Abstract

Pemenuhan hak narapidana merupakan bagian integral dari sistem pemasyarakatan yang berorientasi pada pembinaan dan penghormatan terhadap hak asasi manusia. Dalam praktiknya, pemenuhan hak tersebut tidak hanya ditentukan oleh norma hukum tertulis, tetapi juga sangat dipengaruhi oleh penalaran hukum petugas pemasyarakatan sebagai pelaksana kebijakan di tingkat operasional. Penelitian ini bertujuan untuk menganalisis penalaran hukum petugas pemasyarakatan dalam pemenuhan hak narapidana di Lembaga Pemasyarakatan Kelas IIA Binjai serta menilai kesesuaiannya dengan prinsip sistem pemasyarakatan dan asas keadilan. Metode penelitian yang digunakan adalah pendekatan hukum normatif-empiris dengan sifat deskriptif-analitis. Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan dan wawancara dengan petugas pemasyarakatan yang terlibat dalam pengambilan keputusan terkait pemenuhan hak narapidana. Hasil penelitian menunjukkan bahwa penalaran hukum petugas pemasyarakatan tidak hanya berlandaskan pada ketentuan normatif, tetapi juga dipengaruhi oleh pertimbangan administratif, keamanan lembaga, dan pengalaman praktis petugas. Variasi dalam penafsiran dan penggunaan diskresi berpotensi menimbulkan ketidakkonsistenan dalam pemenuhan hak narapidana, yang berdampak pada kepastian hukum dan keadilan substantif. Penelitian ini menegaskan pentingnya penguatan kualitas penalaran hukum petugas pemasyarakatan agar pemenuhan hak narapidana dapat dilaksanakan secara lebih konsisten, objektif, dan selaras dengan tujuan sistem pemasyarakatan.

Abstract

Keberadaan layanan transportasi online di Indonesia telah membuka kesempatan kerja yang luas dan meningkatkan efisiensi mobilitas masyarakat yang berdampak positif bagi sebagian masyarakat. Namun, perkembangan tersebut membawa potensi berupa meningkatnya risiko kekerasan terhadap para pengemudi driver  transportasi online.Dimana insiden penganiayaan sering terjadi,  dari pertengkaran kecil hingga tindak kekerasan berat yang disertai ancaman atau perampokan, menunjukkan bahwa driver transportasi online menghadapi situasi kerja yang rentan. Meski tercantum dalam KUHP kenyataannya dalam praktik penegakannya tidak selalu berjalan efektif dan sesuai harapan.Penelitian ini  memperlihatkan bahwa perlindungan hukum bagi driver tidak hanya bergantung pada penegakan hukum pidana yang tertulis dalam KUHP, namun perlu adanya peran perusahaan dalam menyediakan mekanisme keamanan yang memadai terhadap driver transportasi online. Maka dari itu, diperlukan sinergi antara aparat penegak hukum, penyedia layanan transportasi online, dan masyarakat untuk bekerja sama memperkuat upaya pencegahan serta memberikan efek jera melalui tindakan represif terhadap pelaku kekerasan

Abstract

Debt collection practices by debt collectors in the consumer finance industry often raise legal issues, particularly when carried out through intimidation, threats, or the seizure of collateral without proper legal procedures. This situation causes the civil legal relationship between the debtor and the financing company to develop into a criminal case requiring law enforcement. In police practice, the resolution of such cases is often directed through restorative justice mechanisms as an alternative to criminal cases, as long as they comply with the provisions stipulated in the Republic of Indonesia National Police Regulation Number 8 of 2021. This study aims to analyze the legal aspects of the application of restorative justice in resolving debt collector cases at the police level and examine the position and responsibility of leasing companies regarding the actions of authorized debt collectors. The research method used is normative juridical with a statutory, conceptual, and case-based approach. The results show that restorative justice can only be applied to debt collector cases that are minor in nature, do not cause serious injuries, and the losses can be recovered through an agreement between the parties. Furthermore, the leasing company remains legally responsible for the actions of debt collectors as its extension, both in civil and criminal aspects. Therefore, the implementation of restorative justice must be carried out proportionally and still ensure legal protection for victims

Abstract

This study aims to analyze the role of the Police in addressing violent theft crimes and the obstacles faced by the Aceh Tenggara Police Resort. The research uses an empirical method with a qualitative descriptive approach. Data were obtained through observation, interviews with police personnel, and documentation related to crime prevention efforts. Data analysis was conducted by examining the roles, strategies, and challenges faced in the implementation of police duties. The results show that the role of the Aceh Tenggara Police Resort is carried out in an integrated manner through preemptive, preventive, and repressive efforts, including legal guidance and public awareness programs, routine patrols in high-risk areas, and law enforcement from investigation to prosecution. The support of Bhabinkamtibmas and active community cooperation enhances the effectiveness of prevention and case resolution, thereby maintaining public security and order. The obstacles faced include limited personnel and infrastructure, difficult-to-access geographical conditions, and technical investigation challenges, such as insufficient evidence and uncooperative witnesses. To overcome these challenges, the Aceh Tenggara Police Resort optimizes investigation management, personnel assignment, cross-functional coordination, persuasive approaches, technology utilization, and regular evaluation of investigations

Abstract

The management of evidence in narcotics criminal cases is the most important stage in the criminal justice system because it is directly related to evidence and legal certainty. Inaccuracies in the administration, storage, and destruction of evidence have the potential to cause abuse of authority, loss of evidence, and even weaken the law enforcement process. This study aims to analyze the legal aspects of accountability for the management of evidence of narcotics crimes in the South Nias District Attorney's Office, identify the management mechanisms applied, and assess the obstacles that affect the effectiveness of its implementation. The research method used is empirical legal research with a legislative approach. Data was obtained through a literature study of regulations related to evidence management and interviews. The results of the study show that the management of evidence has been carried out according to administrative procedures, starting from receipt, recording, storage, to destruction, but obstacles are still found in the form of limited storage facilities, lack of human resources, and not optimal supervision. Legal accountability in the management of evidence is based on the principles of office accountability, administrative responsibility, and potential criminal liability in the event of irregularities. Therefore, it is necessary to strengthen the supervision system, digitize administration, and increase the capacity of the apparatus to ensure transparency and integrity in the management of evidence. This research is expected to make a conceptual and practical contribution in improving the professional and fair governance of narcotics evidence.

Abstract

This research aims to identify the factors that cause domestic violence against children and to analyze the role of the Unit for the Protection of Women and Children (PPA) of the Medan Police in providing legal protection for child victims. The study uses an empirical legal research method with a juridical approach. Data were obtained through interviews with officers from the Unit for the Protection of Women and Children (PPA) of the Medan Police and literature studies on relevant laws, books, and journals. The results show that domestic violence against children is caused by various interrelated factors, including economic hardship, low educational levels, patriarchal culture, psychological pressure, substance abuse, and disharmonious family relationships. The Unit for the Protection of Women and Children (PPA) of the Medan Police plays three main roles: preventive efforts through public legal education, repressive efforts through law enforcement against perpetrators, and rehabilitative efforts through psychological and social recovery for victims. However, the implementation of legal protection for child victims is not yet optimal due to limited human resources, insufficient facilities, and weak inter-agency coordination. Strengthening institutional cooperation and public legal awareness is essential to achieve effective and sustainable protection for children who are victims of domestic violence.
