Abstract

The right to control from the state is a right that at the highest level is controlled by the state as an organization of power for all the people. This right gives the state authority as stated in Article 2 paragraph (2) of the UUPA. However, these various regulations and policies at the level of implementation do not harm the principles of the rights of the Indonesian people. The presence of the Job Creation Law which regulates land acquisition for development is considered pragmatic, more oriented towards investment and economic interests so it is considered to ignore the ideals and rights as well as the spirit of agrarian reform that favours the interests of farmers. The right of control of this state builds relations between the state and the nation, namely a kind of customary rights relationship that is raised at the highest level, namely the level that affects the entire territory of the country. The meaning of being controlled by the state contained in Article 33 of the 1945 Constitution is not explicitly formulated in its explanation. This allows the emergence of various interpretations of the meaning of this service trying to socialize land acquisition policies in the context of agrarian reform.

Abstract

Munculnya kesadaran hukum seyogyanya didorong oleh sejauh mana kepatuhan hukum didasarkan pada indoktrinasi, keakraban, utilitas, dan identifikasi kelompok. Tujuan kegiatan ini untuk mendeskripsikan kesadaran hukum masayarakat saat ini; dan mendeskripsikan upaya peningkatan kesadaran hukum masyarakat. Hasil pengabdian kepada masyarakat dengan mitra Majelis Hukum dan HAM Pimpinan Daerah Muhammadiyah Kabupaten Sragen menunjukan bahwa terdapat permasalahan hukum yang hingga saat ini tengah dihadapi oleh masyarakat antara lain permasalahan perlindungan anak, sengketa pertanahan, pencemaran lingkungan, permasalaha waris, permasalahan hak kekayaan intelektual dan lain sebagainya. Sebagai upaya membantu masyarakat untuk menghadapi persoalan hukum tersebut, maka diselenggarakan Sekolah Advokasi yang dilakukan secara blended (Luring-Daring) sebagai wadah untuk menyiapkan advokat maupun paralegal dalam Majelis Hukum dan HAM Kabupaten Sragen yang professional, berintegritas dan memiliki kepedulian kepada isu-isu hukum dan keadilan social.

Abstract

Children are human beings and therefore respecting children's human rights is the same as respecting human rights. In addition, children are an inseparable part of the survival of human life and the sustainability of the entire nation and state. This community service aims to: 1). Describe the current legal basis for child protection; and 2). Describe legal protection for children in the era of the covid-19 pandemic. The results of the service show that the Covid-19 pandemic phenomenon has an influence on the formation and regulation of children's character in all aspects and conditions, including the current situation in the midst of the COVID-19 pandemic which demands a change in children's interactions with full activities at home. Abstract

There is a lack of maximum realization of sustainable development in the Surakarta City Government’s partnerships. This study proposes a fishbone diagram that seeks the root causes that affect the realization of partnerships that encourage sustainable development in Surakarta. The study aimed to convey ideas on environment-based local government partnership policies (Eco-Partnerships) to achieve sustainable development. It was a descriptive, doctrinal-method legal research. The primary data was sourced from library research, and the author also carried out some field research. The research used several indicators, namely Surakarta City Government’s Partners, Regulations, and Culture as the small bones and the analysis result of the failure to realize eco-friendly partnerships as the big bone. The result of the study showed that the implementation status of 19 out of 52 regional partners and five regional partners with a focus on environmental activities had not yet been followed up by the regional government. The regulation was ineffective because the Surakarta Government lacked adequate policies on eco-partnerships. Therefore, the Surakarta City Government needed to enforce a policy based on regional regulations on partnerships that integrate economic, social, and environmental aspects (Eco-Partnership).

Abstract

This study aims to discuss the description of the implementation process of exchanging forest areas for the relocation of residents and legal certainty of ownership of community land certificates after the relocation of community forest area exchanges in Dusun Ngroto. The research method used in this research is juridical-empirical descriptive by using qualitative data analysis methods to review literature and events that actually occurred through observation and interviews. The research location is in Ngroto Hamlet, Pare Village, Selogiri District, Wonogiri Regency. Abstract

The Covid-19 has become a threat to the sustainability of human life so that the government/ruler is obliged to guarantee the protection of the rights of the people. This research aims to: 1). Describe the policy for the countermeasures and handling of Covid-19; 2). Describe the policy for the countermeasures and handling of Covid-19 from the perspective of Maqashid Syariah. This research is normative legal research conducted by examining library materials or secondary data. The approach used is the statutory approach and the conceptual approach. The current policy for countermeasures and handling Covid-19 marked by the formation of the Task Fore for the Acceleration of Handling Covid-19 through Presidential Decree No. 7 of 2020 and the imposition of restrictions on community activities through Instruction of the Minister of Home Affairs (Mendagri) Number 27 of 2021 concerning the Enforcement of Restrictions on Community Activities Level 4, Level 3, Level 2 Covid-19 in the Java and Bali Regions. The policy for the countermeasures and handling of Covid-19 in the perspective of Maqashid Syariah has been fulfilled in ensuring the protection of people’s rights in the five main elements of human life (din, nafs, nasl, masl, and ‘aql) expect an-nasl in terms of maintaining offspring which during the pandemic the divorce rate continued to increase, in 2015 as many as 5.89 percent of married couples divorced and rose to 6.4 percent in 2020. Therefore, the Government needs to optimize the policy for the countermeasures and handling of Covid-19 so that it can become an important part of the government strategy aimed at ensuring the protection of people’s rights in the five main elements of Maqashid al-Syari’ah.

Abstract

Advances in technology and information demand that the law can accommodate all forms of need for legal protection in the future. Objective : This research aims to describe the picture of threats to data resources in the midst of the COVID-19 pandemic as well as describe personal data protection policies in the midst of the Covid-19 pandemic. Methods : This research uses the literature review method. The literary materials obtained are in the form of scientific papers, online media, books, etc. that concerns the analyzed object. Findings : The current personal data protection policy is still based on Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions which until now is considered not optimal to ensure legal protection of data resources in the era of the Covid-19 pandemic. 19. Data reports from the National Cyber and Crypto Agency show that until 2020 cyber attacks in Indonesia have increased to reach 190 million cyber attacks. Function : This research provides an explanation of the urgency of the need for legislation that specifically regulates the protection of personal data. Novelty : There has not been any researches that study the same topic as that discussed in this article.

Abstract

Every child has human rights as well as the rights of adults, so respecting children's rights is the same as respecting human rights. This paper aims to compare the policy of imposing the death penalty on a child between Iran and Indonesia. This research is a normative legal research conducted by examining library materials or secondary data. The approach used is a comparative approach, which is to compare child protection laws between Iran and Indonesia. The regulation of criminal penalties against children in Iran is regulated in Article 91 of the Iranian Islamic Criminal Code in 2013 and in Indonesia it is regulated in Law Number 35 of 2014 concerning Child Protection and Law Number 11 of 2012 concerning the Child Criminal Justice System. The regulation of legal protection for children in Iran and in the State of Indonesia, when compared, has quite basic differences in several aspects of the provisions of criminal acts and the criminal system. In the criminal setting in Iran, it justifies the application of the death penalty for crimes committed by children under 18 years of age. In the last 7 years, almost all juvenile offenders who were executed were sentenced to death based on qisas and hudud verses. Meanwhile, in Indonesia, it does not apply the death penalty to children but prioritizes restorative justice and diversion which is intended to avoid and keep children away from the judicial process so as to avoid stigmatization of children in conflict with the law and it is hoped that children can return to the social environment naturally.

Abstract

Integration between the correctional system and the protection of human rights is a must in the context of the role of the state as the holder of obligations in various human rights instruments, both national and international. One of these rights is the right to sexual needs. This study will discuss how the implementation of the fulfillment of the right to sexual needs for prisoners in the Class I Penitentiary Semarang? and What is the urgency of the policy to fulfill the right to sexual needs for prisoners at the Class I Penitentiary in Semarang? The research method used is a juridical-empirical approach by conducting field studies. The results of the research in this paper are that the implementation of the fulfillment of the right to sexual needs for prisoners in the Class I Penitentiary Semarang is not carried out in accordance with existing provisions, where the implementation is not provided with adequate facilities and infrastructure or there is a conjugal room, which is related to conjugal visits that have not been carried out. carried out accordingly, meanwhile the provision of leave to visit family 2x24 hours from the data given to 10 people has not been given CMK. Second, the urgency of the policy of fulfilling the right to sexual needs for prisoners at the Class I Penitentiary in Semarang is very necessary with the non-fulfillment of the right to sexual needs which will have a negative impact on the prisoners themselves, namely men who experience blockages in releasing their sexual desires can lead to sexual deviations.Keywords: sexual; convict; correctional institution ABSTRAK Integrasi antara sistem pemasyarakatan dengan perlindungan HAM merupakan suatu keharusan dalam konteks peran negara sebagai pemangku kewajiban dalam berbagai instrument HAM baik nasional maupun internasional. Salah satu hak tersebut yaitu ha katas kebutuhan seksual. Penelitian ini akan membahas mengenai Bagaimana pelaksanaan pemenuhan hak atas kebutuhan seksual bagi narapidana di Lembaga Pemasyarakatan Kelas I Semarang? dan Bagaimana urgensi kebijakan pemenuhan hak atas kebutuhan seksual bagi narapidana di Lembaga Pemasyarakatan Kelas I Semarang? Metode penelitian yang digunakan yaitu pendekatan hokum yuridis-empiris dengan dilakukan studi lapangan. Hasil penelitian di dalam penulisan ini yaitu pelaksanaan pemenuhan hak atas kebutuhan seksual bagi narapidana di Lembaga Pemasyarakatan Kelas I Semarang tidak dilaksanakan sesuai dengan ketentuan yang ada, dimana pelaksanaanya tidak disediakan sarana dan prasarana yang memadai atau adanya conjugal room, yang berkaitan dengan conjugal visit yang belum dilksanakan secara sesuai, sementara itu pemberian cuti mengunjungi keluarga 2x24 jam dari data yang diberikan kepada 10 orang belum ada yang diberikan CMK. Kedua, Urgensi kebijakan pemenuhan hak atas kebutuhan seksual bagi narapidana di Lembaga Pemasyarakatan Kelas I Semarang sangat diperlukan dengan tidak dipenuhinya hak atas kebutuhan seksual ini  akan memberikan dampak negative kepada narapidana itu sendiri yaitu pria yang mengalami sumbatan di dalam melepaskan hasrat seksnya dapat menyebabkan melakukan penyimpangan seksKata kunci: seksual; narapidana; lembaga pemasyarakatan
