Abstract

This study comprehensively analyzes the competence of the military judiciary in examining, prosecuting, and deciding criminal cases involving active soldiers of the Indonesian National Army (TNI), using the Appeal decision Number 88-K/PMT.I/BDG/AL/IX / 2025 as the main case study. In the case, the defendant, who is a navy soldier, was charged with committing a military crime in the form of disobedience to official orders, actions that have the potential to disrupt discipline, command hierarchy, and unit operational order. The verdict of the first instance was handed down by the Bandung high military court I, which was then re-examined in the appeal level after legal remedies were filed by the relevant parties.The appellate panel of judges reviewed the case by considering a number of important juridical aspects, including the absolute competence of Military Justice based on the provisions of Law No. 31 of 1997 on Military Justice, the fulfillment of criminal elements as stipulated in the Criminal Code, and the imposition of crimes that reflect the principle of proportionality and Justice. The appeal ruling also confirmed that the jurisdiction of Military Justice is determined not only by the status of the subject of Law (active soldier), but also by the direct interrelation of criminal acts and military service duties.Through normative legal research methods that combine legislative, doctrinal, and analysis approaches to court decisions, this study found that military justice has full and indisputable competence in dealing with these types of cases, especially when the actions of the accused are directly related to the performance of official duties and affect discipline and command structure. The panel of judges at the appeal level consistently confirms the fulfillment of elements of military offenses, both subjective and objective elements, based on the facts of the trial and valid evidence according to the law of military procedure.Thus, this study concludes that the appeal verdict is a real representation of the consistency of the application of the law in military criminal justice. This ruling not only strengthens the absolute authority of the military judiciary in prosecuting soldiers who commit violations within the scope of service, but also makes an important contribution to legal certainty, official order, and the integrity of the military justice system in Indonesia. In addition, the decision emphasized the function of Military Justice as an instrument for fostering discipline, maintaining the professionalism of soldiers, and ensuring the implementation of military life in accordance with the principles of hierarchy and command.

Abstract

Perubahan cepat dalam sistem pendidikan dan perkembangan teknologi menuntut pendidik memiliki kemampuan adaptif yang tinggi dalam menghadapi dinamika pembelajaran. Workforce agility menjadi kompetensi penting bagi pendidik agar mampu merespons perubahan secara fleksibel, reflektif, dan inovatif. Kegiatan ini bertujuan memperkuat workforce agility pendidik melalui penerapan konsep Agile Classroom. Pelaksanaan dilakukan pada 27 Agustus 2022 di Sekolah Kebangsaan KEM Terendak 2 Melaka, Malaysia, dengan metode pelatihan partisipatif yang meliputi penyampaian konsep, simulasi, diskusi reflektif, dan workshop penyusunan Agile Lesson Plan. Evaluasi dilakukan melalui pre-test dan post-test terhadap lima indikator utama. Hasil menunjukkan peningkatan rata-rata skor dari 56% menjadi 86%, dengan rata-rata kenaikan sebesar 30 poin. Temuan ini menunjukkan bahwa pendekatan Agile Classroom efektif dalam meningkatkan kesiapan adaptif dan profesional pendidik. Konsep ini berpotensi mendukung pengembangan budaya pembelajaran yang fleksibel, kolaboratif, dan berkelanjutan.

Abstract

Peningkatan kualitas pelayanan publik di tingkat kelurahan sangat dipengaruhi oleh kompetensi aparatur dalam menerapkan manajemen sumber daya manusia (MSDM). Kegiatan pengabdian kepada masyarakat ini bertujuan meningkatkan pemahaman aparatur Kelurahan Asam Kumbang terhadap konsep MSDM dan prinsip pelayanan publik. Kegiatan dilaksanakan pada 11 februari 2023 menggunakan pendekatan edukatif-partisipatif melalui ceramah, diskusi interaktif, dan studi kasus. Evaluasi dilakukan terhadap 30 peserta menggunakan desain one-group pre-test dan post-test dengan instrumen skala Likert (1–5). Hasil menunjukkan adanya peningkatan rata-rata skor dari 3,10 pada pre-test menjadi 4,32 pada post-test. Nilai N-Gain sebesar 0,64 menunjukkan efektivitas pada kategori sedang menuju tinggi, dan uji paired t-test menunjukkan perbedaan yang signifikan (p < 0,05). Hasil ini menunjukkan bahwa kegiatan penyuluhan efektif dalam meningkatkan pemahaman aparatur mengenai perencanaan SDM, akuntabilitas, dan profesionalisme pelayanan. Selain peningkatan kuantitatif, kegiatan ini juga mendorong komitmen aparatur dalam memperbaiki kualitas pelayanan publik. Model pengabdian berbasis evaluasi terukur ini dapat direkomendasikan sebagai pendekatan yang efektif dalam peningkatan kapasitas aparatur di tingkat kelurahan.

Abstract

The abuse of class I non-crop narcotics in Indonesia has reached alarming levels and requires comprehensive legal treatment. This study analyzed the Tebingtinggi District Court decision number 252 / Pid.Sus/2025/PN Tbt to understand the application of criminal law in the case of possession of methamphetamine weighing 1.18 grams. Normative juridical research methods are used by examining positive legal norms and their application through literature studies of primary, secondary, and tertiary legal materials. The results showed that the panel of judges managed to prove the elements of Article 112 paragraph (1) of Law No. 35 of 2009 systematically, where the defendant was proven to possess narcotics without legitimate rights. Juridical considerations reflect the application of the principle of legality by distinguishing acts of circulation and ownership, so that subsidiary charges are more appropriately applied. The verdict of five years imprisonment and a fine of one hundred million rupiah shows the proportionality between the weight of the act and the sanctions imposed. The study concluded that the verdict has met the principles of legal certainty and substantive justice, but the rehabilitative approach needs to be optimized to distinguish traffickers and users in order to realize a justice system that is not only repressive but also restorative.

Abstract

This paper initiates the study of Islamic law related to the reverse proof system contained in Articles 77 and 78 in law number 8 of 2010 concerning the Prevention and Eradication of The Criminal Action of Money Laundering. In this study, the authors used qualitative methods to respond to the concept of fiqh life in Indonesia. The purpose of this study is related to the burden of proof reversed using the opinions of Islamic law, usul fiqh, and legislation. From the study results, the evidence to the contrary does not apply to all criminal cases but only to exceptional cases such as money laundering. Money laundering in Indonesia can be in the form of enrichment by illegal means. Islamic law in the development of law in Indonesia also minimizes the crime of criminal origin that develops and continues in money crimes from the influence of controlling illicit money that feels like halal money and also includes sanctions against perpetrators of crimes punished by Islam into national law.

Abstract

Marriage as a normatively protected and religious institution in Indonesia still faces the threat of polyandry practices that are contrary to moral values, religion, and applicable legal regulations. This study aims to examine the Prohibition of polyandry from the point of view of Islamic law and the construction of criminal sanctions in Law Number 1 of 2023 concerning the Criminal Code, as well as formulating an integrative prevention model. The method used is normative juridical approach through the study of literature with descriptive-analytical analysis. The results showed that all schools of jurisprudence have agreed by ijma ' ban polyandry because it is contrary to maqashid al-Sharia, especially the principle of hifzh Al-nasl and hifzh al-'irdh. Indonesia's positive law also prohibits the practice through the principle of monogamy and the provision of double marriage. The meeting point between the two legal systems is an important foundation in building a comprehensive prevention mechanism. The Integrative prevention Model includes institutional synergies between KUA, MUI, and law enforcement officials, strengthening premarital education, and digitizing national marriage records in order to realize equitable family resilience.

Abstract

Law enforcement against narcotics crime requires a balance between legal certainty, justice, and expediency. This study aims to analyze how the principle of justice and legal certainty is applied in the Bekasi District Court decision number 217/Pid.Sus/2025 / PN Bks against two defendants, namely Bayu Setiawan alias Bontot and Ayub Ferdiansyah alias Ayub, who were proven to have committed the crime of conspiracy to sell Class I narcotics. This research uses normative juridical method with case approach. Based on the analysis, the panel of judges sentenced the defendants to imprisonment for eleven years in accordance with Article 114 paragraph (2) in conjunction with Article 132 paragraph (1) of Law No. 35 of 2009 on narcotics. The decision reflects the application of the principle of legal certainty because it is based on valid evidence and the elements of the offense are met. However, from the aspect of substantive justice, the verdict does not fully reflect the rehabilitative approach for users and intermediaries, so the repressive approach is still dominant.

Abstract

Criminal liability is a legal obligation imposed on a person for a criminal act he or she commits, which is based on the existence of fault (intentionality or negligence) and the ability to be legally responsible. In English, namely criminal responbility, the Greek word cosmetics means the skill of decorating. In the Great Indonesian dictionary, it is related to beauty. Criminal responsibility has a community relationship as a social control so that they do not commit criminal acts. In this issue, the author includes a formulation of the problem of how to regulate criminal liability for perpetrators of illegal cosmetics crimes in Indonesia. The research was conducted to find out the actions of the perpetrators of distributing cosmetics without a distribution permit. Based on the above explanation, the author draws the conclusion that cosmetics is that certain substances are used to make up and have an effect on the appearance of normative laws by researching literature materials, cosmetics are a basic need, especially women, it is not surprising that the demand for cosmetic products is increasing and variing. Criminal law regulations for perpetrators of the act of distributing cosmetics without a distribution permit are regulated in Law of the Republic of Indonesia Number 8 of 1999 concerning Consumer Protection Article 62 paragraph (1) and Law Number 36 of 2009 concerning health. Criminal liability for the perpetrators of the act of distributing cosmetics without a distribution permit is appropriate because it meets subjective elements.

Abstract

Indonesia is a country based on law, so every act that violates legal norms in society must be given sanctions according to applicable law. The crime of motorcycle theft committed by muggers is one of the crimes that often occurs in the midst of community life. The role of law enforcement is to make efforts to uphold or function legal norms and provide a sense of security and order in the midst of community life. Based on Article 365 of the Criminal Code, namely a criminal act preceded, accompanied or followed by violence or threats of violence, against people. The obstacles experienced by the Medan Police in revealing the case of the robbery of a motorbike by a mugger are inadequate logistical needs, an indifferent community and the clarity of the victim in providing a report regarding the process of the robbery they experienced. Furthermore, efforts to overcome these obstacles include additional budget funds to overcome the perpetrators of the mugging, socialization to the community regarding the robbery committed by the mugger and taking special steps in handling the mugging case.

Abstract

This community service program aims to educate and raise awareness of inheritance law and criminal law, both national and Islamic, through seminars, community group discussions, and direct community outreach. This legal outreach activity aims to increase legal awareness and understanding in the community of Kutomulyo Village, Biru-Biru District. Mentoring and Workshops: Assisting the community in recognizing, reporting, and handling cases of inheritance embezzlement, as well as training in calculating inheritance rights under civil and Islamic law. Collaboration between Village Officials, Religious Leaders, and the Village Community: Involving religious leaders and village officials to strengthen legal understanding. Evaluation and Reflection: Conducting regular evaluations of community understanding and behavioral changes. Through this legal outreach, it is hoped that the community will be able to resolve inheritance issues fairly, in accordance with legal provisions, thereby minimizing the potential for criminal acts in inheritance distribution.
