Abstract

Penelitian ini membahas kepastian hukum kewenangan Mahkamah Konstitusi dalam menetapkan norma baru yang berkaitan dengan Putusan Mahkamah Konstitusi Nomor 90/PUU-XXI/2023. Permasalahan utama dalam penelitian ini adalah akibat hukum putusan tersebut terhadap kewenangan legislasi serta kepastian hukum kewenangan Mahkamah Konstitusi dalam menjalankan fungsi pengujian undang-undang. Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Bahan hukum yang digunakan terdiri atas bahan hukum primer, sekunder, dan tersier yang dianalisis secara kualitatif normatif melalui interpretasi sistematis, argumentatif, dan preskriptif. Hasil penelitian menunjukkan bahwa Putusan MK Nomor 90/PUU-XXI/2023 menimbulkan akibat hukum berupa perubahan makna Pasal 169 huruf q Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Putusan tersebut tidak hanya menafsirkan norma, tetapi juga membentuk syarat alternatif mengenai pencalonan presiden dan wakil presiden. Kondisi ini menimbulkan perdebatan karena Mahkamah Konstitusi dinilai bergerak dari fungsi negative legislator menuju kecenderungan sebagai positive legislator. Dengan demikian, putusan tersebut memberikan kepastian hukum secara praktis, tetapi sekaligus menimbulkan persoalan kepastian hukum kelembagaan mengenai batas kewenangan Mahkamah Konstitusi dan pembentuk undang-undang.

Abstract

Purpose: This study examines the legal implications of the dismissal of Indonesian National Armed Forces (TNI) soldiers, particularly when a Military Court's review decision revokes the dismissal penalty. It explores whether soldiers, once dismissed for legal violations, should be entitled to reinstatement if the dismissal penalty is nullified. Research Methodology: The research uses a qualitative approach with document studies and interviews. Document studies analyze legal documents, court rulings, and administrative regulations, while interviews involve legal experts, TNI personnel, and stakeholders in military law. Results: The findings suggest that the revocation of the dismissal penalty in a review decision can be considered a novum (new legal fact), nullifying the legal basis for the dismissal. As a result, the dismissal becomes invalid, and the soldier may be entitled to apply for reinstatement in the military. Conclusions: The study concludes that soldiers whose dismissals are revoked in a review decision should have the right to seek reinstatement. However, current regulations do not provide for such a provision, highlighting the need for regulatory changes to accommodate this right. Limitations: The study is limited by the availability of relevant legal cases and the absence of administrative regulations on reinstating dismissed soldiers. Further research may be needed to explore broader implications for TNI personnel. Contributions: This research contributes to the understanding of legal processes regarding military personnel, offering recommendations for policy reforms in military justice and personnel management.

Abstract

his research aims to analyze the legal politics of appointing Indonesian National Armed Forces (TNI) personnel to State Civil Apparatus (ASN) positions and the resulting legal implications. The study is grounded in recent regulatory developments, namely Law Number 20 of 2023 concerning the State Civil Apparatus and Law Number 3 of 2025 amending Law Number 34 of 2004 concerning the TNI, which allow active military personnel to occupy civil positions but spark debates regarding their compatibility with principles of civilian supremacy, military professionalism, bureaucratic neutrality, and the merit-based system. This study employs a normative legal research method using statutory, case, analytical, and conceptual approaches. Analysis is conducted using Legal Politics Theory and Legal Harmonization Theory. The findings reveal that legal policy has shifted from a strictly restrictive model to an accommodative-restrictive model. Nevertheless, placement practices beyond legal provisions result in weakened neutrality, accountability, TNI professionalism, and ASN meritocracy, as well as legal disharmony. Consistent implementation of regulations and legal harmonization are necessary to maintain a balance between defense interests and civil bureaucratic professionalism.

Abstract

Penelitian ini mengkaji kepastian hukum penyelesaian target restorasi gambut dan mangrove pasca berakhirnya masa tugas Badan Restorasi Gambut dan Mangrove (BRGM) pada 31 Desember 2024. BRGM merupakan lembaga nonstruktural yang dibentuk melalui Peraturan Presiden Nomor 120 Tahun 2020 dengan mandat merehabilitasi 1.200.000 hektar lahan gambut dan 600.000 hektar mangrove. Rumusan masalah penelitian ini adalah: (1) bagaimana kedudukan hukum dan implikasi kelembagaan setelah berakhirnya masa tugas BRGM terhadap penyelesaian target restorasi gambut dan mangrove; dan (2) bagaimana kepastian hukum negara dalam menjamin penyelesaian target restorasi gambut dan mangrove pasca berakhirnya masa tugas BRGM. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan analitis. Hasil penelitian menunjukkan bahwa berakhirnya masa tugas BRGM menimbulkan persoalan kepastian hukum karena Pasal 34 Perpres 120/2020 hanya mengatur pengalihan kewenangan secara umum tanpa mekanisme koordinasi yang rinci. Pengalihan fungsi restorasi kepada Kementerian Kehutanan, Kementerian Lingkungan Hidup/BPLH, dan Kementerian Kelautan dan Perikanan berpotensi menimbulkan fragmentasi kewenangan dan inkonsistensi pelaksanaan restorasi. Kepastian hukum negara dalam menjamin penyelesaian target restorasi belum sepenuhnya optimal karena lemahnya desain koordinasi kelembagaan, kekosongan normatif mekanisme transisi, dan minimnya jaminan keberlanjutan pendanaan. Diperlukan penguatan regulasi yang memuat mekanisme koordinasi nasional, penetapan lembaga koordinator, serta sistem pengawasan terpadu.

Abstract

This research examines the legal liability of shareholders who refuse to contribute capital when a company increases its capital, potentially disrupting the company's financial stability and harming creditors and third parties. Using normative juridical research with statutory and conceptual approaches, this study analyzes the legal construction of capital contribution obligations and the forms of legal accountability. The findings indicate that the obligation to contribute capital is essentially a right that shareholders may exercise, yet under certain circumstances it may give rise to legal liability when performed in bad faith and causing harm to the company. Refusal to contribute capital not only results in share dilution but may also trigger legal accountability, including exceptions to limited liability through the piercing the corporate veil doctrine. Therefore, it is necessary to strengthen regulations in the articles of association and shareholders' agreements to prevent disputes and ensure legal certainty.

Abstract

Today, many different narcotics, psychotropics, and other illegal drugs emerged. These new variants are not/have not been regulated by law number 35 of 2009 concerning narcotics. This research uses Normative Juridical methodology. The data used for the formulation of the problem is secondary data consisting of primary, secondary and tertiary legal documents. The results of the analysis show that in order to implement the provisions of Article 6 paragraph (3) of the Narcotics Law, it is necessary to stipulate a Regulation of the Minister of Health concerning Changes in the Classification of Narcotics, which is the last position where this research was written. Minister of Health of the Republic of Indonesia Number 4 of 2021 concerning changes to the classification of narcotics. Law Number 35 of 2009 concerning Narcotics and Regulation of the Minister of Health of the Republic of Indonesia Number 4 of 2021 concerning changes to the classification of narcotics which are guidelines for law enforcement against drug abuse with new variants in Indonesia are still deemed ineffective and efficient and do not accommodate all needs -the need for law enforcement against narcotics abuse, especially narcotics with new types of variants. An alternative policy formulation to Law Number 35 of 2009 concerning Narcotics, the formulation policy that is deemed suitable for implementation in the future is to revise Law Number 35 of 2009 concerning Narcotics in particular to expand the meaning related to narcotics in the provisions of Article 1 number 1 and/or Article 6 paragraph (1).

Abstract

Online gambling has become increasingly prevalent over a long time due to the ease of access and the ability to play from anywhere with an online association. The reason for this consideration is to look at and analyze the legal provisions against online gambling offenders in Indonesia. The research method used in this study can be a normative legal approach supported by experimental law with graphic depiction. In extension, important information is also used as supporting material for additional information. For control checks, legitimate and standardized check strategies are used. From the search results regarding the legal provisions against the perpetrators of online betting violations in Indonesia, it appears that the legal authority against online betting violations is the criminal sanction against online betting based on Article 45 of Law Number 11 of 2008 concerning Electronic Information and Transactions, but the punishment for the perpetrators is lower than the threat of criminal sanctions in Article 303 of the Criminal Code, so it does not have an inhibiting impact on the perpetrators of online betting violations. Criminal liability for online betting offenses in Indonesia is the responsibility of the perpetrators of online betting offenses indicated by the existence of criminal offense components. In addition, the activity component is one of the most important components in criminal liability, because a person cannot be sentenced if he does not commit an act that is classified as an act rejected by the law.

Abstract

This research is motivated by the limited legislative authority of the Regional Representative Council (DPD) in the formulation of the Archipelagic Regions Bill, which is constitutionally participatory rather than decisional in nature. Although the DPD possesses representative legitimacy as a regional chamber and is authorized to propose and deliberate bills related to regional matters, final legislative approval remains vested in the House of Representatives and the President. This condition creates a gap between regional representation and the effectiveness of the DPD in advocating for the interests of archipelagic regions. This study employs the theory of authority and the theory of distributive justice as its theoretical framework. This research adopts a normative legal research method using statutory, conceptual, and analytical approaches. The statutory approach examines constitutional provisions and legislation governing the legislative authority of the DPD. The conceptual approach explores doctrines of authority and the theory of distributive justice, particularly in assessing the allocation of legal benefits and burdens affecting archipelagic regions, while the analytical approach evaluates the consistency between existing legal norms and the practical exercise of the DPD’s legislative authority in the formulation of the Archipelagic Regions Bill. The findings indicate that the legislative authority of the DPD in the formulation of the Archipelagic Regions Bill is normative, procedural, and symbolic, lacking binding decisional power. These limitations have resulted in an uneven realization of distributive justice for archipelagic regions within the national legal framework. This study concludes that an ideal construction of the DPD’s legislative authority requires strengthening its role during deliberative stages, restructuring more effective coordination mechanisms with the House of Representatives, and optimizing its oversight function to ensure that the enactment and implementation of the Archipelagic Regions Law effectively realize distributive justice for archipelagic regions

Abstract

The rapid development of digital payment systems through Payment Service Provider (PJP) companies has significantly enhanced transaction efficiency; however, it has also created legal issues related to the misuse of payment channels for illegal activities such as money laundering, online fraud, and illegal gambling. The central legal problem concerns the unclear boundaries of legal liability imposed upon PJPs when their payment channels are misused by merchants or users. This research applies the theory of legal certainty and the theory of legal liability to assess the extent to which Indonesian positive law regulates the scope of obligations, fault, and liability of PJPs within the digital payment ecosystem. This study employs normative legal research using statute approach, conceptual approach, analytical approach, and comparative approach. The legal materials consist of primary legal sources including legislation governing payment systems, anti-money laundering, and information technology, as well as secondary legal materials derived from legal doctrines and scholarly writings. Data collection was conducted through library research and analyzed qualitatively using grammatical and systematic interpretation methods. The findings indicate that Indonesian positive law does not yet provide clear and definitive limitations regarding PJP liability, resulting in legal uncertainty and potential over-criminalization. In principle, PJPs cannot be held criminally liable in the absence of intent, gross negligence, or participation in unlawful acts. The liability of PJPs is more appropriately positioned within the administrative and risk-based compliance framework, including the obligation to implement prudential principles, Know Your Customer (KYC), and Anti-Money Laundering and Counter-Terrorism Financing (AML/CFT) measures. Accordingly, more comprehensive regulatory clarification is required to ensure legal certainty, protect the digital payment industry, and strengthen the effectiveness of preventing financial cybercrime
