Abstract

Dokumen legal merupakan salah satu dokumen terpenting yang dibutuhkan oleh suatu perusahaan, mulai dari dokumen keuangan sampai dengan dokumen perjanjian kerja antara pihak perusahaan dengan pihak karyawan. Perjanjian kerja bukan sekedar perjanjian lisan antar perorangan melainkan wajib dituangkan secara tertulis serta di tandatangani oleh para pihak yang berkepentingan guna melindungi hak dan kewajiban. Peraturan Pemerintah Nomor 35 tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja, Hubugan Kerja dan Waktu Istirahat serta Pemutusan Hubungan Kerja (PP 35/2021) merupakan salah satu dari banyak PP yang diterbitkan oleh pemerintah. Kontrak Hukum merangkum bagian dari ketentuan PP 35/2021 yang berkaitan dengan Perjanjian Kerja Waktu Tertentu (PKWT) dan Alih Daya. Perlindungan hukum bagi pekerja terutama pada Perjanjian Kerja Waktu Tertentu (PKWT) secara pelaksaan belum berjalan sesuai dengan apa yang diinginkan, masih banyak terdapat pelanggaran yang sering terjadi pada suatu perusahaan karena ketidakjelasan suatu aturan tentang penerapan Perjanjian Kerja Waktu Tertentu (PKWT). Kegiatan Kerja Praktik ini dilakukan dengan metode pelaksanaan yaitu berupa kegiatan pendampingan pembuatan dokumen legal perjanjian kerja. Dalam penelitian ini bertujuan untuk membuat dokumen perjanjian kerja berdasarkan perubahan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan disesuaikan berdasarkan Peraturan Pemerintah (PP) No.35 Tahun 2021. Dari hasil pelaksanaan kegiatan tersebut menghasilkan suatu dokumen legal berupa perjanjian kerja yang berdasarkan perubahan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan disesuaikan berdasarkan Peraturan Pemerintah (PP) No.35 Tahun 2021.

Abstract

Licensing in establishing a business has a legal basis contained in Government Regulation number 24 of 2018 concerning Electronically Integrated Business Licensing Services, where in the regulation it is explained that OSS (Online Single Submission) is a business license issued by the OSS Institution intended and on behalf of the minister. , leaders, institutions, governors, mayors or regents to business actors in carrying out their business. OSS is a product of government that is growing along with advances in technology. With the OSS, business actors who run MSMEs are made easier in the process of registering their businesses to get legal certainty, legal protection, and of course get their right to run a business. The purpose of writing this Community Service is specifically to assist partners in assisting in making OSS-based business legalities. In this Community Service activity, data collection techniques that are more widely used are online interviews and documentation for each stage of registration on the OSS website. Thus, the output of activities that have been achieved in Community Service is obtaining a NIB issued by the OSS institution, which will be used by business actors Cakey Bakey Co and Joyi Bakes to conduct business activities. Abstract

Trademark Rights are Intellectual Property Rights that often used in daily life and very important for business actors where they become differentiators from other products and or services. Brand rights can also provide protection for the owner to avoid imitation from competitors. But the fact is that there are still many business actors who have not registered their trademarks for their businesses because of the lack of knowledge about brands. One of them is Steak Jobs. The owner of Steak Jobs objected to the relatively high cost of registering a mark if it was registered by an IPR consultant and the complicated process of registering a trademark if it was done by himself. In this case, Steak Jobs requires legal assistance in the form of assistance in registering its trademark. The method of implementation carried out by the author is in the form of a survey to find partners, interviews to find out the problems being faced, providing insight to partners related to the trademark registration mechanism, collecting the necessary documents and registering the mark online on the merek.dgip.go.id site. The output of this project is assistance for the registration of the Steak Jobs Trademark which is submitted online to the Directorate General of Intellectual Property, the issuance of an online application receipt for the registration of the Steak Jobs Trademark until the trademark registration application is declared complete and enters the announcement stage as a result of the assistance for the registration of the Steak Jobs Trademark.

Abstract

Companies are places for profit or profit, and every company is founded on a legal basis. In order for workers and prospective workers to understand existing company regulations, companies need to formulate company regulations and work agreements, with company regulations and employment contracts, prospective workers and workers must comply with existing company rules, because company regulations are made based on existing facts or to minimize risks that will occur in a company. Establishment of company regulations so that we can comply with existing regulations and comply with company SOPs. The work agreement contains a binding agreement, in which the worker will work by receiving a wage order from the employer, and contains the terms of work as well as written and oral rights and obligations from both parties. The implementation of this community service uses an advocacy method to help partners (employers) improve their legal documents/agreements. The result of this community service is a draft PKWTT and a modernized draft of company regulations.

Abstract

Company legal documents, both financial documents and other documents have a very important position for the company. Company documents can be used as a reference for companies in making business decisions. Including documents regarding work agreements. Employment agreements between companies and employees have clearly become a big necessity. A work agreement is not just an oral agreement between individuals, but a work agreement must be legally written in writing and signed by both parties concerned. This is necessary to protect the rights and obligations of employees who work for a company. In February 2021 to be exact on the 16th, the government has issued 49 legal regulations no. 11 of 2020 concerning Job Creation (UU Ciptaker). The issued regulations consist of 45 Government Regulations (PP) and 4 Presidential Regulations (PERPRES). One of the PPs issued is PP No. 35 of 2021 concerning Specific Time Work Agreements, Outsourcing, Working Time, Work Relations and Rest Time and Termination of Employment (PP 35/2021). The Legal Contract summarizes part of the provisions of PP 35/2021 relating to a Specific Time Work Agreement (PKWT) and Outsourcing. Legal protection for workers, especially in the Specific Time Work Agreement (PKWT) is basically not running optimally, there are still many violations that often occur in a company due to the unclear rules regarding the implementation of a Specific Time Work Agreement (PKWT). This study aims to update the work agreement document based on changes to Law Number 13 of 2003 concerning Manpower and adjusted based on Government Regulation (PP) No. 35 of 2021.

Abstract

This article critically examine the reason of the delay in introducing Islamic law into the form of corporate business to help Muslim society in their economic activity. In addition, this study also aims to provide an explanation regarding the legal validity of the concept of corporate legal personality in Islamic law. This study aplied the method of juridical-normative research by using socio-legal analysis. The article conclude that: (1) Delayed development of corporate business organizations in the Muslim world caused by; the view that organizing community by using corporate form can damage the vision of united ummah because it can lead to factionalization in the community; The lack of capital resources because it endowment institution on wakaf; stagnant institutional development of business organizations in Islamic law; and last the capital group of Merchant class could not consolidated because hard for them to keep persistence on capital accumulation for accross generations and for conglomeration activity. (2) Fuqoha actually understand the concept of personality legal and it aplicable to non-humans corpus, but they are reluctant to develop this concept because it can’t work the legal system that they have created. Therefore, the formation of a nonhuman corpus actually possible in Islam by rule rely on assiyasah syariyah as the ulil domain domain (political authority).

Abstract

This article examines the social foundation which posed challenges to the adoption of corporate form as a business entity within the framework of Islamic legal tradition. This article employs juridical-normative research analysis with socio-legal approach. This paper concludes: (1) The corporate legal form was not required by the medieval Islamic legal system as well as the case in Western Europe due to several reason such as: an institutional vacuity; withdrawal of community capital resources into waqf institutions; stagnancy in institutional development of business organizations in Islamic law; and inability of the Muslim business elite to consolidate power. (2) In classical fiqh discussions, Islamic business organizations do not have legal personality. The closest approximation to corporate legal entities found in Islam have been bayt al-māl (public treasury), mosque property, and waqf (trusts).  Recently, the scholars have approved the corporate form on the basis of fiqh principles of qiyas (analogy) and istihsan, or masaliha mursalah (public interest).

Abstract

Jaminan kesejahteraan sosial bagi seluruh rakyat Indonesia merupakan amanat UUD Negara Kesatuan Republik Indonesia 1945 yang secara resmi dituangkan dalam Pasal 28 H ayat (3). Program jaminan sosial terdiri dari jaminan sosial Kesehatan dan ketenagakerjaan. Salah satu yang kerap kali menjadi permasalahan yaitu jaminan hari tua atau imbalan yang diterima pekerja ketika terjadi pemutusan hubungan kerja. program jaminan hari tua bertujuan untuk menyejahterakan para tenaga kerja yang besar iurannya adalah 5.7% dari gaji pekerja setiap bulannya, dimana 2% dipotong dari upah bulanan pekerja dan 3.7% merupakan tanggung jawab perusahaan. Tulisan ini bertujuan untuk menganalisis kepatuhan hukum perusahaan serta faktor penyebab terhadap hak-hak tenaga kerja berdasarkan aturan hukum yang berlaku di Indonesia, dalam hal ini yang dimaksud adalah jaminan sosial berupa jaminan hari tua (JHT). Penulis menggunakan metode analisis yuridis normatif atau analisis berdasarkan peraturan perundang-undangan yang berlaku dan metode doktrinlah yaitu dengan mempertanyakan posisi hukum apakah telah sesuai peraturan perundang-undangan yang berlaku atau belum. Hasil menunjukkan bahwa perusahaan di Indonesia masih belum patuh akan aturan hukum tentang jaminan hari tua jaminan sosial ketenagakerjaan karena kondisi finansial perusahaan, tidak adanya perjanjian kerja yang jelas, serta kurangnya kepedulian terhadap pentingnya jaminan sosial pekerja.

Abstract

The growing incidence of cyber theft has exposed critical deficiencies in trade secret protection regimes, particularly in jurisdictions lacking integrated cybersecurity measures. This study analyses the legal frameworks of Indonesia, India, and Australia, using the United States' Defend Trade Secrets Act (DTSA) as a benchmark to evaluate their capacity to address digital trade secret misappropriation. Employing a comparative legal methodology, it examines statutory provisions, judicial interpretations, and enforcement mechanisms relevant to cybersecurity threats. The findings reveal that while Indonesia has enacted a trade secret statute, it lacks procedural safeguards specifically designed to address cyber theft. India and Australia, by contrast, depend on disjointed protections rooted in contract law, breach of confidence, and general cybercrime statutes. None of the jurisdictions provide a robust legal framework incorporating vital cybersecurity components such as ex-parte seizure, digital evidence management, or encryption standards. These shortcomings highlight a critical vulnerability in safeguarding proprietary information amidst escalating cyber threats. The study underscores the urgent need for legislative reform to align trade secret protection with contemporary cybersecurity challenges. Its insights contribute to the ongoing academic and legal discourse on the adequacy of current laws in mitigating cyber-enabled intellectual property violations. Meningkatnya insiden pencurian siber telah mengungkap kelemahan mendasar dalam rezim perlindungan rahasia dagang, terutama di yurisdiksi yang belum mengintegrasikan langkah-langkah keamanan siber dalam kerangka hukumnya. Studi ini menganalisis sistem hukum Indonesia, India, dan Australia, dengan membandingkannya terhadap Defend Trade Secrets Act (DTSA) dari Amerika Serikat untuk menilai efektivitasnya dalam menangani penyalahgunaan rahasia dagang secara digital. Dengan pendekatan hukum komparatif, kajian ini mengevaluasi ketentuan undang-undang, doktrin yurisprudensi, dan mekanisme penegakan yang relevan terhadap ancaman siber. Hasilnya menunjukkan bahwa meskipun Indonesia memiliki undang-undang khusus, perlindungan prosedural terhadap pencurian siber belum memadai. India dan Australia justru mengandalkan perlindungan yang terfragmentasi melalui hukum kontrak, asas kepercayaan, dan regulasi kejahatan siber umum. Tidak satu pun dari ketiga negara menyediakan kerangka hukum menyeluruh yang mencakup unsur penting seperti penyitaan ex-parte, pengelolaan bukti digital, atau standar enkripsi. Kekosongan ini menunjukkan lemahnya perlindungan terhadap informasi bisnis sensitif di tengah meningkatnya ancaman digital. Studi ini menekankan urgensi reformasi legislatif untuk menyelaraskan perlindungan rahasia dagang dengan tantangan keamanan siber modern. Temuan ini memberi kontribusi penting bagi wacana akademik dan hukum terkait perlindungan kekayaan intelektual di era digital.
