Abstract

Notary public in carrying out their duties can be carried away in forms of errors that cannot be done and give statements to someone. This can be done accurately for Notaries who provide information to a Notary or use fake letters in making a deed. The author in this study wants to examine and reveal further about the validity of the notary deed issued on evidence that is declared false and the legal protection for Notaries in the name of the virus submitted by the complainants. The research method used is normative legal research, namely legal research carried out using library materials or legal materials used using approaches and conceptual approaches. The results showed that the making of a Notary deed based on evidence or null and void. Notary is not spiritually obliged from something conveyed by the complainant. Legal protection for a Notary on behalf of the person submitted by the complainant is mentioned in the Notary Position Act (UUJN) that the Notary deed essentially contains only formal truth.deed with fake information or evidence provided by the client. Abstract

The deed made by notary has the strength of perfect evidence, both in formal and material aspects. Therefore, a notary must be accountable for the accuracy of the deed formally and materially. If the deed is not made as determined by regulations, it will impact on juridical defect of the deed and on authenticity loss of it or on cancellation of it. If the comer faces a notary to formulate and write his/her action or actions into the authentic deed in accordance with the authority of the notary, and then the notary makes the deed in accordance with the comer request or desire, in this case it provide the basis that it has occurred an engagement between the comer and the notary. Therefore, in addition to the main task that the notary pours the desire or the will of the parties who require his/her services into authentic deeds, the notary also has the obligation to ensure the validity of the authenticity. Act No. 2 of 2014 and the provisions of Article 84 and 85 of Act No. 30 of 2004 on Notary governing provisions of witnesses, do not regulate the procedure of imposing sanctions on the notary, as cost replacement, compensation and interest. Similarly, the procedure of verification to cancel the notary deed or to state that the deed only has the strength of evidence as the deed under the hand.

Abstract

Perkembangan obyek wisata dipengaruhi oleh berbagai komponen yang masing-masing memiliki fungsi dan peran yang berbeda dan saling menunjang satu dengan lainnya. Di masa pandemi ini, sektor wisata sangatlah terdampak. Tujuan dari kegiatan pengabdian masyarakat ini adalah untuk meningkatkan pengetahuan dan ketrampilan masyarakat, khususnya UMKM di bidang perancangan kontrak serta memberikan pelatihan agar UMKM dapat memiliki daya saing di era pandemic ini dengan memasarkan produknya di online market place. Pengabdian masyarakat ini dilaksanakan dengan memberikan penyuluhan secara hybrid, yang berisi penyampaian materi tentang perancangan kontrak dalam pengembangan dan pengelolaan pariwisata, kebijakan pemerintah untuk mendorong peran UMKM dalam menunjang pengembangan pariwisata daerah, yang dilanjutkan dengan tanya jawab (diskusi). Ruang lingkup yang menjadi sasaran kegiatan pengabdian masyarakat ini adalah wilayah Desa Kare, Kecamatan Kare, Kabupaten Madiun. Pelaksanaan kegiatan pengabdian masyarakat ini juga bekerjasama dengan Yayasan Senyum Desa yang memiliki jaringan di seluruh Indonesia, sehingga kegiatan yang terlaksana secara hybrid tidak hanya diikuti oleh masyarakat desa Kare, Kecamatan kare, Kabuaten Madiun tetapi juga oleh masyarakat di berbagai wilaya di dalam maupun luar Jawa Timur. Dengan pelaksanaan kegiatan ini, hasil yang diperoleh berupa panduan Teknik perancangan kontrak bagi masyarakat awam yang dapat diterapkan oleh UMKM dalam membuat kontrak. UMKM memiliki peran penting dalam turut mengembangkan pariwisata suatu daerah. Dalam membantu promosi produk local suatu daerah tentu tidak lepas dari kontrak/ perjanjian yang membingkai hubungan hukum para pihak, Dengan demikian, pengetahuan dan ketrampilan di bidang hukum kontrak sangat penting bagi pelaku UMKM.   The Urgency of Understanding Contract Design in the Development and Management of Tourism Objects in Kare Village, Madiun Regency The development of tourism objects is influenced by various components, each of which has different functions and roles that supports each other. During this pandemic, the tourism sector has been badly affected. The purpose of this community service activity is to improve the knowledge and skills of the community, especially MSMEs in the field of contract drafting and provide training so that MSMEs can have competitiveness in this pandemic era by marketing their products in online market places. This community service is carried out in hybrid counseling, which contains the material on contract design in tourism development and management, government policies to encourage the role of MSMEs in supporting regional tourism development, followed by a discussion session. The scope of this community service activity is the Kare Village area, Kare District, Madiun. The implementation of this community service activity is also in collaboration with the Senyum Desa Foundation which has a network throughout Indonesia, so that the activities carried out hybrid are not only joint by the people of Kare village, Kare sub-district, Madiun, but also by communities in various regions inside and outside East Java. With the implementation of this activity, the results obtained are in the form of a contract drafting technique guidance for ordinary people that can be applied by MSMEs in making contracts. MSMEs have an important role in developing tourism in an area. In assisting the promotion of local products in an area, of course, it cannot be separated from contracts/agreements that frame the legal relationship of the parties. Thus, knowledge and skills in the field of contract law are very important for MSME actors.

Abstract

This study aims to analyze the construction of the cancellation of the land purchase agreement and legal protection for the seller in land purchases before the custody. The study used statute, case, and conceptual approaches. It focuses on the concept of custody and good faith. After analyzing the relevant legal sources, it is known that, on the one hand, Article 447 of the Indonesian Civil Code allows for the retroactive application of the custody in some conditions: (1) the custody is due to unwise, mental disorder, and irrational; and (2) the reasons underlying the custody had existed at the time the legal action is taken. The implementation of Article 447 can cancel land purchases made before the custody. On the other hand, the state must protect the buyer’s principle of good faith even though the seller is an unauthorized person. Article 447 must be applied because (1) the Indonesian Civil Code is a positive law that must be enforced; (2) people who are placed under custody are more at risk of experiencing losses in land purchases, and (3) construction of good faith land buyers cannot be applied because there are fewer parties.DOI: https://doi.org/10.22304/pjih.v9n2.a6

Abstract

A project of one million domestic gas installations across Indonesia has been implemented by PT Perusahaan Gas Negara (PGN) since 2014. However, the right and obligation between the company and consumers who installed the domestic gas is not clearly stated. This may cause a right dispute between them when it comes to an unexpected occurrence. Whereas, their relationship is important as it relates to some aspects of consumer protection and obligation, which may lead into claims when something bad happen. Based on Article 19 of the Act of 1999 No. 8 about Consumer Protection, an enterprise is responsible to give compensations in the form of cash money or other similar goods/services with equal value or medical treatment and/or insurance. In regard to consumer‟s liability, they have to provide evidence. The liability of the enterprise is classified into a liability of guilt by shifting the weight of evidence. It is mentioned in Article 28 UUPK that if an enterprise is unable to prove that it is not guilty or if it is found guilty conducting action against its liability of law, the enterprise has to give compensation to its consumers, who feel disadvantageous. The basis of applying that claim toward the enterprise points to the lack of performance or legal violence.

Abstract

Lahirnya lembaga jaminan hak tanggungan melalui diundangkannya Undang-undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan Atas Tanah Beserta Benda-Benda Yang Berkaitan Dengan Tanah (UUHT) bertujuan untuk mengakomodasi kebutuhan lembaga perbankan sebagai upaya mengamankan kredit yang disalurkan kepada masyarakat. Hak Tanggungan memberikan kedudukan yang diutamakan kepada kreditur tertentu terhadap kreditur-kreditur yang lain apabila terjadi wanprestasi oleh debitur. Namun demikian masih terdapat kekosongan hukum dalam UUHT terkait perlindungan hukum bagi kreditur apabila terjadi obyek hak tanggungan dinyatakan gugur demi hukum berdasarkan putusan pengadilan. Penulis dalam penelitian ini ingin menelaah dan menganalisa lebih lanjut tentang akibat hukum bagi kreditur setelah obyek Hak Tanggungan dinyatakan gugur berdasarkan putusan pengadilan dan bentuk perlindungan hukum bagi kreditur atas gugurnya obyek jaminan hak tanggungan. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan pendekatan masalah dilakukan dengan menggunakan pendekatan undang-undang dan pendekatan konseptual.Hasil penelitian menunjukkan bahwa gugurnya obyek Hak Tanggungan oleh putusan pengadilan mengakibatkan berubahnya posisi Kreditur yang semula berkedudukan sebagai Kreditur preferent menjadi kreditur konkuren yang dalam pemenuhan piutangnya tidak dapat didahulukan pelunasannya. Perlindungan hukum bagi Kreditur atas hapusnya obyek hak tanggungan dapat diperoleh secara preventif melalui perjanjian dengan memasukkan klausul mengenai penggantian obyek jaminan dengan obyek lainnya dan secara represif dengan cara mengajukan gugat ke pengadilan bersamaan dengan permohonan peletakan sita jaminan terhadap harta pihak yang melakukan wanprestasi.

Abstract

Construction work in its implementation is carried out based on a contract. If there are problems in carrying out construction work, a dispute between the parties, in this case the service user and the service provider, will occur. Indonesia Law No. 2/2017 about Construction Services (hereafter called UU 2/2017) provides a new dispute resolution model option if problems occur in the construction sector, namely through the Dispute Board. The Dispute Board was created by the International Federation of Consulting Engineers / Federation Internationale des Ingenieurs-Conseils or FIDIC which was adopted into UU 2/2017. However, the regulation regarding the Dispute Board in UU 2/2017 needs to be studied further, especially regarding the nature of the final binding decision, because it still raises problems in its implementation. The purpose of this study is to examine the development of dispute resolution in the field of construction and the implementation of the final and binding nature of dispute board decisions. This study employed legal research methods with a conceptual and statute approach. The results of this study found that construction disputes can be resolved through litigation or non-litigation. The presence of the Dispute Board still does not provide legal certainty for the parties because the nature of the decision is final and binding but is not supported by an implementation mechanism.

Abstract

This study was to find out the provision of corporate guarantee between the bank and limited partnership as the guarantor based on the corporate guarantee deed. This study used a normative juridical method emphasizing the science of the law by examining the prevailing legal norms in society. Using this method, it was concluded that the legal consequence of the corporate guarantee deed between the bank and limited partnership as a corporate guarantor is an agreement that binds the partners of limited partnership. In addition, legal protection for the bank is by changing the position of limited partnership's partners as a personal guarantee.

Abstract

Permasalahan sengketa konsumen e-commerce salah satunya berkaitan tidak dipenuhinya janji oleh pelaku usaha, dan tercermin dalam Pasal 8 huruf f, Pasal 9 huruf k, Pasal 13 ayat (1), dan Pasal 16 UU 8/1999.  Pada umumnya tidak dipenuhinya janji oleh pelaku usaha, dapat dikategorikan sebagai wanprestasi. Tetapi, dalam Pasal 62 UU 8/1999 terdapat pengaturan khusus sebagai perlindungan konsumen, yang memuat adanya sanksi pidana. Hal demikian menyebabkan permasalahan berupa kekaburan hukum upaya hukum perdata yang dapat dilakukan, dan kekosongan hukum terkait tata urutan prosedur hukum yang dapat digunakan secara sistematis. Rumusan masalah di dalam artikel ini pertama, karakteristik penyelesaian sengketa konsumen e-commerce terkait tidak dipenuhinya janji oleh pelaku usaha, dan kedua formulasi penyelesaian sengketa konsumen e-commerce yang sistematis terkait tidak dipenuhinya janji oleh pelaku usaha. Metode penelitian di dalam artikel ini adalah penelitian hukum (legal research), dengan pendekatan perundang-undangan dan pendekatan konseptual. Adapun sumber data yang digunakan adalah data sekunder dengan bahan hukum primer berupa peraturan perundang-undangan dan bahan hukum sekunder berupa buku, jurnal, hasil penelitian, dan pendapat ahli yang berkaitan dengan fokus artikel ini. Hasil temuan artikel ini adalah pertama, karakteristik penyelesaian sengketa konsumen e-commerce terkait tidak dipenuhinya janji oleh pelaku usaha dapat dilakukan dengan penyelesaian sengketa secara non-litigasi yakni melalui Badan Penyelesaian Sengketa Konsumen (BPSK), serta secara litigasi, melalui upaya hukum pidana, maupun upaya hukum perdata, berupa gugatan perbuatan melanggar hukum. Kedua, formulasi penyelesaian sengketa konsumen e-commerce yang sistematis terkait tidak dipenuhinya janji oleh pelaku usaha dalam konstruksi ius constituendum adalah wajib melalui mekanisme penyelesaian sengketa alternatif, yaitu BPSK, baru kemudian dapat melalui mekanisme litigasi, baik perdata atau pidana, tetapi sebaiknya menggunakan mekanisme pidana terlebih dahulu agar putusan pidana yang berkekuatan hukum tetap dapat digunakan sebagai alat bukti surat yang sempurna dalam gugatan perbuatan melanggar hukum yang dilakukan oleh pelaku usaha.

Abstract

Proportionality is a legal principle not only requires equility of the rights and obligations among parties based on competing values, but also has purpose to deliver justice among parties. This principle is in line with the Al Musawah principle in the Islamic contract or agreement which it also has the same goal: ad ‘adl wa tawazun. This principle is the implementation of the principle of good faith, the principle of transactions based on honesty including in terms of determining the profit margin. The research significance are to provide enhance knowledge about proportionality principle in Islamic crowdfunding in Indonesia, especially in financing contract in Islamic financial technology as a new business innovation scheme. This paper in order to promote the impartial perception and to harmonize the Islamic law and Indonesian laws. The type of the research is legal research. The research methods apply the conceptual approach to the the Islamic crowdfunding under proportionality principle in financing contract.
