Abstract

This article examines the concept and implementation of legal certainty in the resolution of disputes in Indonesia's Sharia capital market. As part of the national financial system, the Sharia capital market adheres not only to general capital market regulations but also to Islamic legal principles. The article identifies normative and practical challenges in ensuring dispute resolution mechanisms that are consistent with both positive law and Islamic values. Using a normative juridical approach supported by secondary legal materials, this study reveals that legal certainty in the Sharia capital market is still evolving, particularly in terms of institutional authority, procedural clarity, and the enforceability of Sharia-based decisions. The role of the Indonesian Ulema Council (MUI), the Financial Services Authority (OJK), and religious arbitration institutions such as Basyarnas is analyzed in depth. The findings highlight the need for an integrated regulatory and institutional framework that ensures both compliance with Sharia and the protection of investor rights. The article concludes that the future of dispute resolution in the Sharia capital market depends on harmonizing positive law with Islamic jurisprudence to foster a more just, transparent, and legally certain investment climate.

Abstract

This article evaluates the effectiveness of legal protection for auction winners in executing Mortgage Rights and the practical enforceability of the Mortgage Rights Certificate. While the Mortgage Law provides creditors with privileged authority for parate execution under Articles 6 and 14, execution is often hindered when the debtor or possessor files an objection (derden verzet). The research uses a normative legal method, examining the Mortgage Law, Indonesian Civil Procedure Code, Ministry of Finance Regulation 122/2023, and relevant court decisions. The findings suggest that legal protection for auction winners is inadequate due to insufficient preventive measures, such as execution seizure before the auction. This allows objections to delay execution for years. Additionally, Article 195 of the Civil Procedure Code lacks clear time or scope limitations for resistance, enabling its misuse. The research recommends mandatory execution seizure before auction and stricter court standards for accepting execution delay requests, enhancing parate execution effectiveness and auction winner protection.

Abstract

This research focuses on analyzing the status of e-wallet balances as part of inherited assets in the Indonesian inheritance law system amidst the rapid development of the digital economy. The main issues examined are the suitability of the concept of e-wallet balances with the construction of assets in civil law and the legal and technical obstacles faced by heirs in the process of acquiring them. This research uses a normative legal research method with a statutory, conceptual, and comparative legal approach. Data were obtained through a literature review of laws and regulations, expert doctrines, court decisions, and relevant legal literature, then analyzed qualitatively and systematically. The results show that conceptually and legally, e-wallet balances qualify as intangible assets with economic value and are under the legal control of the heir, thus deserving of their status as part of inherited assets. However, the lack of explicit regulations regarding the inheritance of digital assets, coupled with strict personal data protection regimes and account security systems, creates legal uncertainty and practical obstacles for heirs in accessing e-wallet balances. The implications of this research emphasize the need for updating and harmonizing inheritance law regulations with personal data protection laws and digital financial services regulations, in order to create a digital asset inheritance mechanism that provides legal certainty, protects heirs' rights, and is responsive to technological developments.

Abstract

This study aims to analyze the legal status and evidentiary strength of the Land Ownership Statement (SKT) in relation to the Certificate of Ownership (SHM), as well as the legal protection and certainty afforded to certificate holders. The research employs normative legal research methods using statutory, conceptual, and case approaches. The findings indicate that the SKT merely functions as an administrative basis of title, whereas the Certificate of Ownership constitutes a strong form of evidence of land rights, although it is not absolute under the negative publication system and may still be challenged if juridical or administrative defects are proven. The main issue addressed in this study is the lack of clear regulation regarding the legal status and limits of the evidentiary value of the SKT vis-à-vis the Certificate of Ownership. This study concludes that the land registration system based on negative publication has not yet fully ensured legal certainty and protection for holders of Certificates of Ownership, thus necessitating clearer regulation of the legal standing of the SKT and the strengthening of the land registration system.

Abstract

This research delves into the factors influencing consumer protection within the context of digital financial services, with a focus on the regulatory landscape, technology integration, consumer awareness, and data privacy. The primary objective is to analyze the impact of these factors on the improvement of consumer rights and safety. A quantitative approach was employed, utilizing data collected through surveys of digital financial service users. Confirmatory factor analysis was used to validate the measurement model, followed by structural equation modelling to test the hypotheses. The results demonstrate the significant and positive impact of the regulatory landscape, technology integration, consumer awareness, and data privacy on consumer protection. This study theoretically contributes by empirically confirming the role of these factors in consumer protection in digital financial services. From a practical standpoint, it underscores the importance of robust regulations, seamless technology integration, and effective consumer awareness initiatives in upholding consumer rights and safety. However, it is important to acknowledge certain limitations within this study. Its context-specific nature may restrict its generalizability to other regions, and the analysis primarily focuses on antecedent factors while neglecting potential influences from other variables. Nevertheless, this study's novelty lies in its comprehensive exploration of the foundational factors and their profound impact on consumer protection in the digital financial services landscape, furnishing valuable insights for informed policymaking and industry practices.

Abstract

The rapid growth of Sharia-based financial institutions in Indonesia, particularly Sharia Savings and Financing Cooperatives (Koperasi Simpan Pinjam dan Pembiayaan Syariah, or KSPPS), has elevated the importance of murabahah financing as a primary product for community economic empowerment. However, the implementation of murabahah contracts at KSPPS faces significant legal challenges arising from the divergence between Indonesia's civil law framework and Islamic Sharia principles. This study aims to analyze the harmonization of civil law and Sharia principles in the validity and dispute resolution of murabahah contracts within KSPPS. Employing a normative legal research method, this study utilized three approaches: the statute approach, the conceptual approach, and the case approach. Legal materials were gathered from primary sources including statutory regulations (KUHPerdata, Law No. 21/2008 on Islamic Banking, Law No. 3/2006 on Religious Courts), DSN-MUI fatwas, and the Compilation of Sharia Economic Law (KHES), as well as secondary sources comprising legal journals and academic literature. The novelty of this research lies in its dual-perspective analysis that integrates civil law doctrines with Sharia normative standards to evaluate murabahah contract validity, particularly in the KSPPS institutional context. The study finds that murabahah contracts are valid under civil law provided they satisfy Article 1320 of the Civil Code, while Sharia validity requires compliance with DSN-MUI Fatwa No. 04/2000, especially the prerequisite of actual goods ownership by KSPPS prior to sale. Harmonization is achieved through dual legal drafting, inclusion of forum selection clauses referring to Religious Courts or BASYARNAS, and the recognition of DSN-MUI fatwas as material legal sources in dispute resolution. This research contributes to the formulation of better regulatory policies for integrating civil law and Sharia principles in Islamic cooperative finance.

Abstract

The existence of Dayak customary law in Central Kalimantan plays an important role in resolving customary land disputes. Recognition of customary institutions and the authority of the Damang (Customary Chief) is affirmed in Central Kalimantan Provincial Regulation Number 16 of 2008. In practice, customary land disputes in Kurun District are often resolved through customary legal mechanisms without proceeding to formal courts. This study aims to analyze the position and authority of the Damang in enforcing Dayak customary law and the process of resolving customary land disputes based on the regulation, with a case study of Damang Decree Number 02/DKA/KK/I/2026. This research employs a legal research method with an empirical juridical approach using statutory and case approaches. Data were collected through literature review and interviews with the Damang Customary Chief, Mantir Adat (customary officials), and the disputing parties, and were analyzed qualitatively. The results indicate that the Damang holds a recognized customary authority with normative legitimacy to enforce customary law and resolve customary land disputes. The dispute resolution process involves complaint submission, examination, customary deliberation, site inspection of the disputed land, and the issuance of a Damang Decree accepted by the disputing parties without further litigation in formal courts.

Abstract

Penelitian ini bertujuan menganalisis Kompetensi Yurisdiksi Pengadilan Palangka Raya dalam memeriksa dan memutus perkara hak asuh antar-Warga Negara Asing di Indonesia berdasarkan Studi Putusan Nomor 117/PDT.G/2019/PN. PLK. Fokus penelitian ini yaitu, menganalisis pertimbangan Hakim Pengadilan Negeri Palangkara Raya terhadap Kompetensi Yurisdiksi Perkara hak asuh anak luar perkawinan Warga Negara Asing (WNA), dan pertimbangan Hakim dalam perkara Hak asuh anak berdasarkan prinsip Hukum nasional dan hukum Perdata Internasional. Penelitian ini merupakan jenis penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan pendekatan kasus. Hasil penelitian ini menunjukkan Pengadilan Negeri Palangka Raya memiliki kompetensi yurisdiksi absolut dan relatif dalam memeriksa perkara tersebut, walaupun para pihak berkewarganegaraan asing dan tinggal (domisili) di Palangka Raya, hal tersebut  sesuai dengan rujukan prinsip hukum Foru Rei (tempat tinggal tergugat) dan prinsip hukum Forum Actoris (tempat tingal penggugat), dan Locus perbuatan hukumnya (Locus Legit Actum), yang dimana prinsip tersebut sesuai dengan ketentuan hukum perdata internasional. Sebagaimana ketentuan yang diatur dalam Undang-Undang Perlindungan Anak, dan Putusan Mahkamah Konstitusi No. 46/PUU-VIII/2010, dengan usia anak masih balita, Hakim menetapkan hak asuh kepada ibu, akan tetapi tetap memberi akses kepada ayah untuk bertemu, dan memenuhi kewajiban anak.

Abstract

Penelitian ini bertujuan untuk menganalisis serta menjelaskan mengenai bentuk-bentuk perilaku Bullying yang terjadi di lingkungan panti asuhan. Kemudian menganalisis faktor yang menyebabkan terjadinya bullying di Panti Asuhan, serta perlindungan hukum yang diberikan kepada korban bullying. Peneliti menggunakan metode penelitian yuridis empiris, dengan melakukan wawancara, observasi, serta studi kepustakaan. Hasil penelitian menunjukkan bahwa tindakan bullying, baik secara fisik maupun verbal sering kali disebabkan oleh faktor internal, seperti lingkungan keluarga, tekanan dari dari teman sebaya, dan pengaruh media. Perlindungan hukum terhadap anak sebagai korban bullying terdapat diantaranya dalam KUHAP, Undang-Undang Perlindungan Anak, Undang-Undang Hak Asasi Manusia, Undang-Undang Perlindungan Saksi dan Korban.
