Abstract

Based on the developments that have occurred in Indonesia since August 18, 1945, this research explains how the idea of the constitution was born. The author's goal is to delve into various ideas and laws related to the Indonesian constitution. This research uses normative juridical methodology; qualitative descriptive analysis and secondary data collection are the backbone of the research. The research results show that the Indonesian Constitution has undergone four changes, namely from the 1945 Constitution to the RIS Constitution, the 1950 Constitution, and back to the 1945 Constitution. These changes have been influenced by internal and external factors, as well as different political and legal situations in Indonesia. Therefore, Indonesia's state system continues to evolve. In conclusion, in Indonesia, the constitution continues to undergo revisions. Several factors contribute to the evolution of the Indonesian constitution. One of them is the hasty and imperfect drafting of the BPUPKI document. Another example is the pressure from the Netherlands, which led to the amendment of the 1945 Constitution, changing the legal politics of the state and the constitutional framework of the Republic of Indonesia.

Abstract

The Constitutional Court was formed to maintain the integrity of the Constitution through a deeper interpretation based on the 1945 Constitution. This journal discusses the influence of CC Decision No. 90/PUU-XXI/2023 on the Authority and Dignity of the Constitutional Court as Guardian of the Constitution. The study combines a literature review methodology with a qualitative approach. The research results show that CC Decision No. 90/PUU-XXI/2023 is contrary to the Constitutional Court's authority based on the 1945 Constitution. The addition of new regulations that were previously unregulated or not is not outside the Constitutional Court's jurisdiction, but rather the legislative authority. Research examines the importance of maintaining judicial neutrality to prevent abuse of power. The Constitutional Court, as the Guardian of the Constitution, must pay attention to the rights of citizens and maintain the balance of power. With this controversial decision, in the context of the CC authority which should be limited to constitutional review and maintaining the neutral role of the judiciary in fighting abuse of power by the legislature and executive. Even though the Constitutional Court is the final decision maker on laws based on the 1945 Constitution, its authority is limited to reviewing laws and is not involved in the legislative realm.

Abstract

Public service at the sub-district level serves as the frontline of government in ensuring citizens’ basic rights, particularly for vulnerable groups such as persons with disabilities, the elderly, and underprivileged families. This study analyzes governance practices in Banjarmasin Utara Sub-district by focusing on policy integration, staff capacity, collaboration among actors, and local cultural dynamics. A qualitative case study was conducted through in-depth interviews, participatory observation, and document review. The findings indicate that although regulations and standard operating procedures for priority services exist, their implementation is constrained by limited budgets, insufficient staff training, and uneven digital infrastructure. Community support, staff improvisation, and informal social networks help bridge institutional gaps, but may also lead to inequities. A hybrid model combining digital and face-to-face services emerges as an adaptive strategy to reach vulnerable groups. The study contributes by showing that the effectiveness of inclusive governance at the sub-district level depends on the synergy between formal policy, operational capacity, collaboration, and cultural sensitivity.

Abstract

This study evaluates the implementation of the E-Mutasi application in the process of proposing periodic salary increases for Civil Servants (PNS) at the Regional Civil Service Agency (BKD) of South Kalimantan. The application is designed to enhance the efficiency of civil service administration through process digitalization, reducing the use of physical documents, and accelerating decision-making. The study employs a descriptive qualitative approach using observation and interviews. The findings indicate that the E-Mutasi application supports the principles of good governance, such as transparency, efficiency, and accountability, despite encountering technical challenges, including limited file upload capacity and insufficient training for new users. Recommended solutions include increasing server capacity, integrating the application with the employee information system, and providing continuous training for personnel administrators. With these optimizations, the E-Mutasi application is expected to improve the quality of public services and support bureaucratic reform toward better governance.

Abstract

Flooding in South Kalimantan has become increasingly severe due to deforestation, inadequate infrastructure, and urbanization. This study analyzes strategies to mitigate floods through infrastructure strengthening and environmental conservation. Using a mixed-methods approach, the research identifies deforestation as a primary driver of flood risk, reducing the land's water absorption capacity and worsening runoff. Urban areas, particularly Banjarmasin and Martapura, experience recurrent floods due to outdated drainage systems incapable of handling extreme rainfall exacerbated by climate change. Infrastructure improvements, such as modernized drainage systems, dams, and embankments, are crucial but must be supported by conservation efforts. Reforestation, river restoration, and sustainable watershed management significantly reduce flood risks by enhancing ecological resilience. Collaborative governance involving government agencies, local communities, and private sectors is essential to address resource limitations and improve flood preparedness. This integrated approach combines infrastructure development and ecosystem-based solutions to create sustainable, long-term flood mitigation strategies. By prioritizing environmental restoration, adaptive infrastructure, and multi-stakeholder collaboration, South Kalimantan can enhance its resilience against flood disasters.

Abstract

This study aims to examine the implementation of a Risk-Based Governance Audit (GBA) at the Banjarmasin City Inspectorate and its contribution to strengthening local government governance. The research employed a descriptive qualitative method with a case study design, using in-depth interviews, participatory observation, and audit document analysis, analyzed through the interactive model of Miles & Huberman. The results show that the Banjarmasin Inspectorate has implemented a Risk-Based Annual Supervision Work Program (PKPT) by categorizing Regional Apparatus Organizations (OPD) based on vulnerability levels, indicating improvements in the Government Internal Control System (SPIP), Risk Management Index (MRI), and Corruption Control Effectiveness Index (IEPK). However, the limited number of certified auditors, weak local regulations, and bureaucratic cultural resistance remain significant challenges. This research expands the GBA model by incorporating the dimension of bureaucratic culture as a determinant of risk-based audit effectiveness while reinforcing the role of risk-based GBA in enhancing transparency, accountability, and the overall effectiveness of local government governance.

Abstract

Transformasi digital dalam administrasi pemerintah daerah merupakan keharusan strategis untuk mewujudkan efisiensi, transparansi, dan akuntabilitas. Penelitian ini menganalisis implementasi E-Finance di Sekretariat Daerah Kabupaten Hulu Sungai Utara sebagai inovasi terintegrasi dalam pengelolaan administrasi keuangan, dengan fokus pada efektivitas sistem, hambatan yang dihadapi, serta strategi keberlanjutan dan replikasi. Melalui pendekatan kualitatif dengan metode studi kasus, dilakukan wawancara mendalam dengan 12 informan kunci (PPTK, Verifikator, KPA, Bendahara, dan pimpinan), observasi langsung penggunaan aplikasi, serta telaah dokumen SOP, kebijakan, dan laporan implementasi. Hasil penelitian menunjukkan bahwa E-Finance berhasil mengurangi waktu pemrosesan SPJ dari 2-3 hari menjadi 3-5 jam, meminimalisir kesalahan administrasi hingga 85%, dan meningkatkan transparansi real-time dalam pelacakan anggaran. Sistem ini telah mengintegrasikan empat aktor kunci (PPTK, Verifikator, KPA, Bendahara) melalui dashboard terpusat yang menghubungkan perencanaan anggaran hingga pencairan dana dan pelaporan. Namun, tantangan signifikan ditemukan pada resistensi SDM terhadap perubahan digital (52% masih menganggap rumit), kapasitas infrastruktur jaringan yang belum merata, dan perlunya penyesuaian SOP yang berkelanjutan. Penelitian merekomendasikan: (1) penguatan pelatihan ASN berbasis kompetensi digital dan change management; (2) pengembangan infrastruktur jaringan terintegrasi di seluruh SKPD; (3) monitoring evaluasi berkelanjutan dengan KPI terukur; (4) kolaborasi dengan Dinas Kominfosandi untuk peningkatan aplikasi; serta (5) strategi replikasi bertahap ke SKPD lain sebagai scalable innovation. Kontribusi novelty penelitian ini terletak pada: dokumentasi lengkap model implementasi E-Finance di tingkat kabupaten, analisis mendalam terhadap mekanisme integrasi aktor-aktor keuangan dalam ekosistem digital, serta kerangka kerja strategis untuk transformasi digital berkelanjutan di administrasi publik daerah.

Abstract

This study analyze the implementation of good governance-based protocol management in enhancing the leadership image of the regional head in Hulu Sungai Utara Regency. The research employed a qualitative approach with a case study design. Data were collected through in-depth interviews, observations, and documentation studies involving eleven informants from the Protocol and Leadership Communication Division of the Regional Secretariat of Hulu Sungai Utara Regency. Source and method triangulation techniques were used to ensure data validity, while data analysis followed the interactive model of Miles and Huberman. The results show the principles of good governance have been applied in protocol management through four main aspects: transparency, accountability, effectiveness, and professionalism. Transparency is reflected in the openness of official activity information shared through internal media and online publications. Accountability is demonstrated through the preparation of comprehensive and periodic activity reports. The effectiveness of the protocol team is evident in strong inter-departmental coordination and adaptability to field conditions, while professionalism is reflected in discipline, work ethics, and adherence to protocol standards in appearance and conduct. However, the study also identifies several challenges, including limited human resources, the dense schedule of the regional head’s activities, and the suboptimal use of information technology for digital documentation. Overall, the implementation of good governance-based protocol management has positively contributed to improving the leadership image of the regional head. Well-organized, transparent, and professional official activities have shaped public perceptions of credible, open, and authoritative leadership.

Abstract

This study analyzes the governance crisis in tourism management at Kampung Ketupat, a community-based tourism destination in Banjarmasin, Indonesia, in 2024. The city government promoted the area as a community-based tourism destination; however, over time, it experienced a decline in visitor numbers and ceased operations in early 2024. This research employs a qualitative approach through in-depth interviews with local communities, government officials, and tourism stakeholders, complemented by field observations and analysis of relevant policy and planning documents. The data were analyzed using thematic analysis to examine patterns of collaboration, forms of participation, and power relations among actors. The findings indicate weak collaborative governance, the dominance of top-down decision-making, and limited community participation that remains largely symbolic. Although formally involved, local communities lack substantive influence over planning, management, and benefit distribution processes. Government and non-community actors continue to dominate policy direction, financial management, and spatial utilization. This condition reflects social exclusion and spatial injustice, in which communities are marginalized from spaces they have historically and culturally inhabited. The study emphasizes that the governance crisis is not merely technical or administrative in nature, but is rooted in unequal power relations, weak accountability, and institutional failure to ensure meaningful citizen participation.

Abstract

Talent management plays an important role in improving managerial job retention, especially in the public sector. This study aims to explore talent management implementation strategies that can improve employee loyalty in Banjarbaru City. Using a descriptive qualitative approach, data were collected through in-depth interviews and document analysis. The results of the study indicate that competency development, performance-based rewards, and work-life balance policies are the main factors in reducing turnover. As well as providing practical recommendations for policy makers. This study also highlights the need for transparency in promotion and employee participation in policy making. The theoretical and practical implications of this study provide insights for more effective human resource management in the government sector. Further studies are recommended to expand the scope and use quantitative methods to increase the validity of the findings.
