Abstract

The concept of judicial guardianship in marriage is a significant issue in Islamic family law that highlights the fundamental differences between the Shafi‘i school in Indonesia and the Ja‘fari school in Iran. This distinction is not only juridical but also closely linked to the objectives of marriage (maqasid al-nikah), namely the preservation of religion (hifz al-din), lineage (hifz al-nasl), dignity (hifz al-ird), and family welfare. This study employs a qualitative-juridical approach with normative-comparative analysis. Data were drawn from classical fiqh texts, Indonesian and Iranian marriage regulations, and contemporary literature. The analysis proceeded in three stages: (1) identifying normative texts concerning guardianship and judicial guardianship in the Shafi‘i and Ja‘fari traditions, (2) comparing their conceptual and practical applications, and (3) evaluating their alignment with maqasid al-nikah, particularly in promoting benefits, preventing harm (mafsadah), and ensuring family continuity. The findings show that the Shafi‘i school regards the guardian as a prerequisite for valid marriage, with the judicial guardian acting as a substitute when a lineage guardian is absent or unqualified. By contrast, the Ja‘fari school allows adult women to contract marriage without a guardian, except under specific circumstances. These differences reflect the dynamic nature of Islamic legal thought in responding to social realities, yet both approaches ultimately aim to realize the maqasid al-nikah: legal certainty, protection of dignity, and household stability. The novelty of this research lies in integrating cross-sectarian comparative analysis with the framework of maqasid al-shariah, an approach still rarely applied in studies of Islamic family law, particularly in the Indonesian and Iranian contexts. The implications of this research are twofold: enriching comparative fiqh scholarship as a reference for academic discourse and providing practical insights for the formulation of marriage regulations that remain faithful to shariah while responsive to evolving social dynamics.

Abstract

Penelitian ini bertujuan untuk mengetahui model ketahanan keluarga pada pasangan Long Distance Relationship (LDR) di desa Bangsri, Kec. Laren, Kab. Lamongan. Ketahanan keluarga merupakan kondisi dinamis suatu kelurga yang mempunyai ketangguhan dan keuletan, serta mengandung kemampuan dari segi fisik material dan psikis mental spiritual untuk meningkatkan kesejahteraan diri dan keluarga untuk hidup harmoni serta meningkatkan kesejahteraan dari lahir dan batin. Dalam kehidupan berkeluarga terdapat kondisi pernikahan yang terjalin secara long distance relationship atau menjalani kehidupan keluarga secara terpisah atau tidak dapat bertemu secara langsusng sebab terhalang oleh jarak, waktu dan tempat namun mereka tetap saling berkomitmen kepada pasangannya. Penelitian ini menggunakan jenis penelitian field research dengan analisis data penelitian kualitatif. Teknik pengumpulan data dilakukan dengan wawancara, observasi, dan dokumentasi pada pasangan LDR dan Stakeholder terkait.

Abstract

Cases of paedophile are becoming increasingly prevalent in Indonesia, with data from the Indonesian Child Protection Commission showing a consistent annual rise, particularly in child sexual abuse cases. This study aims to analyze a court verdict that acquitted a paedophile offender, identify appropriate legal sanctions, and examine the Islamic legal (fiqh jinayah) perspective on chemical castration as a form of punishment. Using a qualitative method with a content analysis approach, the study examines legal documents, including Decision No. 36/Pid.Sus/2023/PN.LBB, Law No. 35 of 2014 on Child Protection, and Law No. 17 of 2016, as well as secondary sources such as scholarly journals, articles, and books. The analysis reveals that: (1) the acquittal was primarily based on conflicting witness testimonies, which weakened the evidence; (2) appropriate sanctions should be based on Articles 81(1) and 82(2) of the Child Protection Law in conjunction with the Indonesian Criminal Code, including chemical castration as regulated in Law No. 17 of 2016; and (3) from a fiqh jinayah perspective, chemical castration is considered permissible to safeguard public welfare. These findings offer insights for further legal and Islamic jurisprudential discussions on effective responses to sexual crimes against children.

Abstract

Industrial revolution 4.0. causing a shift in lifestyle from a social, religious pattern to a materialistic and secular individual pattern. Apart from that, the cultural sector has been disrupted due to the development of social media which has reconstructed the cultural structure of society. Social relations between communities are now more closely established in the virtual world, so that relationships in the real world have become relative. This results in a lack of direct communication with family members because they focus on seeking their own pleasure. In the era of the industrial revolution 4.0, parents have also given gadgets to their children aged around 4-6 years. This research uses a social approach method and structural functionalism as its theory. The results of the research are that families do not reject revolution and use technology to help their daily lives. Apart from that, there are implications of structural functionalism theory with the occurrence of disruption in the era of the industrial revolution, especially in the social and cultural fields of society. The Industrial Revolution Era 4.0 is an era where various things in life are filled with sophisticated technology. Several families that the author studied have used technology produced by the industrial revolution 4.0. They use it in their daily lives so that it is felt as a need and urgency. As a result, there is a shift in perspective and lifestyle in society in various areas of life, one of which is social and cultural, resulting in disruption. The disruption process has gone through a process of externalization, objectification and internalization as per the theory of structural functionalism so that both are relevant.
