Abstract

In general, interfaith marriages have the potential to cause legal problems, both for the married couple and for third parties, including the inheritance rights of children born from interfaith marriages. As a village with the largest number of religious adherents in Tebing Tinggi Timur Sub-district, Kepau Baru Village is also a village that is very thick with its customary law, of course in terms of marriages of different religions it cannot be avoided so that the role of the local customary leader and customary rules is needed. Therefore, the purpose of this research is first, to find out the provisions of interfaith marriages according to the Customary Law of Kepau Baru Village. Secondly, to find out the consequences of interfaith marriage according to the Customary Law of Kepau Baru Village. The type of research used in this research is sociological. The approach used by researchers is the type of sociological research. The location of the research conducted by the author is in Kepau Baru Village, East Tebing Tinggi District, Meranti Islands Regency. The population and samples in this study were the tribal chief/datuk and the perpetrators of interfaith marriages. This research uses data in the form of primary data and secondary data and data collection techniques are carried out by interview. The results of this research have two main points that can be concluded. First, the customary provisions in Kepau Baru Village for interfaith marriages must go through several stages, namely choosing one of the religions to be embraced, having been approved by both parents and the customary leader. Interfaith marriage in Kepau Baru Village requires a long process. Nevertheless, in this case, interfaith marriage according to Kepau Baru's custom is contrary to freedom of religion. Secondly, there are no major consequences of interfaith marriages in Kepau Baru Village, either in marriage registration or population data. If there are household problems in Kepau Baru Village, they are resolved by going to the customary leader for advice.

Abstract

Consumer protection is an important part of creating a balance between the rights and obligations between consumers and business actors. In practice, there are still many consumers who have not received optimal protection, especially in terms of fulfilling their rights to information, services, and product guarantees. One form of protection that often becomes a problem is product warranty. This study aims to determine the implementation of consumer protection for the provision of product warranty for mattresses in the box at Atria Furniture and the responsibility of business actors for this. This research uses a sociological legal approach, namely by looking at the law as a social symptom that can be documentation in the interaction between consumers and business actors. Data were obtained through interviews with six consumers who submitted warranty claims, as well as managers and employees of Atria Furniture in Pekanbaru. The data was analyzed using a descriptive method with a qualitative data analysis approach that aims to systematically describe the facts in the field. The results showed that the implementation of the mattress in the box product warranty by Atria Furniture has not fully reflected the principles of consumer protection as stipulated in Law Number 8 of 1999 concerning Consumer Protection. Consumers experience difficulties in claim procedures, lack of information transparency, and slow and unsatisfactory responses from business actors. Based on these findings, it is necessary to evaluate the warranty service mechanism and increase the responsibility of business actors so that legal protection for consumers can be realized optimally.

Abstract

Penelitian ini membahas perlindungan konsumen dalam transaksi pembelian sepatu preloved di Teras Rumah Shoes, Pekanbaru, yang berkaitan dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). Pokok permasalahan yang dikaji adalah sejauh mana hak konsumen terlindungi, tanggung jawab pelaku usaha, serta upaya yang dilakukan konsumen ketika mengalami kerugian akibat pembelian sepatu preloved. Tujuan penelitian ini adalah untuk mengetahui penerapan prinsip perlindungan konsumen, praktik tanggung jawab pelaku usaha, dan tindakan konsumen dalam menghadapi kerugian. Penelitian ini menggunakan pendekatan yuridis-sosiologis dengan sifat deskriptif. Lokasi penelitian ditetapkan di Toko Sepatu Preloved Teras Rumah Shoes, Kota Pekanbaru. Populasi penelitian meliputi penjual dan pembeli sepatu, dengan sampel purposive sebanyak 1 penjual dan 15 pembeli. Pengumpulan data dilakukan melalui wawancara, observasi, dan studi dokumentasi. Analisis data dilakukan secara kualitatif dengan menghubungkan fakta di lapangan dengan teori hukum yang relevan, sehingga kesimpulan dapat ditarik secara deduktif. Hasil penelitian menunjukkan bahwa praktik penjualan sepatu preloved masih membatasi hak konsumen, antara lain melalui kebijakan “No Refund No Return” dan deskripsi produk yang kurang rinci. Mayoritas konsumen (60%) mengalami kerugian karena ketimpangan informasi dan minimnya edukasi hukum mengenai hak konsumen. Pelaku usaha mengakui tanggung jawab terbatas sesuai kebijakan internal, sementara konsumen jarang menggunakan mekanisme penyelesaian sengketa formal. Kesimpulannya, meskipun perlindungan konsumen telah diatur dalam UUPK, implementasinya dalam praktik transaksi sepatu preloved belum optimal. Diperlukan edukasi konsumen, transparansi pelaku usaha, dan sosialisasi lembaga perlindungan konsumen agar hak konsumen lebih terlindungi. Kata kunci: perlindungan konsumen, sepatu preloved, UUPK, tanggung jawab pelaku usaha.
