Abstract

Perlindungan varietas tanaman merupakan cabang Hak Kekayaan Intelektual (KI) yang menjadi objek perlindungan hukum di Indonesia. Kurangnya pengetahuan dari para pemulia tanaman, menjadikan varietas baru hasil pemuliaan tanaman  tidak didaftarkan pada Pusat Perlindungan Varietas Tanaman dan Perizinan Pertanian Kementerian Pertanian, sehingga tidak mendapatkan perlindungan hukum. Penelitian ini  membahas implementasi dan bentuk perlindungan hukum terhadap hak pemulia tanaman di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris. Hasil penelitian menunjukkan bahwa perlindungan hak pemulia tanaman tidak bisa diperoleh tanpa adanya pendaftaran hak varietas tanaman oleh pemulia tanaman, sehingga dengan adanya pendaftaran hak varietas tanaman, negara akan memberikan sertifikat sebagai jaminan kepastian hukum pemulia tanaman dalam memanfaatkan hak ekonomi sebesar-besarnya. Pemulia tanaman dapat mempertahankan hak terhadap siapapun  tanpa izin menggunakan varietas tanaman barunya. Bentuk perlindungan hukum yang diperoleh pemulia tanaman yaitu perlindungan hukum preventif, yang bersifat sebagai pencegahan agar tidak terjadi nya sengketa dan perbuatan melawan hukum. Selanjutnya perlindungan hukum represif, dengan memberikan sanksi pidana apabila terjadinya pelanggaran hak pemegang PVT oleh pihak yang tidak bertanggungjawab.

Abstract

This study aims to determine the role of the Bojonegoro Regency Health Office in Supervising the Pharmacy Technical Staff (TTK) Practice Permit at Pharmacies and the legal consequences received by Pharmacists as Pharmacy Manager Pharmacists (APA). This research is normative-empirical legal research (applied normative law), with a qualitative approach, combining a normative legal approach with the addition of various empirical elements. The data collection method used in this research is information obtained directly in the field in the form of interviews and document studies from various sources related to legal norms. The results showed that socialization, monitoring and guidance were gradually implemented by the Bojonegoro District Health Office if there were new rules and/or regulations from the government. There is a direct inspection to the field, but it is not optimal, because there are obstacles, namely the lack of Health Human Resources at the Health Office. The legal consequences received by pharmacists from violations of the governing laws and regulations include administrative sanctions, disciplinary sanctions, and criminal sanctions. The conclusion that can be drawn is that the Supervision of Utilization of TTK Practice Permits in Bojonegoro Regency in its implementation is still not optimal because the Bojonegoro Regency Health Office cannot carry out Supervision routinely due to the lack of Health Human Resources at the Bojonegoro Regency Health Office. As well as the legal consequences that can be received ranging from administrative, disciplinary, to criminal sanctions.

Abstract

Pekarangan adalah praktik penggunaan lahan untuk tujuan pertanian, yang melibatkan penggunaan alat mekanis untuk mengubah lahan menjadi ladang tanam. Perkarangan Pangan Lestari (P2L) yaitu konsep atau program yang diciptakan sekelompok masyarakat yang bekerja sama dalam memanfaatkan lahan pekarangan rumah sebagai sumber pangan berkelanjutan, mendorong kemandirian pangan dan meningkatkan akses masyarakat terhadap pangan bergizi, meningkatkan pemanfaatan lahan secara optimal dan mampu meningkatkan pendapatan keluarga, Hal ini dilakukan dengan memanfaatkan lahan perkarangan yang kurang produktifitas. Oleh karena itu, diperlukan upaya untuk mendorong masyarakat mengoptimalkan lahan pekarangan yang mereka miliki. Menurut Yoland Wadworth, Participatory Action Research (PAR) adalah istilah yang mencakup serangkaian gagasan yang mendasari suatu bentuk ilmu pengetahuan baru yang bertentangan dengan cara pembelajaran tradisional atau kuno. Ide-ide baru ini menekankan pentingnya kerja sosial dan kelompok dalam mengambil keputusan tentang “apa saja yang terjadi” dan “apa kosekuensi dari perubahan” dan dipandang berguna oleh berbagai orang yang dalam situasi bermasalah dan mengarah pada penelitian. Pendekatan yang digunakan dalam program P2L adalah Participatory Action Research (PAR) dimana metode penelitian dan pengembangan partisipasi yang melibatkan jaringan sosial dan nilai-nilai pengalaman.Hasil dari kegiatan ini adalah para anggota PKK mendapatkan pemahaman tentang manfaat yang ditawarkan oleh Program Pertanian Pangan Berkelanjutan (P2L), sehingga mereka menjadi mahir dalam melaksanakan program tersebut.

Abstract

Abstrak Ketidaksesuaian antara label harga promo dan harga riil yang dikenakan kepada konsumen merupakan isu penting dalam perlindungan hak konsumen. Praktik ini sering terjadi di minimarket dan toko modern, menyebabkan ketidakpuasan, kerugian materiil, dan pelanggaran prinsip keadilan dalam transaksi. Penelitian ini mengkaji perlindungan hukum terhadap konsumen berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, dengan mempertimbangkan pula perspektif hukum ekonomi syariah yang menekankan transparansi dan kejujuran dalam perdagangan. Selain itu, penelitian ini menyoroti tanggung jawab pelaku usaha dalam memastikan harga yang tercantum pada label sesuai dengan pembayaran di kasir serta memberikan solusi untuk mengatasi masalah ketidaksesuaian harga. Hasil analisis menunjukkan bahwa ketidaksesuaian harga melanggar prinsip dasar perlindungan konsumen, termasuk hak atas informasi yang jelas dan jujur. Studi ini merekomendasikan penguatan regulasi, peningkatan pengawasan oleh otoritas terkait, dan edukasi konsumen agar lebih kritis terhadap hak-hak mereka dalam bertransaksi. Kata kunci: Perlindungan konsumen, label harga, promosi Abstract The mismatch between promotional price labels and actual prices charged to consumers is a significant issue in consumer rights protection. This practice frequently occurs in minimarkets and modern stores, causing dissatisfaction, material losses, and breaches of fairness principles in transactions. This study examines legal protections for consumers under Law Number 8 of 1999 on Consumer Protection, while also considering the perspective of Islamic economic law, which emphasizes transparency and honesty in trade. Furthermore, it highlights the accountability of business actors in ensuring that listed prices align with cashier payments and provides solutions to address price discrepancies. The analysis reveals that such mismatches violate fundamental principles of consumer protection, including the right to clear and honest information. This study recommends strengthening regulations, enhancing oversight by relevant authorities, and educating consumers to be more critical of their rights during transactions. Abstract

A significant issue that many nations, including Indonesia, face is child labour, particularly in the oil palm plantation industry. A number of laws and policies, such as Law No. 13 of 2003 on Manpower, which specifically forbids the employment of child labour, and Law No. 23 of 2002 on Child Protection, have been put into place to safeguard children from exploitation. Furthermore, Indonesia is more committed to ending child labour and dangerous work because it has ratified international treaties including ILO treaties No. 138 and No. 182. Children's safety and sustainable community development are the two main goals of this research. This study's normative research approach focusses on examining laws and policies pertaining to child labour in Indonesia's oil palm plantation industry. Additionally, more and more palm oil companies are implementing sustainability strategies that address kid protection. Government and non-governmental organisation (NGO) programs emphasise access to education and public awareness of the risks associated with child labour. Violations of this rule can result in fines, business licence revocation, and criminal penalties.

Abstract

The development of digital technology and social media has allowed the creation of remixes and mashups that are increasingly popular, but often have the potential to infringe copyright. Many remixes and mashups are commercialized without permission from the original copyright holders, causing problems in the protection of rights to the work. This research is important to provide a deeper understanding of the challenges and solutions of copyright protection in cyberspace, especially related to works that are traded on social media platforms. Remixes of songs carried out by content creators by changing the tempo of the song and the tone of the singer's voice are done without the permission of the creator and/or copyright holders. The purpose of this study is to analyze the form of copyright infringement that occurs in remix and mashup works that are commercialized on social media. The method used is a qualitative approach with case studies, collecting data through literature studies and juridical analysis of the laws and regulations that regulate copyright in Indonesia and related international regulations. The research also involved interviews with legal experts and social media practitioners to gain practical perspectives on the implementation of copyright protection. It is hoped that the results of this research can contribute to optimizing legal protection for copyright holders of remix and mashup works commercialized on social media.

Abstract

Registration of Intellectual Property Rights (IPR) for industrial designs is a crucial step in increasing product competitiveness in the global era. In the midst of increasingly fierce competition, protection of innovative designs is important to maintain the uniqueness and added value of products. IPR registration not only provides legal protection for designs, but also improves the company's image and reputation, and encourages innovation. In addition, IPR owners can take advantage of exclusive rights to explore new business opportunities and improve their bargaining position in the global market. The method used in this study is the normative research method. It is important for industry players to understand and utilize IPR registration as a primary strategy in facing the challenges of a dynamic global market. This study aims to explore the urgency of industrial design IPR registration and its impact on industrial competitiveness, as well as provide recommendations for industry players in maximizing the potential of IPR as a strategic asset. Government policies have an important role in supporting and facilitating the industrial design registration process to increase the competitiveness of local products in the international market. Industrial design registration provides legal security for design owners in running their businesses. With the legal protection provided by the Industrial Design Law, design owners can be more confident in doing business, investing in the development of new designs, and establishing business partnerships without fear of imitation or copyright infringement

Abstract

Kesadaran hukum masyarakat merupakan fondasi penting dalam menciptakan tatanan sosial yang adil dan tertib. Di Desa Semenpinggir, Kabupaten Bojonegoro, peran pemuda sebagai agen perubahan memiliki potensi besar dalam meningkatkan pemahaman dan kepatuhan masyarakat terhadap hukum. Penelitian ini bertujuan untuk mengkaji strategi optimalisasi peran pemuda dalam membangun kesadaran hukum di lingkungan desa. Metode yang digunakan adalah ceramah dan diskusi menggunakan pendekatan partisipatif yang melibatkan seluruh angota karang taruna Desa Semenpinggir. Kegiatan sosialisasi sadar hukum yang dilaksanakan dengan Karang Taruna Desa SemenPinggir berhasil meningkatkan pemahaman dan kesadaran hukum di kalangan pemuda desa. Peserta tidak hanya mendapatkan pengetahuan dasar tentang hukum, tetapi juga menunjukkan sikap yang lebih proaktif dalam menjaga ketertiban dan keamanan lingkungan. Munculnya inisiatif pembentukan kelompok pemuda sadar hukum menjadi bukti nyata bahwa kegiatan ini memberikan dampak positif dan berkelanjutan. Dengan demikian, kegiatan sosialisasi ini dinilai efektif dalam membangun budaya hukum di masyarakat, khususnya di kalangan generasi muda sebagai agen perubahan.

Abstract

This research explores the legal perspective on intellectual property rights (IPR) cases in technology businesses with a focus on the provisions of Article 25 of the Information and Electronic Transactions Law (UU ITE). Article 25 of the ITE Law is the central point in regulating IPR protection in the digital business world in Indonesia. In this context, this research investigates the implementation and impact of Article 25 of the ITE Law on cases of intellectual property rights violations in the era of digital technology. This research uses qualitative descriptive research. This research methodology involves legislative analysis and case studies to identify challenges and opportunities faced by intellectual property rights holders and technology business actors. Using a normative and descriptive legal approach, this research analyzes whether Article 25 of the ITE Law provides adequate protection for intellectual property rights and the extent to which its implementation provides legal certainty for business actors. The research results show that Article 25 of the ITE Law provides a sufficient legal basis for protecting intellectual property rights in technology businesses. However, challenges related to the interpretation and enforcement of Article 25, especially in cases of IPR violations, remain an issue that requires serious attention from policy makers and legal practitioners. This research provides recommendations for improvements and clarifications in the implementation of Article 25 of the ITE Law, as well as the need to increase legal awareness among technology business players to ensure optimal protection of intellectual property rights in this digital era

Abstract

Palm oil or crude palm oil (CPO) is one of Indonesia's leading export commodities. The high level of exports is not accompanied by the provision of subsidized fertilizer for independent community farmers. Through the Ministry of Agriculture (Kementan) it has decided to remove subsidized fertilizer for oil palm plantations. With the elimination of fertilizer subsidies for oil palm farming, it makes it difficult for farmers to meet their fertilizer needs. The policy of eliminating subsidized fertilizer assistance has a direct impact on the productivity of oil palm farmers. The problems studied are limited to: What impact will there be after the ratification of the Minister of Agriculture Regulation No. 10 of 2022 concerning Procedures for Determining the Allocation and Highest Retail Prices for Subsidized Fertilizers in the Agricultural Sector related to the elimination of fertilizer subsidies for oil palm plantations? and How to overcome the problem of no subsidized fertilizer for oil palm farmers? The research method used is the Empirical Juridical method. The research results show that there are many impacts that can occur with the elimination of subsidized fertilizers by the government, especially for oil palm plants. Fluctuating CPO prices tend to make farmers unable to predict their income and set aside to purchase non-subsidized fertilizer which is unaffordable. Then the countermeasure initiated by the government is to use organic fertilizer, but it can take a long time to process organic fertilizer and the results can only be seen one year later. This is different from chemical fertilizers where the results can be seen immediately in a matter of months.
