Abstract

Saat ini, perdagangan online menjadi familiar bagi usaha bisnis masyarakat karena dapat memperluas cakupan bisnisnya. Di sisi lain, perdagangan online juga dimanfaatkan oleh beberapa orang sebagai platform untuk menjual obat-obat psikotropika. Penelitian ini legal normatif dengan pendekatan legal (pendekatan statuta) dan pendekatan kasus. Penelitian ini menjelaskan fakta perdagangan obat-obatan psikotropika yang tidak sejalan dengan hukum dan membahas aspek legalitas penjualan obat psikotropika secara online. Hasil penelitian bahwa peraturan perundang undang tentang psikotropika masih belum memenuhi kebutuhan hukum yang muncul akibat dari perkembangan transaksi online terutama terkait penjualan psikotropika secara online. Perlu melakukan pembaharuan hukum dengan cara melanjutkan amandemen dan mengesahkan RUU tentang Pengawasan Obat dan Makanan yang prosesnya terhenti di tahun 2019, dalam rangka pengendalian secara hukum penggunaan pasar online (marketplace) secara illegal untuk menjual obat-obatan psikotropika

Abstract

The government expects all health workers to be able to provide optimal quality health services without being forced into carrying out their duties and responsibilities, both in government and private hospital service facilities, independent clinics, and independent practice. When the general practitioner is unable to attend on a predetermined schedule, the replacement of medical services is replaced by an internship doctor. This study aims to analyze the legal norms and responsibilities of general practitioners who provide delegation to substitute doctors who are still with internsip program status if medical negligence occurs at an independent clinic. The research method used normative juridical with a conceptual and legal approach. There is still a void in the legal norms in the legislation regarding the duties and roles of internship doctors in replacing medical services in independent clinics. The responsibility of a general practitioner who delegates duties to a substitute doctor who is still in the internship program status is mandatory. Thus, if medical negligence occurs at an independent clinic caused by medical services performed by an internsip doctor, the general practitioner will also be responsible administratively, civilly, or criminally.

Abstract

Medical records in hospitals are data for compiling health information and every health service and every health service, whether providing outpatient or inpatient services, is required to make a medical record and sanctions are imposed for those who violate it in accordance with applicable laws and regulations. The aim of this research is to analyze the norms for storing and destroying manual medical record documents and to analyze the legal responsibility of hospitals for storing electronic medical records in hospitals. The type of research used in this research is legal research. This type of research is carried out by examining legal norms in applicable laws and regulations related to guidelines and codes of ethics for a profession, especially in this case, medical laboratory technology experts in providing health services. Specifically, the type of research is normative juridical or doctrinal research. The findings of this research are that the legal responsibility of hospitals for storing electronic medical records in hospitals has been regulated by Minister of Health Regulation No. 24 of 2022, while the responsibility of hospitals in implementing electronic medical records is also outlined in the Ministry of Health in the form of ministerial supervision through the director general. If deviations occur, administrative sanctions will be given in the form of a warning or revocation of accreditation status.

Abstract

Health is a human right that must be realized in accordance with Pancasila and the 1945 Constitution. BPJS patients have the right to get good health services and medicines according to their diseases, including heart disease. The administration of drugs in the National Health Insurance (JKN) program must be in accordance with the National Formulary (Fornas). There are rules regarding drug restrictions in Fornas that cause problems in outpatient services for BPJS patients with heart disease. The purpose of this research is to analyze the legal protection of patients and the hospital's responsibility for drug restrictions. Research Methods: The type used in this study is normative juridical with a statute approach and a conceptual approach. Collection and processing of legal materials using document studies or library materials with added literature, journals and expert opinions related to legal issues and then read, studied and analyzed to arrive at a conclusion. Results: Legal protection for BPJS patients with heart disease is contained in the 1945 Constitution and the Law on Health in 2023. The hospital is also responsible for BPJS patients to get medicines according to medical examination. Conclusion: BPJS patients with heart disease have legal protection to get optimal therapy and the hospital is responsible for administering restricted heart drugs so that patients get therapy according to the guidelines.

Abstract

Covid-19 is a virus originating from Wuhan, China, which has spread throughout almost the world. In Indonesia, the virus spread began on March 2, 2020, allegedly starting from an Indonesian citizen who had direct contact with a foreign citizen from Japan. Over time, the spread of Covid-19 has experienced a significant increase. Due to the delay in anticipating and handling Covid-19 by the government, the government did not immediately determine the status of handling Covid-19, so the flow of coordination between the central government and regional governments became unclear in handling the substance, and technical aspects of Covid-19 in the Central Government and Regional governments experience overlapping authorities because there are arrangements in several laws that contradict each other and are not in harmony between the Central Government, Regional Governments and Duties and National Disaster Management Agency (Badan Nasional Penanggulangan Bencana/BNPB) so as to allow for the handling of the Covid-19 disaster. Thus, it is important to study whether the government’s authority central and regional governments under the control of Covid-19 have been and are in accordance with the structure, duties, functions, as well as applicable regulations and the extent to which the consequences are due to the overlapping of central and regional authorities in the grip of the Covid-19 pandemic and how to deal with it. Abstrak Covid-19 merupakan virus yang berasal dari Wuhan, China yang menyebar di hampir seluruh dunia Di Indonesia Penyebaran virus ini dimulai sejak tanggal 02 Maret 2020, diduga berawal dari salah satu warga negara Indonesia yang melakukan kontak langsung dengan warga negara asing yang berasal dari Jepang. Seiring dengan berjalannya waktu, penyebaran Covid-19 telah mengalami peningkatan yang signifikan. Meningkatnya kasus Covid-19 salah satunya disebabkan Karena adanya Keterlambatan antisipasi dan penanganan Covid-19 oleh pemerintah, pemerintah tidak segera menentukan status penanganan Covid-19 sehingga alur koordinasi antara pemerintah pusat dan pemerintah daerah menjadi tidak jelas Dalam penanganan substansi dan teknis Covid-19 di lapangan Pemerintah Pusat dan pemerintah daerah mengalami tumpang tindih kewenangan karena ada pengaturan di dalam beberapa Undang- Undang yang saling bertolak belakang dan tidak harmoni antara Pemerintah Pusat, Pemerintah daerah dan gugus Tugas serta Badan Nasional Penanggulangan Bencana (BNPB) sehingga berpotensi memperpanjang birokrasi penanggulangan bencana Covid-19. Dengan demikian, penting untuk dikaji adalah Apakah kewenangan pemerintah pusat dan daerah dalam menangani Covid-19 telah efektif dan sesuai dengan struktur, tugas, fungsi, serta peraturan-peraturan yang berlaku serta Sejauh mana akibat yang ditimbulkan karena adanya Tumpah Tindih kewenangan Pusat dan daerah dalam menangani Pandemi Covid-19 dan bagaimana pertanggung jawaban hukum Pemerintah Pusat dan Daerah akibat lambatnya Penanganan Covid-19. Abstract

The objective of this research is to determine the legal framework regarding the role of the state in providing health services and to identify the legal safeguards available to impoverished individuals seeking healthcare in hospitals. This research employs normative juridical research methods, which involve a statutory and conceptual approach. The findings of this study indicate that the state's responsibility in fulfilling the right to health, as outlined in Law No. 17 of 2023 on Health and Law No. 24 on the Social Security Agency for Health (BPJS), lacks consistency in terms of the essence and substance of state responsibility. It has been demonstrated that there are still a significant number of economically disadvantaged individuals in Indonesia who qualify as recipients of contribution assistance (PBI). Additionally, patients are currently lacking legal protection in relation to their entitlement to receive services at a hospital, as stipulated in Article 189 of Law number 17. This refers to the state's obligation to ensure the right to health by offering sufficient and easily accessible healthcare facilities for all segments of the population. The state bears the primary obligation to ensure the fulfilment of its citizens' right to health as mandated by the constitution. States shall prioritise and ensure the realisation of the right to health without any kind of neglect or disregard.

Abstract

The relationship between the health insurance company and the customer is a coverage relationship which is proven by the existence of an insurance policy. KThe authority of an insurance agent to market an insurance product comes from an Agency Agreement.The insurance company's legal responsibility related to insurance agent errors can take the form of criminal, civil and administrative responsibility. The research aims 1) to explain the legal relationship of the parties in the health insurance agreement and 2) to explain the legal responsibility of the insurance company related to the insurance agent's error for health. The type of research used in writing this research is normative juridical research, namely research that examines the internal aspects of positive law. There are several types of approaches in legal research that were used in the preparation of this paper, namely 1) Statute approach, namely the approach used to study and analyze all laws and regulations relating to the legal issue being handled.[1]; 2) Conceptual approach (conceptual approach). The relationship between the agent and the helath insurance company is a contractual relationship as evidenced by an agency agreement for health. Agents act for and on behalf of insurance companies, where agents market and sell insurance products. The relationship between the insurance company and the customer is a coverage relationship which is proven by the existence of an insurance policy. The authority of an insurance agent to market an insurance product comes from an Agency Agreement. The conclusion of research showed that the legal relationship between the parties is interrelated and there is a policy agreement.

Abstract

BPJS Kesehatan memiliki kewajiban membayar Fasilitas Pelayanan Kesehatan (FASKES) atas layanan yang telah diberikan paling lambat 15 (lima belas) hari kerja setelah berkas klaim diterima lengkap dan benar. Terkait klaim pelayanan oleh rumah sakit kepada BPJS Kesehatan sering ditemui permasalahan, seperti ketidaksesuaian tarif yang diajukan dengan tarif yang tercantum dalam paket INA CBGs dan yang dibayarkan oleh BPJS Kesehatan, ataupun keterlambatan pembayaran klaim oleh BPJS Kesehatan.  Persoalan ini timbul dikarenakan, pihak BPJS menganggap bahwa berkas klaim yang diajukan oleh pihak rumah sakit masih ditemukan ketidaksesuaian dengan prosedur pengajuan klaim, padahal pelayanan yang telah dilakukan di rumah sakit sebelumnya telah diverifikasi oleh TIM verifikator BPJS dan pihak rumah sakit telah menerima sejumlah pembayaran 70% dari total pengajuan. Namun, ketika ada audit atau post review klaim, rumah sakit diminta mengembalikan dana yang sudah dibayarkan sebagai jasa pelayanan bahkan sudah dibukukan dalam laporan pajak. Kata kunci:  Perlindungan Hukum, Pelayanan, Rumah Sakit

Abstract

This study analyzes the legal responsibility of orthopedic doctors in assessing disability and return to work fitness for workers with limb disabilities due to work accidents. The focus of this study includes aspects of legal regulation, medical ethics standards, and the legal implications of negligence in assessment practices. The analysis was conducted based on Article 46 of Law No. 44 of 2009 concerning Hospitals and the principle of vicarious liability, which highlights the importance of hospital responsibility for the actions of doctors operating under their supervision. This aims to protect patients and minimize the risk of litigation. The method used in this study is normative juridical with a descriptive-analytical approach. This study emphasizes the importance of clear communication and comprehensive documentation in medical practice as part of efforts to prevent negligence. The results of the study indicate that the application of strict professional standards and ongoing training can strengthen legal protection for orthopedic doctors. In addition, this also has the potential to increase patient trust in medical practice. Thus, this study contributes to the understanding of legal and ethical responsibility in the context of treating patients with disabilities due to work accidents.

Abstract

In order to guarantee that all citizens, notably individuals who have enrolled in national health insurance, are capable of getting medical care without any barriers, national health insurance is necessary. This research indicates to analyze the legal safeguards provided for individuals that are part of the national health insurance program whenever choosing first level health facilities. This study combines a normative and empirical approach for examining the laws and regulations controlling the legal entitlements of national health insurance participants, as well as their implementation in practice. Legal materials for this study were collected from books, magazines, articles, papers, journals, newspapers, and works by legal experts to obtain relevant secondary legal data. The findings are presented systematically, linking the materials to address the research problem comprehensively. In the analysis phase, which is crucial for the study, the collected data is processed and interpreted to uncover truths that answer the research questions. The legal material was analyzed qualitatively using descriptive-analytical methods. This approach relates the identified issues to literature, expert opinions, and applicable legal regulations. The outcomes of the research reveal that, despite legal regulations granting national health insurance participants the opportunity to choose first-level health care facilities, this right is still violated. The key hurdles include the limited number of first-level health facilities that partner with national health insurance, unequal distribution of health facilities, and a lack of socialization from national health insurance. The research presented here suggests raising socialization about national health insurance participants' rights since deciding on first level healthcare facilities, raising the number of joining forces primary level with health facilities, and more rigorous oversight of participant rights implementation. With these efforts, it is envisaged that the rights of national health insurance participants to choose first level health facilities may be properly preserved and enable expanded access and quality of health services in Indonesia.
