Abstract

Proses pemeriksaan saksi dimulai dari penyidikan sampai pada tingkat penuntutan di pengadilan. Di tingkat penyidikan maka terlebih dahulu saksi diperiksa oleh penyidik dengan memperhatikan perlindungan terhadap saksi yaitu tanpa ancaman atau tekanan.dari pihak manapun. Kemudian saksi dapat diperiksa di tempat kediaman saksi dan saksi diperiksa tanpa disumpah. Sedangkan pada tingkat penuntutan atau pesidangan maka terlebih dahulu saksi dipanggil untuk didengar keterangannya. Penelitian ini bertujuan untuk memenuhi kebutuhan terhadap objek penulisan atau suatu karya ilmiah guna mendapatkan data-data, pokok-pokok pikiran, serta pendapat lainnya dari pakar atau media apapun, yaitu terkait pemeriksaan saksi dalam perkara pidana berdasarkan ius contitum indonesia. Dalam penelitian ini penulis menggunakan metode penelitian hukum normative.

Abstract

The state's obligation to protect children's rights is not only based on national law but must also be in line with international commitments. The aim of the research is to analyze the extent to which the state fulfills its responsibilities in ensuring the protection of children's rights in accordance with international provisions, such as the Convention on the Rights of the Child (CRC), and national regulations, such as the Child Protection Law in Indonesia. The research method used is a normative juridical approach with analysis of legal documents, statutory regulations, and literature studies. The research results show that although the international legal framework has been adopted into national law, its implementation still faces various obstacles, including a lack of inter-institutional coordination, limited resources, and a lack of public understanding of children's rights. This journal recommends strengthening national regulations and increasing institutional capacity to ensure more optimal protection of children's rights.

Abstract

Abstract: Indonesia already has a law that regulates consumer protection, namely Law No. 8 of 1999 concerning consumer protection. This law was passed by BJ Habibie, the transitional president at that time. In Article 4 of Law Number 8 of 1999 concerning Consumer Protection, it is stated that consumer rights include the right to comfort, security and safety in consuming goods or services. This law stipulates that every consumer, including Muslim consumers who constitute the majority of consumers in Indonesia, has the right to obtain goods and services that they are comfortable consuming. This law also states that consumers have the right to correct, clear and honest information regarding the condition and guarantee of goods or services. Abstract

This research examines the influence of entrepreneurial orientation and digital transformation on small and medium enterprises (SMEs) performance in Padang City. The research method used is quantitative, with a descriptive approach and statistical analysis. The research sample consisted of 40 owners and/or employees of SMEs in Padang City, selected using a purposive sampling technique. Data were collected through questionnaires and analyzed using SPSS 22. The research results show that entrepreneurial orientation has a positive and significant impact on the performance of SMEs. On the other hand, digital transformation hurts the performance of SMEs. Multiple linear regression analysis shows that these two independent variables simultaneously have a significant impact on SME performance. This research provides empirical contributions to the existing literature and emphasizes the importance of entrepreneurial orientation and proper digital transformation management in improving SME performance. Furthermore, this research provides empirical evidence on the impact of entrepreneurial orientation and digital transformation on the performance of small and medium enterprises, which can contribute to the understanding of the importance of entrepreneurial orientation and the use of technology to enhance the performance of small and medium enterprises.

Abstract

Persaingan antar perusahaan yang semakin ketat menuntut perusahaan untuk dapat bertahan dan bersaing dengan perusahaan lain. Sebuah instansi merupakan sekelompok manusia yang bekerja sama dalam mencapai tujuan bersama yang telah direncanakan sebelumnya. Penelitian ini dilakukan untuk mengetahui bagaimana Pengaruh Human Relation Dan Budaya Organisasi Terhadap Etos Kerja Pegawai Pada Badan Pengelolaan Keuangan Dan Pendapatan Daerah Kota Pariaman. Penelitian ini bertujuan untuk mengetahui pengaruh human relation dan budaya organisasi secara parsial dan simultan. Jenis penelitian ini adalah kuantitatif dengan metode anasisis regresi linear berganda menggunakan data primer, metode pengumpulan data dilakukan dengan menyebarkan kuesioner. Populasi penelitian ini adalah pegawai Badan Pengelolaan Keuangan Dan Pedapatan Daerah Kota Pariaman yang berjumlah 63 orang, dari semua kuisioner yang dibagikan yang berjumlah 63 tetapi yang mengembalikan hanya 54 orang tersebut dijadikan sampel karema menurut Sugiyono (2017) jumlah tersebut sudah memenuhi jumlah minimal sampel penelitian yaitu 30 responden. Hasil penelitian menunjukkan human relation dan budaya organisasi berpengaruh signifikan terhadap etos kerja pegawai Badan Pengelolaan Keuangan Dan Pendapatan Daerah Kota Pariaman secara parsial dan simultan. Regresinya adalah Y=14,292X1+0,383X2+0,712 dan nilai Adjusted R Square sebesar 0,393, artinya variabel independen mampu menjelaskan variabel dependen sebesar 39,3% sedangkan sisanya 60,7% dijelaskan oleh variabel lain yang tidak diteliti pada penelitian ini.

Abstract

This study evaluates legal certainty in the implementation of Regional Regulations (Perda) in West Sumatra based on Minangkabau customary values. Using a juridical-empirical approach and normative analysis, this research examines how well these regulations can be integrated into the existing legal system without disregarding local customs. The main findings indicate that although Minangkabau-based Perda are legally recognized, there are inconsistencies in their implementation due to differences between positive law and customary law. This leads to challenges in applying the law consistently and fairly. This research contributes to the literature by highlighting the need for more effective harmonization between state law and customary law to enhance legal certainty in culturally rich regions like West Sumatra. The practical implications include the importance of strengthening cooperation between policymakers and customary communities in the legislative and legal implementation processes.

Abstract

The purpose of this study is to assess the impact of revoking State Civil Servants' voting rights (ASN) on the quality of democracy in Indonesia. This study employs a normative research method, drawing on primary legal materials such as the 1945 Constitution, the General Election Law, and the International Convention on the Protection of Human Rights, as well as secondary legal materials such as books, articles, scientific works, or research findings relevant to the subject of study. The findings of this study show that revoking ASN voting rights is an undemocratic action that harms the interests of the entire community because it is fundamentally contrary to democratic principles, violates constitutional provisions, and restricts citizens' political rights. To improve this situation, it is recommended that the government evaluate the policy and consider restoring ASN voting rights, as well as formulating a more effective mechanism to maintain bureaucratic neutrality.

Abstract

In the context of local governance in Indonesia, the harmonization of national law and customary law presents a significant challenge. This study examines the juridical integration of constitutional values with Minangkabau adat in the formulation of regional regulations (Perda) in West Sumatra. The study is based on the premise that regional regulations must align with constitutional principles, while West Sumatra also has a strong and influential customary law heritage in its community life. Using a normative juridical approach, this research aims to analyze how constitutional values can be harmonized with Minangkabau customary norms in the regional legislative process, as well as identify the legal challenges that arise in this endeavor. The findings reveal that although there is potential tension between constitutional law and customary law, with the right approach, these two legal systems can be synergized to produce Perda that are constitutionally valid while maintaining social legitimacy and relevance in the local community. The study also provides strategic recommendations for the formulation of Perda in West Sumatra that considers the harmonization between national law and local wisdom.

Abstract

This research aims to analyze the application of the principle of justice in Civil Law in Indonesia, as well as to identify the challenges faced in its practice. This study uses a qualitative method with an empirical approach, which includes a review of laws and regulations, court decisions, and interviews with legal practitioners. The results of the study indicate that although the principle of justice is recognized in Civil Law, its implementation is often hampered by various factors, including the lack of uniformity in legal interpretation and the influence of local culture. This study recommends the need to improve understanding of the principle of justice among law enforcers and the community in order to achieve fairer dispute resolution.

Abstract

This journal discusses the Harmonization of State Administrative Law with the Constitution in the Government system in Indonesia. The purpose of the study is to analyze the extent to which State Administrative Law is in line with the values ​​contained in the constitution and how its implementation can strengthen an effective, transparent, and accountable government system. The research method used is a normative legal approach with qualitative analysis, which examines laws and regulations, legal doctrines, and related court decisions. The results of the study indicate that although state administrative law has accommodated constitutional principles, such as justice, legal certainty, and protection of human rights, there are still gaps in implementation. This is due to inconsistencies in regulations, overlapping authority between institutions, and lack of supervision in government administration practices. Therefore, harmonization steps are needed that involve revising regulations, strengthening institutions, and fostering state apparatus to ensure that state administrative law can optimally support the goals of the constitution.
