Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana pertimbangan hakim dalam Putusan Pengadilan Negeri Mataram Nomor 239/Pdt.G/2020/PN.Mtr dan pertanggungjawaban penjual yang wanprestasi dalam perjanjian jual beli mobil. Penelitian dilaksanakan dengan mengaplikasikan metode penelitian normatif yang menggunakan pendekatan undang-undang, pendekatan konseptual, dan pendekatan kasus. Perjanjian jual beli mobil yang menjadi objek jaminan fidusia tersebut adalah sah sebagaimana diatur dalam Pasal 1458 KUHPerdata dan penjual dinyatakan wanprestasi karena tidak menyerahkan BPKB. Penjual bertanggungjawab untuk menyerahkan BPKB kepada pembeli. Majelis hakim menghukum lembaga finance untuk menyerahkan BPKB kepada pihak ketiga (penggugat).

Abstract

Tujuan Penelitian menjelaskan proses jual beli rumah subsidi dengan cara oper kredit dibawah tangan dan mengetahui perlindungan hukum pembeli dalam jual beli rumah subsidi secara oper kredit dibawah tangan. Jenis penelitian hukum Normatif-Empiris menggunakan metode pendekatan peraturan perundang-undangan, konseptual dan sosiologis. Kesimpulan: pertama, penjual dan pembeli melengkapi semua dokumen persyaratan jual beli rumah pada umumnya, kemudian membuat perjanjian guna penulasan sisa cicilan pemilik rumah subsidi oper kredit ke bank beralih kepada pembeli. Kedua, pembeli dapat meminta ganti kerugian dengan melakukan gugatan kepengadilan negeri atas dasar wanprestasi atau Perbuatan melawan hukum.

Abstract

This research aims to find out and explain cooperation agreement between BRI Bank and BRILINK Agent in distributing Social Security PKH and legal relationship, implementation procedure, and obstacles of cooperation agreement through BRILink Agent. The method of this research is normative-empirical legal research. The result of this research shows that legal relation between BRI Bank and BRIlink Agent is based on agency agreement that bound both parties. The implementation procedure of the cooperation agreement is conducted by contract, based on cooperation agreement procedure of disbursemant social security of PKH is executed by the BRILink Agent. There are several obstacles which are faced in cooperation agreement in disbursement social security PKH that consist of technical obstacles and many account number from PKH recipient community which is blocked.

Abstract

This research aims to find out legal consequences of divorce in isbat marriage according to Islamic law compilation and Marriage Law and to know the custody after divorce in isbat marriage. The method of this research is normative legal research. Data analytical technique that has been used in this research is qualitative. The result of this research shows that legal consequences of divorce in isbat marriage are former husband or wife that must look after and educate their children, having right to share the property and inheritance. On the other hand, the custodian to the children before adult (mumayyiz) is in their mother and after adult the children have right to choose their custodian.

Abstract

Belum adanya bukti kepemilikan tanah (sertifikat) terhadap suatu hak atas tanah menyebabkan belum terwujudnya tertib hukum dan tertib administrasi sehingga hal ini dapat memicu terjadinya sengketa hak atas tanah. Masyarakat kurang memahami arti pentingnya melakukan legalitas formal terkait dengan kepemilikan tanah, hal ini mengakibatkan sering terjadi sengketa hak atas tanah, sebagai akibat dari tidak dilakukannya kegiatan legalits formal terhadap tanah yang ia miliki sebagaimana yang diatur dalam ketentuan peraturan perundang-undangan yang beralaku. Kegiatan pengabdian kepada masyarkat ini bertujuan untuk mensosialisasikan pentingnya legaitas formal dalam kepemilikan tanah. Metode yang digunakan dalam penyuluhan ini adalah metode ceramah dan diskusi. Dalam kegiatan ini, jumlah peserta yang mengikuti kegiatan sosialisasi tidak begitu banyak karena kondisi pandemi covid 19. Pelaksanaan kegiatan penyuluhan hukum berjalan dengan tertib, aman dan lancar serta sesuai dengan protokol kesehatan. Para peserta penyuluhan hukum mengikuti kegiatan dengan rasa antusiasme yang tinggi, hal ini terlihat dari keaktifan mereka dalam mengajukan sejumlah pertanyaan-pertanyaan dan kasus-kasus hukum yang mereka hadapi kepada tim penyuluh terutama yang terkait dengan legalitas formal kepemilikan hak atas tanah. Sehingga dengan dilakukannya kegiatan sosialisasi tersebut dapat menambah informasi, merubah pola pikir dan sikap masyarakat Desa Senteluk akan pentingnya melakukan kegiatan legalitas formal terhadap hak atas tanah yang dimilikinya

Abstract

This research aims are to know the implementation of loan agreement between member and multiple business cooperative Bhakti Karya Praya, Central Lombok, also to know dispute settlement mechanism in the loan agreement. The applied method was normative legal search. Research’s result said that implementation of loan agreement between members and cooperative conducted in several phases, are submission of loan applications, filling in data on prospective borrowers, checking loans, evaluating loan applications, making decisions, and monitoring loans. Dispute settlement mechanism in the loan agreement always prioritize the principle of kinship by conducting some efforts, such as collecting the debt at the residence of the debtor, issue a warning letter to the debtor, as wll as retain and sell collateral belonging to the debtor or credit applicant.

Abstract

This study aims to determine the process of agreement in land use between STIE AMM Mataram and the Government of West Lombok, as well as the legal certainty provided based on the PTTUN Surabaya decision. This study uses normative legal research using the Legislative and Conceptual approaches. After the researcher carried out the investigation, it was found that the use of West Lombok government land by the STIE AMM was based on a borrow-to-use agreement as outlined in the Regent's Decree No. 254/593/287 concerning the Transfer of Use of Land Controlled by the Government of West Lombok, related to the Decree of the Regent of West Lombok Number: 697/72/BPKAD/2020 concerning the Revocation of the Decree of the Regent Number: 254/593/287 concerning the Transfer of Use of Land Controlled by the Level II Regional Government of West Lombok based on Decision No. 132 /B/2021/PTTUN SBY ​​tried and declared the actions of the West Lombok Government categorized as arbitrary actions and ordered the Appellant/Defendant to revoke the Decree of the Regent of West Lombok.

Abstract

This study aims to determine the marital status held abroad between Foreign Citizens (WNA) and Indonesian Citizens (WNI) and to determine the citizenship status of children born from mixed marriages. This research uses normative legal research methods. The results of the study concluded that marriages held abroad between Foreign Citizens (WNA) and Indonesian Citizens (WNI) marriages are valid if they do not violate the legal provisions of Singapore or the country where the marriage is held. Children born from such mixed marriages can choose their own nationality after the age of 18 because they are considered legally capable in accordance with the citizenship law.

Abstract

Purpose of this research is to know the implementation of credit agreement with proof of vehicle ownership (Bukti Pemilikan Kendaraan Bermotor-BPKB) as guarantee and also to know the obstacles in its implementation at PT. International Finance. Method of this study was normative empirical legal research, which applied statute, conceptual and sociological approaches. Implementation of credit agreement with BPKB is started with the debtor comes to the FIF Office and bring some required documents and until the signature of credit agreement phase. Obstacles in the implementation of credit agreement is the breach of contract, consumer data, vehicle tax and guarantee execution. The method to overcome the problem is “Collection Management or Account Receivable (AR) Management”.

Abstract

This research aims are to know the validity of unregistered sale and purchase agreement with the Title Certificate. Type of this research was normative legal research which applied conceptual, statute and case approaches. The used legal analysis of this study was legal interpretation. Result of this study shows that legal force in the verdict Number 3/PDT.G/2021/PN is valid and has legal force since there was witness statement in the court. The panel of Judges gave permission or power of attorney to the Plaintiff for and on behalf of the Defendant before the authorized Land Deed Making Officer (PPAT) to sign the Deed of Sale and Purchase/Transition of land rights with the ownership certificate. The transfer of land rights does not occur, while the agreement remains valid and has the same binding legal force as an authentic deed. It is better if every agreement is made by and before a Notary.
