Abstract

The Compilation of Islamic Law (KHI) stipulates that both the decedent and the heirs must be Muslim; therefore, non-Muslim children generally have no right to inherit from Muslim parents. However, in the practice of religious courts, there has been a legal development through the granting of a mandatory bequest (wasiat wajibah) to non-Muslim children, as outlined in Ruling No. 232/Pdt.P/2026/PA. Sby. This study aims to analyze the inheritance provisions for non-Muslim children according to the KHI and to examine the implementation of the rights of children of a different religion in that ruling. This study employs a normative legal research method using both a statutory approach and a case-based approach. The legal materials utilized consist of primary, secondary, and tertiary sources. The findings indicate that Islamic inheritance law and the KHI do not recognize interfaith inheritance, as religious affinity is a primary requirement in inheritance relationships. However, through the development of Supreme Court jurisprudence, non-Muslim children can still receive a share of the estate through the mechanism of a mandatory bequest (wasiat wajibah) as a form of protection for a sense of justice and the welfare of the family. Nevertheless, this practice remains controversial because it is not explicitly regulated in the KHI. Therefore, legal reform is needed to provide legal certainty while addressing the need for justice in a diverse society.

Abstract

People’s welfare is a primary objective of state administration, which is pursued through various social protection policies, including the Direct Cash Assistance (Bantuan Langsung Tunai [BLT]) program. Although the poverty rate has continued to decline, vulnerable populations still experience economic pressure due to increasing living costs. Therefore, effective and targeted policy interventions are required. This study aims to examine the implementation of the Direct Cash Assistance (Bantuan Langsung Tunai [BLT]) policy in improving community welfare based on Cirebon Regent Regulation Number 71 of 2023 concerning the Social Welfare Center (Pusat Kesejahteraan Sosial [Puskesos]) and to evaluate its effectiveness and targeting accuracy. This study employed a normative juridical approach with a qualitative research design. The results showed that the implementation of Direct Cash Assistance (Bantuan Langsung Tunai [BLT]) in Cirebon Regency was generally consistent with applicable legal provisions through stages of beneficiary data collection, verification, validation, and assistance distribution involving the Social Welfare Center (Pusat Kesejahteraan Sosial [Puskesos]). However, the policy has not been fully effective because the assistance remains primarily consumptive in nature and challenges persist regarding the accuracy and improvement of the beneficiary data system. Therefore, improvements are needed in data management systems, implementer capacity, optimization of the Puskesos role, and strengthening of economic empowerment programs to achieve sustainable social welfare.

Abstract

This study aims to analyze the implementation of Good governance principles in the governance of Ciawigajah Village, Beber District, Cirebon Regency and examine the obstacles and solutions to its implementation from a legal perspective. The research method used is empirical juridical with a statutory regulatory approach and field studies through interviews. The results of the study indicate that the principles of participation, transparency, accountability, effectiveness and legal certainty have been implemented, but are not optimal due to limitations in the quality of community participation, access to information, apparatus competence and public communication related to village fund management. Strengthening apparatus capacity, substantive transparency and participatory oversight are needed to realize good village governance.

Abstract

Background. The phenomenon of increasing teacher reporting by students' parents due to the imposition of disciplinary sanctions shows that there is a change in relations in the world of education that has an impact on the legal position of teachers. Disciplinary actions that are actually part of the pedagogical process are often questioned as a violation of the law, thus leading to a tendency to criminalize. Aims. This study aims to analyze the legal limitations of teacher disciplinary actions from a positive legal perspective, examine the criminalization practices that occur, and formulate a proportionate legal protection model. Methods. The method used is normative-juridical, with legislative, conceptual, and case approaches. Data were obtained through literature studies of primary and secondary legal materials and were then analyzed qualitatively using a prescriptive approach. Result. The results of the study show that there is no clear boundary between disciplinary action and violence in positive law, thus creating legal uncertainty. In practice, it is found that there is a tendency to use criminal law excessively for pedagogical actions without considering the context and educational purpose. Conclusion. This research offers a legal protection model based on the principle of proportionality, a restorative justice approach, standardization of disciplinary actions, and limited immunity for teachers who act in good faith. This model is expected to strike a balance between protecting children's rights and protecting the teaching profession. Implication. This condition has implications for the weakening of teachers' authority and the emergence of concerns in carrying out educational functions.

Abstract

Background. The increasing circulation of alcoholic beverages among minors has become a significant legal and social concern in Indonesia, particularly in regions where local governments have enacted regulations to restrict their distribution. Aims. This study aims to examine the effectiveness of Indramayu Regency Regional Regulation Number 15 of 2006 in controlling the circulation of alcoholic beverages to minors and to identify the factors affecting its implementation. Methods. The research employed an empirical juridical approach using descriptive qualitative analysis. Primary data were collected through interviews with officials from the Indramayu Regency Civil Service Police Unit (Satpol PP) and other relevant authorities, while secondary data were obtained from legislation, legal literature, scholarly publications, and official documents. Result. The findings reveal that although the regional regulation provides a comprehensive legal framework for prohibiting the production, distribution, sale, storage, and consumption of alcoholic beverages within the regency, its implementation has not been fully effective. Enforcement activities, including routine patrols, raids, inter-agency coordination, and community reporting mechanisms, have helped control illegal alcohol distribution. However, persistent violations remain due to limited human resources, inadequate public awareness, insufficient socialization of the regulation, weak supervisory capacity, economic incentives for illegal traders, easy access to alcoholic beverages through informal vendors, and social tolerance toward alcohol consumption among adolescents. Conclusion. The study concludes that legal regulation alone is insufficient to effectively protect minors without consistent law enforcement, adequate institutional capacity, and active community participation. Implementation. Strengthening cross-sector collaboration, enhancing public legal education, improving monitoring systems, and conducting regular policy evaluations are essential to increasing the effectiveness of local regulations in preventing underage access to alcoholic beverages and promoting public safety.

Abstract

Penghapusan Hak Tanggungan melalui roya merupakan konsekuensi hukum setelah utang yang dijamin telah dilunasi. Dalam praktik, proses roya sering menghadapi kendala akibat hilangnya Sertipikat Hak Tanggungan (SHT) yang menjadi salah satu dokumen pendukung penghapusan Hak Tanggungan. Untuk mengatasi keadaan tersebut, berkembang penggunaan Akta Konsen Roya yang dibuat oleh Notaris sebagai alat bukti pelunasan utang dan persetujuan kreditur terhadap roya. Penelitian ini bertujuan menganalisis kedudukan hukum Akta Konsen Roya sebagai pengganti SHT yang hilang serta mengkaji kekuatan pembuktiannya dalam proses penghapusan Hak Tanggungan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa Akta Konsen Roya berkedudukan sebagai akta autentik yang dibuat berdasarkan kewenangan Notaris, namun tidak menggantikan kedudukan yuridis SHT sebagai bukti pendaftaran Hak Tanggungan. Akta Konsen Roya hanya berfungsi sebagai instrumen pembuktian administratif yang melengkapi proses roya ketika SHT hilang. Selain itu, Akta Konsen Roya memiliki kekuatan pembuktian lahiriah, formal, dan materiil sehingga dapat digunakan untuk membuktikan pelunasan utang dan persetujuan kreditur terhadap penghapusan Hak Tanggungan. Meskipun demikian, penggunaannya tetap harus didukung oleh data pendaftaran tanah yang tersimpan pada Kantor Pertanahan guna menjamin kepastian hukum dalam pelaksanaan roya.

Abstract

This research aims to analyze the implementation of sanctions against Correctional Inmates (WBP) who commit disciplinary violations at the Class IIB Correctional Institution in Majalengka, based on the Regulation of the Minister of Law and Human Rights Number 8 of 2024 concerning the Implementation of Security and Order in Correctional Work Units. The research method employed is normative juridical, using a statutory approach and analysis of primary and secondary legal materials, supported by empirical field data. The findings indicate that common disciplinary violations include the possession of communication devices (mobile phones), the possession of sharp weapons, acts of violence among inmates, and debt practices that potentially disrupt security and order within the correctional institution. Sanctions for these violations are imposed in the form of light, moderate, and severe disciplinary measures, including placement in isolation cells, transfer to other correctional institutions, and recording in Register F, which results in the loss of certain rights such as remission and integration programs. The imposition of sanctions is carried out through an examination mechanism by the investigation team and the Correctional Observer Team, while upholding the principles of proportionality, justice, and equality before the law. The challenges encountered include overcrowding, limited human resources, and inadequate supporting facilities and infrastructure. Therefore, enhanced supervision, additional personnel, and the optimization of facilities are required to support the effectiveness of disciplinary sanctions and to ensure security and order within correctional institutions.

Abstract

Background. The juvenile criminal justice system has evolved to incorporate restorative justice (RJ) practices, which emphasize repairing harm and rehabilitating offenders through dialogue and reconciliation. The implementation of RJ in juvenile justice systems aims to provide an alternative to punitive measures and encourage offenders to take responsibility for their actions while addressing the needs of victims and communities. Despite its promise, the effectiveness of RJ in reducing recidivism and promoting positive outcomes for juvenile offenders remains underexplored. Objective. This study aims to evaluate the effectiveness of restorative justice practices in the juvenile criminal justice system, focusing on recidivism rates, victim satisfaction, and the rehabilitation of juvenile offenders. The research seeks to assess whether RJ methods contribute to better long-term outcomes compared to traditional punitive approaches. Method. A mixed-methods approach was employed, combining quantitative analysis of recidivism rates and qualitative interviews with juvenile offenders, victims, and justice system professionals involved in RJ programs. Results. The findings show that restorative justice significantly reduces recidivism rates and improves victim satisfaction. Juvenile offenders reported feeling more accountable for their actions, and communities experienced a greater sense of justice and restoration. Conclusion. Restorative justice practices prove to be effective in the juvenile criminal justice system, offering promising alternatives to traditional punitive methods. Policymakers should consider expanding RJ programs to further enhance rehabilitation and community healing.

Abstract

Background. Climate change is one of the most pressing global challenges, with significant consequences for ecosystems, economies, and human societies. International environmental law plays a critical role in shaping global efforts to mitigate climate change by establishing legal frameworks for cooperation and action. Objective. This study aims to analyze the role of international environmental law in climate change mitigation efforts, with a focus on the key legal instruments and agreements that shape global climate governance. The research seeks to evaluate the effectiveness of these legal frameworks in reducing greenhouse gas emissions and promoting sustainable environmental practices. Method. A qualitative research design was employed, using case studies, legal analysis, and interviews with environmental law experts, policymakers, and practitioners. The study examined major international agreements such as the Paris Agreement and the Kyoto Protocol to assess their impact on climate change mitigation efforts. Results. The findings indicate that while international environmental law has contributed to raising awareness and setting targets for climate change mitigation, the implementation of these efforts remains uneven, with many countries struggling to meet their commitments due to domestic challenges. Conclusion. The study concludes that international environmental law has been instrumental in global climate change efforts, but enhanced implementation mechanisms and greater international cooperation are necessary to achieve meaningful progress.
