Abstract

Being in the correctional system, convicts have obligations that they must carry outand rights that must be fulfilled by the state. These rights and obligations are outlined in LawNumber 12 of 1995 concerning Corrections and Menkum HAM Regulation Number 6 of 2013concerning Rules of Correctional Institutions and State Detention Centers. This researchexamines the rights of an inmate as a worker in the Pekanbaru Class II A CorrectionalInstitution and the fulfillment of the rights of an inmate as a worker in the Pekanbaru Class IIA Correctional Institution.This type of research can be classified as sociological, because in this study theauthor directly conducts research at the location or place under study in order to provide acomplete and clear picture of the problem under study. This research was conducted at thePekanbaru Class II A Penitentiary, while the population and sample were all parties relatedto the problems studied in this study, the data sources used were primary data, secondarydata, and tertiary data, data collection techniques in this study were observation, interview,questionnaire, and literature study.From the results of the study, it can be concluded that the rights of convicts asworkers in Class II A Penitentiary in Pekanbaru have not been carried out optimally, one ofwhich is the absence of guarantees for work safety, because the work provided does not havea high risk and the tools used in work are safe . Nevertheless, convicts should have the rightto work safety guarantees. Second, convicts who take part in the apprenticeship do not get apremium. Even so, some of the rights of convicts as workers have been implemented.Furthermore, convicts working at the Pekanbaru Class II A Penitentiary already know whattheir rights are, so this is also one of the transparent information for convicts about the rightsthey should receive. Second, the suggestion according to the author is that the governmentshould stipulate regulations or laws that regulate in detail the large percentage of wages thatconvicts are entitled to receive as well as adding more tutors/guidance trainers so that theycan match the number of convicts attending training..Keywords: Rights, Prisoners, Workers

Abstract

Law 8 of 1999 on Consumer Protection has guaranteed legal certainty toprotect consumers. This research is related to legal protection for consumersagainst drinking water depots in Pekanbaru City. The development of drinkingwater depots has an impact on consumer concerns. Therefore, it is necessary tostudy first, legal protection for consumers of drinking water depots in PekanbaruCity, second, factors inhibiting legal protection for consumers of drinking waterdepots in Pekanbaru City.This research is sociological legal research, because it is based on fieldresearch by collecting data from interviews, questionnaires and literature studiesthat have a relationship with problems that use qualitative data analysis so as toproduce descriptive data and are concluded with deductive thinking methods.From the results of the study, it was concluded that, first, legal protectionfor consumers of drinking water depots in Pekanbaru city has not been maximizedas expected by the Consumer Protection Law Number 8 of 1999. Second, theinhibiting factors of consumer protection itself are due to consumers lack ofknowledge of their rights that have been regulated in the UUPK, lack ofawareness of business actors to maintain the cleanliness and quality of theirdrinking water, as well as the absence of authority of the Pekanbaru City HealthOffice and the Pekanbaru City Industry and Trade Office to follow up on drinkingwater depots that are not in accordance with applicable laws and regulations.Keywords: Consumer Protection-Drinking Water Depots-Inhibiting Factors.

Abstract

E-Commerce is an online buying and selling transactionvia the internet. E-commerce can be accessed through a website orthrough an application. And the various payment methods offered,can be via account transfer, via electronic money and also with theCash on Delivery (COD) payment system. In its implementation,buying and selling transactions online creates problems. Theproblem that occurs is the unilateral cancellation made by the buyerto the merchants so that the merchants suffers a loss. The purpose ofwriting this thesis: First, to find out the arrangements for unilateralcancellation by the buyer in the on-site payment system via e-commerce in the field of online food ordering in the city ofPekanbaru according to the Civil Code. Second, what are theefforts so as not to harm business actors for unilateral cancellationsby buyers in the on-site payment system via e-commerce in the fieldof online food ordering in the city of Pekanbaru.This type of research used in legal research is sociologicallegal research. Where, this research takes an approach by lookingat legal facts and facts in a society in the city of Pekanbaru. Analysisof the data used is the author to analyze data qualitatively.The research results show that unilateral cancellationsmade by buyers cause losses to business actors. This is because themerchants has carried out his obligations but he does not receivepayment. According to the Civil Code, merchants can file a lawsuitagainst buyers who cancel unilaterally. Abstract

Article 1313 of the Civil Code concerning agreements, which states that"An agreement is an act by which one or more people bind themselves to one ormore people. Endorsement agreements between Influencers and Online Shopsverbally which often lead to defaults. The purpose of writing this thesis is first, tofind out why influencers do not carry out endorsement agreements that are madeorally in terms of civil law. Second, to find out the obstacles in verbalendorsement agreements between Influencers and online shops (Famosta Shop) interms of civil law.This type of research is sociological legal research, namely researchconducted on the identification of laws and the effectiveness of laws that apply insociety. In this case, look at the reasons for influencers not carrying out theendorsement agreement verbally and what obstacles arise from the verbalagreement. The nature of the research is descriptive which provides precise dataabout humans, conditions and other symptoms.The results of this study indicate that the reasons for influencers notcarrying out endorsement agreements verbally are carried out verbally without athird person as a witness, the influencer's limitations in carrying out agreementsand the obstacles the parties have in making verbal endorsement agreements thatoften occur come from both parties. such as the lack of online shop policies inmaking agreements, influencers do not establish good communication in carryingout agreements so that defaults occur.Keywords:Agreement-Endorsement-Influencer-Online Shop

Abstract

PT Amartha Micro Fintech comes with the aim of increasing UMKMthrough a group of underprivileged women by providing financing services aimedat business capital. The financing provided by Amartha to the underprivilagedwoman’s group uses sharia principles with a mudharabah. In Beringin MakmurVillage, especially the Amartha Beringin assembly, only 5 out of 30 customerscarry out their obligations using financing for business capital, even though thisprovision has been stated in Article 1 paragraph (4) of the Funding Agreement –Special Requirements of PT Amartha Micro Fintech, Article 1paragraph (11) ofLaw Number 20 of 2008 Concerning Mikro, Small, and Medium Enterprises, andNational Sharia Council Fatwa on Mudharabah (Qiradh).This type of research is empirical juridical research, while the pupulationand sample are PT Amartha Micro Fintech Pangkalan Kuras Branch and thecustomers of the Amartha Beringin assembly in Beringin Makmur Village. Thepurpose of this research is to find out the obligation of customers to use thefinancing received as business capital which aim to increase Micro, Small, andMedium Enterprises (UMKM).The conclusion of this research is the obligation of PT Amartha MicroFintech customers, especially the Amartha Beringin assembly, has not beenmaximizes due to several factors from the customer’s side as well as from the sideof field officers. The weak economic situation of customers is one of the obstaclesfor customers to establish a business through capital loans given and the largetarget that must be achieved by field officers also result in giving loans tocustomers even though they do not meet their obligations optimally. The author’sadvice for customers is given socialization related to rights and obliggations aswell as literacy to improve the business that is being run and balanced withregular monitoring of customers after the disbursement of financing.Keywords: Model – Mudharabah Financing – Application – Capital Loan.

Abstract

The main problem with Government Regulation Number 35 of 2021concerning Work Agreements for Specific Periods, Outsourcing, Working Timeand Break Time, and Termination of Employment is that through this regulation,severance pay for victims of layoffs is only half of the rule if a number ofconditions are met. One of them, severance half of the provisions if the companycloses and loses money.The type of research used is sociological juridical, namely researchconducted by identifying the law and how the effectiveness of the implementationof the law applies in society. Because in this study the authors directly conductedresearch at the location or place under study to provide a complete and cleardescription of the problem under study.The conclusions that can be obtained from the research results are First,the Fulfillment of Workers' Rights for a Certain Time During the Covid-19Pandemic Period in View of Government Regulation Number 35 of 2021Concerning Work Agreements for Specific Periods, Outsourcing, Working Timeand Rest Time, and Termination of Employment Relations (Study at PT. MedanBioenergy Nusantara) where workers/laborers basically get equality and theopportunity to get treatment without discrimination under any pretext to manifestthe welfare of workers and their families without neglecting profit and businesscompetition. Second, Obstacles to Fulfilling Workers' Rights for a Specific TimeDuring the Covid-19 Pandemic Period are reviewed from Government RegulationNumber 35 of 2021 Concerning Work Agreements for Specific Periods,Outsourcing, Working Time and Break Time, and Termination of Employment(Study at PT. Medan Bioenergy Nusantara), namely that there are not verydetailed regulations governing the fulfillment of workers' rights in a pandemicsituation, so that it is biased regarding the rights and obligations of businessactors and employees.Keywords: Fulfillment of Rights, Termination of Employment, Labor,Settlement.

Abstract

Hak privasi finansial atau rahasia bank (bank secrecy, financial privacy) dipandang sebagai hak asasi manusia yang harus dilindungi dari campur tangan pihak lain, termasuk negara. Aturan rahasia bank dibuat untuk melindungi kepentingan nasabah dalam menjaga kerahasiaan informasi keuangan mereka dan juga untuk kepentingan bank sendiri dalam mempertahankan kepercayaan dan kelangsungan hidupnya. Penelitian ini bertujuan untuk menjelaskan mengenai hak dan kewajiban bank untuk menjaga kerahasiaan informasi nasabah dan penggunaan informasi tersebut, serta tindakan hukum yang dapat diambil jika ada pelanggaran terhadap rahasia bank. Penelitian ini menggunakan metode yuridis normatif untuk mengkaji fenomena yang diteliti. Metode ini melibatkan analisis kaidah-kaidah yang terdapat pada peraturan perundang-undangan yang berlaku. Undang-Undang No. 10 Tahun 1998 Pasal yang telah ditetapkan tidak memberikan ketentuan mengenai kemungkinan bagi bank untuk mengungkapkan simpanan nasabah meskipun dengan prosedur memohon izin kepada pimpinan Bank Indonesia, Oleh karena itu prosedur dan ketentuan pengungkapan rahasia bank, seperti sebagai kebutuhan perpajakan, sebagai urgensi Penyelesaian Piutang Bank, sebagai urgensi Peradilan Pidana dan Perdata ataupun urgensi kegiatan perbankan. Dengan kata lain terjaminnya kerahasiaan pada bank tidak bersifat mutlak melainkan bersifat nisbi.

Abstract

This research is motivated by the existence of problems regarding consumer lossesbecause the scale measuring instrument at Pasar Bawah City of Bukittinggi is not standard.The non-standard measuring instruments for Traders' scales are caused by Traders who donot standardize regularly. Traders also do not provide compensation to consumers becausetraders think that the measuring instruments they have are up to standard. This contradictsArticle 7 letter d with Article 7 letter f of the Consumer Protection Act. Traders are requiredto carry out standardization in order to achieve uniformity of results until quality standardsare met on measuring scales.The method used in this study is a sociological research type, the nature of thisresearch is inductive and the research was conducted at Pasar Bawah Bukittinggi. Thesamples taken in this study were forty-two people. Data collection techniques are byquestionnaires, interviews and literature study. Data analysis uses the concept ofstandardization and law enforcement theory which aims to be an analytical knife in thisstudy, so data analysis is carried out qualitatively, namely data based on sentencedescriptions. Described and concluded with the inductive thinking method by understandingsomething through specific observations and drawing broad conclusions based on theseobservations.The results of this study indicate that the effect of the low legal awareness of tradersand consumers as well as the lack of metrological human resources has caused up to now inPasar Bawah City of Bukittinggi there are still cases of consumer losses due to non-standardmeasuring instruments. Therefore, it is necessary to have the maximal role and efforts of theMetrological UPTD against the deficiencies that occur in the Pasar Bawah City ofBukittinggi by playing an active role in counseling, outreach, monitoring, and taking actionon non-standard measuring instruments. The fulfillment of quality standards for weighingmeasuring instruments has an impact on increasing consumer confidence in these tradersand reducing cases of losses experienced by consumers.Keywords : Consumer Protection, Standardisation, Quality Standards, LawEnforcemen

Abstract

\ Agreement, is a legal relationship (rechbetrekking) concerning the law of wealth between two or more persons (persons) or more, which gives rights to one party and obligations to the other party regarding an achievement. The agreement between PT. Application Karya Anak Bangsa which is an electronic application that distributes services and community needs, one of which is a system of buying food from home or often known as Gofood with restaurants that work together as merchants or called business partners, which is very practical in practice. obstacles often occur, such as the existence of a bill dispute where the restaurant does not get its rights as a partner of PT. Application Karya Anak Bangsa. The problems discussed are about how to implement the partnership agreement between PT. AKAB and sales partners in the field and based on the Civil Code and other laws and regulations. The study was conducted in the Bukit Raya area, while the sample population was restaurants and UMKM s in collaboration with PT. AKAB and all parties related to the problems studied in this study.
