Abstract

n the practice of law enforcement, many advocates who abuse the right of immunity of this profession and similarly in contrast, many other law enforcers do not understand the rightof Advocate immunity. This right of immunity will be strong if an advocate carries out hisprofession in line with his integrity. Abstract

Marriage as a normatively protected and religious institution in Indonesia still faces the threat of polyandry practices that are contrary to moral values, religion, and applicable legal regulations. This study aims to examine the Prohibition of polyandry from the point of view of Islamic law and the construction of criminal sanctions in Law Number 1 of 2023 concerning the Criminal Code, as well as formulating an integrative prevention model. The method used is normative juridical approach through the study of literature with descriptive-analytical analysis. The results showed that all schools of jurisprudence have agreed by ijma ' ban polyandry because it is contrary to maqashid al-Sharia, especially the principle of hifzh Al-nasl and hifzh al-'irdh. Indonesia's positive law also prohibits the practice through the principle of monogamy and the provision of double marriage. The meeting point between the two legal systems is an important foundation in building a comprehensive prevention mechanism. The Integrative prevention Model includes institutional synergies between KUA, MUI, and law enforcement officials, strengthening premarital education, and digitizing national marriage records in order to realize equitable family resilience.

Abstract

Law enforcement against narcotics crime requires a balance between legal certainty, justice, and expediency. This study aims to analyze how the principle of justice and legal certainty is applied in the Bekasi District Court decision number 217/Pid.Sus/2025 / PN Bks against two defendants, namely Bayu Setiawan alias Bontot and Ayub Ferdiansyah alias Ayub, who were proven to have committed the crime of conspiracy to sell Class I narcotics. This research uses normative juridical method with case approach. Based on the analysis, the panel of judges sentenced the defendants to imprisonment for eleven years in accordance with Article 114 paragraph (2) in conjunction with Article 132 paragraph (1) of Law No. 35 of 2009 on narcotics. The decision reflects the application of the principle of legal certainty because it is based on valid evidence and the elements of the offense are met. However, from the aspect of substantive justice, the verdict does not fully reflect the rehabilitative approach for users and intermediaries, so the repressive approach is still dominant.
