Abstract

Perjanjian Pengikatan Jual Beli (PPJB) sering sekali digunakan pihak developer perumahan terlebih bagi mereka yang tanah yang dijadikan untuk perumahan belum lunas dilakukan peralihan dari pemilik asli tanah kepada pihak developer perumahan. Namun potensi masalah akan muncul mengenai adanya ancaman kepailitan yang dialami oleh pihak developer, mengingat bisnis perumahan merupakan salah satu bisnis yang memberikan keuntungan yang tinggi namun juga diiringi dengan resiko yang tinggi pula. Ketika devoleper perumahan mengalami proses kepailitan, maka akan berdampak kepada konsumen perumahan yang sudah terlanjur menjadi bagian dari proyek developer tersebut, terlebih banyak para konsumen ini hanya mendapatkan PPJB dari developer meskipun lunas dibayar dalam proses pembelian rumah dan tanah, maka penting melihat aspek perlindungan hukum pada permasalah ini. Metode penelitian yang digunakan adalah penelitian normatif dengan data sekunder. Hasil pembahasan yang didapat peneliti antara lain, pertama, kedudukan hukum PPJB dalam sistem hukum perdata Indonesia masih bersifat ambigu karena secara formil hanya dianggap sebagai perjanjian pendahuluan (voorovereenkomst) yang tidak mengalihkan hak milik, namun dalam praktik memiliki peran penting sebagai dasar transaksi properti. Walaupun sah dan mengikat berdasarkan asas kebebasan berkontrak dalam Pasal 1338 KUHPerdata, PPJB kerap menimbulkan ketidakseimbangan posisi antara developer dan konsumen, terlebih dalam pembagian budel pailit developer perumahan. Kedua, meskipun Mahkamah Agung melalui yurisprudensi terbaru mulai melindungi pembeli beritikad baik dengan mengeluarkan rumah dari boedel pailit, sifat yurisprudensi yang kasuistik belum menjamin kepastian hukum menyeluruh. Oleh karena itu, diperlukan pembaruan regulasi yang menegaskan hak konsumen atas rumah yang dibayar lunas agar perlindungan hukum lebih kuat dan kepastian hukum benar-benar terwujud.

Abstract

Abstract: The rapid property development in Indonesia is often followed by issues related to land rights abuse by developers, which harms consumers in property transactions. One of the main problems is the sale of land with unclear legal status or land under dispute, leading to the risk of consumers losing their property rights. This study aims to analyze the impact of land rights abuse by developers on consumer protection and the implementation of the Consumer Protection Law in improving dispute resolution mechanisms in cases of developer default. The study uses a normative legal research method with a descriptive-analytical approach, analyzing applicable regulations, legal principles, and relevant legal theories. Data was collected through library research using primary and secondary data sources and analyzed qualitatively. The results indicate that land rights abuse by developers significantly impacts consumers, both financially and psychologically. Developer defaults related to delays, discrepancies in property specifications, and land legal issues increase consumer distrust in the property sector. The implementation of the Consumer Protection Law through the Consumer Dispute Settlement Body (BPSK) can improve dispute resolution mechanisms, although challenges in consumer awareness and the enforcement of BPSK decisions still need to be addressed. Stronger law enforcement and improved transparency will enhance consumer protection. Keywords: Land Rights Abuse, Developer Default, Consumer Protection

Abstract

The app-based transportation sector, such as Gojek and Grab, has rapidly developed in Indonesia, yet it still faces significant challenges regarding the legal regulations governing the partnership between platform providers and driver partners. The lack of clear legal norms has led to uncertainty regarding the rights and obligations of both parties, which ultimately reduces legal protection for both drivers and consumers. This study aims to analyze how Indonesia's legal system regulates this partnership and evaluate the extent to which existing regulations provide adequate protection for drivers and consumers. The main research questions address how Indonesia's legal system governs partnerships in this sector and to what extent the regulations support the principle of justice. The research method used is normative legal research, employing legislative, conceptual, and theoretical approaches. The findings show that Indonesia's legal system has not provided sufficient legal certainty in these partnerships. Protection for both drivers and consumers remain limited, particularly regarding labor rights and dispute resolution mechanisms. This study suggests the need for clearer and more detailed regulatory reforms to create a more equitable and transparent relationship between companies, drivers, and consumers.

Abstract

This research is motivated by the need to adjust online transportation regulations in Indonesia with technological developments and rapidly changing societal dynamics. The main issue raised is how the regulatory framework of online transportation in Indonesia is and how it compares to several ASEAN member countries. The discussion shows that regulations in Indonesia still use a conventional approach that is less adaptive to online transportation innovation, often causing legal vacuums and uncertainty for stakeholders. The conclusion of this study states that existing regulations need to be updated to be more comprehensive and responsive to changes. The advice given is that the government should adopt best practices from other ASEAN countries to create more effective regulations, including paying attention to fairness, safety, and welfare aspects for both users and service providers.

Abstract

The development of religious courts to address Sharia economic cases in Indonesia is considered a historic moment by many parties. However, efforts to improve the quality of resolving Sharia economic issues in religious courts have become increasingly important. This aims to enhance the trust of legal seekers, especially in Sharia economic disputes, towards dispute resolution through the alternative path faced through religious courts. The research was conducted using normative research methods and the analysis used was qualitative. The results show that religious courts in Indonesia have absolute jurisdiction in handling Sharia economic cases. Although the number of cases is increasing, the expansion of this authority challenges all elements of religious courts, including employees and judges. Despite the efforts of guidance carried out by the Supreme Court (Mahkamah Agung) in this case implemented by the Directorate General of Religious Courts, there are still several obstacles, such as the lack of harmony in laws related to Sharia economic matters. Then there are other factors influencing the quality of problem handling, namely the dualism of judicial institutions, namely Religious Courts as well as General Courts. The dualism of dispute resolution after the issuance of the Constitutional Court Decision Number 93/PUU-X/2012 remains a barrier, so the public has not fully been able to trust religious courts in the context of handling Sharia economic problems. Submission to the Consumer Dispute Settlement Board (BPSK) and agreements in contracts to use General Courts as a forum for resolving Sharia economic disputes reflect distrust in religious courts. Therefore, concrete steps are needed to overcome these barriers and increase public trust in religious courts to resolve Sharia economic problems.

Abstract

The development of hire-purchase agreements in Indonesia has shown a significant increase; however, the bargaining position of consumers remains weaker than that of business operators, resulting in contractual imbalances, particularly in standard clauses that disadvantage consumers. This article examines the legal protection of consumers in hire-purchase agreements under Indonesian civil law and its practical implications. The research addresses two main questions: how consumer legal protection is regulated in hire-purchase agreements under Indonesian civil law, and what shortcomings exist in protecting consumers against unfair standard clauses. Using a normative legal research method with a literature study and qualitative analysis of relevant legal regulations, this study finds that although civil law upholds the principle of freedom of contract, consumer protection remains inadequate in practice. The most frequent violations of consumer rights are found in standard clauses that unilaterally shift risks to consumers, limit or exclude the liability of business operators, impose disproportionate penalties in cases of default, and restrict consumers’ rights to dispute resolution. These practices significantly weaken consumers’ legal position in hire-purchase agreements. Therefore, stricter supervision of standard clauses is necessary, along with more specific and clearer regulations to prevent abusive contractual practices. This study recommends strengthening regulatory frameworks to balance the bargaining position between consumers and business operators and enforcing stricter oversight of standard clauses in hire-purchase agreements.
