Abstract

This study comprehensively examines the position of female witnesses in Islamic law, focusing on the scholarly debates regarding the acceptance or rejection of female testimony, particularly in cases related to criminal law (hudud). Using a qualitative approach, this study analyzes the theoretical and legal foundations that underpin the role of female witnesses and evaluates their application in Indonesia's modern judicial system. The main sources of this research include classical texts of Islamic law, the views of scholars, and applicable positive legal regulations. This research is conducted as a library study, drawing from classical texts of Islamic law, scholarly views, and relevant positive legal regulations. The findings reveal differing interpretations regarding women's testimony, with some classical scholars placing less weight on it compared to men, while contemporary perspectives tend to be more inclusive, aligning with principles of justice and equality. The results show that, although challenges remain in implementation, the role of female witnesses is increasingly recognised and accepted in the Indonesian judiciary, especially in cases that require a female perspective. The main contribution of this research is to provide insights that strengthen the discussion on gender justice in Islamic law, while offering recommendations to optimise women's participation in the legal process. These recommendations include strengthening policies that ensure witness equality based on the principles of maqasid al-shariah (the objectives of sharia) and applying norms that are more contextualised to social realities in Indonesia. As such, this research contributes to the development of a more just and inclusive justice system, capable of addressing contemporary legal and social challenges.

Abstract

At this time, there is a stagnation of thought among Muslims regarding whether the concept of an Islamic state is still being debated or not. Islamic socio-political movements are divided into two streams, namely Substantive Islam and Symbolic Islam. Nurcholish Madjid firmly rejects the politicization of Islam in the interests of political groups that are members of Islamic parties. With the motto: "Islam Yes, Islamic Party No!". According to Nurcholish Madjid, Islamic political power is not always related to Islamic parties. He tries to convey a more substantial view of Islam, not just symbolism. Seeing the current situation, the criticism conveyed by Nurcholish Madjid is still very relevant. This research was conducted to explore the relevance of Nurcholish Madjid's thoughts on state politics in Indonesia by considering the current situation. Based on the results of this research, it was revealed that Nurcholish Madjid chose Islam which is more substantial than just symbolism. This has its roots in the universal values of Islam, not just the symbol of the "Islamic party" itself. If we look at the current situation, the criticism raised by Nurcholish Madjid is still relevant because, at this time, the politicization of religion is generally used to attack political opponents or increase party electability. Instead of using Islam as a moral guide for politics, political elites tend to use Muslims for individual interests.

Abstract

Purpose – This study aims to develop and evaluate an entrepreneurship-based curriculum aligned with the Freedom to Learn (Merdeka Belajar) initiative at State Madrasah Aliyah in Bukittinggi, Indonesia. Recognizing the necessity of equipping students with entrepreneurial skills, creativity, and self-reliance, this research addresses the critical gap between traditional Islamic education and modern labor market demands Design/methods/approach – A qualitative case-study approach, complemented by quantitative analysis, was utilized. Data collection involved purposive sampling, participatory observation, semi-structured interviews, document analysis, and closed-ended questionnaires. Participants included school leaders, teachers, students, alumni, and parents. Qualitative data were analyzed thematically, while quantitative data provided descriptive statistics to strengthen findings. Findings – The integration of experiential learning and project-based entrepreneurship significantly enhanced students’ practical business skills, creativity, problem-solving ability, and interpersonal competencies. The curriculum explicitly incorporates principles of student autonomy and flexible learning, central to Indonesia’s Freedom to Learn (Merdeka Belajar) initiative. However, substantial challenges were identified, including inadequate infrastructure, limited funding, a shortage of qualified teachers, and societal resistance rooted in traditional perceptions of madrasahs as purely religious institutions. Student questionnaire results indicated positive perceptions of the curriculum’s effectiveness (mean score > 4.2 out of 5). Research implications – Findings provide actionable insights for policymakers, educators, and administrators seeking to implement effective entrepreneurship curricula. Strategic interventions such as enhanced teacher training, structured mentoring, and robust industry collaboration are recommended to address implementation barriers, preparing students for real-world economic challenges and ultimately fostering socio-economic growth and community development.

Abstract

This study aims to analyze the challenges of character education in Islamic boarding schools (pesantren) caused by the impact of digital technology on students’ academic performance. A mixed methods design was employed, combining qualitative interviews with teachers, students, and staff members, and quantitative surveys distributed to teachers and students. The qualitative approach explored key informants’ perspectives on integrating technology into character education, while the quantitative data were statistically analyzed to evaluate the effect of technology and provide concrete illustrations. The findings indicate that character education in pesantren becomes significantly more effective when digital tools are integrated with religious instruction. Notably, 85% of students reported a stronger understanding of moral principles when technology was used to complement religious learning, demonstrating its role in enhancing moral responsibility. However, the study also highlights limitations, particularly the regional scope and resource constraints that hinder the full application of digital technology in some institutions. The research implies that pesantren can successfully modernize their pedagogy by combining traditional religious teachings with digital innovation without compromising moral and religious values. These findings offer practical guidance for teachers and administrators to adapt their instructional approaches in the digital age. Future research is recommended to investigate the long-term effects of this methodology on students’ moral and ethical development.

Abstract

The COVID-19 vaccination program in Indonesia experiences various dynamics depending on the socio-cultural conditions of each region, and within this context, dynamics in urban areas are crucial as they represent the acceptance, understanding, and implementation of vaccination within a diverse and multicultural society. This research aims to examine how beliefs, social and economic conditions, and the role of religious institutions influence the urban community's acceptance of the COVID-19 vaccination program scheduled by the central government and implemented by local authorities. This study is a field research conducted in Pangkalan Kerinci Sub-district, Pelalawan Regency, Riau, Indonesia. Data were collected through interviews, observations, and documentation. The study indicates that the implementation of vaccination by local authorities reflects a harmonization between religious principles, public policies, and the socio-economic conditions of the community. This highlights the importance of health policies being aligned with the ethical foundations and religious principles embraced by the local community, which can serve as a strategy to address common challenges encountered in vaccination efforts across various locations.

Abstract

The ongoing Houthi insurgency in Yemen has led to severe humanitarian impacts, particularly affecting women and children as the most vulnerable groups. This research aims to examine the protection of human rights for women and children amidst continuous violations committed by the Houthi armed movement. Using a qualitative field research approach, the study is based on direct interviews with humanitarian workers, legal experts, and victims, supported by the analysis of human rights reports and international legal instruments. The findings reveal that despite the existence of frameworks such as the Convention on the Rights of the Child and CEDAW, protection remains ineffective due to political instability, the dominance of non-state actors, and limited access for humanitarian organizations. Key violations include child soldier recruitment, sexual violence, forced displacement, and denial of access to education and healthcare. The study concludes that stronger international monitoring mechanisms, targeted sanctions, and the integration of gender- and child-sensitive frameworks into Yemen’s peacebuilding agenda are urgently needed. This study contributes a field-based legal analysis of the systemic failures in protecting the rights of women and children in armed conflict, and emphasizes the importance of a more effective international legal response in the context of the dominance of non-state armed actors.
