Abstract

Execution is the creditor's ultimate step. If the debtor fails to comply with the conditions of Law No.4 of 1996 respecting Mortgage Rights over Land and Related Objects, an auction or execution may be held. The fundamental challenge in this study is how to conduct an auction of mortgage rights on property as collateral for debt repayment. What are the hurdles to auctioning mortgage rights on land as collateral for debt repayment? This research is classed under Survey or Empirical Law. Meanwhile, the character of this study is descriptive. The research focuses on auction implementation at Bank BPR Wonogiri and BKK Wonogiri. The results of this research is that the auction process carried out by Bank BPR Wonogiri, if the debtor is in default, is carried out at a public auction through the State Property and Auction Service Office or by selling privately. Auctioning mortgage rights is a bit hampered because in the current situation it is difficult to find buyers and auctions are lacking. The findings of this study indicate that if a debtor is in default, Bank BPR Wonogiri conducts a public auction through the State Property and Auction Service Office or sells privately. Auctioning mortgage rights is complicated by the existing difficulty in finding purchasers and the scarcity of auctions.  The obstacles faced were that when executing the promise, it did not work effectively, there was a third lawsuit, the binding of the mortgage was not carried out perfectly, interference from third parties during the execution and disagreements regarding the auction price between the debtor and the auction official.

Abstract

This research explores the obligations of Electronic System Providers in protecting the personal data of consumers in electronic services during digital transactions in e-commerce, particularly in the applications Akulaku, Lazada, and Tokopedia. In the field of digital economic transactions, the significance of personal data is increasing, driven by the widespread use of big data. Although the digital economy undoubtedly contributes to overall economic growth, consumer data protection is still inadequately addressed, leading to concerns about numerous data breach cases. This research analyzes the extent to which these three platforms fulfill their legal obligations. The issues are examined through the lens of legal certainty, utilizing a normative juridical method focused on the analysis of legislation, legal norms, and often-used legal principles. Compliance of electronic service providers is reflected in the privacy policies and usage regulations implemented by each platform. Additionally, non-compliance with these obligations results in administrative sanctions. Proactive efforts such as improving security systems, community training, and the involvement of certification institutions are also focal points in minimizing the risks of data breaches. It is crucial to continually monitor the developments in data protection practices on these platforms, given their dynamic nature, and ensure that regulations and policies remain up-to-date. Thus, the results of this research provide insights into the extent to which e-commerce electronic service providers have fulfilled their obligations in protecting consumer personal data.

Abstract

Digital transformation presents significant challenges in safeguarding the personal data of banking customers, particularly when banks collect and manage extensive personal information without ensuring adequate protection. This study examines the implementation of the accountability principle by personal data controllers within the banking sector. The objective is to assess how far this principle has been integrated into the obligations stipulated by data protection regulations. Using a qualitative legal research method combined with a comparative approach, this study analyzes the Personal Data Protection Law (PDPL) in Indonesia and the General Data Protection Regulation (GDPR) in Sweden. The findings reveal that Indonesia’s PDPL still demonstrates several deficiencies, including limited data leakage notifications, lack of transparency in third-party data disclosure, insufficient information technology security responses, and inefficient data updates. Similarly, under the GDPR framework, challenges persist in managing data shared with third parties and in providing timely written notices in cases of data breaches. The study concludes that the weaknesses identified in both jurisdictions highlight the need for strengthening the accountability principle to enhance the effectiveness of personal data protection in the banking sector. Reinforcing this principle will ensure greater responsibility among data controllers and foster public trust in digital financial systems.
