Abstract

This article will examine the Criminal Law loophole which can still be found in the qualification of the crime of, “having intercourse with a woman out of wedlock”. In Verdict Number 30/Pid.B/2017/PN.bdw the perpetrator of crime and the victim who are both adults and without marital ties have intercourse without coercion, threats of violence and/or violence in different private areas. The Bondowoso District Court judge sentenced the perpetrator to three years in prison with a subsidiary indictment of the Public Prosecutor, namely Article 5 paragraph (3) letter b of the Emergency Law Number 1 of 1951 jo. Article 289 of the Criminal Code in Verdict Number 30/Pid.B/2017/PN.Bdw. This article will examine the accuracy of Article in Verdict Number 30/Pid.B/2017/PN.Bdw which uses Article 5 paragraph (3) letter b of the Emergency Law Number 1 of 1951 jo. Article 289 of the Criminal Code regarding the criminal act of obscenity and to examine the application of Article 412 in the new Criminal Code no. 1 of 2023 for perpetrators of criminal acts in Verdict Number 30/Pid.B/PN.Bdw.The research uses normative juridical research with statute approach and a conceptual approach.The temporary conclusion of this article is that the act of two single adults who have intercourse with the promise of marriage is still not punishable by crime. Indonesia's positive law and criminal law reforms still have legal loopholes, so they require government regulations to regulate actions that are considered morally bad. Law enforces need to take a legal sources outside of the appropriate law to convict perpetrator of criminal acts are that unequaled in the Criminal Code to fill the legal vacuum so that it does not become arbitrary space for law enforcers.

Abstract

Pandemi Covid-19 yang melanda dunia terkhusus di Indonesia, menyebabkan Lapas menjadi salah satu tempat yang beresiko tinggi penyebaran Covid-19. Kondisi terebut diperparah dengan tingkat hunian Lapas yang melebihi kapasitas (overcrowded) menyebabkan diharuskan adanya penyesuaian kebijakan untuk menangani keadaan tersebut. Mengingat kondisi tersebut, maka berdampak pada pemenuhan hak-hak warga binaan pemasyarakatan didalamnya terutama hak mendapatkan akses kesehatan dan makanan yang layak. Hak untuk mendapatkan pelayanan kesehatan merupakan suatu hak asasi manusia dan harus diwujudkan sebagaimana diatur dalam Pancasila dan Undang-Undang Negara Republik Indonesia Tahun 1945. Dengan mendapatkan pelayanan kesehatan yang baik dapat meningkatkan kualitas kesehatan yang lebih tinggi dari sebelumnya. elayanan kesehatan akan terganggu apabila jumlah tahanan dan narapidana tidak terkendali sehingga menciptakan situasi kelebihan kapasitas (overcrowded) sehingga menciptakan situasi yang dapat mengancam kesehatan narapidana. Dalam waktu yang bersamaan di tengah situasi overcrowded yang terjadi di Lapas di Indonesia, negara menghadapi situasi bencana non alam yang melanda dunia, yaitu pandemi Corona Virus Disiase (Covid-19) yang telah menyebar masif di Indonesia.

Abstract

This paper aims to analyze the mechanism for submitting and granting restitution as the responsibility of perpetrators of crimes. This is to fulfill the rights of children who are victims of criminal acts. The implemented provisions governing the submission and granting of restitution are regulated in PP No. 44 of 2008 and PP No. 43 of 2017. However, the implementation of the restitution provision,which is the right of the child (victim), has not been fully implemented due to a lack of maximum assistance by the relevant government, such us fulfilling the rights of victims to obtain rehabilitation, compensation and restitution as a form of protection of children after the occurrence of a crime for the loss suffered by the child and / or the family of the victim. This study uses doctrinal research (doctrinal legal research), while the approach used is (socio-legal studies) an effort to explore a problem by not only fulfilling the study of legal norms or doctrines, but also looking comprehensively at the context of norms and enforcement. The results showed that the submission of restitution stipulated in Government Regulation No. 43 of 2017 outlines that restitution is a compensation payment charged to the perpetrator based on a court decision.  It  has permanent legal force for material and immaterial losses suffered by the victim or his family, as in the case of giving restitution for a non specifically regulated the period of payment and a rejection of payments from perpetrators of sexual crimes.

Abstract

Penelitian ini bertujuan untuk mengetahui bentuk perlindungan hukum beserta kendala dalam pemberian perlindungan hukum kepada perempuan sebagai korban tindak pidana di PPA Kepolisian Resor Jember. Metode penelitian yang digunakan penelitian ini menggunakan metode penelitian yuridis empiris dengan pendekatan yuridis sosiologis berdasarkan sumber data primer dan sekunder. Hasil yang diperoleh dalam penelitian menunjukkan bahwa bentuk perlindungan hukum terhadap perempuan sebagai korban di PPA Kepolisian Resor Jember melalui perlindungan secara represif namun belum diterapkan terhadap perempuan sebagai korban tindak pidana kekerasan umum. Adapun kendala unit PPA Kepolisan Resor Jember dalam memberikan perlindungan terhadap korban tindak pidana yaitu tidak adanya tenaga psikologi khusus, keterbatasan ruangan yakni ruangan istirahat, dan belum ada aturan yang mengatur tentang perintah perlindungan hukum secara khusus terhadap perempuan sebagai korban tindak pidana kekerasan umum. Oleh karena perlu adanya pembenahan unit PPA Kepolisian Resor Jember dan adanya peraturan hukum terkait perlindungan terhadap perempuan korban tindak pidana kekerasan umum.

Abstract

This research reviews the phenomenon of child marriage during the pandemic, from a legal, social and health perspective. Based on data from UNICEF, Indonesia ranks eighth in the world with the number of child marriages reaching 1.4 million children. Data on child marriage from the 2018 National Socio-Economic Survey recorded that the number of child marriages in Indonesia was quite high, reaching 1,220,900 incidents. This means that about 1 in 9 women aged 20-24 get married before the age of 18. This research was conducted in Jember Regency by taking 17 representations in 9 sub-districts. This study uses a qualitative method with an observation and interview approach. From the results of the study, it was found that a small proportion of informants were legally married at Religious Affair Office because they had not met the minimum age for marriage, which was 19 years. Some informants applied for a marriage dispensation at the Religious Courts, and some falsified the date of birth by increasing the age so that it meets the minimum age for marriage. Before getting married, a small number of informants got engaged first and most of them did not go through the engagement process. Informants who are engaged are usually engaged for a relatively long time, between 10 months to a year and then get married. Child marriage is against fundamental rights and freedom of children. The recommendation from this study is the need for more intense socialization about the rules of marriage age and the dangers of early marriage, especially related to their health.

Abstract

Background: Pondok pesantren sebagai lembaga pendidikan dituntut untuk menjadi wilayah yang ramah terhadap tumbuh kembang anak. Perlu kebijakan dan tindakan khusus untuk membentuk model pesantren ramah anak. Pondok Pesantren Attanwir dapat memainkan peranan yang baik sebagai rintisan pesantren model ramah anak. Kegiatan ini bertujuan untuk memberikan pembinaan terhadap para Pembina pesantren di lingkungan Pondok Pesantren Attanwir menjadi model pesantren ramah anak. Metode: Kegiatan ini di lakukan di Pondok Pesantren Attanwir, Dusun Sumber Gadung, Desa Slateng, Kecamatan Ledokombo, Jember dengan melibatkan seluruh stakeholder dengan metode Participatory Action Research (PAR). Hasil: Terbentuknya model pesantren ramah anak yang bebas dari tindakan kekerasan dan bullying terhadap anak sehingga pesantren sebagai lembaga turut andil menciptakan Kawasan ramah anak. Kesimpulan: Meningkatnya pengetahuan pengelola terkait manajemen pondok pesantren berbasis ramah anak sehingga terbentuk lingkungan ramah anak dan mendukung tumbuh kembang anak.

Abstract

Masyarakat Indonesia menggunakan media sosial yang memudahkan informasi disebar dan dikelola. Namun secara sadar maupun tidak sadar masyarakat menyebarkan data pribadinya di sosial media yang berdampak pada berbagai aspek kehidupan. Negara memiliki kebijakan mengenai pelindungan data pribadi yang diatur dalam UU PDP. Pasal 2 Ayat (2) UU PDP menimbulkan pertanyaan berkaitan dengan penyebaran data pribadi anak oleh orang tua dan bentuk upaya perlindungan hukumnya. Penelitian ini bertujuan untuk mengetahui apakah perbuatan orang tua yang membagikan data anaknya termasuk kegiatan pribadi atau rumah tangga sebagaimana diatur dalam Pasal 2 Ayat (2) UU PDP dan untuk mengetahui bentuk perlindungan hukum bagi data pribadi anak. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual dengan menggunakan bahan hukum primer dan sekunder. Penelitian ini menghasilkan bahwa perbuatan orang tua yang menyebarkan data pribadi anak diperbolehkan dan termasuk kegiatan pribadi atau rumah tangga selama orang tua mengedepankan tanggung jawab dan kewajibannya sesuai Pasal 26 Ayat (1) UUPA sedangkan bentuk upaya perlindungan hukum bagi anak dapat dilakukan oleh negara dengan megoptimalkan tugas KPAI dan adanya kebijakan berupa UU ITE yang melindungi anak sebagai pengakses sistem elektronik dan UU PDP yang berisi larangan dan sanksi penyalahgunaan data pribadi.

Abstract

Di sekitar kita masih banyak ditemukannya sampah organik yang belum dimanfaatkan atau terolah dengan baik. Sehingga keberadaannya sering dianggap sebagai sampah yang berserakan dan tidak memiliki manfaat. Contoh kecil yang sangat mudah ditemukan yakni pada sampah organik skala rumah tangga. Padahal sampah organik skala rumah tangga yang tidak terolah dapat dijadikan sebagai pupuk. Salah satu metode yang dapat digunakan adalah menggunakan maggot. Pemanfaatan maggot sebagai mikroorganisme untuk mengurai sampah dipandang sebagai pendekatan baru dalam pengelolaan sampah. Tujuan kegiatan praktik ini dilakukan sebagai praktik percobaan yang kemudian menjadi sebuah pengetahuan terkait pemanfaatan maggot sebagai pengurai sampah organik yang menghasilkan pupuk organik. Maggot menghasilkan cairan yang dapat digunakan sebagai pupuk cair, lalu untuk sisa makanan dan kotoran maggot bisa dijadikan pupuk padat yang dinamakan kasgot (bekas maggot).

Abstract

Freedom of speech is one of the rights that individuals possess for expressing themselves, sharing opinions, and is protected by positive law in Indonesia. With the advancement of technology, public opinions are often shared through social media, where information can be quickly and easily obtained. Expressing opinions on social media may sometimes involve elements of defamation or insults toward others, which can lead to legal consequences. One case concerning defamation on social media is Decision Case Number 986/Pid.Sus/2021/PN Tjk. The research method used is normative juridical legal research. The research results indicate two legal issues to be examined. First, what are the differences in the elements of defamation offenses under the Electronic Information and Transactions Law and the Criminal Code? Second, has Decision Number 986/Pid.Sus/2021/PN Tjk aligned with the facts presented in the trial regarding defamation? The research findings suggest that the regulation of defamation in the Criminal Code is general, while in the Electronic Information and Transactions Law it is specific. The case of Decision Number 986/Pid.Sus/2021/PN Tjk does not align with the legal facts presented in the trial, as further analysis reveals that the more appropriate charge for the defendant would be the crime of defamation under Article 311 paragraph (1) of the Criminal Code.

Abstract

The Covid-19 pandemic, which has become a global epidemic, requires the implementation of health protocols in order to prevent its spread, creating its own social problems, especially for the growth and development of children, so that they are the most affected. This study uses empirical juridical methods and uses a conceptual approach. The results of this study indicate that the problem of fulfilling children's rights during the pandemic is still a priority scale program by the government in Jember Regency which must be resolved immediately, especially in terms of health and education. In the context of health, children still have not received vaccination facilities. On the other hand, online children's education is also not optimal due to limited interaction between teachers and students. This research also formulates recommendations for formulating precise policies in terms of mainstreaming the fulfillment of rights to children during the Covid-19 pandemic, especially in Jember Regency, establishing an accountable and accurate information system regarding the distribution of children affected by the Covid-19 pandemic, and making new breakthroughs related to mechanisms. education, health and the environment in favor of the fulfillment of children's rights
