Abstract

Electronic-based sexual violence in Indonesia has increased compared in prior years, one of which is sextortion. Practice of handling sextortion cases in Indonesia show that law enforcement institution only focus on the dissemination of victim sexual content, without following up with extortion and threats to perpetrators, also the absence of victims protection. Victims comply with the wishes of perpetrators and not brave enough to report because victims are worried that victim sexual content will be disseminated. Normative legal research is a research method are used by analyzing literature research, statutory research, and case study. The research results show that Article 14 Law Number 12 of 2022 on Sexual Violence Criminal Act can be used in handling sextortion cases because it has a more accommodating formulation and form of punishment, also provides comprehensive protection of victims.

Abstract

The principle of ultimum remedium suggests that criminal sanctions should be used as a last resort when other legal avenues have been exhausted. The principle is not explicitly stated in the Indonesian Criminal Procedure Law and is often considered a mere slogan in practice.  Recently, there has been a growing trend of resolving minor criminal cases outside the formal judicial process. Instead of imposing criminal penalties, conciliation or restorative justice methods are being used. In this context, restorative justice involves reaching an agreement that resolves conflict between the offender and victim. Although not specifically regulated by the Criminal Procedure Law, there has been a shift in how criminal law enforcement views minor cases, allowing for reconciliation or peace agreements. The introduction of restorative justice mechanisms by law enforcement agencies has made the practice of reconciliation more flexible, moving away from its initially punitive nature. Additionally, including peace within restorative justice indirectly strengthens the ultimum remedium principle, ensuring that criminal sanctions are truly used as a last resort in certain minor cases.DOI: https://doi.org/10.22304/pjih.v10n3.a1

Abstract

Memperoleh pendampingan hukum merupakan salah satu hak yang dimiliki oleh seorang terdakwa ketika menjalani proses peradilan. Pemberian bantuan hukum kepada terdakwa selama masa pandemi Covid-19 sedikit banyak mengalami kendala. Beralihnya mekanisme pendampingan hukum selama masa Pandemi Covid-19 yang dahulu dilaksanakan tatap muka secara langsung menjadi daring menggunakan perantara alat elektronik dianggap memicu munculnya hambatan dan kendala bagi Posbakum untuk melakukan pendampingan hukum secara optimal kepada terdakwa. Berdasarkan hal tersebut, Penelitian ini dilakukan untuk mencari tahu sejauh mana peran Posbakum sebagai penyedia layanan hukum cuma-cuma di pengadilan dan efektivitas pelaksanaan pemberian bantuan hukum yang dilakukan oleh Posbakum kepada terdakwa selama masa Pandemi Covid-19. Penelitian dilakukan menggunakan metode yuridis empiris, sehingga permasalahan tidak hanya dilihat secara normatif, tetapi juga melihat bagaimana kenyataan yang terjadi di lapangan secara langsung. Data lapangan didapatkan melalui hasil observasi dan wawancara dengan beberapa narasumber yang memiliki keterlibatan dengan proses pemberian bantuan hukum. Hasil penelitian menunjukkan bahwa pelaksanaan pemberian bantuan hukum yang dilakukan oleh Posbakum Pengadilan Cibinong selama masa Pandemi Covid-19 belum sepenuhnya efektif karena dalam pelaksanaannya masih menemukan kendala-kendala yang menjadikan pendampingan hukum tidak dapat diberikan secara optimal, sebagai akibat dari keterbatasan interaksi dan komunikasi antara penasihat hukum dengan terdakwa dan ketiadaan sarana atau prasarana yang kurang mumpuni.

Abstract

Sexual violence crimes not only affect adults as victims but also targetand impact children. Concern over the high number of sexual crimes experienced by children should not solely focus on punishing the perpetrators but also on fulfilling the rights of child victims of criminal acts. One way to restore the condition of child victims of sexual violence is through restitution. In cases of sexual crimes against children, the Public Prosecutor (JPU) plays a central role in ensuring the fulfillment of the victim's right to restitution. The central role of the Public Prosecutor in providing restitution is stated in Government Regulation No. 43 of 2017. This study aims to examine the urgency of the Public Prosecutor's role in fulfilling restitution rights and to identify the challenges and efforts in the process of fulfilling these rights for child victims. This research uses a normative juridical approach. The findings indicate that filing for restitution for child victims of sexual violence crimes is crucial and should be included in the Public Prosecutor's indictment as a form of legal protection for the child victims. However, the implementation of restitution requests in the indictment still faces obstacles, both from within the prosecutor's office and from external institutions.

Abstract

The agrarian reform in Indonesia has not been effectively implemented, leading to significant challenges, particularly regarding the unresolved status of Right to Use Enterprises (HGU) held by plantation entrepreneurs. As a result, many plantation lands remain abandoned, which farming communities—lacking formal land ownership—subsequently cultivate. The government views this activity as unauthorized land occupation, commonly referred to as reclamation. Conflicts over plantation land arise from differing perspectives: while farming communities seek justice, the government perceives plantation land as state property that necessitates state control and management. This issue is further complicated by plantation entrepreneurs who believe they retain valid HGU rights. To address this multifaceted problem, a solution model is needed that engages victims, perpetrators, and community stakeholders to foster a sense of justice. This research employs socio-legal methodologies, utilizing an interdisciplinary approach that incorporates non-legal disciplines to enhance doctrinal analysis and better understand the legal realities faced by all parties involved. The findings indicate that a restorative justice model for resolving conflicts between farming communities and HGU holders is highly appropriate, as it facilitates a sense of fairness for all stakeholders. By bridging the divergent understandings and paradigms of the farming communities and the government, restorative justice mechanisms can effectively restore the rights of those affected and promote peace in the resolution process.

Abstract

This study examines how DSN-MUI fatwas can be transformed into operational and binding legal norms within the governance of Sharia fintech in Indonesia. The main problem identified is the absence of an integration mechanism between fatwas and OJK regulations, resulting in a dualistic supervisory framework that creates legal uncertainty and weakens the enforcement of Sharia compliance. Using a normative legal research method with legislative, conceptual, and comparative approaches, this study analyzes regulatory gaps, supervisory structures, and governance practices across several countries. The findings indicate that the dual authority model hampers regulatory effectiveness and undermines public trust in Sharia fintech. This study recommends an integrated governance framework through normative harmonization, the establishment of an OJK-DSN-MUI coordination platform, and the incorporation of fatwa provisions into formal regulations to strengthen legal legitimacy, ensure Sharia compliance, and enhance consumer protection. Study analyzes the transformation of fatwas into enforceable legal frameworks within the governance of Sharia fintech in Indonesia. Using a normative and comparative legal approach, this study examines the relationship between the regulations of the Financial Services Authority (OJK) and the fatwas issued by the National Sharia Council–Indonesian Ulema Council (DSN–MUI).
