Abstract

Indonesia adalah salah satu negara yang mempunyai masalah sampah dikarenakan jumlah penduduk di Indonesia sangat tinggi yang menempati urutan ke 4 terbesar di dunia, selain itu pertambahan penduduk dan perubahan pola konsumsi masyarakat menimbulkan bertambahnya volume, jenis, dan karakteristik sampah yang semakin beragam dikalangan masyarakat. Ketidakperdulian terhadap permasalahan pengelolaan sampah berakibat terjadinya degradasi kualitas lingkungan yang tidak memberikan kenyamanan untuk hidup, sehingga akan menurunkan kualitas kesehatan masyarakat. Degradasi tersebut lebih terpicu oleh pola perilaku masyarakat yang tidak ramah lingkungan, seperti membuang sampah di badan air ataupun got, sehingga sampah akan menumpuk di saluran air yang ada dan menimbulkan berbagai masalah turunan lainnya.Berdasarkan Peraturan Pemerintah Republik Indonesia Nomor 81 Tahun 2012 Tentang Pengelolaan Sampah Rumah Tangga dan Sampah Sejenis Sampah Rumah Tangga serta didukung melalui Peraturan Menteri Lingkungan Hidup Nomor 13 Tahun 2012 Tentang Pedoman Pelaksanaan Reduce, Reuse dan Recycle melalui Bank Sampah, maka aparat pemerintah dan masyarakat dapat bekerja sama dalam melaksanakan pengelolaan sampah untuk mewujudkan lingkungan yang bersih dan sehat. Berdasarkan pada Undang-Undang Nomor 18 Tahun 2008 tentang Pengelolaan Sampah menyatakan bahwa pertambahan penduduk dan pola konsumsi berpengaruh pada bertambahnya volume, jenis, dan karakteristik sampah yang semakin beragam. Data dari Statistik Lingkungan Hidup 2017 (Environment Statictics of Indonesia 2017) menunjukkan bahwa limbah padat atau yang lebih dikenal dengan istilah sampah merupakan limbah yang paing banyak terdapat dalam lingkungan hidup.

Abstract

Article 31 of the 1945 Constitution mandates that the government is able to guarantee the provision of education for every citizen. To realize this mandate, the government organized a school operational assistance fund program regulated in the Regulation of the Minister of Education and Culture Number 18 of 2019. The research aims to discuss the use and accountability of the School Operational Assistance program at the elementary school level in Serang City, as well as the constraints in its implementation. The School Operational Assistance Program (BOS). This research uses juridical empirical research methods, as well as library data, and analysis in qualitative form. The results showed that the use of BOS funds in elementary schools in Serang City was focused on developing libraries, purchasing books, developing non-textbooks, admitting new students, learning and extra-curricular students, evaluating learning, school management, developing teacher professional, education personnel. as well as school management, subscriptions to resources and services, maintenance of school facilities and infrastructure, honoraria, and maintenance of multi- media learning tools. The form of school accountability for school operational assistance funds is in the form of submitting reports on the realization of the use of BOS funds through bos.kemdikbud.go.id. The obstacles in the implementation of the BOS Program are the insufficient transparency of the school against parents and students, and there are still some things that are not right on target in the management and distribution of School Operational Assistance Funds.

Abstract

The bureaucracy in this developing country has not positioned itself as a good servant to the community. Maladministration that often occurs in the realm of government makes the bureaucracy in Indonesia bad. The number of corrupt practices in public services encourages the government to be more active in bringing up various regulations in the wrong bureaucracy with the issuance of Minister of Law and Human Rights Regulation Number 29 of 2019 concerning the development of integrity zones towards WBK and WBBM. The zone of integrity is a renewal of good governance for transparency and accountability in the government realm as an effort to prevent acts of corruption, collusion and nepotism. The method used in this research is the empirical juridical method. Specifications of descriptive analytical research. The data source uses primary data and is supported by secondary data consisting of primary, secondary and tertiary legal materials. Data collection techniques in this study by means of interviews. The data obtained were analyzed descriptively with a qualitative data analysis approach. The theory used in this study is the theory of good governance and the theory of law enforcement. The results of the research regarding the implementation of the development of the integrity zone towards WBK/WBBM in the Ministry of Law and Human Rights of the Banten Regional Office in six areas of change have been implemented. The supporting factors include the commitment of the leadership and staff that looks very strong, and the inhibiting factors include weak supervision, lack of IT human resources in making public service innovations. In conclusion, with the implementation of the construction of the integrity zone as an improvement in the quality of public services as a form of obtaining the WBK and WBBM predicates

Abstract

Garbage Banks are one of the innovations that societies make in reducing waste at their source: environment-based waste management and garbage management starting at the source. Garbage can can be a environmental problem, especially garbage from communities in which garbage comes from communities in which it is not treated well, so it will become a load of garbage-based garbage Banks, which are based on citizen citizen participation become an alternative to garbage solutions based on principles of distribution, reuse, Recyle and replant (4r) mean communities become social capital to phase out the existence of trash Banks in household garbage management programs. A change in people's thinking on the management of household garbage should be built through the education of junk management based on community participation to reduce garbage from its source so that people should be aware of and eventually integrated into community-based garbage bank programs. The method of community participation in the home environment should be part of a region that should be done through both educational and dialogue and referrals as an adaptation of the Banks of garbage to the community to act out environmental concerns through the participation of trash based programs through trash Banks. Public-based waste bank education programs will impact the next ward in which people will be involved in high rates of engagement to move together to maintain the environment, especially the city.

Abstract

of handling and managing waste by recycling is another dimension that helps in the utilization of waste. Plastic waste originating from household activities is a problem wherever there are settlements, especially densely populated settlements. A method is needed to be able to reduce the production of waste into new products in order to be able to reuse the waste that has been disposed of. Tangerang Regency is one of the densely populated areas that has problems with household waste. Ecobricks or environmentally friendly bricks are made by compressing plastic waste into bottles to a certain density, 1 bottle of 600ml drinking water can compress plastic waste up to 200gr. The basic principle of Ecobrick is to make the people of Jatiwaring village want to reduce the production of plastic waste and can make something of value. If every household turns their household plastic waste into Ecobrick, a lot of plastic waste will be reduced from the Final Processing Site (TPA). We involve the people of Jatiwaringin village to overcome the problem of the large amount of plastic waste production in Jatiwaringin Village, starting from providing an understanding of the importance of suppressing plastic waste production and providing training and assistance on how to make Ecobricks. The results of this study state that Ecobricks are an effective step to reduce household-level waste production, besides that the work made from Ecobricks also has the potential to increase the eco the economic value of household scale.

Abstract

The resolution of state administrative disputes is intricately tied to the procedural law of the state administrative court, employing routes through both judicial and administrative channels. Governed by Laws No. 5 of 1986 and No. 9 of 2004, the State Administrative Court serves the purpose of providing a platform for dispute settlement and protection for the public, rooted in the general principles of good governance. The settlement of state administrative disputes, particularly those arising from negative object disputes, involves addressing unprofessional conduct by state administration officials, as delineated in Article 3 of Law No. 5 of 1986. This conduct, even if not formalized through a decision letter, is deemed a rejection under the said law. The unprofessional conduct, indicative of losses incurred by individuals or legal entities, aligns with the broader principles of good governance. In this context, state administration officials incur losses through violations of obligations that should safeguard the rights of individuals or legal entities. Article 53, paragraph (2) of Law No. 9 of 2004 underscores the importance of filing a lawsuit based on violations of the general principles of good governance. The application of these principles becomes pivotal in handling state administration disputes with negative object disputes, given the absence of a written object of dispute and reliance solely on the unprofessional conduct of state administration bodies or officials, who reject claims without issuing a formal decision. This underscores the significance of examining the procedural law of the state administrative court, where actions of state administrative bodies or officials are scrutinized for potential violations of the law in the absence of formalized government actions.

Abstract

Provinsi DKI Jakarta sebagai ibu kota negara termasuk ke dalam kota metropolitan karena dihuni oleh lebih dari 10 juta penduduk. Masalah yang ada di kota besar adalah pencemaran udara yang diakibatkan oleh kendaraan bermotor dan industri manufaktur. Pencemaran udara berdampak pada kesehatan masyarakat, menurut data dari WHO, pencemaran udara ambien bertanggung jawab atas 7,6% kematian global dan sekitar 7 juta kematian dini terjadi setiap tahun sebagai akibat dari kombinasi polusi udara dalam ruangan (rumah tangga) dan polusi ambien (luar ruangan), sebagian besar karena peningkatan kematian akibat stroke, penyakit jantung koroner, penyakit paru-paru, Penyakit Paru Obstruktif Kronik (PPOK), dan Infeksi Saluran Pernapasan Akut (ISPA). Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Sumber data yang digunakan dalam penelitian ini adalah data sekunder yang berasal dari buku, artikel, jurnal ilmiah dan literatur yang berhubungan dengan penelitian ini. Berdasarkan analisis yang dilakukan penulis mengenai upaya pemerintah Provinsi DKI Jakarta terhadap pengendalian pencemaran udara adalah dengan memberikan mandat pada Tim Kerja Pengendalian Pencemaran Udara melalui Keputusan Gubernur Nomor 576 Tahun 2023 tentang Strategi Pengendalian Pencemaran Udara untuk melaksanakan rencana aksi dalam pengendalian pencemaran udara. Hambatan yang terdapat dalam pelaksanaan pengendalian pencemaran udara ini adalah keputusan gubernur tersebut kurang komprehensif sehingga tidak menyentuh akar permasalahan dan kurangnya koordinasi dengan pemerintah pusat serta pemerintah daerah lain.

Abstract

Tangerang City Regional Regulation Number 2 Year 2022 on Waste Management contains technical regulations on waste management and a prohibition on burning waste that is not in accordance with the technical requirements of waste management. This research focuses on: How is the Implementation of the Authority of the Tangerang City Environment Agency over waste management that affects pollution caused by waste burning based on Tangerang City Regional Regulation Number 2 Year 2022? How are the Obstacles and Solutions of the Tangerang City Environmental Agency in overcoming pollution caused by waste burning in Tangerang City? The theories used are Authority Theory and Law Enforcement Theory. The method used is the empirical juridical approach method so that the author uses a qualitative and descriptive type of research. The results obtained are that the Tangerang City Environmental Agency is responsible for managing waste by inviting the community to participate in the waste bank and waste alms program and supervising and enforcing the law on this waste burning case. There are obstacles, namely the difficulty of monitoring the waste burning area, illegal trash bins, lack of public awareness. The suggestion is to conduct an analysis in the implementation of the regulation, increase supervision at points where waste burning often occurs, eradicate illegal trash bins, improve waste management by cooperating with organizations regarding the development of waste banks, inviting the public to participate in socialization and conduct waste alms

Abstract

Spatial Planning is a system of spatial planning, spatial utilization, and control of spatial utilization. Based on of Law Number 26 of 2007 concerning Spatial Planning, the Public Works and Spatial Planning (PWSP) of Bima City has the authority to realize the implementation of spatial planning. In its implementation, Bima City still has space utilization that is not in accordance with what has been determined by the government. As for the identification of the problem, how is the authority of the PWSP Office of Bima City in realizing the implementation of spatial planning based on Law Number 26 of 2007 concerning Spatial Planning? and how are the obstacles faced by the PUPR Office of Bima City in realizing the implementation of spatial planning based on Law Number 26 of 2007 concerning Spatial Planning? The theory used is the theory of authority and spatial planning theory. The method used is empirical juridical method with data analysis through a qualitative approach using primary data in the form of interviews with resource persons from the Spatial Planning Division of the PWSP Office of Bima City, and secondary data. The results of the research, the PWSP Office of Bima City exercises its authority in realizing the implementation of spatial planning in accordance with the provisions in Article 11 paragraph (1) and paragraph (2) of Law Number 26 of 2007 concerning Spatial Planning. The conclusion of this research is that the authority of the PWSP Office of Bima City is obtained by delegation and exercises its authority in the form of regulation, guidance, planning, utilization, and control of space. Its activities are in the form of issuing Regional Regulations and Mayor Regulations, as well as socialization to the community. They are also responsible for the preparation of spatial plans, coordination of spatial utilization, zoning, licensing, and supervision through monitoring and evaluation, and reporting. There are 4 obstacle factors, namely the inadequate competence of human resources organizing spatial planning, there are still laws and regulations related to space that need to be synchronized, limited budgets that do not support the implementation of spatial planning, and limited spatial planning information systems. The suggestion is that the PWSP Office of Bima City needs to improve socialization and spatial information systems.

Abstract

The statutory 2% labour quota for persons with disabilities, as mandated by Law No. 8 of 2016, remains largely unfulfilled. Discriminatory practices persist in the recruitment of civil servants, as illustrated by the case of Muhammad Baihaqi (Supreme Court Decision No. 471 K/TUN/2021). This study aims to analyse the capacity of the State Administrative Court (PTUN) to deliver substantive justice and to identify the key obstacles that hinder such efforts. The methodology employed is a doctrinal legal study, utilising primary legal sources (statutes and court decisions) and secondary materials (reports from the Central Statistics Agency [BPS], academic literature, journal articles, and media coverage). Findings indicate that lower administrative courts tend to prioritise procedural compliance, such as adherence to filing deadlines, while neglecting the substantive issue of discrimination. In contrast, the Supreme Court underscored the importance of substantive justice; however, systemic barriers remain prevalent. For instance, in 2019, only 0.017% of civil servant hires were persons with disabilities, reflecting ongoing institutional bias and inadequate reasonable accommodation. This study is the first to explicitly link the procedural rigidity of PTUN to broader human rights violations, arguing for a paradigm shift towards a socio-legal approach that bridges administrative law with justice for persons with disabilities. The paper recommends several reforms: stricter enforcement of the labour quota, the standardisation of disability-inclusive recruitment assessments, the imposition of sanctions for non-compliance, and the integration of disability rights training for judges. Urgent institutional reforms are necessary to align administrative law with human rights principles and to ensure equitable participation of marginalised groups in public employment.
