Abstract

ABSTRAK Pernikahan di bawah umur sering menjadi polemik dan kontroversial dalam masyarakat umumnya dikarenakan masih ada asumsi bahwa pernikahan di bawah umur itu dibolehkan agama, serta dicontohkan oleh Nabi Muhammad Saw, seperti halnya Rasulullah Saw dengan Siti Aisyah ra. Dalam kaitannya dengan praktek pelaksanannnya di Indonesia sendiri, sudah banyak terjadi hal semacam ini termasuk di Desa Temba Lae Kec. Pajo Kab. Dompu Nusa Tenggara Barat. Metode penelitian ini adalah studi kasus dengan pendekatan kualitatif. Adapun teknik pengumpulan data yaitu menggunakan observasi, wawancara, dan dokumentasi. Data yang telah terkumpul kemudian di analisis dengan tahapan reduksi, display dan verifikasi selanjutnya di tarik kesimpulan. Hasil penelitian ini menunjukkan bahwa 1) Pernikahan di Dompu dikenal dengan dua istilah yaitu nikah taho dan nikah iha. Nikah taho adalah pernikahan yang disepakati oleh kedua keluarga, sedangkan nikah iha adalah pernikahan yang tidak disetujui oleh kedua belah pihak terutama dari keluarga wanita. Adapun faktor penyebab pernikahan di bawah umur di Desa Temba Lae ialah, faktor hamil pranikah, faktor kekhawatiran orang tua, faktor ekonomi, dan faktor rendahnya tingkat pendidikan. 2) Kemudian akibat pernikahan di bawah umur yaitu, yang pertama kesehatan ibu dan calon bayi. Pada dasarnya pernikahan di bawah umur berakibat negatif terhadap kesehatan ibu dan calon bayi, namun pada kenyataannya di lapangan hal tersebut tidak sesuai, sejauh ini baik ibu serta bayi yang dilahirkan oleh pasangan pernikahan di bawah umur masih aman dan baik-baik saja. Yang kedua keharmonisan rumah tangga, selama ini pasangan pelaku pernikahan di bawah umur di Desa Temba Lae masih menjalankan rumah tangga mereka dalam keadaan langgeng dan harmonis. Yang ketiga perceraian, memang pernikahan di bawah umur rentan terhadap percekcokan dan perselisihan antara kedua pasangannya namun sejauh ini frekuensi perceraian yang terjadi akibat pernikahan di bawah umur masih sangat sedikit.

Abstract

Marriage as a sacred bond between a man and a woman, is meant to produce offspring and the continuation of human life. However, not all couples want to have children or choose to be childfree. This phenomenon raises questions about the ideal concept of marriage in Islam towards childfree and its implications for inheritance. This study aims to determine the concept of marriage, the phenomenon of childfree, and its impact on inheritance in the perspective of Maqashid al-syari'ah. By using a qualitative method with a type of literature review research, this research analyzes the Islamic perspective on childless marriages, emphasizing the importance of maintaining human lineage (hifdz an-nasl) and protecting property (hifdz al-mal). The results of this research are: 1) The concept of ideal marriage in Islam related to protecting offspring (hifdz an-nasl) and protecting property (hifdz al-mal) aims to create a family that is prosperous materially and spiritually. 2) That having children is recommended in Islam, but not an obligation, and childfree is allowed as long as it does not conflict with the objectives of Islamic law. If childfree is contrary to Maqashid al-syari'ah, then it is prohibited. 3) For heirs who are childfree, the impact of inheritance can involve changes in the distribution of inherited property.

Abstract

This study investigates the implementation of Syed Muhammad Naquib al-Attas' concept of justice within Islamic economic law as a strategy to overcome the culture of patronage for the sustainability of the Indonesian economy. It aims to fill a literature gap by integrating al-Attas philosophical framework into an analysis of Indonesia's economic system. The research employs a systematic literature review (SLR) guided by the PRISMA protocol, with searches conducted in the Scopus database using relevant keywords. From 238 identified articles, 73 met the inclusion criteria for thematic analysis. The results reveal three primary findings. First, al-Attas' concept of justice, which emphasizes distributive justice, transparency, and the avoidance of exploitation, provides a robust philosophical foundation for Islamic economic law. Second, the deeply ingrained patronage culture acts as a major structural obstacle to realizing these justice principles, fostering social and economic inequality. Third, integrating Islamic values with sustainability principles such as the circular economy offers a holistic solution to contemporary challenges. The discussion underscores the need for interdisciplinary approaches and the leveraging of digital technology to enhance accountability and public participation. In conclusion, applying al-Attas' concept of justice holds significant potential for fostering a more inclusive and sustainable economic system. The practical implications call for policy reforms that align Sharia principles with sustainable development goals. However, this review is limited by its reliance on a single database (Scopus) and the predominance of conceptual rather than empirical studies, which may restrict the generalizability of the findings Future research should empirically test this framework using quantitative methods and further explore the role of technology in strengthening Islamic economic governance.

Abstract

Abstract: A teacher is required to be more creative in processing the learning process into something unique and interesting. Teaching creativity is defined as a quality in which teachers must develop new and imaginative ideas in teaching. Therefore, a creative response in teaching can be in the form of good classroom management that can create a conducive learning atmosphere, the use of interesting learning media, and variations in teaching styles. Real Work Lecture (KKN) is a concrete manifestation of the duties of lecturers and students in carrying out the Tri Dharma of Higher Education, namely the aspect of service. Through community service activities in the RW 06 area, Petukngan Selatan, there is a synergy between universities and the community as a form of democratic knowledge. The purpose of this service is to provide understanding to the local community about the importance of education to assist the government in educating the nation's children. Service is carried out through activities: Teaching KKN. The results of the service provide an illustration of increasing enthusiasm and increasing public understanding, especially teachers and parents, about how to foster creativity in educating, educational psychology, the importance of reading for children, tutoring and making learning media for teachers as materials for teaching in monotheism-based classes.

Abstract

Sharia governance has long been treated as an internal compliance apparatus built around the Sharia supervisory board, yet the digitalisation of Islamic finance has moved the object of governance beyond the boundaries of the conventional Islamic bank. This study reviews how the literature has framed Sharia governance in the context of Islamic financial technology and identifies the conceptual, contextual and methodological gaps that remain. Following the PRISMA protocol, 319 records were retrieved from Scopus and screened against publication window, journal quartile, duplication and abstract availability, yielding 86 studies published between 2015 and 2026. The corpus was coded thematically and organised through the Context, Intervention, Mechanism and Outcome logic. The results show a field geographically concentrated in Indonesia, Malaysia and the Gulf and Middle East and North Africa region, epistemologically dominated by agency theory, and methodologically weighted towards panel regression on secondary disclosure data, with quantitative designs accounting for 48.8 per cent of the classifiable corpus. Three findings stand out. The intervention repertoire remains structural, centred on board composition and disclosure, while technology enabled instruments are asserted rather than tested. The mechanisms documented in qualitative work, including fatwa repositioning, impression management and identity drift, indicate that compliance is negotiated rather than enforced, which the dominant quantitative apparatus cannot capture. Reported outcomes stop at financial performance, risk mitigation and disclosure quality, leaving maqasid oriented outcomes unmeasured. The study proposes a research agenda organised around hybrid governance design, algorithmic accountability and cross jurisdictional harmonisation.

Abstract

Background: The increasing interest in entrepreneurship among Generation Z, particularly in developing regions such as Bekasi, raises questions about the factors shaping their entrepreneurial motivation and confidence in the digital era. Understanding these influences is essential for fostering young entrepreneurs. Purpose: This study aims to examine the influence of social media, risk perception, and social support on the entrepreneurial motivation and confidence of Generation Z in Bekasi. Design/method/approach: A quantitative approach using path analysis was employed, involving 325 Generation Z respondents aged 18-29 years in Bekasi. Data were collected through a Likert-scale questionnaire and analyzed using SmartPLS 4.0. The analysis included outer model tests (convergent validity, discriminant validity, composite reliability, and Cronbach’s alpha), inner model tests (path coefficient and goodness of fit), and hypothesis testing. Results: The findings indicate that social support and risk perception have a direct and significant effect on entrepreneurial motivation, while social media does not. Entrepreneurial motivation also serves as a strong mediator, through which social support and risk perception indirectly influence entrepreneurial confidence. Contribution/value: This study contributes to the understanding of entrepreneurial behavior among Generation Z by highlighting the mediating role of motivation and the relative insignificance of social media, offering insights for educators, policymakers, and entrepreneurial programs targeting youth.

Abstract

This study aims to identify the role of fintech innovation in improving public literacy on endowments (wakaf) in Indonesia, as well as the opportunities and challenges in its implementation. Although the potential of endowments in Indonesia is vast, public understanding of its concepts and benefits remains limited. The research gap shows that the traditional and opaque management of endowments requires innovation to optimize it. Fintech innovation can bridge this gap by offering digital platforms that ease access and enhance transparency in endowment management. The research method used is a qualitative approach with a literature review, collecting data from relevant written sources, such as books, articles, and journals. Data analysis follows the Miles and Huberman interactive model, involving data reduction, presentation, and conclusion drawing. The results show that fintech for endowments has significant potential to improve public literacy through digital platforms that provide comprehensive and easily accessible information. However, this innovation also faces challenges such as unclear regulations, low digital literacy, and security threats. Therefore, collaboration among the government, endowment institutions, and fintech providers is necessary to develop clear regulations, improve digital literacy, and ensure transaction security. With these steps, fintech for endowments can effectively optimize the potential of endowments as an Islamic philanthropy instrument.

Abstract

The issue of justice in the distribution of joint property after divorce is still a crucial issue in Indonesia, both in the practice of religious justice and in the life of the Muslim community. This article discusses the concept  of distributive justice from the perspective of Islamic law and its implementation in the settlement of common property disputes. The purpose of this study is to analyze the extent to which the principles of distributive justice derived from Islamic teachings, such as proportional justice, benefits, and gender equality, are applied in the practice of sharing common wealth. The method used is library research with a normative qualitative approach, examining some of the data obtained and then analysis is carried out by examining how the principles of distributive justice are formulated in Islamic legal theory and how their implementation is reflected (or even neglected) in the practice of resolving joint property disputes in court. The findings of the study show that in Islamic legal theory, the division of common property emphasizes the principle of justice based on the contributions and needs of each party, rather than merely equal distribution. In practice, the implementation of this principle often encounters obstacles, both due to the limitations of proof of economic contribution and cultural bias factors that are still strong in the community and the legal apparatus. In conclusion, the application of distributive justice in common property disputes requires a deep understanding of the principles of maqāṣid al-sharī'ah and innovation in proving contributions, so that the goal of substantive justice is truly achieved in every court decision.

Abstract

The growing demand for sharia-compliant property financing among the millennial generation has positioned Musyarakah Mutanaqishah (MMQ) as a strategic contract within Islamic banking. However, the practical implementation of MMQ in Indonesia continues to face challenges related to sharia compliance, contract structure rigidity, and limited adaptability to digital financial behaviors of younger consumers. This study aims to: First, examine the level of sharia compliance in the implementation of MMQ contracts at Indonesian Islamic banks, Second, identify innovations needed to enhance MMQ relevance for millennial customers; and Third, analyze the determinants of millennial preferences toward MMQ-based property financing. The research employs a sequential mixed-methods design, combining qualitative content analysis of MMQ contract documents from five major Islamic banks with a quantitative survey of 412 millennial respondents (aged 25-40) across five major Indonesian cities, analyzed using Structural Equation Modeling-Partial Least Squares (SEM-PLS). The findings reveal that: (1) sharia compliance scores ranged from 72.4% to 88.6%, with critical issues identified in the rental pricing mechanism (ujrah) and the proportional risk distribution; (2) digital integration, contract transparency, and rental flexibility significantly influence millennial preferences (β = 0.412, p < 0.001; β = 0.327, p < 0.001; β = 0.285, p < 0.001 respectively); and (3) religiosity moderates the relationship between sharia compliance perception and intention to use MMQ products. This study contributes to the Islamic finance literature by proposing an Integrative MMQ Innovation Framework that synthesizes sharia governance, digital transformation, and generational preferences. Practical implications are offered for Islamic banks, regulators (DSN-MUI, OJK), and Sharia Supervisory Boards to design more adaptive and compliant MMQ products for the millennial market.

Abstract

Penelitian ini dilatarbelakangi oleh meningkatnya praktik Child Grooming di era digital yang menjadi pintu masuk terjadinya kekerasan dan eksploitasi seksual terhadap anak. Penelitian bertujuan untuk mendeskripsikan bentuk dan praktik Child Grooming serta menganalisisnya melalui perspektif Maqashid Usrah dengan pendekatan Hifz Al-Nasl dan Hifz Al-Irdh. Penelitian menggunakan metode kualitatif dengan pendekatan studi kasus eksploratif dan pendekatan normatif. Data diperoleh melalui wawancara mendalam dengan Komisioner Komisi Perlindungan Anak Indonesia (KPAI), studi dokumentasi atas sejumlah kasus konkret yang ditangani KPAI, serta kajian literatur yang relevan. Analisis data dilakukan melalui tahapan reduksi data, penyajian data, dan penarikan kesimpulan dengan uji keabsahan menggunakan triangulasi teknik dan member check. Hasil penelitian menunjukkan bahwa praktik Child Grooming umumnya dilakukan melalui media digital dengan membangun kedekatan emosional, memperoleh kepercayaan korban, mengisolasi anak dari lingkungan terdekat, hingga mengarah pada eksploitasi seksual, sebagaimana tergambar dalam sejumlah kasus nyata yang ditangani KPAI. Ditinjau dari perspektif Maqashid Usrah, praktik tersebut bertentangan dengan tujuan syariat karena mengancam perlindungan keturunan (Hifz Al-Nasl) melalui rusaknya keamanan, perkembangan, dan masa depan anak, serta mencederai kehormatan (Hifz Al-Irdh) dengan merusak martabat, privasi, dan integritas korban. Oleh karena itu, diperlukan sinergi antara keluarga, masyarakat, negara, dan platform digital dalam memperkuat perlindungan anak serta meningkatkan literasi digital sebagai upaya pencegahan. Penelitian ini juga merekomendasikan agar KPAI mempertimbangkan pembentukan kategori pengaduan khusus Child Grooming, mengingat sejumlah kasus yang selama ini tercatat dalam klaster umum anak korban pornografi dan kejahatan siber pada dasarnya menampilkan pola pendekatan bertahap yang konsisten dengan karakteristik grooming.
