Abstract

This study aims to analyze the validity of reports on domestic violence (DV) crimes filed after divorce, focusing on the Military Court Decision Number 85-K/PM.II-08/AD/II/2022. This article is categorized as normative legal research using a statutory approach and a case approach. The methodology employed is descriptive analytical study. The study concludes that reports of domestic violence crimes filed after divorce remain legally valid, provided they meet the formal and material requirements as stipulated by applicable regulations. The military court's decision in this case highlights the importance of recognizing victims' rights to justice, regardless of marital status.

Abstract

This study examines the protection of Domestic Violence (KDRT) victims perpetrated by military personnel in Indonesia. Domestic violence cases involving military members are complex issues requiring serious attention, as they encompass aspects of general criminal law and military disciplinary law. Based on Law No. 23 of 2004 on the Elimination of Domestic Violence and Law No. 25 of 2014 on Military Discipline, military personnel who commit domestic violence can be subjected to both criminal and disciplinary sanctions. The legal process for military domestic violence cases involves two pathways: the criminal pathway, managed by the police and prosecution, and the military disciplinary pathway, handled by the authorized superior. Besides law enforcement, this study highlights the importance of protecting victims’ rights, such as security, physical and psychological recovery, and legal support. However, there are several obstacles to victim protection, including the strong patriarchal culture, lack of understanding about domestic violence within the military, and the complexity of the legal enforcement process. This study recommends increasing awareness of domestic violence, strengthening support for victims, and improving legal procedures to make the protection of domestic violence victims more effective.

Abstract

Penelitian ini menganalisis tindak pidana penjualan senjata api dan amunisi oleh oknum TNI kepada kelompok separatis di Papua yang berdampak serius terhadap stabilitas nasional dan keamanan negara. Penjualan senjata ilegal oleh anggota TNI tidak hanya melanggar tugas dan tanggung jawab mereka sebagai pelindung kedaulatan negara, tetapi juga memperkuat kelompok separatis yang melakukan pemberontakan terhadap pemerintah. Melalui pendekatan yuridis normatif, penelitian ini mengeksplorasi penerapan Undang-Undang Darurat Nomor 12 Tahun 1951 dan berbagai regulasi terkait lainnya yang mengatur kepemilikan, distribusi, dan penggunaan senjata api. Temuan menunjukkan bahwa motif utama tindakan ini adalah keuntungan finansial, sementara lemahnya pengawasan internal di lingkungan TNI turut berkontribusi terhadap peningkatan kasus penjualan senjata kepada kelompok separatis. Penegakan hukum melalui peradilan militer dan sipil perlu diperkuat untuk memastikan adanya efek jera dan mencegah kasus serupa di masa mendatang

Abstract

Dispute can occur in medical practice if patient(s) feel their interests are being damaged or they received results not as expected. This study is a normative, qualitative research using secondary data on dispute resolution in accordance to Act Number 17 Year 2023 on Health, compared to before the Law was enacted. According to the Act, patients or their representatives who felt aggrieved can report the doctor(s) to Professional Disciplinary Council, to the authorities for suspected criminal act, and/or to the court for civil act violation. The Council’s recommendation that states there is a violation on current standards is required for criminal investigation to proceed, and for civil lawsuit to go to court. Such requirement is nonexistent in Act Number 29 Year 2004 on Medical Practice. This could be observed in the case of dr. Dewa Ayu Sasiary Prawan, et al in 2010 where patient Mrs. Julia Fransiska Makatey that they treated was deceased. They were found not guilty in district court, sentenced to imprisonment in Supreme Court cassation, and finally ruled not guilty in Supreme Court judicial review verdict because no proven standard violations. Learning from this, such Council that has utmost integrity and works profesionally is needed for a fair dispute resolution.

Abstract

This research examines the legal protection for PT Pegadaian on pawn collateral that is proven to be the result of a criminal offense, such as in the case of Kotamobagu District Court Decision Number 150/Pid.B/2023/PN.Ktg. The purpose of this study is to examine the availability of legal protection. to PT Pegadaian and the legal actions that may be done in the event that problematic material is encountered. This study employs a normative legal approach that draws on statutes and case law and adopts the theory of preventive and repressive legal protection. The results show that although PT Pegadaian has applied the precautionary principle following the Standard Operating Procedure (SOP), there is still a risk of receiving collateral from criminal acts that can cause material and immaterial losses. Therefore, a clearer legal protection mechanism is needed to maintain trust in the relationship between debtors and creditors and ensure legal certainty in business activities.

Abstract

The judicial process in Indonesia must be carried out or implemented based on the provisions of the laws in Indonesia. The criminal justice process was born in order to resolve problems that arise from criminal acts. Although the procedures for the judicial process have been regulated by law, we still find many cases of errors in the judicial process that occur in Indonesia. One case of error in the judicial process can be found in cases of mistaken arrest by law enforcement officers. Wrongful arrests or mistakes in arrest generally occur due to procedural errors and also errors in the investigation process carried out by law enforcement officers. In order to protect the interests and rights of victims that are lost during the judicial process, a form of protection is needed that can be given to victims of mistaken arrest. Legal protection for victims of mistaken arrest was born in order to provide protection for victims or innocent people who were arrested illegally or mistakenly by law enforcement officers. Including provisions for victim protection aims to increase the government's focus on the plight of victims and can restore the conditions and rights of victims that are lost from the act of mistaken arrest considering that the act of mistaken arrest is a form of gross human rights violation that greatly tarnishes human dignity

Abstract

This study aims to analyze the application of restorative justice as an alternative solution in handling criminal offenses in the digital era, which is marked by increasingly complex forms of crime and their impact on victims. The contribution of this research lies in its effort to offer a more humanistic, participatory, and relevant approach to punishment in line with the dynamics of modern criminal law, particularly in addressing legal challenges in digital spaces. The methodology used is library research with a qualitative approach and normative legal study, by analyzing statutory regulations, legal theories, and related scholarly literature. The findings indicate that restorative justice can serve as an effective alternative to conventional sentencing for resolving digital-based criminal offenses, as it promotes peaceful resolution between offender and victim, restores social relations, and reduces the burden on the formal criminal justice system. However, the implementation of restorative justice still faces challenges such as low digital legal literacy, unprepared infrastructure, and the absence of standardized procedural guidelines.

Abstract

JKN is program issued by the government aimed providing certainty in providing comprehensive health services for all Indonesian citizens. However, since JKN was first implemented until now, many challenges have been experienced, one of which is the large number of fraudulent acts in its implementation dominated by JKN participants themselves. Therefore, this research aims to find out. what prevention efforts have been carried out, the application of current sanctions, and how to update the application of sanctions for JKN participants who commit fraud in the implementation of JKN in Indonesia. This research is normative legal research referring to legal sources, especially statutory regulations relating to acts of fraud in healthservice programs. Legal sources in this writing consist of primary legal materials and secondary legal materials. The data collection technique used is library research. The data analysis techniques carried out in this research will go through a qualitative processing and analysis stage. The results of this research show that prevention efforts that have been carriedout by the government include reporting suspected fraud to the Fraud Prevention and Handling Team, maintaining the confidentiality of residence identity and JKN KIS cards so that they are not misused, and complying with all existing regulations, then implementing sanctions against Currently, acts of fraud only take the form of administrative sanctions,therefore the effort to reform the application of sanctions is to include the concept of criminalization in the form of imprisonment in order to catch fraudsters in the implementation of JKN in Indonesia.

Abstract

Perang siber antara Rusia dan Ukraina telah memperlihatkan bentuk konflik modern yang tidak hanya berdampak pada sistem militer, tetapi juga infrastruktur sipil termasuk fasilitas kesehatan. Artikel ini mengkaji bagaimana Hukum Kesehatan Internasional dan Hukum Humaniter Internasional memberikan perlindungan terhadap fasilitas medis dalam situasi perang siber. Dengan menggunakan pendekatan kualitatif normatif, tulisan ini menganalisis prinsip-prinsip hukum yang dilanggar dalam serangan siber serta tantangan implementasi hukum di ranah digital. Artikel ini juga menawarkan solusi berupa penguatan regulasi, peningkatan kerja sama internasional, serta edukasi terhadap aktor-aktor terkait.

Abstract

A country's legal system is a fundamental aspect of health insurance. Indonesia and the United States have different approaches to regulating health insurance, both in terms of regulation, coverage of participants, and financing mechanisms. This paper compares the legal systems of Indonesia and the United States in regulating health insurance by highlighting differences in policies, legal bases, and implementation in each country. In Indonesia, health insurance is organized by the government through BPJS Kesehatan which has mandatory participation. Meanwhile, in the United States, the health insurance system is more mixed with the dominance of the private sector and public programs such as Medicare and Medicaid. This study uses a normative legal method with a comparative legal approach to analyze the effectiveness, challenges, and impacts of each system on access to and quality of health services. The results of the study show that the Indonesian system is more inclusive but faces financial sustainability constraints, while the United States system provides flexibility for participants but still experiences problems with affordability. By understanding the advantages and disadvantages of each system, this study is expected to contribute to the development of more effective and equitable health insurance policies
