Abstract

Adanya program pengabdian masyarakat yang dituangkan dalam kegiatan pemberdayaan ekonomi diharapakan menambah penghasilan para tuakng becak dan keluarganya sehingga meningkatkan kesejahteraan. Pendekatan penelitian ini adalah menggunakan pendekatan kualitatif deskriptif. Analisis kualitatif deskriptif. Teknik pengumpulan data yang dipilih untuk mengungkapkan serta menganalisis data yang didapatkan adalah dengan metode observasi langsung. Selain menggunakan metode observasi, penulis juga menggunakan metode survey dalam pengabdian ini. Metode survey adalah penyelidikan yang diadakan untuk memperoleh fakta-fakta dari gejala-gejala yang ada dan mencari keterangan-keterangan secara faktual. Setelah diberikan bantuan modal kedua mitra telah mempunyai masing-masing usaha mikro. Untuk Bapak Galung memanfaatkan bantuan modal tersebut dengan membuka usaha tabung gas LPG 3 Kg dengan memanfaatkan teras rumahnya. Sedangkan untuk Bapak Sali memanfaatkan dana bantuan tersebut dengan membuka usaha warung makan. Dengan bantuan istri dan anaknya Bapak Sali membuka warung dengan menjual berbagai makanan dan jajanan. Sasaran pengabdian ini dapat digunakan oleh masyarakat dengan penghasilan rendah seperti tukang becak. Lokasi pengabdian dilakukan di daeah jalan Kalimosodo, Kelurahan Polehan, Kota Malang. Dalam pengabdian ini difokuskan pada masyrakat dengan berpengahsilan rendah yaitu tukang becak. Dengan adanya program bantuan modal ini para tukang becak dapat membuka usaha mikro, sehingga diharapkan akan meningkatkan kesejahteraan.

Abstract

This research examines the persistence of child marriage in the Madura region through the lens of legal pluralism, particularly the intersections of Islamic, customary, and state laws. Although religious and cultural practices continue to shape norms and values, they often counteract statutory provisions designed to safeguard children's rights. Proposed is a harmonization model that integrates fiqh and customary law with national law, providing cultural legitimacy while protecting children at the same time. Adopting the socio-legal qualitative approach, the research uses a combination of normative legal theory and empirical research conducted in Sampang Regency, which embraced interviews and documentation of court decisions, fatwas, local regulations, and case files on child marriage, with religious leaders, elders, lawyers, judges, parents, and child marriage survivors. Spradley’s ethnographic model guided the analysis in documenting core cultural themes and their components. It is cultural and religious rationalization, along with ignorance of laws and weak enforcement, that continue to allow child marriage. Solid legal reform requires improving child protection by local leaders, educating children's rights, and reframing marriage-age laws from religious prohibitions to administrative restrictions. It gaps legal pluralism and children's rights by cohesive laws, socio-cultural practices, and international human rights.

Abstract

The growing number of petitions for marriage annulment and divorce raises a complex legal challenge, as each is grounded in different legal purposes and carries distinct implications. This issue has emerged in several cases before the Religious Courts within the DKI Jakarta High Religious Court jurisdiction, notably Case Number 3000/Pdt.G/2023/PA.JS, where both claims were filed simultaneously. This study aims to analyze the legal construction and judicial reasoning of judges in deciding cumulative applications for annulment of marriage and divorce lawsuits in the Religious Court within the jurisdiction of the DKI Jakarta High Religious Court. This study adopts a descriptive–analytical socio-legal method, drawing on legal construction theory, judicial reasoning, law enforcement principles, and the doctrine of maslahah mursalah to critically analyze judges’ legal reasoning and judicial outcomes. Data were analyzed through normative legal analysis supported by case law. The findings reveal that the legal construction applied by judges in handling the accumulation of annulment and divorce claims prioritizes justice, legal certainty, and human rights protection by harmonizing procedural law with substantive Islamic legal principles. The novelty of this research lies in formulating a coherent legal solution that legitimizes the selective acceptance of claims, enabling courts to resolve procedural conflicts while safeguarding the legal status and post-divorce rights of wives and children. This approach offers a workable judicial framework for adjudicating comparable cases within the Religious Courts.
