted problem, a solution model is needed that engages victims, perpetrators, and community stakeholders to foster a sense of justice. This research employs socio-legal methodologies, utilizing an interdisciplinary approach that incorporates non-legal disciplines to enhance doctrinal analysis and better understand the legal realities faced by all parties involved. The findings indicate that a restorative justice model for resolving conflicts between farming communities and HGU holders is highly appropriate, as it facilitates a sense of fairness for all stakeholders. By bridging the divergent understandings and paradigms of the farming communities and the government, restorative justice mechanisms can effectively restore the rights of those affected and promote peace in the resolution process.

Abstract

This study examines how DSN-MUI fatwas can be transformed into operational and binding legal norms within the governance of Sharia fintech in Indonesia. The main problem identified is the absence of an integration mechanism between fatwas and OJK regulations, resulting in a dualistic supervisory framework that creates legal uncertainty and weakens the enforcement of Sharia compliance. Using a normative legal research method with legislative, conceptual, and comparative approaches, this study analyzes regulatory gaps, supervisory structures, and governance practices across several countries. The findings indicate that the dual authority model hampers regulatory effectiveness and undermines public trust in Sharia fintech. This study recommends an integrated governance framework through normative harmonization, the establishment of an OJK-DSN-MUI coordination platform, and the incorporation of fatwa provisions into formal regulations to strengthen legal legitimacy, ensure Sharia compliance, and enhance consumer protection. Study analyzes the transformation of fatwas into enforceable legal frameworks within the governance of Sharia fintech in Indonesia. Using a normative and comparative legal approach, this study examines the relationship between the regulations of the Financial Services Authority (OJK) and the fatwas issued by the National Sharia Council–Indonesian Ulema Council (DSN–MUI).

Abstract

Article 5 Paragraph (1) of Perja 15/2020 is a cumulative principle requirement. However, in certain criminal acts the three principle conditions can be distorted as in Article 5 Paragraph (2), Paragraph (3), and Paragraph (4). This study examines the current regulation of the implementation of deviations from Article 5 Paragraph (1) letter b and c of Perja 15/2020 and the enforcement of law deviations from Article 5 Paragraph (1) Letter b and c of Perja 15/2020 by the public prosecutor. The research method used is juridical normative in the form of an assessment of literature materials or secondary data. The statute approach and the case approach are the two approaches used in this study. To obtain information that supports this study, data collection techniques in the form of interviews were also used. The results showed that currently the implementation of the termination of prosecution deviates from Article 5 Paragraph (1) Letters b and c referring to Perja 15/2020.

Abstract

The enforcement of military discipline is essential to operational readiness; however, the normative and ethical foundations of disciplinary authority within the Indonesian National Armed Forces (TNI) remain insufficiently examined. Existing scholarship largely treats ANKUM (Superior Officers Authorized to Impose Punishment) as a procedural or administrative mechanism, leaving a significant gap concerning its ethical legitimacy, normative coherence, and institutional accountability as a command-based disciplinary authority. This article addresses that gap by critically reassessing ANKUM’s role beyond its formal legal mandate. By employing a normative juridical method combined with conceptual and comparative approaches, this study examines Indonesian military disciplinary law alongside selected models from the United Kingdom, Australia, and the United States. The analysis demonstrates that the concentration of discretionary power in ANKUM generates normative vulnerabilities, including inconsistent enforcement, limited procedural safeguards, and ethical tension in balancing command loyalty with justice. The article’s original contribution lies in reconceptualizing military discipline not merely as an instrument of hierarchical control, but as an ethical institution inherent in command responsibility, operationalized through three analytical dimensions: ethical proportionality in sanctioning, institutional accountability mechanisms, and the alignment of disciplinary enforcement with unit cohesion and operational readiness. Grounded in comparative military justice and moral philosophy, the article proposes a reform-oriented framework that enhances legal legitimacy and strengthens ethical command within democratic civil–military relations

Abstract

Penelitian ini mengkaji disharmoni peraturan perundang-undangan antara Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer dan Undang-Undang Nomor 46 Tahun 2009 tentang Pengadilan Tindak Pidana Korupsi (Tipikor) dalam penanganan kasus korupsi yang dilakukan oleh Prajurit Tentara Nasional Indonesia (TNI). Permasalahan ini menciptakan ketidakpastian hukum, seperti yang terlihat pada kasus korupsi di Basarnas tahun 2023 yang pada akhirnya menimbulkan konflik tarik menarik yurisdiksi antara KPK dan Puspom TNI atas kewenangannya. konflik kedua undang-undang yang bersifat lex specialis ini dipicu oleh penggunaan metode  pendekatan yang berbeda, antara lain pendekatan subjek (pelaku) oleh peradilan militer dan pendekatan objek (tindak pidana) oleh Pengadilan Tipikor.Penelitian ini menggunakan metode yuridis normatif dengan data sekunder berupa undang-undang, buku, dan jurnal, serta data primer dari wawancara, yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa konflik norma tersebut menimbulkan implikasi negatif, termasuk potensi impunitas, hambatan dalam pemberantasan korupsi, dan diskriminasi perlakuan hukum yang bertentangan dengan prinsip equality before the law.Sebagai kesimpulan, diperlukan harmonisasi hukum dengan cara pembaruan hukum. Penelitian ini menyarankan agar Undang-Undang Peradilan Militer direvisi untuk mengecualikan tindak pidana korupsi dari yurisdiksi peradilan militer dan secara eksplisit menyerahkannya kepada Pengadilan Tipikor. Untuk mewujudkan hal ini, disarankan pembentukan mekanisme hukum acara kolaboratif antara penyidik militer (POM TNI) dan sipil (KPK/Kejaksaan) dengan penuntutan dan peradilan tetap berada di Pengadilan Tipikor, tanpa perlu persetujuan khusus, untuk menjamin kepastian hukum, transparansi, dan akuntabilitas.
