Abstract

Indonesia as a legal state, the implementation of governments is based on the principle of law supremacy, thus e ach deed by the government must be in line with the existing law. This condition gave birth to an antithesis that the government's deeds outside of it can not be authorized, beyond authority, or arbitrary. Problems, in Lord acton terms, known toes Power texs to Corrupt; Absolute Power Corruptsare absoluteely so that without the restriction of power then the direction destined by the government is only a particular interest and certain groups alone. Different conditions with the Government that embrace the system of absolute monarchy, with the inflammatory authority of the unlimited, because the king is the law it self.

Abstract

Since the issuance of the Constitutional Court Decision Number 46 / PUU-VIII / 2010, the contents granted the request of Machica Mochtar who was married to Moerdiono in an Islamic way but was not listed. From the marriage a boy named Muhammad Iqbal Ramadhan was born. After the Constitutional Court's decision was issued, the status of an extramarital child not only had civil relations with his mother and family, but also had civil relations with his father and father's family. MK decisions have broad implications, because children outside of marriage include children born of marriage that are religiously valid but not recorded, and children born from adultery.

Abstract

Corona Virus Disease 2019 or COVID-19 has been determined by President Joko Widodo to become a National Disaster with Presidential Decree No. 12 of 2020 concerning Determination of Non-Disaster in the Spread of Corona Virus Disease 2019 (COVID-19) as a National Disaster in Jakarta on April 13, 2020. The President has issued Presidential Decree 11 of 2020 concerning Establishment of Community Health Emergency COVID-19. The spread of Corona Virus Disease 2019 (COVID-19) has had an impact on negative global economic growth, including engagement. Parties who cannot fulfill their achievements in an engagement because the covid-19 pandemic does not necessarily classify the condition of the covid-19 pandemic as a state of overmacht or force majeure. Must be assessed on a case by case basis in accordance with the circumstances and factual conditions that occur. Except if the parties in a contract agreed upon with the parties have described in detail about what is qualified as a force majeure.

Abstract

Two years from now, Indonesia will hold a democratic party for the Presidential Election in 2024, which is the 2024-2028 leadership period, on February 14, 2024. In relation to this election, the political elites and political parties have begun to propose a postponement of the holding of the Presidential and Vice Presidential Election and the issues of the position of President and Vice President will be extended to three periods. The history of postponing election has happened in Indonesia, however, it was based on the reasons for postponing which have a clear constitutional basis. In the Amendment of the 1945 Fundamental Constitution, there is no regulation regarding the postponement of the implementation of the Presidential Election or the President who held the government for approximately three periods. Nevertheless, what if the political elite’s decision is motivated by the economic situation, which is still recovering from COVID-19. Therefore, the writers are interested in discussing: (1) The postponement of the implementation of the Presidential Election in Indonesia and the extension of the President’s term of office to three periods is related to the Constitution theory; (2) The legal implications of postponing the implementation of the Presidential and Vice Presidential Election and the extension of the term of office of the President and Vice President Election to three periods in the perspective of the Amendment of the 1945 Fundamental Constitution. The writers conduct a survey of the relevant literature using a normative juridical approach to resolve this research. So as to obtain the conclusion: (1) The Amendments to the constitution can be made as long as they meet the indicators for amending the constitution, which include the existence of urgent reasons for amendments, obtaining support from the people for amendments, and the existence of social, political, and economic conditions which cause changes to occurs; (2) If wish to postpone further elections or extend the Presidential term to three periods, it must be constutional, so if the constitution must change its function, it is not to maintain power but to overcome the existing problems.Keywords: The Presidential and Vice Presidential Election, The Constitution, The Amendment of The 1945 Fundamental Constitution

Abstract

Electronic commerce is increasingly in demand by the public. One of them is trading beauty products electronically. The city of Padang is one of the cities that includes many electronic trading activities. E-commerce often encounters obstacles such as payment procedures, legal protection, electronic signatures, and dispute resolution mechanisms that may occur in the future. E- commerce must also comply with positive laws. Even though there are a number of barriers to e-commerce, this type of trading still has its fans. In addition, ignoring technological developments will have a negative impact in the future, so openness and being proactive and anticipatory are alternatives that can be chosen in dealing with the dynamics of technological developments including trade developments such as electronic commerce or what is commonly referred to as electronic commerce or e-commerce. This is because Indonesia has become part of the global e-commerce market. The focus of this research is: First, to determine legal protection for consumers in trading beauty products electronically in Padang City; Second, to find out the legal settlement in the event of a dispute by the parties in the e-commerce of beauty products in the city of Padang. Abstract

Community Service Activities that will be carried out by the Lecturer Team of the Dharma Andalas University Law Study Program will be accomplished in the form of law counseling related to Online Loans. This is intended to socialize to the public about legal online loans and vice versa. It is because the illegal online loans are very widespread and disturbing to the public because debt collectors who collect loans terrorize their victims. Law counseling was provided in one of the sub-districts in Padang City due to the large number of complaints from the people who were caught in online loans where the relevant task force received 8,991 complaints related to illegal loan until October 2023, so that the public needed to be given an understanding regarding to loan money, both legal and illegal, and the impacts from the perspective of law. This service is carried out by using a lecture method with laptop and LCD Projector in Padang City, particularly at the house of one of the residents in Unand Housing Complex, Padang Besi Village, Lubuk Kilangan District, Padang City. To measure their understanding, the participants were asked questions in the form of question-and-answer games.

Abstract

Kemunculan pandemi virus corona di Wuhan, China, pada bulan Desember tahun lalu menjadi ancaman kematian global. Hal ini disebabkan kemampuan virus menyebar dengan cepat dan kemampuannya dalam menimbulkan dampak yang fatal bagi kesehatan. Kekhawatiran akibat dampak yang ditimbulkan virus corona, menyebabkan karantina kesehatan menjadi wacana yang harus segera dilakukan pemerintah Indonesia. Wacana ini berkembang karena termaktub dan tercantum jelas bahwa karantina kesehatan merupakan cara yang efektif memutus mata rantai penyebaran virus di saat terjadi kedaratan bencana seperti wabah virus corona hari ini yang dapat menimbulkan dampak dan kerugian besar bagi negara dan masyarakat Indonesia. Dalam Undang-Undang Nomor 6 Tahun 2018 Tentang Kekarantinaan Kesehatan dengan jelas menerangkan tentang adanya pembatasan mengenai masuk dan keluarnya individu ke suatu daerah yang telah dinyatakan sumber wabah, termasuk mengatur pula tentang adanya perintah untuk melakukan isolasi, karantina wilayah, vaksinasi dan lain sebagainya untuk menghentikan penyebaran wabah yang terjadi di Indonesia.

Abstract

There are many cosmetics on the market today with various types of brands in line with women's desire to always look beautiful. This is then exploited by irresponsible business actors by producing or trading cosmetics that do not meet the requirements for distribution to the public. Not a few women are interested in buying products at low prices but with fast visible results. So many women choose shortcuts to buy a product even though the cosmetics they buy do not meet the requirements and are not registered with BPOM. It is not uncommon for these illegal cosmetics to be obtained at affordable prices because there is no distribution permit number from BPOM. There is no cosmetic raw material label, and there is no product expiration date. Because the price is cheap and can be purchased easily, cosmetics without a distribution permit are easily consumed by the public. Consumers' ignorance of the side effects of cosmetics containing dangerous ingredients is one of the reasons many women continue to use illegal cosmetics. Consumers usually do not research a product before buying, this is also one of the factors that causes cosmetic products containing dangerous ingredients to still be in demand by many women. They generally buy cosmetic products without prior consideration considering that the products they buy have direct side effects. The data analysis method used is sociological juridical.

Abstract

Electronic trading (PMSE) facilitates transactions, both nationally and internationally. This study aims to examine PMSE regulations within the scope of the ASEAN Economic Community (AEC) and their impact on consumers in Indonesia. This study employs a normative legal method with a descriptive-prescriptive approach. Data collection was conducted through literature review, while data analysis was performed descriptively. The results of the study reveal that PMSE regulations in ASEAN are governed by the ASEAN Blueprint, the ASEAN Charter, and the ASEAN Agreement on E-Commerce (AAEC). The AAEC consists of 19 articles, covering various aspects such as cooperation mechanisms and scope, facilitation of cross-border electronic commerce, cybersecurity, digital payment systems, logistics, transparency, dispute resolution, and agreement implementation. These regulations aim to strengthen cross-border trade in ASEAN, create a business environment that supports Small and Medium Enterprises (SMEs), and strengthen cooperation among member countries to accelerate inclusive economic growth and reduce disparities in the region. Regarding the impact of the ASEAN trade agreement on Indonesian consumers following the implementation of Law No. 4 of 2021, it was found that there are still other national regulations governing e-commerce, including the Electronic Information and Transactions Law (EIT Law), the Trade Law, and Government Regulation No. 82 of 2012 on the Implementation of Electronic Systems and Transactions.

Abstract

Kabupaten Kepulauan Mentawai memiliki risiko tinggi terhadap berbagai bencana alam, termasuk gempa bumi, tsunami, banjir, tanah longsor, gelombang ekstrim, dan kekeringan. Kondisi ini menuntut strategi mitigasi yang adaptif dan berkelanjutan. Pengabdian masyarakat ini bertujuan mendampingi pemerintah desa dan masyarakat dalam mengintegrasikan Pengurangan Risiko Bencana (PRB) dan Adaptasi Perubahan Iklim (API) ke dalam dokumen perencanaan desa (RPJMDes dan RKPDes). Metode yang digunakan berbasis partisipatif, meliputi sosialisasi, pelatihan, pemetaan risiko, penyusunan Rencana Aksi Komunitas (RAK), dan fasilitasi integrasi ke dokumen perencanaan. Hasil menunjukkan peningkatan pemahaman masyarakat terhadap potensi risiko, kemampuan menyusun rencana mitigasi dan adaptasi sesuai kondisi lokal, serta penguatan kapasitas desa menghadapi bencana. Temuan ini menegaskan pentingnya integrasi PRB dan API untuk membangun desa yang tangguh, adaptif, dan berkelanjutan.
