Abstract

The services provided by the regional government in the appointment of honorary workers in the education sector, especially the appointment of non-ASN teachers to become PPPK are still colored by various obstacles and conditional interests, in Article 66 of Law Number 20 of 2023 non-ASN employees are required to complete their arrangements no later than December 2024. So, since this Law came into effect, Government Agencies are prohibited from appointing non-ASN employees or other names other than ASN Employees. The research method used is empirical juridical and the research specifications used are analytical descriptive. The results of this study indicate that the Tangerang City BKPSDM is currently arranging and determining the formation of non-ASN employees to take part in the PPPK selection, there are 5,186 non-ASN employees who will take part in PPPK in 2024. The conclusion in the arrangement of non-ASN workers, the Tangerang City government through the BKPSDM office does lack workers to carry out its duties, so then there is PPPK whose arrangement must be completed in 2024.

Abstract

The Bukit Barisan Selatan National Park (TNBBS) in Tanggamus Regency has tourism potential that has not been optimally managed by the local government. This study aims to analyze the efforts of the local government in managing TNBBS as a tourist destination based on Tanggamus Regency Regional Regulation No. 6 of 2019 on Integrated Tourism Development, as well as to identify the natural resources that can be developed. This research employs the theories of authority and tourism, using an empirical juridical method with a descriptive-analytical approach. Primary and secondary data were collected through interviews, observations, and documentation, then analyzed descriptively using a qualitative approach. The results indicate that the Tanggamus Regency Government has made efforts to designate tourist destinations, coordinate development, and organize tourism education, training, and research. TNBBS has several tourism potentials, including Sukaraja Waterfall, Teluk Semaka, camping grounds, Tarsius and Rafflesia observation plots, and other biodiversity. However, these efforts remain suboptimal, particularly in tourism marketing, since the primary authority for managing TNBBS lies with the Bukit Barisan Selatan National Park Agency as a conservation area. The tourism potential in this region has met several strategic tourism area aspects outlined in Article 32 of Regional Regulation No. 6 of 2019. In conclusion, although the local government has carried out part of its authority, further optimization of tourism management and marketing is still needed. Therefore, the local government is expected to be more proactive in promoting tourism to enhance the attractiveness of TNBBS in the Tanggamus area.

Abstract

Abstract: According to General Explanation of Presidential Decree No. 1/PNPS/ 1965 on Prevention of Misuse and/or Blasphemy, there are six religions in Indonesia. There are Islam, Kristen, Katolik, Hindu, Budha, and Khong Cu (Confucius). It raises the issue of Indonesian who choose conscience or religions out of the six religions. One example is the Ahmadiyya Muslim Community who choose their conscience. Ahmadiyya Muslim Community often received public rejection and some limitations from the Government of Indonesia.  This paper aims to: (1) examine and analyze the international instrument about the limitation in the right to freedom of thought, conscience, and religion (Forum externum); (2) observe and value the limitation in the right to freedom of thought, conscience, and religion (Forum externum) in Indonesia (Ahmadiyya Muslim Community case). Deploying normative legal research, this research argues that the limitations in religious activities and sealing of several places of worship of the Ahmadiyya Muslim Community by the Government have a legal basis in the international law of externum forum principle and that- the Government limitation on religious activities of Ahmadiyya Muslim community is designed and applied to protect public safety, order, health, or morals or the fundamental rights and freedoms of others. Abstrak: Berdasarkan Penjelasan Umum Penetapan Presiden Republik Indonesia No. 1/PNPS/1965 tentang Pencegahan Penyalahgunaan dan/atau Penodaan Agama. Hanya Ada 6 agama di Indonesia yaitu Islam, Kristen, Katolik, Hindu, Budha dan Khonghucu (Confusius). Pembatasan enam agama tersebut menimbulkan persoalan mengenai bagaimana warga negara Indonesia yang memilih kepercayaan atau agama selain dari ke enam agama tersebut, seperti kelompok Muslim Ahmadiyya yang memiih kepercyaannya sendiri. Kelompok Muslim Ahmadiyya sering mendapatkan penolakan publik dan pembatasan-pembatasan dari Pemerintah Indonesia. Penelitian ini bertujuan untuk: (1) menguji dan menganalisis instrumen internasional mengenai pembatasan hak untuk berfikir, berkeyakinan dan beragama (forum eksternum); dan (2) mengamati dan menilai bagaimana implementasi hak untuk berfikir, berkeyakinan dan beragama (forum eksternum) di Indonesia (kasus Kelompok Muslim Ahmadiyya). Dengan pendekatan hukum normatif, penelitian ini membuktikan bahwa pembatasan-pembatasan dalam melakukan kegiatan keagamaan dan penyegelan beberapa tempat ibadah jemaah Ahmadiyya oleh Pemerintah memiliki basis hukum dalam hukum internasional yakni prisip forum eksternum dan pembatasan pemerintah terhadap kelompok Muslim Ahmadiyya diterapkan demi tercipta keselamatan, ketertiban, kesehatan, atau kesusilaan umum, atau hak-hak dan kebebasan-kebebasan mendasar milik orang lain.

Abstract

The Lebak Regency spatial planning plan was prepared based on Lebak Regency Regional Regulation Number 2 of 2014 concerning the Lebak Regency Regional Spatial Plan for 2014-2034 with the aim of creating a highly competitive and sustainable Regency regional space based on agriculture, plantations, tourism and mining. To realize this, spatial planning is needed based on the principles of spatial planning contained in Article 2 of Law Number 26 of 2007 concerning Spatial Planning. The research method used is the normative juridical method. The normative juridical method is defined as research on statutory rules, both from the perspective of the statutory hierarchy (vertical) and the harmonious relationship of legislation (horizontal). The purpose of this writing is to find out how the application of spatial planning principles in the Lebak Regency Spatial Planning Plan for Mining Activities in the Mount Liman Area is Reviewed Based on Law Number 26 of 2007 concerning Spatial Planning. Based on the results of the discussion, it can be concluded that the regional government has attempted to control spatial planning and supervision of illegal gold mining in Lebak Regency. Regulations for mining activities in Lebak Regency Regional Regulation Number 2 of 2014 concerning Lebak Regency Spatial Planning for 2014-2034. Article 64 paragraph (5) letter c does not allow mining in protected areas. However, there is a discrepancy in the application of spatial planning principles in the 2014-2034 Lebak Regency Regional Spatial Plan, namely consisting of the principle of integration, the principle of harmony, harmony and balance, the principle of sustainability, the principle of efficiency and effectiveness as well as the principle of legal certainty and justice. This is due to the determination of the Cirinten sub-district area as a mining area.

Abstract

Penelitian ini bertujuan untuk menganalisis kewenangan Pemerintah Kota Cilegon dalam mendukung masyarakat petani guna meningkatkan usaha pertanian di Desa Cibeber, Kecamatan Cibeber, Kota Cilegon, sesuai dengan Undang-Undang No. 19 Tahun 2013 tentang Perlindungan dan Pemberdayaan Petani. Selain itu, penelitian ini juga berfokus pada faktor-faktor yang menghambat maupun mendukung proses pemberdayaan petani di wilayah tersebut berdasarkan regulasi yang berlaku. Pendekatan yang digunakan dalam penelitian ini adalah yuridis empiris dengan analisis deskriptif. Teori yang melandasi kajian ini adalah Teori Kewenangan dan Tindakan Pemerintah. Data yang dikumpulkan mencakup data primer sebagai sumber utama, didukung oleh data sekunder. Teknik pengumpulan data dilakukan melalui penelitian lapangan dan studi pustaka, kemudian dianalisis secara deskriptif dengan metode kualitatif. Hasil penelitian menunjukkan bahwa Dinas Ketahanan Pangan dan Pertanian telah berupaya memberdayakan petani melalui perlindungan lahan serta penyuluhan pertanian sesuai dengan ketentuan perundang-undangan. Namun, kesimpulan penelitian mengindikasikan bahwa pemberdayaan petani di Desa Cibeber belum sepenuhnya optimal, karena masih terbatas pada aspek perlindungan lahan dan penyuluhan. Oleh karena itu, disarankan agar Pemerintah Daerah Kota Cilegon meningkatkan koordinasi antara penyuluh pertanian, dinas pertanian, dan kelompok tani. Selain itu, diperlukan komunikasi serta koordinasi yang lebih aktif dalam pengadaan sarana dan prasarana guna mendukung usaha pertanian masyarakat.

Abstract

This research is motivated by the problem of the effectiveness of the BKKBN Banten Province family planning program in realizing quality families in Serang City based on Law Number 52 of 2009 concerning Population Development and Family Development. The identification of the research problem is how effective is the BKKBN Banten Province KB program in efforts to realize quality families in Serang City? and what are the factors that influence the effectiveness of the BKKBN Banten Province KB program and solutions in facing obstacles to realizing quality families in Serang City. The theory used is the theory of legal effectiveness and the theory of the welfare state. The method used is empirical juridical, the research specifications used are descriptive qualitative. Using research data sources in the form of primary data and secondary data. Meanwhile, the data collection technique used in this study uses literature studies and field research. The data analysis used is a qualitative descriptive approach. The results of this study indicate that the family planning program from the BKKBN of Banten Province has been quite effective in realizing quality families in Serang City. The conclusion of this study is that the effectiveness of the KB program in realizing quality families in Serang City is quite effective, this is based on a review of the effectiveness of law from Soerjono Soekanto on five aspects of legal effectiveness, namely legal factors, law enforcement, facilities and infrastructure, society, and culture. However, it still faces obstacles in cultural factors and its society. In addition, the iBangga value in Serang City is 53.41, which indicates that Serang City is in the fairly good (developing) category. This study shows the role of the government in improving the welfare and quality of life of the community. In this case, in an effort to fulfill social services through the BKKBN Banten Province family planning program which aims to realize quality families in Serang City. The obstacles faced require improvements in the legal culture factor that needs to be improved with education and socialization in order to build awareness of the Serang City community about the importance of following the family planning program in realizing quality families in Serang City.

Abstract

Based on the Decree of the Governor of Banten Number 437/Kep.160-Huk/2018 concerning the Zoning Determination of the Cultural Heritage Area of the Sultanate of Banten (Banten Lama). The existence of this decision has brought Banten Tourism currently experiencing significant development, especially in the tourist area. This happened after the Banten Provincial government carried out tourism development. The government has a role to synergize tourism development with the function of protecting cultural heritage objects and the community environment around the cultural heritage area of the Banten Lama, to create sustainable tourism based on the preservation of cultural heritage objects as the core area of cultural heritage. The role of the government is crucial to regulate efforts to manage cultural heritage objects as a form of legal study for the protection of tourism resources and to preserve cultural heritage objects as heritage tourism attractions in the Banten Lama area by establishing a core area of 172.58 hectares and a buffer area of 754.36 hectares. Also, involving the community is a tourism resource that must maintain the quality of the tourism environment to create Sapta Pesona and Tourism Awareness to create a conducive climate for the protection of cultural heritage objects in the Banten Lama Tourism area

Abstract

the method of Istinbath is necessary to support the principle of Ultra Qui Judicat, enabling judges to possess moral characteristics in considering not only knowledge and reason but also Islamic law when making legal decisions. Overall, the significance of the Istinbath method in supporting the principle of Ultra Qui Judicat is paramount, especially in addressing contemporary and empirical issues not governed by legislative regulations. The aim of this research are : explain the concept of Istinbath and Ultra Qui Judicat influence the judge's decisions and the application of the Istinbath method used to reinforce the principle of Ultra Qui Judicat to judicial decisions. The result shows that The method of Istinbath is closely related to the principle of Ultra Qui Judicat since both share the same objective of achieving justice. In practice, judges can use the method of Istinbath to interpret the law and apply the principle of Ultra Qui Judicat in criminal cases. The principle of Ultra Qui Judicat and the method of Istinbath are essential instruments for judges in the criminal justice system to achieve justice in decision-making

Abstract

The study employs descriptive-analytical methods to examine the relevant laws and enforcement practices. It views the RESD as an emerging norm through a constructivist lens, influencing both the host countries and the global normative framework. The research finds a growing momentum to revise BIT clauses to better reflect dynamic RESD principles and social responsibility. This involves moving away from focusing solely on unilateral power. The study proposes a new model for RESD, aimed at promoting good governance and fairness in administrative processes. This model will be vital for renegotiating or redesigning BIT provisions, particularly for countries like Indonesia. By explaining the acronyms and simplifying the sentences, the key points become clearer: the need for a balanced approach in BIT negotiations, the role of RESD in this balance, and the potential for revised treaty clauses to better align with principles of social justice and fairness.

Abstract

Provinsi DKI Jakarta sebagai ibu kota negara termasuk ke dalam kota metropolitan karena dihuni oleh lebih dari 10 juta penduduk. Masalah yang ada di kota besar adalah pencemaran udara yang diakibatkan oleh kendaraan bermotor dan industri manufaktur. Pencemaran udara berdampak pada kesehatan masyarakat, menurut data dari WHO, pencemaran udara ambien bertanggung jawab atas 7,6% kematian global dan sekitar 7 juta kematian dini terjadi setiap tahun sebagai akibat dari kombinasi polusi udara dalam ruangan (rumah tangga) dan polusi ambien (luar ruangan), sebagian besar karena peningkatan kematian akibat stroke, penyakit jantung koroner, penyakit paru-paru, Penyakit Paru Obstruktif Kronik (PPOK), dan Infeksi Saluran Pernapasan Akut (ISPA). Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Sumber data yang digunakan dalam penelitian ini adalah data sekunder yang berasal dari buku, artikel, jurnal ilmiah dan literatur yang berhubungan dengan penelitian ini. Berdasarkan analisis yang dilakukan penulis mengenai upaya pemerintah Provinsi DKI Jakarta terhadap pengendalian pencemaran udara adalah dengan memberikan mandat pada Tim Kerja Pengendalian Pencemaran Udara melalui Keputusan Gubernur Nomor 576 Tahun 2023 tentang Strategi Pengendalian Pencemaran Udara untuk melaksanakan rencana aksi dalam pengendalian pencemaran udara. Hambatan yang terdapat dalam pelaksanaan pengendalian pencemaran udara ini adalah keputusan gubernur tersebut kurang komprehensif sehingga tidak menyentuh akar permasalahan dan kurangnya koordinasi dengan pemerintah pusat serta pemerintah daerah lain.
