Abstract

Improving communities concience regarding the legal protection of genetic resources as an instrument for environmental conservation is an urgent activity, particularly to empower farmer groups who are highly vulnerable to various problems. This is exacerbated by a lack of public understanding regarding the prohibition on illegal logging, including the permissibility of illegal logging in the area. Given this situation, legal awareness is crucial, particularly regarding the legal obligation to conserve forests, especially in forest areas. The community of Pakuli Village, Gumbasa District, Sigi Regency, needs to understand this to foster a harmonious relationship between the environment and humans. The activity began with field observations, followed by contact with the neighborhood unit (RW) head for administrative purposes, scheduling activities, and inviting prospective participants to the training. Lectures and interactive dialogues were held in the afternoon, as this time would not disrupt residents' work. It can be concluded that the community's low level of understanding regarding the legal protection of genetic resources is due to a lack of information/socialization regarding the prohibition on illegal logging, including the permissibility of illegal logging in the area.

Abstract

This study aims to analyze the terminological weaknesses and regulatory overlaps within the Electronic Information and Transactions Law (UU ITE) and the Personal Data Protection Law (UU PDP) that create legal loopholes for invasive direct marketing practices via SMS spam, as well as to formulate a comprehensive legal reconstruction for the privacy rights of telecommunication customers. Employing a normative legal research method with conceptual and comparative approaches, this study reveals that the ambiguous definition of personal and household activities in Article 2 paragraph (2) of the UU PDP and the multi-interpretable phrase in Article 26 paragraph (1) of the UU ITE have led to regulatory disharmony and an enforcement gap. This loophole is heavily exploited by electronic system operators and third parties to send commercial messages without prior consent, directly violating the privacy rights of the consumers. As a resolution, this study concludes and recommends legal reconstruction through regulatory synchronization adopting General Data Protection Regulation (GDPR) standards, the enforcement of product liability for telecommunication providers, the limitation of commercial promotion hours, and the implementation of strict corporate sanctions. Furthermore, the government and legislative bodies are advised to immediately establish an independent data protection supervisory agency to ensure legal certainty, justice, and utility for the public.

Abstract

Foreign investment in Indonesia’s mineral and coal mining sector has surged significantly, driven by growing global demand and the country’s strategic resource position, particularly amid the energy transition. However, this influx exposes two critical challenges. First, the investment regulatory framework remains fragmented and inconsistent, creating loopholes that enable foreign investors to dominate strategic national resources without sufficient safeguards for domestic stakeholders. Second, weak enforcement of competition law fosters unfair business practices, including cartel formation, abuse of dominant positions, collusive tendering, and regulatory manipulation through undue influence on public officials. These practices undermine fair competition, harm local enterprises, reduce state revenue, and threaten environmental sustainability. This study critically examines the gaps in Indonesia’s investment and competition legal frameworks and their interaction within the mining sector. Using a normative and comparative legal analysis, it reveals how governance weaknesses perpetuate imbalances in the business relationships between foreign and domestic actors. The principal contribution lies in proposing a legal policy reform agenda aimed at balancing the imperative of attracting foreign capital with ensuring equitable competition and responsible resource management. Recommendations emphasize regulatory harmonization, institutional strengthening, and the implementation of effective sanctions to foster a transparent, fair, and sustainable investment climate. This research is timely given Indonesia’s pivotal role in the global mineral supply chain and its commitment to sustainable development.

Abstract

This paper explores the intersection between international investment law and domestic regulatory frameworks in Southeast Asia, with a particular focus on unfair competition in Indonesia’s mining sector. As Southeast Asia continues to attract foreign direct investment (FDI), legal disputes involving foreign investors and host states have become more frequent, particularly in resource-rich industries. Using Indonesia as a case study, this research analyzes how allegations of unfair competition—such as discriminatory licensing, state favoritism toward domestic enterprises, and lack of transparency—can trigger claims under international investment agreements (IIAs). The novelty of this paper lies in its focus on the underexplored tension between international investment protections and national efforts to regulate competition in strategic sectors. Through doctrinal legal analysis and selected case reviews, the paper highlights inconsistencies between Indonesia’s domestic legal framework and its international obligations, particularly under bilateral investment treaties (BITs). The contribution of this study is twofold: first, it provides a critical legal mapping of how unfair competition claims in the mining sector may escalate to investor-state dispute settlement (ISDS); second, it offers policy recommendations to harmonize investment protection with fair competition principles. Ultimately, this paper argues that unless Southeast Asian countries, particularly Indonesia, reform their investment governance and competition policies, they risk increased litigation and a chilling effect on sustainable investment. This research adds to the growing discourse on how developing countries can balance investor protection with national economic sovereignty.

Abstract

The era of free trade, including trade in labour services, has been confirmed in the General Agreement on Trade in Services, which guarantees everyone the right to work anywhere, including in Indonesia, without discrimination while complying with Indonesian national laws. However, the entry of foreign workers raises several problems in the social and economic fields as well as security and order regarding the placement of these foreign workers. Regulation over the workers is ineffective because only a few authorities are delegated to the local government. This study aims to determine and measure the effectiveness of supervision of foreign workers by the Department of Manpower and Transmigration of the Central Sulawesi Province and to describe the supervision standards of foreign workers that already exist and should be implemented. The empirical legal research is used to examine the provisions of the supervision of foreign workers through observation, in-depth interviews, and focus group discussions. The data that have been collected are processed, classified, qualified, and then analysed qualitatively. The study found that only a few authorities regulated the duties and functions of supervision. The standard of foreign worker supervision has yet to be specifically regulated, so it still faces obstacles regarding coordination between the authorised agencies.

Abstract

Addresses the urgent need for a legal framework to regulate rock mining in the geologically fragile Palu–Donggala coastal region, where exploitation often conflicts with the constitutional Right to a Good and Healthy Environment (Article 28H of the 1945 Constitution). It examines the failure of local governments to fulfill their obligation to protect citizens’ rights and the ineffectiveness of existing sanctions. Using a normative legal (juridical-normative) method with constitutional, progressive human rights, and conceptual approaches, the research analyzes ius constitutum and ius constituendum through doctrinal interpretation. The research formulates the Dual Liability Model, which holds corporations financially accountable for ecological losses and local governments legally responsible for rights violations. This model promotes the use of Environmental Carrying Capacity (ECC) as an absolute veto in licensing, ensuring stronger environmental governance and effective restoration of citizens’ rights in disaster-prone regions..

Abstract

Peningkatan angka perkawinan campuran di Indonesia turut memperbesar populasi anak berstatus hukum ganda yang akan menghadapi persoalan keperdataan lintas yurisdiksi, termasuk hak atas warisan, sementara Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan tidak mengatur   secara eksplisit kedudukan anak tersebut sebagai ahli waris. Kasus konkret seperti Putusan Pengadilan Tinggi DKI Jakarta Nomor 521/PDT/2020/PT.DKI menegaskan bahwa ketidakpastian ini bukan sekadar wacana teoretis, melainkan persoalan nyata dalam praktik peradilan. Penelitian ini bertujuan menganalisis implikasi hukum perkawinan campuran terhadap hak waris anak serta menentukan sistem hukum yang berlaku dalam pembagiannya. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, historis, dan konseptual. Bahan hukum primer, sekunder, dan tersier dikumpulkan melalui studi kepustakaan dan dianalisis secara kualitatif-preskriptif. Hasil penelitian menunjukkan adanya kekosongan norma dalam Undang-Uundang Perkawinan berinteraksi dengan status keperdataan anak berdasarkan Pasal 42 dan 43, serta status kewarganegaraan ganda terbatas yang menimbulkan ketidakjelasan kecakapan menerima hak milik atas tanah sesuai Pasal 21 Undang-Undang Nomor 5 Tahun 1960. Dalam praktik, hakim menerapkan prinsip public ordre sebagai instrumen protektif, bukan penolakan. Sistem hukum yang berlaku ditentukan melalui kerangka bertingkat: titik taut lex rei sitae untuk harta tidak bergerak dan lex patriae untuk harta bergerak, dilanjutkan penentuan hukum waris internal berdasarkan agama dan golongan penduduk pewaris. Penelitian ini menyimpulkan adanya ketidakharmonisan antara ketentuan yang ada pada Undang-Undang perkawinan, Undang-Undang Kewarganegaraan dan Undang-Undang Pokok Agraria.

Abstract

Introduction: Social problems such as poverty, violence, discrimination, and environmental degradation often lead to legal challenges that exacerbate inequality. Communities facing these problems need not only legal interventions but also resilience-building strategies to cope with ongoing challenges.Purpose: This paper examines comprehensive legal interventions aimed at building legal resilience in communities, focusing on how community legal services can empower individuals to navigate complex social problems effectively.Method: The research is based on qualitative interviews with community leaders, legal professionals, and individuals who have benefited from legal interventions. It also includes a review of community legal initiatives that combine legal aid with empowerment strategies.Findings and Results: The study finds that legal interventions that include education, empowerment, and long-term support help communities build resilience to social problems. Successful programs also focus on creating networks of legal advocates within the community to ensure sustainability.Urgency: The urgency of addressing legal vulnerabilities in marginalized communities cannot be overstated, as these issues contribute to long-term cycles of poverty and inequality.Contribution: This paper contributes by offering a framework for building legal resilience, which is essential for empowering communities and fostering sustainable solutions to social problems.Recommendation: The study recommends investing in community-led legal programs that emphasize education, empowerment, and long-term capacity building.
