Abstract

The rapid development of the global economy has increased the need for foreign exchange (Sharf) transactions across individuals, financial institutions, and nations. However, concerns about the permissibility of foreign exchange transactions from the perspective of Islamic law (fiqh muamalah) have become increasingly relevant. This study examines the sharia principles governing Sharf transactions, focusing on the application of fiqh muamalah to both classical and contemporary foreign exchange practices, particularly those involving digital technology. The research employs a descriptive qualitative method through a literature-based approach, exploring the views of classical and contemporary scholars, and analyzing the role of fatwas in ensuring compliance with sharia principles. The findings reveal that foreign exchange transactions must fulfill requirements such as immediate mutual exchange (taqabudh fi al-majlis) and avoid elements of usury (riba), uncertainty (gharar), and gambling (maysir). In the digital era, new challenges have emerged with the rise of financial instruments such as forex margin trading and cryptocurrency, requiring adaptive legal interpretations within the framework of fiqh muamalah to maintain sharia compliance. Thus, contemporary ijtihad and fatwas from sharia financial authorities are essential in guiding technology-based foreign exchange transactions to remain within Islamic legal boundaries.

Abstract

Nepotism is an attitude that can be detrimental to society. it could have entered into a variety of bureaucratic system. Its existence has become a debate in a variety of scientific perspective. In the Islam perspective, particularly Hadith, it was found that nepotism has number of Hadiths, among the allowing and banning. Based on various Hadith, it can be stated that the nepotism between banning and allowing depends on condition.

Abstract

In completing something that does not have a proposition to establish legal, then maqasid sharia is necessary, because it is wasilah to understand the texts of the Qur'an and the Hadith, in addition, maqsid sharia also aims to meme care of a benefit of mankind and able to provide solutions to the texts contradictory. To understand the maqasid sharia, there is some way to reach them, first; lafaz analysis of these commands and prohibitions and more aimed at issues of worship, the second stage; amr and nahy illah study aimed at social problems of society (muamalah) and a third way; al-sukut 'an syar'iyyah al' charity.

Abstract

Transformasi hukum Islam adalah sebuah keniscayaan  yang harus terjadi dalam merespon persoalan-persoalan kontemporer yang dihadapai oleh masyarakat. Transformasi hukum Islam tersebut sangat terkait dengan berbagai faktor yang berada dalam bingkai hukum Islam. Faktor-faktor tersebut diramu dan dijadikan sebagai teori Ibnu Qayyim menjadi sebuah “icon”. Yaitu faktor zaman, tempat, situasi niat dan adat.

Abstract

Sengketa ekonomi syariah lahir karena tidak adanya peraturan  yang jelas dalam mengaturnya. Atau, dengan kata lain, adanya ambiguitas hukum. Dalam praktiknya, sengketa ekonomi syariah, menimbulkan tanda tanya apakah diselesaikan di Pengadilan Negeri atau Pengadilan Agama. Dengan lahirnya UU No. 3/2006 dan UU No.50/2009 telah memberikan wewenang kepada Pengadilan Agama untuk menyelesaikan sengketa  ekonomi Syariah.

Abstract

Secara historis, perkembangan Hukum Islam di Indonesia telah melewati berbagai fase di dalam konstitusi. Secara faktual perkembangan tersebut merupakan sebuah perjuangan panjang dalam pergumulan hukum di Indonesia. Hukum Islam sebagai hukum yang bersumber dari Alquran dan Hadis memiliki sumber otentik yang berbeda dengan hukum-hukum lainnya. Adaptasi hukum Islam ke dalam hukum kenegaraan secara historis berimplikasi pada dinamika sejarah perjalanan bangsa Indonesia.

Abstract

This study aims to determine the position of the four madhhabs and understand their point regarding giving dowry using digital money. The library study method was adopted with a comparative approach. Based on the arguments mentioned by the al-Shafi’i madhhab, giving a dowry using digital money can be used or valid, inasmuch as the contract is in accordance with existing provisions. Therefore, the provision of dowry using digital money is still an agreement between the parties concerned. In this contemporary era, everything will shift to the world of technology or digital, and all possibilities will occur, including the transformation of purchasing and selling tools into digital money. The madhhab priest explains that it is permissible and legal, insofar as it does not deprive him of the rights and obligations in the dowry.

Abstract

Tingkat kepuasan masyarakat terhadap pelayanan kesehatan merupakan faktor yang penting dalam sistem penyediaan pelayanan kesehatan. Semakin baik pelayanan kesehatan akan meningkatkan tingkat kepuasan masyarakat sehingga usaha tersebut akan dinilai semakin bermutu. Tujuan penelitian adalah untuk mengevaluasi kualitas pelayanan dilihat dari sudut pandang masyarakat yang berobat di RSUD Dr. M. Yunus Bengkulu, menganalisis kesesuaian antara tingkat kepentingan kualitas pelayanan dibandingkan pelaksanaannya menurut masyarakat, dan menyusun strategi pengembangan mutu pelayanan rumah sakit berdasarkan metode Importance Performance Analysis. Dari hasil pengujian validitas dengan uji statistik Product Moment Pearson terhadap 100 responden pada bulan Juli - Agustus 2023, dihasilkan data valid, rhitung berkisar antara 0.062 – 0,628 untuk tingkat pelaksanaan, dimana lebih tinggi dari rtabel 0,195 dan hasil pengujian reliabilitas dengan uji statistik pearson correlation, dihasilkan reliabilitas yang cukup tinggi yaitu 0,801 untuk tingkat kepentingan dan 0,807 untuk tingkat pelaksanaan, maka dapat disimpulkan bahwa reliability, assurance, emphaty, tangibles, dan responsiveness tergolong baik. Dalam menyusun strategi mutu pelayanan rumah sakit, terdapat tiga komponen yang harus diperbaiki yaitu terkait dengan informasi tindakan perawatan yang dilakukan pada pasien, kecepatan dan kesigapan perawat dalam pelayanan penanganan pasien, serta jaminan pengantian obat yang rusak.
