Abstract

Munculnya kesadaran hukum seyogyanya didorong oleh sejauh mana kepatuhan hukum didasarkan pada indoktrinasi, keakraban, utilitas, dan identifikasi kelompok. Tujuan kegiatan ini untuk mendeskripsikan kesadaran hukum masayarakat saat ini; dan mendeskripsikan upaya peningkatan kesadaran hukum masyarakat. Hasil pengabdian kepada masyarakat dengan mitra Majelis Hukum dan HAM Pimpinan Daerah Muhammadiyah Kabupaten Sragen menunjukan bahwa terdapat permasalahan hukum yang hingga saat ini tengah dihadapi oleh masyarakat antara lain permasalahan perlindungan anak, sengketa pertanahan, pencemaran lingkungan, permasalaha waris, permasalahan hak kekayaan intelektual dan lain sebagainya. Sebagai upaya membantu masyarakat untuk menghadapi persoalan hukum tersebut, maka diselenggarakan Sekolah Advokasi yang dilakukan secara blended (Luring-Daring) sebagai wadah untuk menyiapkan advokat maupun paralegal dalam Majelis Hukum dan HAM Kabupaten Sragen yang professional, berintegritas dan memiliki kepedulian kepada isu-isu hukum dan keadilan social.

Abstract

Children are human beings and therefore respecting children's human rights is the same as respecting human rights. In addition, children are an inseparable part of the survival of human life and the sustainability of the entire nation and state. This community service aims to: 1). Describe the current legal basis for child protection; and 2). Describe legal protection for children in the era of the covid-19 pandemic. The results of the service show that the Covid-19 pandemic phenomenon has an influence on the formation and regulation of children's character in all aspects and conditions, including the current situation in the midst of the COVID-19 pandemic which demands a change in children's interactions with full activities at home. Abstract

There is a lack of maximum realization of sustainable development in the Surakarta City Government’s partnerships. This study proposes a fishbone diagram that seeks the root causes that affect the realization of partnerships that encourage sustainable development in Surakarta. The study aimed to convey ideas on environment-based local government partnership policies (Eco-Partnerships) to achieve sustainable development. It was a descriptive, doctrinal-method legal research. The primary data was sourced from library research, and the author also carried out some field research. The research used several indicators, namely Surakarta City Government’s Partners, Regulations, and Culture as the small bones and the analysis result of the failure to realize eco-friendly partnerships as the big bone. The result of the study showed that the implementation status of 19 out of 52 regional partners and five regional partners with a focus on environmental activities had not yet been followed up by the regional government. The regulation was ineffective because the Surakarta Government lacked adequate policies on eco-partnerships. Therefore, the Surakarta City Government needed to enforce a policy based on regional regulations on partnerships that integrate economic, social, and environmental aspects (Eco-Partnership).

Haryono No. 169 Malang e-mail: mohd.indrabangsawan15@gmail.com Abstrak Pada tulisan ini, Penulis mengangkat permasalahan terkait Suara Abstain pada E-RUPS Perseroan Terbuka. Pemilihan tema yang diangkat oleh Penulis dilatar belakangi oleh ketiadaan pengaturan Suara Abstain pada Undang-Undang Perseroan Terbatas (UU PT) dan hanya ditemukan pada Pasal 47 POJK Nomor 15/POJK.04/2020 dan Pasal 11 ayat (6) POJK Nomor 16/POJK.04/2020 di mana Suara Abstain tunduk pada ketentuan kuorum pada UU PT. Namun, secara normatif norma yang berkenaan dengan Suara Abstain memiliki beberapa kelemahan yang memberi celah hukum. Berdasarkan hal tersebut, penulis mengangkat rumusan masalah: (1) Apa urgensi dibentuknya pengaturan terkait kedudukan Suara Abstain pada agenda pengangkatan direksi dalam E-RUPS Perseroan Terbuka? (2) Apa formulasi pengaturan terkait kedudukan Suara Abstain pada agenda pengangkatan direksi dalam E-RUPS Perseroan Terbuka?. Penulisan ini menggunakan metode penelitian yuridis normatif dengan menggunakan pendekatan konseptual, perundang-undangan dan perbandingan. Hasil dari penelitian ini menunjukkan bahwa urgensi pengaturan kedudukan Suara Abstain didasari pada ambiguitas pemaknaan suara mayoritas yang ditambahkan oleh Suara Abstain yang belum menyesuaikan mekanisme voting yang berlaku pada rapat. Hal ini dapat menghambat pengambilan keputusan dalam rapat salah satunya keputusan pengangkatan direksi, sehingga direksi sebagai organ representatif perseroan pun terhalangi dalam menjalankan tugas dan wewenangnya. Kata Kunci: Suara Abstain, E-RUPS, Perseroan Terbuka, Direksi Abstract This research studies the issue of abstaining votes in an Electronic General Meeting of Shareholders (henceforth referred to as E-RUPS) in a public company. This research topic departs from the absence of the regulation of abstaining votes in Law concerning Public Company (UU PT) and this matter is only outlined in Article 47 Number 15/POJK.04/2020 and Article 11 Paragraph (6) of POJK Number 16/POJK.04/2020, where abstaining votes must comply with the quorum in UUPT. However, normatively, the norm regarding abstaining votes seems to have left a legal loophole. This research, therefore, is focused on studying: (1) the urgency of setting the regulation concerning abstaining votes in the appointment of a director of E-RUPS in a public company and (2) the formulation of the regulation concerning the position of abstaining votes in the appointment of a director of E-RUPS in a public company. This research refers to a normative-juridical method and conceptual and comparative approaches, revealing that the urgency of the regulation regarding abstaining votes is based on the ambiguity in the definition of majority votes added with abstaining votes, and this ambiguity is not relevant to the voting mechanism in a meeting. This issue certainly impedes a decision-making process in a meeting including that of the appointment of a director. In this case, the director as a representative organ in a company faces some hurdles in executing tasks and authority. Keywords: abstaining votes, E-RUPS, public company, director

Abstract

This study aims to discuss the description of the implementation process of exchanging forest areas for the relocation of residents and legal certainty of ownership of community land certificates after the relocation of community forest area exchanges in Dusun Ngroto. The research method used in this research is juridical-empirical descriptive by using qualitative data analysis methods to review literature and events that actually occurred through observation and interviews. Abstract

The Covid-19 has become a threat to the sustainability of human life so that the government/ruler is obliged to guarantee the protection of the rights of the people. This research aims to: 1). Describe the policy for the countermeasures and handling of Covid-19; 2). Describe the policy for the countermeasures and handling of Covid-19 from the perspective of Maqashid Syariah. This research is normative legal research conducted by examining library materials or secondary data. The approach used is the statutory approach and the conceptual approach. The current policy for countermeasures and handling Covid-19 marked by the formation of the Task Fore for the Acceleration of Handling Covid-19 through Presidential Decree No. 7 of 2020 and the imposition of restrictions on community activities through Instruction of the Minister of Home Affairs (Mendagri) Number 27 of 2021 concerning the Enforcement of Restrictions on Community Activities Level 4, Level 3, Level 2 Covid-19 in the Java and Bali Regions. The policy for the countermeasures and handling of Covid-19 in the perspective of Maqashid Syariah has been fulfilled in ensuring the protection of people’s rights in the five main elements of human life (din, nafs, nasl, masl, and ‘aql) expect an-nasl in terms of maintaining offspring which during the pandemic the divorce rate continued to increase, in 2015 as many as 5.89 percent of married couples divorced and rose to 6.4 percent in 2020. Therefore, the Government needs to optimize the policy for the countermeasures and handling of Covid-19 so that it can become an important part of the government strategy aimed at ensuring the protection of people’s rights in the five main elements of Maqashid al-Syari’ah.

Abstract

The legal approach (Law No. 35 of 2014 concerning Child Protection) in solving problems related to child protection during the Covid-19 pandemic has not shown optimal results so that an alternative approach is through a holistic approach that will elaborate on the relationship between law and other scientists. Objective: This research aims to: 1). Describe a holistic paradigm from a legal perspective; 2). Describe the concept of a holistic paradigm as an effort to protect children from acts of family-based violence during the Covid-19 pandemic. Methods: This research is normative legal research with a statutory approach and a holistic concept approach. Findings: A holistic approach in law means reinstatement the law with its environment; by reuniting it with society’s realities, it will restore the integrity of the law itself. A holistic approach to child protection in the Covid-19 pandemic era can be learnt in several aspects, namely religious aspects, health aspects, psychological aspects, sociological aspects, economic aspects and legal aspects. Function: This research explains the urgency of the holistic concept that regulates child protection, which means recombining the law with its environment. Novelty: There has not been any research that studies the same topic as that discussed in this article

Abstract

Advances in technology and information demand that the law can accommodate all forms of need for legal protection in the future. Objective : This research aims to describe the picture of threats to data resources in the midst of the COVID-19 pandemic as well as describe personal data protection policies in the midst of the Covid-19 pandemic. Methods : This research uses the literature review method. The literary materials obtained are in the form of scientific papers, online media, books, etc. that concerns the analyzed object. Findings : The current personal data protection policy is still based on Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions which until now is considered not optimal to ensure legal protection of data resources in the era of the Covid-19 pandemic. 19. Data reports from the National Cyber and Crypto Agency show that until 2020 cyber attacks in Indonesia have increased to reach 190 million cyber attacks. Function : This research provides an explanation of the urgency of the need for legislation that specifically regulates the protection of personal data. Novelty : There has not been any researches that study the same topic as that discussed in this article.

Abstract

Berangkat dari permasalahan perlu adanya perhatian serius dari pemerintah terkait jaminan perlindungan tenaga kerja Indonesia di luar negeri melalui penegakan hukum sehingga dapat menepis anggapan bahwa hukum dimanfaatkan oleh oknum tidak bertanggungjawab untuk membuat pola aktivitas perbudakan modern akibat lemahnya penegakan hukum. Pengabdian kepada masayarakat ini bertujuan untuk: 1). Mendeskripsikan perlindungan hukum pekerja migran Indonesia saat ini; dan 2). Mendeskripsikan upaya penyelesaian problem yang menimpa para pekerja migran Indonesia di luar negeri. Hasil pengabdian kepada masyarakat dengan mitra Pimpinan Cabang Istimewa ‘Aisyiyah Hong Kong menunjukan bahwa terdapat permasalahan hukum yang hingga saat ini tengah dihadapi oleh masyarakat antara lain permasalahan belum optimalnya penyelesaian konflik yang dialami oleh pekerja migran Indonesia di luar negeri. Sebagai upaya membantu masyarakat untuk menghadapi persoalan hukum tersebut, maka diselenggarakan pengabdian kepada Masyarakat yang dilakukan secara langsung sebagai wadah untuk menyiapkan pekerja migran Indonesia yang memiliki kesadaran diri dan kepedulian kepada isu-isu hukum dan keadilan sosial. Melalui Pengabdian hukum ini, para Pekerja Migran Indoensia menjadi paham terkait hak-hak dan metode penyelesaian hukumjika terjadi konflik.   Abstract Counseling on Problems and Legal Protection of Indonesian Migrant Workers in Hong Kong. Starting from the problem, there needs to be serious attention from the government regarding guaranteeing the protection of Indonesian workers abroad through law enforcement so that it can dispel the notion that the law is being used by unbalanced individuals to create a modern pattern of freezing activities due to weak law enforcement. This community service aims to: 1). Describe the current legal protection of Indonesian migrant workers; and 2). Describe efforts to resolve problems affecting Indonesian migrant workers abroad. The results of community service with partners from the Special Branch Leader of 'Aisyiyah Hong Kong show that there are legal problems that are currently being faced by the community, among other problems that have not yet optimally resolved the conflicts experienced by Indonesian migrant workers abroad. As an effort to help the community face these legal problems, community service is carried out directly as a forum for preparing Indonesian migrant workers who have self-awareness and concern for legal and social justice issues. Through this legal service, Indonesian migrant workers become aware of their rights and methods of legal resolution if a conflict occurs.
