Abstract

This article examines how state territorial regulation can encourage development in Indonesia's border regions. This article also tries to explain the need for better management of borders between countries because there are several obstacles in implementing cross-border regulations. This research uses qualitative methods by taking the perspective of international law and constitutional law and collecting data through field research and reviewing related literature. Field research was carried out for 3 months by conducting in-depth interviews with several informants. Secondary data was obtained from reviewing books, journals, writings and mass media regarding international law, international relations and constitutional law. This research shows that the idea of ​​reforming border management between countries must be based on several aspects, namely law, institutions, development approaches and spatial planning. Abstract

 Abstract  This research aims to describe and analyze the implementation of coordination between the Prosecutor's Office and the Government Internal Monitoring Apparatus (APIP) in handling reports or complaints about government administration, especially in Pontianak City as well as obstacles in handling and efforts to overcome these obstacles.Research is divided into two, namely normative legal research and sociological or empirical legal research. Data analysis was carried out using descriptive juridical and qualitative methods, which were carried out according to the information or data obtained when the research was carried out, then processed and applied as a tool for analysis and discussion of research results.The results of the research found that APIP will only submit the Audit Results Report and Minutes files to the Pontianak District Prosecutor's Office if there is a failure to recover state financial losses by government officials in Pontianak City. Factors inhibiting coordination between the Pontianak District Prosecutor's Office and APIP come from regulatory factors, APIP's role will be hampered by its position as a subordinate to the Regional Head as well as the minimal amount of evidence and evidence attached by the reporter as well as the limited number and ability to carry out investigative audits. Optimizing coordination between APIP and the Pontianak District Prosecutor's Office is carried out in accordance with the scope of duties and authorities held individually or jointly.  Keywords: Coordination; Complaint; Government Administrator; Report  Abstrak  Penelitian ini bertujuan menguraikan dan menganalisis pelaksanaan koordinasi antara Kejaksaan dengan APIP dalam menangani penanganan laporan atau pengaduan penyelenggaraan pemerintah, khususnya di Kota Pontianak serta hambatan dalam penanganan dan upaya mengatasi hambatan tersebut.Penelitian terbagi menjadi dua yaitu penelitian hukum normatif dan penelitian hukum sosiologis atau empiris. Analisa data dilakukan dengan metode deskriptif yuridis dan kualitatif, yang dilakukan sesuai informasi atau data yang diperoleh pada saat penelitian dilakukan, kemudian diolah dan diaplikasikan sebagai alat analisis dan pembahasan hasil penelitian.Hasil penelitian menemukan bahwa APIP baru akan menyerahkan berkas Laporan Hasil Pemeriksaan dan Berita Acara kepada Kejari Pontianak bila terjadi kegagalan pengembalian kerugian keuangan negara oleh penyelenggara pemerintah di Kota Pontianak. Faktor penghambat koordinasi antara Kejari Pontianak dan APIP berasal dari faktor regulasi, peran APIP akan terbentur dengan posisinya sebagai bawahan Kepala Daerah serta minimnya jumlah alat bukti dan barang bukti yang dilampirkan pelapor serta terbatasnya jumlah dan kemampuan dalam melakukan audit investigatif. Optimalisiasi koordinasi APIP maupun Kejari Pontianak dilakukan sesuai lingkup tugas dan kewenangan yang dimiliki masing-masing maupun secara bersama.

Abstract

Tujuan dari penelitian ini adalah untuk mendeskripsikan serta menganalisis faktor pendorong dan faktor penghambat pelaksanaan program Kartu Identitas Anak (KIA) sesuai dengan Peraturan Menteri Dalam Negeri Nomor 2 Tahun 2016 di wilayah Kabupaten Kapuas Hulu. Penelitian ini menggunakan jenis penelitian yuridis empiris dengan sifat penelitian deskriptif, cara pengumpulan data dengan melakukan observasi, wawancara, dan studi dokumen, serta teknik analisis datanya menggunakan teknik kuantitatif. Hasil dari penelitian ini ialah kepemilikan Kartu Identitas Anak (KIA) bagi anak di Kabupaten Kapuas Hulu sudah mencapai 70%, namun dalam penerapannya masih terdapat kendala-kendala seperti kurangnya informasi yang didapatkan masyarakat, kurangnya pemahaman masyarakat, kurangnya dukungan & koordinasi antar instansi, serta wilayah kabupaten Kapuas Hulu yang luas dan sulit dijangkau menjadi kendala-kendala dalam pengimplementasiannya. Selain itu, kemanfaatan yang dirasakan masyarakat dengan adanya Kartu Identitas Anak masih kurang. Saran dari penulis adalah Pemerintah diharapkan untuk mengkaji kembali terkait dengan program Kartu Identitas Anak ini terlebih kemanfaatan dan kegunaannya agar program ini dapat berjalan dengan efektif, serta perlu ditingkatkan kembali sosialisasi kepada masyarakat agar masyarakat mengetahui dan mengerti tentang program Kartu Identitas Anak (KIA).

Abstract

Abstract  In this thesis, raises the issue of the implementation of the provisions of Article 15 Paragraph (1) of Pontianak Mayor Regulation Number 6 of 2019 concerning Reducing the Use of Plastic Bags (Study of Modern Retail Business Actors in Pontianak City). This thesis aims to find out the implementation of the provisions of Article 15 Paragraph (1) of the Pontianak Mayor Regulation Number 6 of 2019, the obstacles faced by modern retail business actors in Pontianak City and the role and efforts made by the Environmental Service in implementing these regulations.In this study, the method used is an empirical method with a descriptive analysis approach. Collecting legal materials through interviews, observations, questionnaires, and literature studies. Based on the research conducted by the author, the results and conclusions are obtained: first, Article 15 Paragraph (1) of the Pontianak Mayor Regulation Number 6 of 2019 concerning Reducing the Use of Plastic Bags in Pontianak City as a whole has not been going well as it should. There are still some modern retailers in Pontianak City experiencing obstacles in implementing this Mayoral Regulation, including many consumers who complain and protest, the lack of consumer interest in bringing their own shopping bags so that it becomes one of the considerations for modern retailers not to provide plastic bags and the difficulty of raising consumer awareness in carrying your own shopping bag. Second, the Pontianak City Environment Service has carried out its role properly and has made efforts that are also in accordance with the responsibilities it carries, but it is not quite optimal because it experiences several obstacles in implementing this mayoral regulation, especially in terms of human resource instruments which are still very limited. Efforts that have been made include putting up banners and giving appeals to stakeholders in each retailer.Keywords: Regulation Implementation, Mayor, Modern Retail.    Abstrak  Pada skripsi ini, penulis mengangkat permasalahan Implementasi Ketentuan Pasal 15 Ayat (1) Peraturan Walikota Pontianak Nomor 6 Tahun 2019 Tentang Pengurangan Penggunaan Kantong Plastik (Studi Terhadap Pelaku Usaha Ritel Modern Di Kota Pontianak). Skripsi ini bertujuan untuk mengetahui bagaimana implementasi ketentuan Pasal 15 Ayat (1) Peraturan Walikota Pontianak Nomor 6 Tahun 2019, mengetahui kendala-kendala yang dihadapi oleh pelaku usaha ritel modern yang ada di Kota Pontianak dan mengetahui peran dan upaya yang dilakukan oleh Dinas Lingkungan Hidup dalam menerapkan peraturan tersebut.Dalam penelitian ini metode yang penulis gunakan adalah metode empiris dengan pendekatan deskriptif analisis. Pengumpulan bahan hukum melalui wawancara, observasi, kuisioner, dan studi kepustakaan. Berdasarkan penelitian yang dilakukan oleh penulis, diperoleh hasil dan kesimpulan: pertama, Pasal 15 Ayat (1) Peraturan Walikota Pontianak Nomor 6 Tahun 2019 tentang Pengurangan Penggunaan Kantong Plastik di Kota Pontianak secara keseluruhan memang belum berjalan dengan baik sebagaimana mestinya. Masih ada beberapa ritel modern di Kota Pontianak mengalami kendala-kendala dalam menerapkan Peraturan Walikota ini, diantaranya yaitu konsumen banyak yang mengeluh dan protes, kurangnya minat konsumen untuk membawa tas belanja sendiri sehingga menjadi salah satu pertimbangan ritel modern untuk tidak menyediakan kantong plastik dan susahnya untuk menumbuhkan kesadaran konsumen agar membawa tas belanja sendiri. Namun secara perlahan pastinya akan terus berkembang kearah yang positif yang nantinya akan menjadi kabar yang menggembirakan apabila dapat berjalan dengan sebagaimana mestinya berdasarkan peraturan yang ada. Kedua, Dinas Lingkungan Hidup Kota Pontianak telah melakukan peran dengan sebagaimana mestinya dan telah melakukan upaya yang juga sesuai dengan tanggung jawab yang diemban , namun memang belum cukup maksimal karena mengalami beberapa kendala dalam menerapkan peraturan walikota ini terutama dalam hal instrumen sumber daya manusia yang masih sangat kurang. Upaya yang telah dilakukan diantaranya adalah melakukan himbauan kepada stakeholder dimasing-masing ritel dan memasang banner di pusat-pusat perbelanjaan.Kata Kunci: Implementasi Peraturan, Walikota, Ritel Modern.

Abstract

The Indonesian Government is currently in the process of developing several new ports in its territory as a means of supporting infrastructure development and maritime connectivity. One of them is the Development of the Kijing Terminal Port in the Province of West Kalimantan. It is important to study international and national legal regulations related to ports and how they affect the development of Tanjungpura Port, Kijing Terminal, which will be directed to become one of the international hub ports in Indonesia. The research methodology employed in this study is normative, with in-concreto legal study approach. It is found that, the consequence of the status of the "international hub" is that it is necessary to ensure that the best international port management and regulatory systems can be implemented at Tanjungpura Port, Kijing Terminal. The development plan for the Kijing Terminal Area to support increased regional competitiveness includes the construction of a Bauxite Smelter, the construction of the Kijing Industrial area, the construction of the Kijing Special Economic Zone (SEZ), the construction of a nuclear power plant to meet community and industry needs, the construction of the Pontianak - Sei Pinyuh, Sei Toll Road route Pinyuh – Mempawah, Mempawah – Kijing, Kijing – Singkawang, the construction of the Trans Kalbar Railway Road to increase ease of access and the establishment of the PT EUP refinery in Kijing. Several inputs that need to be considered so that Tanjungpura Port Governance can be carried out efficiently include repositioning the Government's role in the management and development of the Port with a focus on supporting market mechanisms and fair competition. In addition, related parties need to stipulate a Minister of Transportation Regulation on Ship Security Management and Port Facilities to provide a reference regarding the implementation of the ISPS Code or International Provisions for Ship Security and Port Facilities.
