Abstract

This study examines the legal uncertainty regarding the management of land previously under the Right to Cultivate (HGU) granted to PT Cemerlang Abadi in Babahrot District, Aceh, which presents a significant issue. Although the land has been utilised by around a thousand households for agricultural purposes, the government has not provided official certificates as legal proof of ownership. The slow administrative process and land redistribution by the Aceh government and the Southwest Aceh District Government contradict the principle of legal certainty as stipulated in Law No. 5 of 1960 on Basic Agrarian Regulations (UUPA). From an Islamic legal perspective, the land in question is a public asset that must be managed for the welfare of the people. This uncertainty poses potential social, economic, and legal risks, including future disputes. Therefore, concrete steps are needed, such as expediting data collection, issuing certificates, and providing legal education to the public. Addressing this issue would reflect social justice and the government's commitment to implementing fair and sustainable agrarian principles.

Abstract

This study aims to determine the use of labeling for sharia hotels in Banda Aceh City, todetermine the halal guarantee for hotels that are not labeled as sharia in Banda Aceh City,and to comply with supervision of sharia regulations in hotels in Banda Aceh City. In thisstudy the author uses a qualitative research method with a descriptive pattern. Data werecollected through interviews, documentation, and literature studies. Data analysis focuseson the labeling of sharia hotels in Banda Aceh City ( study of Sharia Labeled And NonLabeled Hotels). The results of the study indicate that to obtain labeling the hotel must obtaina permit and maintain order, although not all hotels in Banda Aceh City have sharialabeling, but they also comply with sharia rules and they also prohibit guests who are notnon-muhrim couples. The halal guarantee system for sharia hotels that refers to a series ofhotel rules or policies and procedures applied to hotel operations must be in accordancewith sharia principles. Supervision of hotels in the Banda Aceh city o focuses on shariaregulations, namely to ensure comfort for visitors. and see the halalness of products andprovide services that support business actors in obtaining halal certification.

Abstract

Gambling is a criminal act by risking a certain amount of money where the party who wins will get all the betting money. Gambling can be detrimental to society and damage the nation's morals. Gambling behavior will become a problem when it starts to approach the diagnostic criteria for pathological gambling, where the behavior is mal-like. -adaptive and sustainable, giving rise to a series of further problems, such as continuing to try to bet even though you have lost many times. According to all religious views, gambling is something that is prohibited. Online gambling games played by people are the result of social interactions that occur between them. Social interaction can be likened to a currency that has two sides: positive and negative. One example of the negative impact is what happens to people who take part in online gambling games. As technology develops, gambling is now moving to a place that is a little more elite. Technological advances too. changing the way of playing gambling, along with developments in technology, now gambling has moved to a slightly more elite place. Advances in technology have also changed the way of playing gambling. Now, gambling doesn't have to be hidden like in the past, just by sitting relaxed in front of a computer or cellphone that is connected to the internet network, we can play this haram game.

Abstract

This article aims to analyze the suitability of the management of Kapal PLTD Apung as a halal tourist attraction with the principles contained in Milk al-Daulah and Qanun Number 3 of 2022 concerning the Implementation of Halal Tourism in Banda Aceh city. This research uses a qualitative approach with descriptive analysis methods, as well as an empirical juridical approach to evaluate the implementation of halal tourism policies in the field. The research results show that although there have been efforts to adapt the management of Kapal PLTD Apung to halal tourism standards, there are still several challenges, such as physical damage, lack of innovation, lack of accessibility for people with disabilities, lack of halal certification for food and drinks, and lack of facilities. which makes it easier for visitors to access information. However, the management of Kapal PLTD Apung in most aspects reflects sharia values ​​and has great potential to contribute to the development of better and more sustainable halal tourism in Banda Aceh city.

Abstract

This study aims to determine how the system of buying and selling imported used clothing in Banda Aceh is viewed from the perspective of fiqh muamalah and to examine it in terms of the elements of gharar and the fatwa of DSN-MUI No: 110/DSN-MUI/IX/2017 concerning the contract of sale. This study employs a qualitative method using a legal-empirical approach. The findings reveal that the system of buying and selling imported used clothing in Banda Aceh involves three parties in the transaction: the seller, the buyer, and the distributor. The seller orders and purchases clothing from the distributor in the form of bags without being allowed to inspect the contents. Upon arrival, the clothing is sorted according to quality, washed thoroughly, and then sold to the buyer. In general, the practice of buying and selling imported used clothing in Banda Aceh aligns with the principles and conditions of Islamic sales transactions. However, when examining the transactions between sellers and distributors of imported used clothing, there is an element of gharar, which involves uncertainty about the goods being purchased, as sellers are not permitted to inspect the goods in the bags before they are shipped. This falls under the category of gharar, which is not permitted in Islam.

Abstract

Witchcraft or black magic is still believed to be an act that can cause harm to a person through occult science. The losses caused by witchcraft can be seen directly and clearly in witchcraft victims, but it is difficult to explain medically and scientifically. Although it cannot be proven based on criminal law, the impact of witchcraft can be known based on indications that are widespread in the victim, such as foreign objects found in the victim, causing physical and non-physical suffering for a long time, even causing the victim to die. The focus of this research is on how to resolve witchcraft cases through customary law in the Simeulue community. The method used is qualitative, with data obtained from interviews and supported by literature sources. The results of the study showed that the phenomenon of witchcraft in Langi Village, Teupah Village, and Suka Jaya Village in Simeulue Regency had a motive of displeasure between the perpetrator and the victim. Santet is not always used for evil, but can also be used for good, such as medicine, predicting the whereabouts of a person or lost item (tendung). In general, the people of Simeulue do not accept the presence of witchcraft (for evil) in their lives, but specific individuals still abuse witchcraft as a power to harm people. The abuse of witchcraft that causes others to suffer is not in line with the principles of Islamic criminal law. Witchcraft can be held accountable if proven to have committed a crime that causes harm to others, both physically, psychologically, or socially.

Abstract

Abstract The distribution of subsidized LPG is part of the government’s policy to ensure access to basic energy needs for low-income communities. However, in practice, several irregularities persist, including off-target distribution, prices exceeding the official Retail Price Ceiling (HET), and weak oversight mechanisms at the base distribution level. This study aims to examine the supervision system in the distribution of 3-kg subsidized LPG cylinders in Kuala Batee District, Southwest Aceh Regency, and to assess the extent to which current distribution practices align with the principles of Maqashid Syariah. This research employs a qualitative method with a descriptive-analytical approach. Data were collected through field observation, in-depth interviews with LPG outlet owners, five subsidy recipients from the local community, one relevant village official, and a review of policy and regulatory documents. The findings were analyzed within the framework of Maqashid Syariah, focusing on the principles of hifz al-mal (protection of wealth) and hifz al-nafs (protection of life). The results indicate that the existing supervision of LPG distribution remains ineffective. Key issues include the misidentification of eligible recipients, inconsistent pricing beyond regulatory limits, and the absence of a robust verification system. From the perspective of Maqashid Syariah, such shortcomings not only undermine social justice but also hinder the realization of public welfare. Therefore, improvements are needed in the form of data-driven distribution systems, collaborative oversight, and public education to ensure that LPG subsidies are distributed fairly and in accordance with Islamic ethical values.

Abstract

This study aims to document the traditional knowledge of the local community in Kaloy Village, Tamiang Hulu Subdistrict, Aceh Tamiang Regency regarding the use of medicinal plants for treating circulatory system disorders. The methods used include in-depth interviews, direct observation, and documentation involving 90 respondents from various age groups and two key informants. The results show that the community's trust in medicinal plants remains high, particularly among individuals aged over 50. A total of 10 plant species were identified and used to treat diseases such as hypertension, high cholesterol, anemia, stroke, and diabetes. The most commonly utilized plant parts were leaves and rhizomes, with traditional processing methods such as boiling, pounding, and chewing. The study also calculated the Index of Cultural Significance (ICS) to assess the cultural importance of each species in the community. These findings indicate that ethnobotanical knowledge is still well preserved among the older generation but is beginning to decline among the youth.

Abstract

This study aims to analyze the role of the Aceh Dayah Education Office in preventing sexual harassment within Islamic boarding schools (dayah) from the perspective of Islamic criminal law. The focus of the study includes understanding the concept of sexual harassment in Islamic law, identifying the factors contributing to the rise of such cases in dayah, and formulating effective prevention strategies. The findings reveal that weak regulations, lack of supervision, and limited education are the main contributing factors. Therefore, strengthening the role of the Dayah Education Office through the revision of Qanun Aceh Number 6 of 2014 on Jinayah Law, enhancing the capacity of educators, establishing a safe and integrated complaint mechanism, and providing Islamic-based sexual education are strategic steps to create a safe and Sharia-compliant dayah environment.

Abstract

SMPN 1 Baitussalam is one of the recipients of BOS funds as referred to in Permendikbudristek No. 63 of 2023. However, the lack of transparency to the public and efficiency in its use raises issues that contradict Permendikbudristek No. 63/2023. This study examines the evaluation system for managing BOS funds in 2023 at SMPN 1 Baitussalam, Aceh Besar Regency, based on the concept of milk al-daulah, which emphasizes proper, transparent, and fair management. The method used is qualitative descriptive analysis with a formal juridical approach, data obtained through in-depth interviews, document studies, and field observations. The results of the survey indicate that SMPN 1 Baitussalam has effectively managed BOS funds by Permendikbud and the principles of milk al-daulah. However, the findings reveal that there are still instances where students are asked to contribute independently for competitions or school events, and some facilities, such as classroom chairs, are in unsuitable condition due to insufficient funds. Additionally, the BOS fund announcement board must be re-displayed to ensure public access. Therefore, this research recommends that the government increase the funding allocation to optimize school facilities.
