Abstract

Abstract The limitation of the presidential term has become one of the mandates of the 1945 Constitution of the Republic of Indonesia (UUD 1945), serving as the foundation for various laws in Indonesia. The restriction on the presidential term, allowing a president to be elected for only two consecutive or non-consecutive terms, imposes additional demands on the president to build Indonesia in line with prevailing ethical standards. However, issues arose in the year 2021 when there was discourse regarding the extension of the presidential term, leading to various parties presenting arguments on the matter. Therefore, researchers intend to conduct a study to interpret the UUD 1945 regarding the limitation of the presidential term using a normative juridical method. The researchers found that the UUD 1945 concerning the limitation of the presidential term can be interpreted as a means to avoid absolute power, enhance transparency, ensure the balance of the trias politica, increase participation and dialogue with the public, and promote the president's compliance with prevailing ethical standards.

Abstract

The performance target of the DPRD Secretariat is to provide satisfactory services and facilities for DPRD leaders and members and work together to achieve SKPD goals. The Banjarbaru City Regional People's Representative Council Secretariat carries out its main duties and functions to support all operational activities of DPRD leaders and members to guide several regulations so that they do not conflict with applicable legal norms. Description of the main duties and functions of the Banjarbaru City DPRD secretariat, there are changes to the Organizational Structure and Work Procedures (SOTK) which are determined and implemented in 2023. This research aims to analyze the effectiveness of the DPRD Secretariat's performance with the latest Mayor's Regulation Number 5 of 2023 for Banjarbaru City. In carrying out this analysis, the author used a normative qualitative approach (literature) and participant observation. The research results show that Mayor Regulation No. 5 of 2023 has returned all functional positions resulting from the alignment into structural positions again. With the enactment of Mayor's Regulation Number 5 of 2023, the DPRD Secretariat can perform optimally by achieving SKPD targets through strategic targets and Key Performance Indicators. This is because; 1) there is clarity of responsibility; 2) have a clear position; 3) have a clear relationship path; and 4) The duties and functions of each have been clearly described (job description).

Abstract

This study examines the multifaceted impacts of corrupt practices in the nickel mining industry in North Maluku. Corrupt practices in the mining sector remain a major issue, leading to various problems such as agrarian conflicts, environmental degradation, economic inequality, and health issues. Numerous studies indicate that these corrupt practices stem from the same scheme such as excessive exploitation of natural resources due to abuse of power by political elites at both local and national levels, who collude with entrepreneurs to commit maladministration mining permits, issuing overlapping licenses, and seizing land. This qualitative research collects data through interviews, field observations, and documentation. Data analysis includes reduction, presentation, and conclusion drawing. The study reveals that the nickel mining business in North Maluku still contradicts the principles of sustainable environmental conservation, human rights, and neglects the living rights of local communities. Therefore, To mitigate the impacts of mining exploitation, entrepreneurs need stronger corporate social responsibility, effective government policies, building collaborative partnerships, eliminating institutional corruption, and prioritizing a holistic and integrated approach to surrounding communities through social and economic development programs that emphasize community welfare and improve the equality of the environment, community, health, and local economy.

Abstract

Penelitian ini bertujuan untuk mengetahui peran Hakim dalam mewujudkan keadilan melalui hukum publik. Hukum yang diharapkan bisa memberikan keadilan bagi masyarakat ternyata sebaliknya. Efektifitas penegakan hukum hanya berlaku bagi masyarakat kecil yang melakukan kejahatan kecil. Sedangkan pelaku-pelaku kejahatan besar seperti korupsi, kolusi, dan nepotisme (KKN) yang lazim disebut penjahat berkerah putih (white collar crime) sangat sulit untuk disentuh. Penulisan ini menggunakan metode penelitian hukum normatif, karena penulis tidak melakukan studi lapangan. Hasil penelitian menunjukkan bahwa Hakim sudah menjalankan perannya dalam mewujudkan hukum publik dengan memperhatikan norma dan prinsip-prinsip dari negara hukum. Masyarakat yang baik adalah masyarakatyang taat dengan hukum yang berlaku baik tertulis maupun tidak tertulis.

Abstract

The Implementation of inclusive elections is one of the important indicators in the realization of substantive democracy. In Katingan Regency, efforts to fulfill the constitutional rights of person with disabilities in elections have become a serious concern of the local government and election organizers. The study examines in depth the policy implementation,challenges, and improvement efforts in ensuring the political participation of person with disabilities in Katingan Regency. The research uses a qualitative approach with normative-empirical legal research methods. The results show that despite strong legal guarantees, the implementation of the constitutional rightsof person with disabilities in elections still faces various challenges, including physical and information accessibility, a administrative barries, and social stigma. Efforts by the government and the General Election Commission to overcome these challenges include the provision of inclusive voting aids, officer training, and public awareness campaigns. This research recommends strengthening the legal framework, improving accessibility, active participation of people with disabilities, inclusive voter education, and improving the data collection system. In conclusion, commitment and sustained efforts from all stakeholders are needed to realize truly inclusive and accessible elections for people with disabilities, so as to strengthen democracy and realize for equality for all Indonesians. Abstract

Talent management plays an important role in improving managerial job retention, especially in the public sector. This study aims to explore talent management implementation strategies that can improve employee loyalty in Banjarbaru City. Using a descriptive qualitative approach, data were collected through in-depth interviews and document analysis. The results of the study indicate that competency development, performance-based rewards, and work-life balance policies are the main factors in reducing turnover. As well as providing practical recommendations for policy makers. This study also highlights the need for transparency in promotion and employee participation in policy making. The theoretical and practical implications of this study provide insights for more effective human resource management in the government sector. Further studies are recommended to expand the scope and use quantitative methods to increase the validity of the findings.

Abstract

Protocol ethics are an important aspect in government management that significantly influences the image of a leader. This study focuses on the Mayor of Banjarbaru and how protocol ethics contribute to public perception. The data shows that leaders who implement good protocol ethics tend to have a positive image in the eyes of the public. The research method used is qualitative with interviews, observations, and literature studies as data collection techniques. This study aims to identify the principles of protocol ethics and their impact on the image of the Mayor of Banjarbaru and provide recommendations for protocol practices in government.

Abstract

Researchers are interested in conducting research on the effectiveness of ATCS use policies in improving the smoothess and safety pf traffic in Banjarbaru City, because ATCS is a policy implemented by the Banjarbaru City government to reduce the level of congestion and also a form of public service in the traffic sector. This research was conducted with the aim of evaluating the effectiveness of ATCS use polocies in overcoming traffic problems in Banjarbaru City. The research uses qualitative research methods using interviews, observation and documentation to collect problem data based on facts. The research results show that the implementation of ATCS in Banjarbaru City has shown positive results in reducing congestion. With the ability to manage traffic dynamically, this system can adjust the timing of green and red lights based on the volume of passing vehicles. This is very important, especially during rush hour, where traffic tends to by heavy.

Abstract

The rapid development of information and communication technology (ICT) in the Industrial 4.0 era has transformed governance globally, including in Indonesia, where e-government initiatives are a national priority. This study examines the implementation and impact of Parak Acil Online, a digital platform introduced by the Population and Civil Registration Office (Disdukcapil) in Banjarmasin, aimed at streamlining public service delivery for population documents such as e-KTP, family cards, and birth certificates. The research employs a qualitative approach, guided by the E-GovQual and Delone & McLean IS Success models, to evaluate the platform’s performance across six dimensions: Ease of Use, Trust, Functionality of Interaction Environment, Reliability, Content and Appearance, and Citizen Support. Findings reveal that Parak Acil Online significantly enhances service accessibility, transparency, and efficiency. However, challenges persist, including digital literacy gaps, infrastructure limitations, and system performance issues, such as delays and occasional crashes during peak usage. Respondents highlighted the need for improved accessibility features, real-time support tools, and enhanced backend optimization. This study contributes by providing a comprehensive evaluation framework and actionable insights for optimizing e-government platforms in developing regions. By addressing these challenges, Parak Acil Online can achieve sustainable digital transformation and serve as a benchmark for equitable public service delivery in Indonesia and beyond.

Abstract

Puasa merupakan praktik universal yang melintasi berbagai zaman dan budaya, termasuk dalam konteks prasejarah, sejarah global, dan spesifik di Nusantara. Pada masa prasejarah, puasa mungkin berfungsi sebagai ritual spiritual dan strategi bertahan hidup, dengan indikasi dari temuan arkeologis yang menunjukkan adanya praktik menahan diri sebagai bagian dari upacara religius atau sebagai adaptasi terhadap kekurangan makanan. Di tingkat global, puasa dipraktikkan dalam berbagai bentuk di berbagai agama, seperti puasa Ramadan dalam Islam, puasa Yom Kippur dalam Yahudi, dan puasa Upawasa dalam Hindu, menunjukkan betapa pentingnya puasa dalam kehidupan spiritual dan sosial manusia. Di Nusantara, puasa menggabungkan elemen-elemen tradisi lokal dengan ajaran agama, seperti puasa Ramadan di kalangan Muslim, Upawasa di Bali, dan puasa adat di berbagai suku. Selain dimensi spiritual dan budaya, puasa juga memiliki mekanisme biologis yang signifikan. Autofagi, proses seluler di mana sel memecah dan mendaur ulang komponen internalnya, meningkatkan kesehatan dan ketahanan sel. Integrasi antara aspek historis, budaya, dan mekanisme biologis puasa menunjukkan kompleksitas dan pentingnya praktik ini dalam berbagai konteks. Program kreatifitas masyarakai (PKM) ini menyoroti evolusi budaya berpuasa dan manfaatnya untuk bertahan hidup. Berdasarkan uraian pada evolusi budaya berpuasa dan dielaborasi dengan metode structural equation modelling (SEM), tanggapan 31 responden menunjukan sebagai berikut ini; sangat mengerti (2,3 %), mengerti (66,9 %), kurang mengerti (27,9 %) dan tidak mengerti (2,9 %). PKM ini dapat dimanfaatkan sebagai informasi untuk menjelaskan bagaimana manusia bisa bertahan hidup dengan berpuasa. Kata kunci: puasa; prasejarah; agama; autofagi; hidup
