Abstract

Tujuan dari penelitian ini adalah untuk bagaimana perspektif hukum pidana dan upaya penanggulangan kejahatan di dunia maya (cybercrime) khususnya di Indonesia dilihat dari berbagai aspek. Metode Penelitian yang digunakan dalam penelitian ini adalah metode kualitatif dengan pendekatan kualitatif deskriptif. Penelitian ini dilakukan dengan menggunakan literarur review dari memperoleh data dokumentasi. Adapun hasil yang ditemukan adalah Kriminalisasi cybercrime dalam perundang-undangan di Indonesia diformulasikan dalam Undang-undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik serta Undang-undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Upaya dalam pemberantasan cybercrime dilakukan melalui kebijakan penal yakni dengan Kriminalisasi perbuatan dalam undang-undang sehingga perbuatan tersebut termasuk kejahatan didunia maya, harmonisasi ketentuan hukum nasional dengan hukum internasional dalam memberantas cybercrime dan penegakan hukum melalui penjatuhan sanksi pidana bagi pelaku cybercrime serta kebijakan non penal yakni Menyusun kebijakan di luar hukum pidana yang mendukung upaya pencegahan cybercrime, melakukan sosialisasi terhadap potensi kejahatan didunia maya, membangun kerjasama dengan pihak swasta untuk membangun sistem keamanan di dunia maya dan membentuk jaringan kelembagaan dalam mencegah cybercrime baik dalam tataran nasional maupun dalam tingkat internasional.

Abstract

Tulisan ini berjudul analisis strategi pemberantasan mafia narkoba melalui pendekatan politik hukum. Latar belakang dari penulisan jurnal ini adalah disebabkan pada saat ini diindonesia sedang marak maraknya masalah peredaran narkotika sehingga ini menjadi kajian serius yang harus diteliti. Tingginya penyalahgunaan narkoba menjadi tugas bagi pemerintah dalam pemberantasan para pengedar dan mafia barang haram tersebut. Didalam pencegahan narkoba pemerintah menyerukan Negara darurat narkoba. Oleh karena itu, strategi pemerintah untuk menanggulangi penyalahgunaan narkoba sangat diharapkan mampu mengatasi masalah tentang narkotika sesuai dengan peraturan perundang undangan No.35 tahun 2009 tentang narkotika. Dalam politik hukum pemerintah dalam menanggulangi masalah narkotika adalah dengan membentuk instansi atau badan yang bergerak didalam peredaran gelap narkoba dan bertanggung jawab mengordinir langkah preventif peredaran barang haram tersebut. Dinegara kita masalah merabaknya penyalahgunaan narkoba semakin lama semakin meningkat efek sehingga strategi pemberantasan penyalahgunaan dan peredaran narkoba diperlukan upaya yang terpadu dan komprenship yang meliputi upaya preventif,represif,terapi dan juga rehabilitas penyebab terjadinya peredaran narkoba. Dalam peredaran dan penyalahgunaan narkoba mendapatkan sanksi yang beragam mulai dari hukuman mati, hukuman seumur hidup, dan penjara.

Abstract

Didalam penelitian merupakan penelitian yuridis normatif yaitu penelitian yang mengacu pada norma-norma hukum yang terdapat dalam peraturan perundang-undangan, putusan pengadilan serta norma-norma hukum yang ada dalam masyarakat. Dengan kata lain bahwasanya penelitian ini akan dilakukan analisis dan pembedahan terhadap Undang-Undang Republik Indonesia Nomor 21 Tahun 2007 mengenai tindak pidana perdagangan orang bahwa praktik seksualitas atau pelacuran di Indonesia pada umumnya dilarang keras oleh Undang-Undang, namun secara sembunyi-sembunyi tetap dilakukan dan bahkan terkadang tanpa mengindahkan batasan usia. Sehingga dalam praktik nya sering dilatar belakangi oleh tindak pidana perdagangan orang. Rumusan masalah yang akan menjadi pokok pembahasan, Berdasarkan Undang-Undang Republik Indonesia Nomor 21 Tahun 2007 Tentang Tindak Pidana Perdangan Orang?. Undang-Undang Nomor 21 tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang (PTPPO), masih sangat lemah. Selama ini aparat penegak hukum lebih banyak menggunakan Kitab Undang-undang Hukum Pidana (KUHP), untuk menjerat pelaku perdagangan manusia lintas batas (trafficking) yang jaringannya semakin kompleks.

Abstract

Abstrak lndonesia adalah Negara plural yang terbangun dari keragaman suku, budaya, ras, dan agama. Salah satu sisi pluralisme bangsa Indonesia yang paling mendasar adalah adanya kemajemukan agama yang dianut oleh penduduknya. Agama maupun aliran kepercayaan yang hidup dan berkembang di Indonesia tidaklah tunggal namun beragam. Pemerintah Indonesia telah mengakui enam agama, yaitu Islam, Kristen, Katolik, Hindu, Buddha, dan Konghucu. Sejatinya, Indonesia belum memiliki payung hukum yang eksplisit mengatur persoalan perkawinan beda agama yang sangat kompleks. Sehingga selama ini pasangan perkawinan beda agama harus berjuang lebih, baik melalui upaya legal maupun ilegal agar perkawinannya mendapat legalitas di Indonesia. Tujuan dari penelitian ini adalah untuk mengetahui Perspektif Pernikahan Beda Agama menurut Undang-undang Hukum Positif dan Hukum islam. Penelitian ini menggunakan metode analisis konten dengan pendekatan normatif, untuk data yang diperoleh berasal dari studi literatur dan data analisanya menggunakan pendekatan kualitatif. Hasil dari penelitian ini, Hukum Islam secara tegas mengatakan bahwa Nikah beda Agama adalah Haram. Namun, kacamata peraturan perundang-undangan terdapat inkonsistensi yuridis antara Undang-undang No 1 tahun 1974 Tentang perkawinan dengan Undang-undang No 23 tahun 2006 Tentang pencatatan Sipil. Kata Kunci: Perkawinan, Beda Agama, Undang-undang, Hukum islam.

Abstract

The failure to prosecute the perpetrators of the Rohingya ethnic genocide crime is the beginning of the blunting of international law. The Rohingya ethnic group must get their Human Rights (HAM) back, as we know that Human Rights are basic rights that are inherent from birth by the grace of God and everyone must protect and respect them. Myanmar has a long history of human rights violations, according to Amnesty International. Suppression of freedom of expression and violations of human rights against underrepresented ethnic groups continue. The research used in this study uses normative juridical research methods with a case and legal history approach. In fact, institutional dogmatism is the result of the failure to protect human rights against ethnic groups. Rohingya, this study concludes that international law is blunt and only applies if there is a large benefit to the UN Security Council, the people of a country like Rohingya only suffer from injustice.

Abstract

Sexual violence in Indonesia is an increasing issue, as data from the National Commission on Violence Against Women in Annual Records (CATAHU) shows. This research focuses on a comparative analysis between the Criminal Code (KUHP) and Law no. 12 of 2022 concerning Criminal Sexual Violence (UU TPKS) in the context of preventing and protecting women from sexual violence. This research is important considering the high rate of sexual violence and the lack of effective legal protection for victims, especially women. This research also examines how these two regulations contribute to women's autonomy over their bodies and sexuality.This research uses a normative legal method with a descriptive analytical approach. The focus is a comparative analysis of legal norms in the Criminal Code and the TPKS Law. The data used is secondary, including primary legal materials such as the Criminal Code and the TPKS Law, as well as secondary and tertiary legal materials including books, journals and scientific articles. The analysis was carried out descriptively qualitatively to interpret the data and draw relevant conclusions. Legislative and comparative approaches make it possible to evaluate the effectiveness and fairness of existing regulations in the context of preventing sexual violence and legal protection for women.Research Results Legal protection for women from sexual violence in Indonesia is regulated by Law (UU) Number 12 of 2022 concerning the Crime of Sexual Violence, which provides a legal framework for preventing, handling, protecting and recovering victims. This includes intergovernmental coordination and community engagement. The 1945 Constitution and the Human Rights Law also provide a legal basis for the protection of victims. The Criminal Code contains articles related to sexual violence, including rape and obscenity. The Law on the Elimination of Domestic Violence and Child Protection provides additional legal protection. The PPPA Ministerial Regulation also provides regulations for the protection of women and children. The TPKS Law, as a response to increasing sexual violence, regulates nine types of criminal acts of sexual violence with details of criminal penalties and fines. This includes non-physical and physical sexual harassment, forced contraception, forced sterilization, forced marriage, sexual torture, sexual exploitation, sexual slavery, and electronic-based sexual violence.The old Criminal Code and Law no. 1 of 2023 concerning the new Criminal Code also regulates obscene acts. Proving sexual harassment in criminal law uses five types of evidence according to the Criminal Procedure Code. Efforts to increase the implementation of the TPKS Law depend on the understanding and professionalism of law enforcement officials, as well as improving key factors in law enforcement.Keywords: Prevention of Sexual Violence, Legal Protection of Women, Criminal Code vs TPKS Law

Abstract

Expropriation of land by the government often results in conflict, especially when it impacts existing Building Use Rights (HGB) holders. In Medan City, the Jalan Nibung Raya case is a significant example of how land expropriation policies can affect local communities. This research aims to evaluate the process and results of land expropriation by PEMKO Medan, in particular its impact on HGB holders and the effectiveness of the conflict resolution mechanisms adopted. This research uses qualitative methods to collect and analyze data. Primary data was collected through in-depth interviews with affected HGB holders, government officials and land experts. Field observations and document analysis are also used to understand the policy context and community responses. This analysis makes it possible to assess the effectiveness of the land expropriation process and existing conflict resolution mechanisms. The research results show that the land takeover process by PEMKO Medan did not involve relevant stakeholders, which led to resistance and legal conflicts. Many citizens feel deprived of their rights without adequate compensation or solutions. A lack of transparency and communication between the government and citizens exacerbates the situation, increasing tensions and distrust between parties. Abstract

With the development of technological advances in economic activities and electronic commerce, it can create a loophole for criminal defamation of a product that is given a review or assessment by its consumers. The problem is whether the reviews are true based on the facts perceived by consumers of the product or deliberately to provide negative reviews in order to drop the selling value of the product. The Criminal Code regulates the criminal offence of defamation in Article 310 paragraph (1) and 310 paragraph (2). In its development, the criminal offence of defamation committed through electronic media is also regulated in Article 27 paragraph (3) of the Electronic Information and Transaction Law. The purpose of this research is to find out the legal regulation of criminal defamation of a product on social media based on positive law in Indonesia, and to find out how a review can be said to be a criminal defamation. This research is included in descriptive research with the type of normative juridical research, which uses data sources from secondary data, then the analysis method is qualitative analysis. The legal regulation of criminal defamation of a product review on social media based in Indonesia is regulated in Article 27 paragraph (3) Jo. Article 27 Paragraph (3) of the Law of the Republic of Indonesia Number 19 of 2016 concerning amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions. Forms of actions that can be considered as defamation through product reviews on social media include if someone deliberately spreads false information or spreads slander about products or producers on social media.

Abstract

This study analyzes the role and responsibilities of the Indonesian Ulema Council (MUI) of North Sumatra in the halal certification process after the enactment of Law No. 33 of 2014 concerning Halal Product Assurance (UU JPH). The JPH Law transfers most of the administrative authority of halal certification to the Halal Product Assurance Organizing Agency (BPJPH), but the MUI still plays a crucial role in issuing halal fatwas that form the basis for certification. In its implementation, the MUI of North Sumatra faces a number of challenges, including complex coordination with BPJPH, the length of the certification process due to complicated bureaucracy, and the lack of competent resources and auditors. In addition, the issue of transparency in the certification process and ineffective socialization regarding the new regulations are also significant obstacles. This study recommends strengthening the internal capacity of the MUI of North Sumatra, increasing transparency and accountability in the halal certification process, and improving coordination with BPJPH to reduce bureaucratic obstacles. In addition, increasing socialization to business actors regarding the new procedures in halal certification is very necessary to ensure the effectiveness of the implementation of the JPH Law and maintain public trust in halal certification institutions. With these steps, it is hoped that the MUI of North Sumatra can continue to carry out its role in ensuring the halalness of products more efficiently and reliably.

Abstract

The regulation on war and national defense in the Indonesian constitutional law system has a strategic position in maintaining national sovereignty. The provisions in the 1945 Constitution of the Republic of Indonesia, especially Article 10, Article 11, and Article 30, provide a constitutional basis for the President as the holder of the highest power over the Armed Forces, with a checks and balances mechanism through the approval of the House of Representatives in making decisions to declare war. In addition, the universal people's defense and security system (Sishankamrata) emphasizes the participatory role of all citizens in maintaining the integrity of the nation and state. However, in a global era marked by non-conventional threats such as cyber warfare, disinformation, cross-border terrorism, and hybrid conflicts, the existing constitutional law regulations are considered not yet fully adaptive and responsive. This study uses normative legal research methods with a statutory, conceptual, and comparative approach. The research findings show that there are normative gaps in defining a “state of war” and decision-making mechanisms in dealing with non-conventional threats. In addition, the implementation of the principle of civilian supremacy over the military and the optimization of legislative oversight in defense policy still face various obstacles. The implications of the weaknesses in these regulations have the potential to hinder the effectiveness of protecting national sovereignty. Therefore, it is necessary to update the regulation of constitutional law in order to be able to respond to the dynamics of modern threats and ensure that national sovereignty is effectively protected within the framework of a democratic state of law.
