Abstract

Perspektif gender sebagai pendekatan akademis dalam studi Islam seperti yang dipraktikkan oleh UIN Sunan Kalijaga Yogyakarta Indonesia, merupakan fenomena baru dan masih kontroversial di kalangan para akademisi hingga kini. Makalah ini bertujuan untuk meneliti metode kritik sejarah berbasis gender di UIN Sunan Kalijaga, dan disertai dengan analisis kritis terhadapnya. Dalam kajian yang bersifat kepustakaan ini, penulis menggunakan metode analisis kandungan (content analysis) tehadap buku-buku, jurnal, dan karya ilmiah mahasiswa akhir di UIN Sunan Kalijaga. Kajian menemukan bahwa metode kritik sejarah terhadap studi Islam yang dijalankan di UIN Sunan Kalijaga pada umum mempunyai banyak kesamaan dengan metode kritik sejarah yang dihasilkan oleh pemikir modernis Muslim seperti Nasr Hamid Abu Zayd. Selain itu, metode ini juga telah dipraktikkan oleh sarjana Kristen untuk meneliti kembali validitas teks-teks Bibel dan untuk mendapatkan pemahaman yang objektif. Dekonstruksi tafsir yang dihasilkan metode ini cenderung bertentangan dengan makna hakiki yang terkandung dalam teks yang jelas, dan metode seperti ini tidak dikenal dalam khazanah intelektual Islam.

Abstract

Makalah ini akan menelaah dekonstruksi bahasa gender yang diwacanakan oleh sarjana feminis Indonesia dalam studi Islam. Bahasa gender menurut perspektif feminis dipahamisebagai cara untukmewajarkan diskriminasi terhadap wanita, dan menandakan hubungan gender yang hierarkhi. Oleh sebab itu, bahasa gender perlu didekonstruksi karena ia tercipta berdasarkan budaya patriarkhal. Dekonstruksi bahasa gender dalam studi Islam adalah bertujuan untuk menonjolkan pemahaman Islam yang ramah wanita. Tetapi di sisi lain ia juga menghasilkan berbagai pandangan yang kontradiktif dengan prinsip-prinsip ajaran Islam dan makna kebahasaan yang terkandung dalamteks wahyu. Dalam kajian ini, penulis menggunakan metode analisis kandungan (content analysis) tehadap bukubuku, jurnal, dan latihan ilmiah dari sarjana feminis. Abstract

The following article tries to research the concept of equality in women’s testimony, either in revelation perspective or gender one. For feminists, women’s testimony in Islam which is considered half of the man’s testimony has been led to discrimination against women in the public sector. In Islam, implementing testimony is farḍu kifâyah, including the testimony implemented by women. A woman’s testimony is accepted in all cases that may not be done by men absolutely. Related to this, there are fundamental differences on the issue of women’s testimony between viewpoints based on gender and viewpoints based on Islamic thought. Gender issues in the perspective of Islamic thought are basically always in harmony with nature and the human mind at all times and places. Thus, it is surprising if a Muslim believes that in Islamic law there are aspects of injustice and discrimination against women, he tries to deconstruct interpretation of the Qur’an and the hadits as the feminists do. The principle of fairness and equality in Islam is not just restricted to the meaning of the empirical and material. But it also contains elements of spiritual, welfare, a guarantee of rights and obligations, the aspect of helping each other, supporting each other, and being responsible. Islam does not interpret men and women as a separate entity, apart, and competing. The difference in the rights, obligations and rukhṣah in the law, can not be interpreted as preferential treatment or discrimination.

Abstract

The term mukhannath in the study of Islamic law by Muslim feminists is considered to be the basis for the legitimacy of homosexual behavior. Muslim feminists present the meaning of mukhannath as behavior as well as sexual orientation that is permitted in Islam and in accordance with divine nature, so that homosexuality is a natural act in Islam and must be accepted as it is. On that basis, feminists distinguish homosexuality with liwath behavior that can be applied to homosexual, heterosexual and bisexual perpetrators. This is contrary to Islamic teachings/shari'a regarding the heresy of the Prophet Luth a.s who by the muslim scholars are called luthi, namely the perpetrators of liwath. Likewise, in interpreting mukhannath, the feminist framework is built from the concept of gender which is not derived from the treasures of Islamic scholarship or Islamic perspective. For this reason, the author tries to research and analyze the meaning and concept of mukhannath, and straighten it out according to the Islamic worldview. By using the descriptive-analytical method and using the literature as a database, the researchers came to the following conclusions; The meaning of mukhannath is the behavior of men who resemble women in terms of speech, gestures and clothing. This meaning does not recognize the difference between sexual orientation or behavior, but must be returned to the nature of its creation, namely its absolute gender. The muslim scholars have agreed that homosexual translation in Islam is liwath, which in the Qur'an is punished as destroying human nature (fitrah). The nature of creation (fitrah) must be in harmony with divine destiny which is eternal, as well as homosexual law in Islam is qath'i, not mutaghayyirah. For this reason, it is not appropriate if the gender analysis system is built on the basis of relatively social constructs used in the discussion of qath'i Islamic law.

Abstract

Abstract The Draft Act of the Elimination of Sexual Violence (RUU PKS) was made as an effort to achieve equality and justice before the law. RUU PKS was intended to be proposed as a solution towards problems related to women and sexuality. Philosophically, there are three models of perspectives used as approach of the RUU PKS: standpoint, empiricism, and postmodernism. These three perspectives are inherent parts of the Feminist Legal Theory (FLT), which is also part of global legal discourse. However, a philosophical examination reveals that the epistemology of FLT has fundamental problems in defining reality and truth. The theoretical foundations of FLT is weak, therefore the RUU PKS will fail to achieve its purported goal: justice before the law. This article analyzes this issue critically and provide a solution from an Islamic worldview. Intisari Munculnya Rancangan Undang-Undang Penghapusan Kekerasan Seksual (RUU PKS) adalah salah satu upaya dalam mewujudkan kesetaraan dan keadilan hukum. RUU PKS sebagai tawaran hukum diharapkan mampu menyelesaikan problem dan isu-isu seksual perempuan. Secara filosofis, terdapat tiga model cara pandang yang digunakan dalam pendekatan hukum RUU PKS, yakni: Standpoint, Empirisme dan Postmodernisme. Tiga cara pandang ini mewujud dalam wacana hukum global yang disebut sebagai FLT. Namun jika dikaji secara filosofis, secara epistemologis FLT memiliki problem mendasar dalam memaknai realitas dan kebenaran. Hal itu dapat membuat bangunan teori FLT rapuh sehingga tujuan RUU PKS dalam mewujudkan keadilan hukum tidak sesuai dengan filosofi negara hukum Pancasila. Makalah ini akan lebih dalam mengkaji permasalahan tersebut secara kritis, dan juga menawarkan solusi yang tepat berdasarkan perspektif Islamic Worldview.

Abstract

Moderasi beragama merupakan konsep yang sentral diperbincangkan di era globalisasi dan revolusi industry. Kementrian agama RI dalam hal ini menjadikan gagasan ini sebagai solusi dalam menciptakan toleransi kerukunan antar umat beragama. Namun gagasan ini perlu diperhatikan sebab istilah moderasi sendiri merupakan istilah dan konsep yang muncul di Barat, yang dipengaruhi cara pandang dan budaya Barat. Uraian ini dijabarkan dengan pendekatan library research dan metode analisis konten yang kemudian menemukan bahwa dalam praktiknya dan penerapannya ditemukan bebeberapa problem yang pada akhirnya mengarah pada prinsip pluralisme agama. Problematika konsep moderasi beragama di Indonesia dalam hal ini dapat dikemukakan kedalam tiga isu. Pertama moderasi beragama wajah baru pluralisme agama, kedua problem bias makna toleransi beragama, ketiga problem kebenaran yang relative.

Abstract

This research aims to elaborate on modern Western feminist thinking regarding the role of mothers in the context of gender inequality and social pressure, and identify how this thinking develops along with changes in modern society. The research method uses concept analysis to understand the role of mothers in relevant Western feminist writings and compares it with Islamic educational perspectives. The research results show that Western feminists criticize the traditional concept of motherhood which is considered to burden women with a double burden due to structured gender inequality. In addition, this research found that from an Islamic education perspective, the mother's role in the family is considered very important and of high value, both in spiritual and moral aspects. The conclusions of this study indicate that the application of a Western feminist perspective has the potential to reduce the role of mothers in children's education. The secular paradigm behind Western feminism tends to assess mother's childcare based on materialistic aspects, thus ignoring the spiritual dimensions and values ​​that are considered important in the Islamic view.   Abstrak Penelitian ini bertujuan untuk mengelaborasi pemikiran feminis Barat modern terkait peran ibu dalam konteks ketidaksetaraan gender dan tekanan sosial, serta mengidentifikasi bagaimana pemikiran ini berkembang seiring perubahan masyarakat modern. Metode penelitian menggunakan analisis konsep terhadap pemahaman peran ibu dalam tulisan-tulisan feminis Barat yang relevan serta membandingkannya dengan perspektif pendidikan Islam. Hasil penelitian menunjukkan bahwa feminis Barat mengkritik konsep tradisional peran ibu yang dianggap membebani perempuan dengan beban ganda akibat ketidaksetaraan gender yang terstruktur. Selain itu, penelitian ini menemukan bahwa dalam perspektif pendidikan Islam, peran ibu dalam keluarga dianggap sangat penting dan bernilai tinggi, baik dalam aspek spiritual maupun moral. Kesimpulan penelitian ini mengindikasikan bahwa penerapan perspektif feminis Barat berpotensi mengurangi peran ibu dalam pendidikan anak. Paradigma sekuler di balik feminisme Barat cenderung menilai pengasuhan anak oleh ibu berdasarkan aspek materialistis, sehingga mengabaikan dimensi spiritual dan nilai-nilai yang dianggap penting dalam pandangan Islam.

Abstract

This article focuses on the conception of marriage in Islam called mītsāqan ghalīzhan. In the context of this research, the concept of mītsāqan ghalīzhan is placed as a response to the problem of feminism's perspective that considers marriage and family to only bring misery and oppression to women. Using library research and content analysis methods, this study found that the concept of mīthsāqan ghalīzhan in Islamic marriage indicates a strong and holy covenant, accompanied by the values of devotion, harmony, and mutual understanding between husband and wife. This concept emphasizes loyalty, justice, and cohesion in the bond of marriage. Meanwhile, feminist views on marriage tend to focus on gender equality, rejection of patriarchal structures, and emphasis on women's rights.
